ITEM NO. 4

COUNCIL AGENDA ITEM
FEBRUARY 3, 2026
PREPARED BY: Tiffany Vitorino, Recreation Manager
SUBJECT: Approve Request from Gustine Lions Club to Use Schmidt Park Baseball Fields for Egg Hunt and Vendor Fair
STRATEGIC PLAN GOALS: 6. Community Services

BACKGROUND/ ANALYSIS/DISCUSSION
The Gustine Lions Cub has submitted a request to the City, requesting use of Harry Schmidt Park Baseball Fields and surrounding area, allowance of a vendor fair, including mobile food vendors.

The Gustine Lions Club Easter Egg Hunt has been a long-standing tradition for many years in Gustine. The free event has proven to be a great success in the past, with thousands of children enjoying the fun filled morning. The event will be held Saturday April 4i from 9:00AM - 12:00PM.

The Easter Bunny will be in attendance as well, helping the Lions in hiding thousands of eggs in the surrounding areas around the fields. Among those eggs will be prize-winning eggs, which the Lions Club provides Easter baskets and chocolate bunnies. The Easter Bunny will also be available for photos and the community's enjoyment.

The Lions Club plans to continue enhancing the event by adding attractions such as face painting, balloons, music, crafts, and food vendors. The Miss Gustine Court and Recreation Manager will remain responsible for organizing the vendor fair, with proceeds supporting the pageant and the fireworks fund. These additional attractions have proven to be a great success, enjoyed by both participants and the community.

According to Gustine Municipal Code Section 5-6-3, mobile kitchen-type vendors are permitted only in manufacturing districts, except when granted special permission by the City Council for festivals, parades, or other public events. Staff will ensure that vendors possess a valid City business license and all necessary health permits.

Staff has been in touch with Gustine Youth Baseball and Softball (GYBS), who currently is in contract for use of both fields. GYBS has agreed to forgo scheduling any activities on this date and time to accommodate this special annual tradition. The Lions Club is asking for the use of four (8) barricades for the event. The Club is further requesting waiver of any associated fees.

COMMUNITY OUTREACH
The Lions Club, Recreation Department and Miss Gustine Court practices includes

Page 35 of 96 ends

promoting this event on various social platforms as well as flyer and attached pamphlet distribution throughout downtown.

FISCAL IMPACT
Staff time and materials would be approximately $425.07. The field rental rate is $28 /hour, totaling $168 in loss of facility rental revenue. Total amount requested to waive is $593.07.

STRATEGIC PLAN GOALS
This event falls under Strategic Plan Goal No. 6, Objective No. 5 by bringing a sense of pride to the community as well as enhancing the quality of life. The event aims to bring the community together in a family-friendly setting. This event provides a positive experience for residents who participate while actively engaging with the community.

RECOMMENDATION
Staff recommends Council consider approving the request from the Gustine Lions Club, for use of the fields, allowance of a vendor fair with mobile food vendors and use of barricades, and waive the rental and associated fees for the annual Lions Club Egg Hunt.

Dear City Council,
The Gustine Lions Club is excited to hosting the Annual Easter Egg Hunt on Saturday, April 4, 2026, the day before Easter. This Lions tradition, held for many years in the Harry Schmidt Park Baseball Fields and surrounding area, for the Gustine community and celebrates the spirit of Easter.

We are thrilled to collaborate once again with the Recreation Department and Miss Gustine Court, who will organize a small vendor fair before and after the hunt. This fair serves as a fundraiser for the Miss Gustine Pageant and the Fireworks Fund, further enriching our community's events.

To ensure the event's success, we kindly request permission to include a few food vendors and ask for the facility and any other fees for the event to be waived. Additionally, we would like to request eight barricades to reserve parking spaces for vendor use.

We deeply appreciate the City Council's ongoing support of this historic event and look forward to bringing another memorable celebration to the Gustine community.

Sincerely,
Joe Oliveira
Gustine Lions Club

ITEM NO. 5

COUNCIL AGENDA ITEM
FEBRUARY 3, 2026
PREPARED BY: Jami Westervelt, Economic & Community Development Director SUBJECT: Approve Resolution Required by USDA Naming Users to Online Reporting System
STRATEGIC PLAN GOALS: 6. Community Services

BACKGROUND
Driven by a lack of reliable, affordable internet access for both its businesses and residences, the City applied for and was awarded $1 .35 million in funding for development of broadband that could reach all in the City limits of Gustine.

The no-match funding came through a Congressionally Directed Spending (CDS) request, implemented through the United State Department of Agriculture (USDA) Rural Utilities Service (RUS) ReConnect program.

The funding is an important piece to citywide fiber to the home now available throughout the community that was installed by UnWired broadband as part of an over $6 million project by the company in the City.

DISCUSSION
While the process of working within the USDA Reconnect program and Rural Utilities Service (RUS) has been challenging and long, it is imperative that the City complete its obligations on this project in order to remain in good standing to receive CDS funding in the future.

An important obligation for the project is the filing of required RUS reports online. In order to gain access for that online portal, USDA requires the City provide an approved Resolution designating specific personnel access. Exhibit A attached follows RUS guidelines of what USDA requires in regard to the Resolution.

COMMUNITY OUTREACH
Not applicable to this item.

FISCAL IMPACT
There is no fiscal impact to authorizing staff to enter the required information online.

STRATEGIC PLAN GOALS
This item falls under Goal #6 of the City Strategic Plan. Specifically, providing for both residents and businesses to have reliable, affordable internet access through this project. Additionally, meeting the requirements of this CDS projects is key to the City

Page 40 of 96 ends

remaining eligible to apply for additional CDS funding projects in the future, including those to improve community services.

RECOMMENDATION
Staff recommends that Council consider a resolution approving naming authorized users and roles for the online reporting system as required by USDA.

ITEM NO. 6

COUNCIL AGENDA ITEM
FEBRUARY 3, 2026
PREPARED BY: Tiffany Vitorino, Recreation Manager
SUBJECT: Request to Use Harry Schmidt Park Tennis/Pickleball Courts, Parking Lot and Al Goman Center for Pickleball Tournament
STRATEGIC PLAN GOALS: 6. Community Services

BACKGROUND/ ANALYSIS/DISCUSSION
Daniel Gomes, owner of DJ Dan Entertainment and President of Pickleball for a Cause, has submitted a request to hold the 2nd Annual Pickleball Tournament at the Harry Schmidt Park Tennis/Pickleball Courts on May 30, 2026.

Mr. Gomes is requesting access to the Tennis/Pickleball Courts beginning the night before the event for a warm-up activity, followed by the daytime tournament on Saturday. He is also requesting use of the Goman Community Center beginning May 28, 2026, for event setup, restroom access, and as a break area during the tournament.

The request to utilize the Goman Center leading up to the tournament is new to the 2026 event, adding costs to the waiver request.

This year, the organization would like to add a second Glow-in-the-Dark Pickleball Tournament on May 30", scheduled to begin at 8:00 p.m. Proceeds from the evening tournament will benefit Gustine community activities, and Mr. Gomes has proposed sharing profits to support downtown Gustine beautification efforts.

Mr. Gomes has communicated his understanding of all special event requirements, including the need for permits and vendor compliance. Each vendor will be required to obtain either an annual or one-day City business license. Mr. Gomes will also coordinate with the Recreation Manager and the Merced County Environmental Health Department to ensure that all food vendors obtain the proper permits.

According to Gustine Municipal Code Section 5-6-3, mobile kitchen-type vendors are permitted only in manufacturing districts unless otherwise authorized by special permission of the City Council during festivals, parades, or other public events. Staff will ensure that all participating vendors obtain the appropriate City business licenses and required health permits.

The organizer has also requested that the City Council consider waiving facility fees for the event. In return, the event would list the City as a participating sponsor and supporter. Due to the use of an amplified sound system, Mr. Gomes will be required to obtain a dance permit from the City at a cost of $52. Additionally, Mr. Gomes must provide proof of insurance naming the City of Gustine as an additional insured for all

Page 49 of 96 ends

event locations.

COMMUNITY OUTREACH
The Pickle Ball for a Cause group will promote this event on various social platforms as well as flyers throughout downtown.

FISCAL IMPACT
The Tennis/Pickleball Courts at Harry Schmidt Park are typically accessible to community members with a $26 annual membership. Hosting this event will require closing the courts the night before and the day of the tournament. It is anticipated that existing court members may participate in the event. While the City does not currently have a daily "exclusive use" rental rate for the courts, a weekly rate of $30 has previously been charged for exclusive use of two courts.

The proposed event also includes use of the Goman Community Center, resulting in a loss of rental revenue totaling $635.

Additionally, the use of the parking lot will require support from Public Works staff to deliver and retrieve four barricades and clean the area. Police staff or volunteers will be required to place "No Parking" signs. The estimated cost for this support, including staff time, is approximately $660.09.

Due to limited parking availability, the Ed Peterson Shelter will need to be blocked from rental for the day, resulting in an additional loss of revenue of $110.

In summary, the total estimated fiscal impact of the event is $1435.09 According to the Fee Reduction and Waiver Policy for Special Events, adopted by City Council on April 17, 2018, and the Special Event Policy, adopted on October 17, 2025, this event qualifies as a Major Event, which would normally require a $250 Special Event Permit Fee. However, this event meets the waiver requirements for a qualified special event. Both Valley Children's Hospital and Pickleball for a Cause are registered 501(c)(3) nonprofit organizations, qualifying under the policy guidelines, along with other criteria outlined in the policy. As a result, the total waivable amount is $1,685.09.

Staff recommends that Council consider:

1. Approving the request to hold the Pickleball Tournament fundraiser at Harry Schmidt Park on May 30, 2026.

2. Approving the use of the Tennis/Pickleball Courts, Gamon Community Center, and parking lot for the event, contingent upon compliance with all applicable permits and regulations.

3. Approving the participation of food vendors as part of the event.

4. Consider whether to waive or reduce facility and staff fees associated with the

event.

Dear City of Gustine City Council,
( (209) 2e-9s3
@ [email protected]
( Po.ox 243, Gustine ca, 95322
January 8, 2026
My name is Daniel Gomes, and I am writing to respectfully request permission to organize our second annual Pickleball Tournament fundraiser at the Harry Schmidt Park Tennis and Pickleball Courts on May 30, 2026. In 2025, we successfully hosted a pickleball tournament on May 31, which raised $11,500 and welcomed 80 participants from Gustine and surrounding communities. Due to the success of that event, we are already familiar with and prepared to comply with all procedures and requirements necessary to host a tournament within the City of Gustine.

The daytime tournament on May 30, 2026, will serve as a fundraiser benefiting Valley Children's Hospital, which has provided care to children and families for over 70 years. We have completed the approval process with the hospital and received authorization to host this fundraiser in support of their mission. Following the daytime tournament, we are also planning a glow-in-the-dark pickleball tournament beginning at approximately 8:00 PM, with participation limited to around 32 players.

Proceeds from the evening glow tournament will benefit community activities and downtown beautification efforts within Gustine, allowing this event to support both regional and local causes.

In addition to the tournament, we plan to host a vendor fair that includes food vendors. We understand that all required county permits will be obtained and that each vendor will be responsible for holding either an Annual City of Gustine Business License or a one-day business license. We respectfully request permission to hold the vendor fair in the Tennis Court and Al Goman Center parking lot, and to utilize the Al Goman Center for restrooms and as a cool-down station for participants throughout the event.

We also kindly request access to the Al Goman Center on May 28, 2026, after the yoga class concludes at noon, to allow time for event setup and preparation. Additionally, we respectfully request permission to hang a promotional banner up to 60 days prior to the tournament to help increase visibility and allow participants adequate time to register.

Lastly, we ask the council to consider waiving or discounting any applicable facility fees for this event. If approved, we would be honored to recognize the City of Gustine as a participating sponsor and supporter of the tournament. Thank you for your time and consideration. I look forward to continuing our partnership with the City of Gustine and working together to make this event a success for Valley Children's Hospital and our local community.

Sincerely,
Daniel Gomes

ITEM NO. 7

COUNCIL AGENDA ITEM
FEBRUARY 3, 2026
PREPARED BY: Jami Westervelt, Economic & Community Development Director Kelsey George, Consulting Planner
SUBJECT: Vesting Tentative Subdivision Map Two-Year Extensions Application Submittal by Ron Katakis (APNs 063- 180-030 & 063- 180-029) STRATEGIC PLAN GOALS: 5. Robust Infrastructure

BACKGROUND
On May 17, 2022, the City Council approved a Vesting Tentative Subdivision Map (VTSM) for Mr. Ron Katakis to subdivide approximately two parcels located within the Southeast Gustine Master Plan (APNs 063-180-029 and 063-180-030). The approved subdivision consists of 157 single-family residential lots.

Pursuant to Gustine Municipal Code Section 4-61-130 and Government Code Section 66452.6, the approved VTSM was initially valid for 24 months from the May 17, 2022 approval date. On May 16, 2024, the City Council approved a two-year extension of the VTSM, extending the expiration date to May 17, 2026.

The applicant has now submitted a request for an additional two-year extension of the approved VTSM. Without approval of this request, the map would expire on May 17, 2026.

ANALYSIS/DISCUSSION
Under Gustine Municipal Code Section 4-61-140 and the Subdivision Map Act (Government Code Section 66452.6), the City Council may grant discretionary extensions of an approved Vesting Tentative Subdivision Map for periods not exceeding two years at a time. The Council therefore has the authority to approve the requested extension.

As part of the extension request, the applicant submitted a written justification describing the circumstances supporting the additional time extension. This justification memo is attached as Exhibit A and lists the following justifications:

1. Changes in market conditions for residential subdivisions due to economic uncertainty and resulting in extended due diligence and financing timelines for both public and private builders.

2. Cancellation of a previously executed contract with a national home builder that was terminated in August 2024 due to outstanding items at that time.

3. The applicant has indicated he is actively re-engaging with prospective builders, all of whom require a valid Vesting Tentative Subdivision Map term in order to proceed with acquisition and development of the property.

Page 54 of 96 ends

In addition, the applicant letter makes the following representations:
• There have been no changes to the City of Gustine General Plan, the Southeast Gustine Master Plan, applicable zoning regulations, or subdivision standards that would affect the validity of the approved VTSM.
• There have been no physical changes to the project site or surrounding area that would warrant reconsideration of the original approval. • There have been no changes to the capacity of community resources, including water supply, wastewater treatment, roadway infrastructure, or schools, that would affect the feasibility of the subdivision.

Staff has reviewed the request and finds the applicant's representations to be consistent with current City policies and conditions. The applicant has submitted required deposits associated with the extension request.

Based on the information provided and the continued progress toward final map approval, staff finds the requested two-year extension reasonable and consistent with the Subdivision Map Act and the City's subdivision regulations.

REQUIRED FINDINGS
Pursuant to GMC Section 4-61-140(B), the City Council may approve a VTSM extension only if the following findings can be made:

1. There have been no changes to the provisions of the General Plan, any applicable Specific Plan or this Zoning and Subdivision Code applicable to the project since the approval of the Tentative Map;

2. There have been no changes in the character of the site or its surroundings that affect how the policies of the General Plan or other standards of this Zoning and Subdivision Code apply to the project; and

3. There have been no changes to the capacities of community resources, including but not limited to water supply, sewage treatment or disposal facilities, roads or schools so that there is no longer sufficient remaining capacity to serve the project.

As noted above, the applicant has stated in the submitted justification memo that each of these findings can be met. Additionally, staff has not reviewed or received any information that would indicate these findings cannot be made.

ENVIRONMENTAL REVIEW
Approval of a time extension for an approved Vesting Tentative Subdivision Map does not constitute a discretionary project under CEQA and does not require additional environmental review pursuant to CEQA Guidelines Sections 15061 (b) (3) and 15378.

COMMUNITY OUTREACH
Not applicable.

FISCAL IMPACT
None to the City for the extension.

Page 55 of 96 ends

STRATEGIC PLAN GOALS
Approval of the tentative subdivision map extension is consistent with Strategic Goal #5:

Robust Infrastructure, as it ensures that the City's infrastructure planning remains aligned with anticipated development. Extending the map provides the necessary time to coordinate utility, roadway, and service improvements that will support orderly growth and long-term community needs.

RECOMMENDATION
Staff recommends that the City Council adopt the attached Resolution approving a twoyear extension of the Vesting Tentative Subdivision Map for the Katakis subdivision, extending the expiration date from May 17, 2026 to May 17, 2028.

RE: Request for a two-year time extension of approved VTSM for APN's 063-180-030 and 063-180-029 known as Sullivan Estates located within the Southeast Gustine Master Plan Area Jami,
I hereby request a two-year time extension for my above-referenced approved VTSM. The reasons for my request are below:

1. My current extension, approved by the Gustine City Council on May 7, 2024, expires on May 17, 2026. Marketing times for subdivisions have become extremely lengthy because of all of the economic uncertainly that exists today and builders, large and small, public and private, are extremely cautious and are requiring unreasonable due diligence time periods before closing escrow on subdivisions.

2. As you may be aware, the subdivision was previously under contract with Lennar Homes, but escrow was cancelled on August 27, 2024 because there remained too many uncertainties surrounding the subdivision insofar as not having approved improvement plans, an approved final map, PG & E approved plans, CCID approval, approved landscape plans, fully executed railroad contracts from both the Union Pacific Railroad and the Genesee & Wyoming Railroad and reimbursement agreements from the City of Gustine that were just completed a few days before Nirorn Than left his City Manager position In October. The length of time required to obtain all of the necessary approvals was an arduous and complicated undertaking.

3. I am currently re-engaging with several large, public builders now that I have a complete package, but in all of my conversations with the land acquisition managers of each company, all are requiring that I procure a two-year VTSM time extension, which is exactly what Lennar Homes had required when I was previously under contract with them.

In addition to the above, to the best of my knowledge, I hereby make the following representations:
• There have been no changes to the provisions of the City of Gustine's General Plan, any applicable Specific Plan, the Southeast Gustine Master Plan nor the current Zoning and Subdivision Code applicable to the project since both the initial approval and two-year time extension of my Vesting Tentative Subdivision Map.
• There have been no changes in the character of the property or its surroundings that affect how the policies of the City of Gustine's General Plan or other standards of the current Zoning and Subdivision Code apply to the subdivision.

Page 57 of 96 ends

• There have been no changes to the capacities of community resources, including but not limited to water supply, sewage treatment or disposal facilities, roads or schools so that there is no longer sufficient remaining capacity to serve the subdivision.

I would also like to have my request heard before the City Council at their January 2026 meeting.

Thank you.

ITEM NO. 8

COUNCIL AGENDA ITEM
FEBRUARY 3, 2026
PREPARED BY: Ruben Chavez, Chief of Police
Aaron Chandler City Attorney, Best Best & Krieger
SUBJECT: Request Council to Adopt New Parking Violation Fine Schedule Pursuant to 40203.5 eve and Waive the First Reading
STRATEGIC PLAN GOALS: 4. Financial and Budget Stability

BACKGROUND
When a parking violation occurs in the City of Gustine, Gustine Police Officers/Community Service Officers have the discretion to issue either an administrative citation or a parking citation enforcing the California Vehicle Code (CVC). The authorities which regulate vehicle code violations are listed under Vehicle Code Sections 40200 to 40230 (Procedure on Parking Violations). The sections are specific to local municipalities to issue and update fine schedules. Keeping up with statutory changes provides an avenue for municipalities to keep fines current with contemporary standards. A review of current state regulations and supporting case law give the City broader discretion to update and enforce vehicle code violations.

ANALYSIS/DISCUSSION
The entire purpose of revising the City's ordinances and resolutions regarding fines, and penalties is to ensure the City of Gustine is implementing best practices and procedures when enforcing their rules and regulations. Increasing fines, fees, and penalties are not only allowed and regulated by statute, it allows the City discretion to determine appropriate amounts for deterrence and punishment as allowed by law.

The City's intent is to ensure the fines, fees, and penalties commensurate with the level of severity of the offense, the violator's culpability, and the violator's ability to pay the fine, fee, and penalty.

The California Vehicle Code Authority Section for updating the penalty schedule:
40203.5. eve
(a) The schedule of parking penalties for parking violations and late payment penalties shall be established by the governing body of the jurisdiction where the notice of violation is issued. To the extent possible, issuing agencies within the same county shall standardize parking penalties.
(b) Parking penalties under this article shall be collected as civil penalties. (c) () Notwithstanding subdivision (a) the penalty for a violation of Section 22507.8 or an ordinance or resolution adopted pursuant to Section 22511.57 shall be not less than two hundred fifty dollars ($250) and not more than one thousand dollars ($1,000).

Page 62 of 96 ends

(2) The issuing agency may suspend the imposition of the penalty in paragraph ( 1), if the violator, at the time of the offense, possesses but failed to display a valid special identification license plate issued pursuant to Section 5007 or a distinguishing placard issued pursuant to Section 2251 1 .55 or 22511 .59. (3) A penalty imposed pursuant to this subdivision may be paid in installments if the issuing agency determines that the violator is unable to pay the entire amount in one payment.
40203.6. (a) In addition to an assessment levied pursuant to any other law, an additional assessment equal to 10 percent of the penalty established pursuant to Section 40203.5 shall be imposed by the governing body of the jurisdiction where the notice of parking violation is issued for a civil violation of any of the following:
(1) Subdivisions (b) (c), and (d) of Section 4461.
(2) Subdivision (c) of Section 4463.
(3) Section 22507.8.
(4) An ordinance or resolution adopted pursuant to Section 22511.57. (5) Section 22522.
(b) An assessment imposed pursuant to this section shall be deposited with the city or county where the violation occurred.

State laws also require assessment to fines which are ultimately transferred to the County and State to support specific funds. In short, each parking citation issued results in a total of $12.50 being assessed. The graph below displays the funds and amounts required.

Description of Collection Type Amounts
County -- General Fund Pkg Assessment $2.00
County - Courthouse Construction Fund $1.50
County- Criminal Justice Facilities Construction Fund $1.50 State Immediate & Critical Needs Construction Fund $3.00 State Court Facilities Construction Fund $1.50
State - Trial Court Trust Fund $3.00
Total Due for Each Parking Citation Issued $12.50
The effect of the penalty should act as a deterrent from future similar conduct. This will avoid the fine from becoming "the cost of doing business" where the violation remains despite the fine being paid. Although there are increases in fines, fees, and penalties, City staff have discretion to determine appropriate fine amounts for each violation.

The recent approval of the City contracting with Data Ticket has increased processing costs. While the parking citation services were previously handled by Duncan Solutions, Inc. and administrative citation services handled in-house, the new company will provide a complete wrap-around solution for our processing needs. This will save a tremendous amount of staff time.

The following graph displays the costs involved with processing parking violation citations only. Not every cost will be included, however those requiring extra attention and the times where collections are required, will further increase costs. There is a minimum charge which if not reached (i.e.- low number of citations needing to be processed), will be invoiced by the vendor.

Page 63 of 96 ends

FTB Collections 15% of revenue collected
Adjudication - 15Level Review Hold & Scanning Request $0.50 per citation 1 Level Review Disposition Letters $0.85 per letter
2 Level Hearing Hold, Scanning and Scheduling Hearing $.50 per citation 2" Level Hearing Officer -Optional $85.00 per hour
2" Level Hearing Schedule & Disposition Letters $0.85 per letter Acceptance and Scanning of Indigent Pay Plan Requests Between $2.00 and $5.00 Indigent Payment Plan Denial Letter $0.85 per letter
Additional Correspondence Letter $0.85 per letter
Joint/Banking Services - Optional $150.00 per month
Charge-backs and NFS -- Optional $5.00 per issued instance Refunds - Optional $8.00 per issued instance
Monthly Minimum $200.00 per month
Once the services are implemented, the amount received for each fine will not cover the costs owed to the County, State, and services provided. In short, the costs of doing business will be severely underfunded. The current fine schedule (not comprehensive) for eve violations is listed in Exhibit A. The fines range from $20, $50, $250.

To ensure the City covers the increased administrative costs and complies with 40203.5 eve, the proposed new fine schedule listed in Exhibit B will ensure budget viability while maintaining the spirit of deterrence for conduct.

COMMUNITY OUTREACH
As required by law, prior to adoption of resolution and for transparency, the City Council will provide notice of this item through its council agenda noticing procedure. The City Council will review staff's recommendation for amending its fine schedule for parking violations, and hold a public comment period.

FISCAL IMPACT
The fiscal impact is not precisely known, however the intent is to ensure the City is recouping all associated fees/costs with managing the processing of this legal task.

Dependent on City Council's approval, the budget and sustainability will improve.

STRATEGIC PLAN GOALS
The ability to recoup costs associated with enforcing parking and municipal code violations ensures for budget and financial stability for the agency.

RECOMMENDATION
Staff recommends Council approve the resolution updating the City's parking violation fine schedule pursuant to 40203.5 eve.

COUNCIL AGENDA ITEM
FEBRUARY 3, 2026
PREPARED BY: Tiffany Vitorino, Recreation Manager
SUBJECT: Aquatics Center 2026 Survey and Profit and Loss Presentation STRATEGIC PLAN GOALS: 6. Community Services

BACKGROUND/ ANALYSIS/DISCUSSION
Staff is pleased to present a financial report for the Aquatics Center, including a review of the fiscal budget's profits and losses. This comprehensive overview highlights survey results, financial trends, and operational changes, offering valuable insights into revenue and expenditure categories.

As Council is aware, municipal pools are a valuable asset in enhancing the quality of life within a community, providing recreational fitness, and social opportunities that promote overall well-being. They typically operate through the use of discretionary fund, such as the General Fund, rather than through a cost recovery model. The Gustine Aquatics Center reflects this trend, with an annual transfer from the General Fund required to balance its budget. In recent years, this transfer has increased due to rising inflation, and minimum wage adjustments.

This year, the Aquatics Center celebrates its 73rd year of operation, and the facility continues to show signs of wear and age. City staff is diligent to make every effort to address these challenges and improve the pool's condition. 2024's resurfacing project, approved by Council, was a significant improvement, enhancing the pool's functionality and aesthetics while addressing longstanding maintenance needs.

Additionally, a sponsorship program introduced several years ago has been highly successful in supporting various enhancements. This program has funded purchases such as shade structures, new tables, lifeguard incentive programs, and snack bar upgrades, contributing to the facility's overall appeal and usability.

As part of the presentation, we will share the 2024-2025 budget and provide a comparative breakdown of the last three years. This approach offers a clearer understanding of the facility's financial trends, revenue growth, and expense management.

Revenue Breakdown
The Aquatics Center receives funding from four sources:
• Fees Collected: Includes programming, rentals, and open swims. • Donations: Contributions from community members, businesses and organizations.
• Concession Profits: Funds collected by the sale of snacks and food from the patrons along with the sale oft-shirts, pool noodles and goggles.

Page 69 of 96 ends

• Transfer In: Funds that are transferred from the General fund at the end of the fiscal year to balance its budget.

Key changes include the increase of pool entry fees from $3 to $4 in FY 2023-2024 and an increase in fees for pool parties, movie nights, expanded programming and seasonal pass offerings. These efforts contributed to growth in overall revenue.

However, they also affect the expenses as well due to expanded staffing needs.

Expenditure Breakdown
2024-2025 expenses have been broken down into detailed categories such as employee expenses, chemicals, maintenance, training, utilities, and insurance. Each component has been analyzed across fiscal year, accounting for the unique timing of the Aquatics Center's seasonal operations (June through August). 2024-2025 total expenses came to $165,307.61.

A breakdown of the past three years is included to analyze the Aquatic Center's expenses and trends over time. Since the Aquatics Center season begins in June and ends in August, its operations span two different fiscal years, similar to the Fireworks Fund.

Staff also gathered data from our recreation software, CivicPlus, which demonstrates that the slight decrease in community participation this past season may be attributed to the Boys and Girls Club no longer operating in Gustine. This change is reflected in reduced participation in Open Swim and swim lessons.

Expense highlights include:

Minimum Wage & Workers' Compensation Increases: Payroll remained relatively flat from FY 2023--24 to FY 2024-25. However, increases in minimum wage and Red Cross regulatory requirements are expected to result in higher payroll costs in FY 2025-26.

Insurance: Due to turnover among City Managers and staff, the allocation methodology for insurance costs was modified over time. These changes resulted in a significant reduction in the amount of insurance expense charged to the pool's account.

Utilities: During FY 2024-25, the Aquatics Center benefited from a large PG&E credit.

That credit has now been fully utilized, and utility costs are expected to increase in FY 2025-26.

Training Costs: Variations are primarily due to invoice timing. For example, training invoices from mid-season (e.g., July) may be recorded in the following fiscal year. Costs were lower in FY 2024-25 due to our designation as a new Red Cross Training Facility.

However, new Red Cross requirements and our goal to expand training will result in increased costs in FY 2025-26.

Chemicals: A significant increase is shown in FY 2024--25 due to the Facility Maintenance Worker's year-round focus on water quality. As a result, the pool remained clear and operational with no major issues.

Fiscal Year Trends
• 2022-2023: Lower training costs due to delayed invoice submission but increased payroll and utility expenses.
• 2023-2024: Reflects growth in programming, opening Saturdays, fee adjustments, and timing of training expenses carried over from prior seasons.

Page 70 of 96 ends

• 2024-2025: Shows an increase in Chemicals however working through the PG&.E credit brings the expense final amount down.
• 2025-2026: Staff forecasts an increase in expenses due to additional lifeguard training requirements and the exhaustion of the PG&E credit, which will result in the resumption of utility invoices. Insurance costs continue to rise annually.

Survey Results
Staff conducted two surveys following the 2024 season and prior to the 2025 season.

The first survey focused on hours of operation to identify potential adjustments for the 2025 season. Feedback included requests for additional night swims, movie nights, and expanded weekend availability. In response, staff added more night swims and eliminated one daytime open swim to allow for additional swim lesson offerings. Two Saturdays in June were added but experienced low attendance. Every Sunday in July was also added and showed stronger attendance, particularly when special events were occurring in the park, such as the Westside Auto Club Car Show and the G.P.S.

Festa.

The second survey focused on program performance. Results showed that Open Swim and Movie Nights were the most popular programs. There was also strong interest in swim lessons, aqua workouts led by lifeguards for the 2025 season were well attended.

Other offerings, including private parties and lessons, also received positive feedback.

Survey questions addressed facility entry, lifeguard performance, facility quality, and overall experience, resulting in an impressive average rating of 4.8 out of 5 stars, a slight increase from the previous season. Patrons were invited to provide written comments and suggestions. Feedback included requests for updated restrooms, exterior facility improvements, and even shorter wait times. Many patrons praised the lifeguard staff for their professionalism and dedication and expressed appreciation for recent facility upgrades. All concerns of patrons regarding lifeguard staff will be addressed during the 2026 orientation. Some patrons also noted satisfaction with the implementation of a credit card payment system for the 2025 season, which significantly reduced entry wait times and improved overall access to the facility.

Future Facility Plans and Needs
This presentation demonstrates the Aquatics Center's continued growth. Through fee adjustments implemented two years ago, expanded programming, and strategic bulk purchasing, the center has successfully balanced revenue streams while managing rising operational costs. Staff remains committed to improving operational efficiencies and enhancing services for the community.

For the 2026 season, staff plans to address key operational and facility improvements to further enhance the patron experience. These efforts include providing additional lifeguard training during orientation and throughout the season to improve the overall atmosphere of the Aquatics Center, with a focus on creating a positive experience for both children and parents. Staff also plans to add Wi-Fi to the facility and strengthen lifeguard customer service skills in hopes of increasing overall attendance. In addition, staff will continue utilizing the expertise of the new Facility Maintenance Worker and will proceed with restroom upgrades included in the budget and supported by vendor quotes. Other areas identified through survey feedback will also be addressed.

Page 71 of 96 ends

The pool's perimeter fence requires replacement due to safety concerns. The current fence is outdated, lacks sufficient structural integrity in certain areas, and no longer meets current safety standards. With the recent addition of a new playground adjacent to the Aquatics Center, replacing the fence would significantly improve safety and enhance the overall appearance of the park. A taller, modern fence would eliminate the need for the barbed wire. Staff will explore potential outside funding sources to help offset the cost of the fence replacement. The estimated cost for this project is approximately $29,000.

Additional future critical needs include relocating chemical storage to improve safety, upgrading the pool deck to enhance usability and aesthetics, and completing necessary repairs to the snack bar area.

Looking ahead to the 2026 season, staff plans to continue improving operations, programming, and facility conditions to enhance the patron experience. Although the Aquatics Center operates at a financial loss to the City, it remains a vital community asset, providing valued recreational opportunities, strong patron participation, and consistently positive survey feedback.

STRATEGIC PLAN GOALS
This presentation supports Strategic Goal #6 Community Services by demonstrating the City of Gustine's continued commitment to providing quality, accessible recreational services that enhance community well-being. The Aquatics Center remains a valued community asset, offering safe programming, strong participation, and positive patron feedback. Planned operational improvements and facility enhancements reflect ongoing efforts to respond to community needs while maintaining effective and responsible service delivery.

• Love the junior guard program but Friday afternoon is not ideal for taking off for the weekend which our family does all summer. Would be better for us Mon-Thursday. Also, for kids who attend every year, possibly change the curriculum. Possibly make age divisions so little and teens aren't combined. The night swims are great. The new pool surface was great. The new speakers at movie night were great. It also was nice to have more benches and chairs. Having open swim on the weekends is huge! We love the staff and all of the events. We are extremely grateful for the pool. It feels like part of our family. We are happy to donate to the pool every year. • I would like the City and the city council to know what an asset that they have in the Aquatic Center. Most communities don't have one and won't because of the cost. The city and the council need to appreciate the VALUE that the aquatic center gives to the community. Many children do not know how to swim and the kids in Gustine have a place to learn, not just how to tred water, but learn to swim. The people who were part of the water aerobics class also benefited from exercise and socializing. Additionally the aquatic center allows young people to learn how to be a life guard and obtain meaningful employment.
• My son took swim lessons this year and the lifeguards did such a good job and were SO patient. He truly retained a lot of what they taught him and continues to try to swim better. I'll definitely sign him up next year for a refresher/higher level course. It was well worth the money. • I'm in my 30s, and the pool has not changed much since I was 9 years old. The rusted barbed wire surrounding the pool feels unwelcoming and unsafe (tetanus), and there's got to be something that can be done to improve this community resource. If not in the budge do community fundraiser.

COMMENTS AND

• I think the lifeguards/instructors are great with the students. I would like to see a bit more organization in activities at times. Mostly it was great but there were times that felt like a loss of time especially during Jr. Lifeguard. I would like to have my child continue this every summer, but I would like to feel like she can build on her skills further. Also, I think that not everything was covered that was supposed to be. • Open the pool on Saturdays when people are home. More streamlined entry. Faster entry is more time to enjoy the pool. There's been a few times that I have gone to swim. And it took 10-15 minutes to get in because of the wait.

Other people were taking to long because they were saving spaces for there friends and family. Maybe presell entry's might work.
• Love all the activities you offer! We (my older kids) keep saying we're going to try the workout class .... Maybe this summer '26.
• Morning classes for the water Zumba not everyone can go at night. • Lessons later in the year or year round lessons. • More tables or benches out and cheaper prices .... If it was cheaper I would take my kids more often. Cut and pasted directly from survey.

GOALS FOR
2O26 SEASON
• Implement an internal Lifeguard Instructor {LGI) program: Creating an internal Lifeguard Instructor program that follows American Red Cross standards will build stronger, better-trained lifeguards will allow us to safely operate with fewer guards on duty (lowering payroll) while staying fully compliant with certification and safety requirements.
• Painting entrance and deck and replacing toilets. • Improving the parent experience at the pool through added shade, improved restrooms, Wi-Fi, and enhanced amenities creates a more comfortable and welcoming environment that encourages families to return. Working with lifeguards to promote a friendly, customer-focused attitude further strengthens relationships with parents. • Easing food restrictions for private parties is expected to increase bookings, providing guaranteed revenue and allowing for more accurate lifeguard scheduling and payroll planning compared to the unpredictable attendance of open swim. Adding cash deposits to the pool party rental procedures to insure clean up. • Seek outside funding for fence and other repairs to improve the appearance of the aquatics facility, making it more welcoming and less institutional in feel.

Page 95 of 96 ends

FUTURE NEEDS AND

UPGRADES
• Fence Replacement - Install a durable, secure, and visually appealing fence to enhance safety and aesthetics. - Working on an outside source for this project. • Chemical Relocation - Relocating Chemicals or creating an appropriate driveway to create a more efficient location to avoid chemical driver to have to drive on park lawn. • Deck Construction - Resurface or reconstruct the pool deck to enhance safety, durability, and appearance. Replacing wood on ceiling over deck area. • Snack Bar I Lifeguard Area Upgrade - Update equipment, storage, and layout to improve efficiency for staff and service for guests. Possible AC for staff and first aid area for injured or overheated patrons.
