ITEM NO. 10

COUNCIL AGENDA ITEM
DECEMBER 16, 2025
PREPARED BY: Mike Brinkman, Building Official
SUBJECT: Adopt Ordinance regarding the California Code of Regulations Title 24, 2025 Edition of the California Buildings Standards Code.

STRATEGIC PLAN GOALS: 2. Community-Based Development

BACKGROUND
City ordinances require two readings, the first occurs as an introductory measure, with the second serving as the formal adoption. City staff notices the public in-between the first and second considerations to allow for proper public notification according to the law. This item is the second reading of an ordinance that was introduced at the November 18, 2025 regular meeting.

The model codes are updated every three years. This allows the codes to improve and adjust to the newest materials, methods of construction and technological advances in the industry. The California Building Standards Commission adoption of the 2025 code comes after a comprehensive multi-state agency and stakeholder update of the 2022 building codes.

The objective is to produce a practical building code that ensures public safety first and foremost while implementing the most efficient technology available to conserve the state's natural resources and energy use. California's building code is applied to virtually every commercial and residential structure in the state.

ANALYSIS/DISCUSSION
The new 2025 California Building Standards Code contains thirteen parts that incorporate public health, life safety, and general welfare standards used in the design and construction of buildings in California. These parts incorporate the latest national standards in the International Building, Residential and Fire Codes, California Green Building Code, California Energy Code, National Electrical Code, and the Uniform Mechanical and Plumbing Codes.

Along with the usual Energy and Green code updates, below are a few noteworthy updates:
• New Part 7 stand-alone code book for Wildland-Urban Interface (WUI), was Chapter 7 A in the CBC.
• The Energy and Green codes continue to expand Electric Vehicle Charging requirements to install EV charging infrastructure including receptacles and chargers to new multifamily dwellings, single family homes, hotels, and motels.

Page 39 of 67 ends

• Electric-Ready Buildings:
• The code encourages electric-ready buildings to facilitate future adoption of cleaner electric technologies for cooking and water heating.

Health and Safety Code Section 18941.5 mandates that the Building Standards contained in the 2025 California Building Standards Code shall be effective 180 days after publication by the California Building Standards Commission. If these codes are not adopted by ordinance, they become effective by default without any amendments. The proposed effective date for the City of Gustine will be January 1, 2026.

COMMUNITY OUTREACH
As part of the adoption process this department has made every effort to notify all the parties affected of the proposed changes.

FISCAL IMPACT
None.

STRATEGIC PLAN GOALS
An important part of Community Development is assurance that building within the City follows the appropriate building codes. Therefore, this action falls under Strategic Goal #2: Community-Based Development.

RECOMMENDATION
It is recommended that Council approve adoption and waive the second reading of an ordinance amending Title Four, Chapter Four, Article 2, Section 31 to the City of Gustine Municipal Code, and adopting by reference, The California Code of Regulations Title 24, 2025 Edition of the California Building Standards Code.

ITEM NO. 11

COUNCIL AGENDA ITEM
DECEMBER 16, 2025
PREPARED BY: Mario B. Gouveia, City Engineer
SUBJECT: Resolution Approving the Proposal for Pre-Emergent Weed Control Application at the Wastewater Treatment Plant, Airport, and Jensen Storm Basin, and Authorizing the Interim City Manager to Execute an Agreement in the Amount of $11,700.00
STRATEGIC PLAN GOALS: 5. Robust Infrastructure

BACKGROUND
The City of Gustine (City) owns and operates several facilities that require periodic weed control to help maintain the sites clean and improve operations. The City has had preemergent weed control applied in the past at some of its facilities and is seeking to apply pre-emergent weed control at the wastewater treatment plant, the airport, and the Jensen storm basin.

ANALYSIS/DISCUSSION
City staff researched the availability of companies that provide weed control services.

The City reached out to Allied Weed Control as they had performed these services in the past. City staff requested and obtained proposals from Allied Weed Control for $11,700.00 for the three sites.

COMMUNITY OUTREACH
None associated with this item.

FISCAL IMPACT
Weed control of the three sites will be funded utilizing other contract services across various funds including Airport (Fund 063), Sewer (Fund 061 ), and Borrelli Assessment (Fund 07 4). This expenditure will utilize funding already approved as part of the FY25/26 financial budget, so no additional appropriation is necessary.

STRATEGIC PLAN GOALS
This item correlates to Strategic Plan Goal #5-Robust Infrastructure. Weed control of City facilities will improve the appearance of the sites and proper operation of the related infrastructure.

RECOMMENDATION
Staff recommends that the City Council adopt a resolution approving the proposal from Allied Weed Control and authorizing the Interim City Manager to execute an agreement in the amount of $11,700.00 on behalf of the City of Gustine.

ITEM NO. 14

COUNCIL AGENDA ITEM
DECEMBER 16, 2025
PREPARED BY: Melanie Correa, Interim City Manager
SUBJECT: Approval of Contract Amendments to Public Works Supervisor and Public Works Utility Supervisor Employment Agreements
STRATEGIC PLAN GOALS: 6. Community Services

BACKGROUND
With the expansion of the Public Works Department to include the classifications of Public Works Utilities Supervisor and Utilities Maintenance Worker, the need to update existing procedures for handling after-hours service calls has become increasingly evident.

ANALYSIS/DISCUSSION
The current operational procedure assigns one public works line staff member to receive calls directly from the City's dispatch center for after-hours, holiday, and weekend service requests. This approach has proven limited in its ability to provide adequate service due to constrained resources and has not consistently ensured proper follow-through.

Following discussions with Public Works supervisory staff, it has been recommended that supervisors assume responsibility for receiving calls from the City's dispatch center.

Under this revised procedure, supervisory staff will evaluate each service request to determine whether immediate dispatch of on-call line staff is warranted, or if the matter should be deferred to the next business day to allow for appropriate resource allocation. This adjustment will also strengthen departmental accountability by ensuring service requests are properly logged and that follow-up actions are completed in a timely manner.

Negotiations with supervisory staff have been conducted to establish fair and equitable compensation for the additional responsibilities. The attached contract amendments reflect the agreed-upon terms and compensation.

This operational adjustment is expected to streamline the handling of Public Works service requests during after-hours, weekends, and holidays, thereby improving efficiency, resource management, and follow-up practices.

COMMUNITY OUTREACH
Not applicable.

Page 63 of 67 ends

FISCAL IMPACT
The amendments authorize a five percent (5%) pay adjustment for both the Public Works Supervisor and the Public Works Utilities Supervisor. This adjustment will be distributed in twelve (12) equal installments, with payments issued as a flat rate on a monthly basis.

The additional compensation has been incorporated into the Fiscal Year 2025/2026 budget and will be allocated under the same funding structure currently applied to the employees' salaries.

STRATEGIC PLAN GOALS
This item aligns with Strategic Plan Goal #6 Community Services, objective 2, maintain current level of staff-provided public services.

RECOMMENDATION
Staff recommends Council approve the contract amendments to both the Public Works Supervisor and the Public Works Utility Supervisor employment agreements.
