ITEM NO.5

COUNCIL AGENDA ITEM
APRIL 7, 2026
PREPARED BY: Tiffany Vitorino, Recreation Manager
Ruben Chavez, Chief of Police
SUBJECT: Chamber of Commerce July 4th Parade
STRATEGIC PLAN GOALS: 6. Community Services

BACKGROUND/ ANALYSIS/DISCUSSION
The July 4th Parade is scheduled for Saturday, July 4, 2026, with participant lineup beginning at 8:00 AM and the parade stepping off at 10:30 AM. This year's parade is expected to draw a significantly larger number of participants and spectators as we commemorate the 250th anniversary of American independence. Communities across the country are planning enhanced festivities, which is likely to increase travel, attendance, and overall public interest in local events such as this parade.

Due to the anticipated increase in crowd size and participation, additional safety measures may be necessary. The parade would like to have police escorts to ensure the safety of participants, spectators, and traffic along the route. The route is as follows:

Staging Area:

Radius between the following streets:
- 5th Street between 1st Ave and North Ave
- North Ave between 5l Street and West Ave
1st Ave between 5th Street and West Ave
- 6t Street between 2n Ave and ls' Ave
Parade Route:

Parade will head southbound along 5th Street from Is! Ave to 5t Ave Turning westbound on 5 Ave to 6t Street
Turning northbound on 6t Street and ending at 2ns Ave
Parade floats will be asked to unload passengers at this point, and will be directed to move their vehicles/floats promptly thereafter.

The Chamber is requesting no parking signs along the staging area/parade route and for the area to be cordoned off for the safety of those participating. They also request barricades be placed at the intersections of the entire staging and parade route to avoid any uninvolved vehicles from accidently entering the parade and for the safety of those walking or loading onto the parade floats.

COMMUNITY OUTREACH
The Chamber promotes this parade on various social platforms as well as flyers that are distributed throughout the community.

Page 36 of 97 ends

FISCAL IMPACT
Public Works personnel will deliver and retrieve approximately 20 barricades. Police escort for the parade will require two uniformed Police Officers. Additional officers, volunteers, and Explorers can be staffed for traffic control. The fiscal impact for this event is $1,156.95. The Chamber is requesting all fees to be waived for the event.

STRATEGIC PLAN GOALS
This event falls under Strategic Plan Goal No. 6, Objective No. 5 by bringing a sense of pride to the community as well as enhancing the quality of life. It provides a positive experience for residents who participate in this procession while actively engaging with the community.

RECOMMENDATION
City Council to authorize the request by the Chamber of Commerce for use of City streets and services and waive the fees associated with use of City staff, equipment, and services for the 4 of July parade.

Re: Gustine Chamber of Commerce 4" of July Parade
Dear City Council:

PO Box 16
Gustine CA 95322
209-854-6945
www.gustinechamberofcommerce.com
The Gustine Chamber of Commerce is planning to host the annual 4th of July Parade again this year in downtown Gustine on July 4th at 10:30 AM. As this year marks the 250th celebration of America's independence, we anticipate strong community participation and an especially festive event.

We are requesting approval to use the same parade route as in years past. Below is a detailed explanation of the areas the Chamber would like barricaded, designated as no parking, and otherwise prepared to ensure a safe and successful celebration.

The following parade route we are requesting to have "no parking" signs and barricades blocking the route.

Parade Route:

Start of Parade: Going south on 5 Street from 1st Avenue Parade Travels south down 5" Street, turning right on 5 " Avenue, turning right on 6" Street End of Parade: Parade participants will end the corner of 6 Street and 2" Ave. From there parade participants will only be allowed to stop there to drop off anyone riding on their floats, and they will then be asked to move.

The following line up sections we are requesting to have "no parking signs" and barricades blocking the area. In the past this section has not been barricades, and we have had non-participating vehicles driving through the lineup area many times. We worry of the safety of our parade participants, children, animals. and their personal property. In the lineup area we have many people walking around, animals, and vehicles or floats. We are requesting this specific area to be barricaded to prevent unwanted vehicles from driving through for the safety of all involved.

Parade Line Up:
8:00AM prep (Participants begin arriving around 8:30AM, official line up begins at 9:00AM) Portion of North Avenue barricaded at 5 Street and West Ave. 1"Avenue barricaded at 5" Street and West Ave.
6" Street barricaded at North Avenue and at 2" Ave.

I have included a highlighted map of my requests. Blue highlights is the parade route, yellow highlights is the lineup area, and the red lines are the requested barricades. All along both routes we are requesting "no parking" signs for the morning of the parade beginning at 8:00AM.

The Chamber would like a fee waiver for the above request.

Please contact me if there are any questions, my cell phone number is 209-587-0810.

Thank You
Gustine Chamber of Commerce

ITEM NO. 6

COUNCIL AGENDA ITEM
APRIL 7, 2026
PREPARED BY: Tiffany Vitorino, Recreation Manager
SUBJECT: 4th of July Fireworks Show - Award
STRATEGIC PLAN GOALS: 6. Community Services

BACKGROUND/ ANALYSIS/DISCUSSION
The Gustine 4th of July Fireworks show is a long-standing community tradition, with 2026 marking its 116th annual celebration.

On February 12, 2026, staff issued a Request for Proposals (RFP) for the City's 2026 4 of July Fireworks show in an effort to solicit competitive bids and evaluate alternative vendors.

In response to the RFP, staff received statements from other fireworks companies indicating they were either fully booked for July 4, 2026, or unable to provide services within the City's established budget. Due to the limited availability of qualified vendors and ongoing budget constraints, staff recommends that the City continue services with its current vendor, Pyro Spectaculars by Souza.

Staff has been in ongoing communication with Pyro Spectaculars and has held detailed discussions regarding expectations and desired improvements for this year's show. Based on those conversations, staff anticipates enhancements to the overall presentation. Pyro Spectaculars has informed the City that a new pyrotechnician will be assigned to this year's event and has guaranteed a great and safe show for the community.

To address budget concerns, staff will continue working with the Gustine Chamber of Commerce to pursue major donors and secure sponsorships for the fireworks show. The Chamber will also host its Cow Herd fundraiser, which was very successful last year.

These efforts assisted the City in getting close to its fundraising goal, and staff is hopeful for similar results this year. The fireworks show will be funded primarily through community donations and sponsorships.

Attached as Exhibit A is the 2026 proposal from Pyro Spectaculars by Souza detailing the scope and specifications of the 2026 show. The total proposed amount for the show is $26,950.00.

COMMUNITY OUTREACH
The Recreation Department will be promoting this event along with fundraising efforts on various social platforms as well as flyers distribution throughout downtown.

Page 40 of 97 ends

FISCAL IMPACT
The total cost of the 2026 fireworks show is estimated at $26,950.00. To support funding efforts, City staff, community members, and local organizations have volunteered to assist with face-to-face donation collection. The event will primarily be funded through these donations, with any remaining balance subsidized by the Tip Top Community Contribution funds, as previously directed by Council.

STRATEGIC PLAN GOALS
This event falls under Strategic Plan Goal No. 6, Objective No. 5 by bringing a sense of pride to the community as well as enhancing the quality of life. The event aims to bring the community together in a family-friendly setting. This event provides a positive experience for residents who participate while actively engaging with the community.

RECOMMENDATION
Staff recommends that the City Council approve the resolution authorizing agreement with Pyro Spectaculars for the 2026 4th of July Fireworks show and authorizing the City Manager to execute necessary documents to proceed with the contract.

ITEM NO. 8

COUNCIL AGENDA ITEM
APRIL 7, 2026
PREPARED BY: Desirae Porras, HR Manager/Deputy Clerk
SUBJECT: Declaration of Surplus Property
STRATEGIC PLAN GOALS: 4. Financial and Budget Stability

BACKGROUND/DISCUSSION
Periodically, City departments conduct reviews over City owned equipment and facility appliances to verify the usefulness and operability of such equipment and property.

Staff has recently conducted said review and have identified City-owned equipment that is ready to be declared as surplus.

City staff has recently been in contact with PublicSurplus.com to explore a partnership to auction off surplussed equipment. PublicSurplus.com is an online auction platform used by public agencies nationwide to sell surplus property in a transparent, competitive, and compliant manner. Staff has been in contact with Public Surplus and will utilize their platform to auction the City's surplussed equipment, ensuring broad bidder access and maximizing potential cost recovery.

A declaration of surplus by the Council allows staff to destroy, donate, auction or sell equipment that is no longer serving a useful purpose to the City. All proceeds from any sale of City property will be placed into the general fund.

COMMUNITY OUTREACH
None.

FISCAL IMPACT
Utilizing PublicSurplus.com will incur zero costs to the City. All fees are paid by the buyerand agreed to upon enlisting as a bidder through the site. All auctions are expressly deemed as-is, and logistics on removal of the surplussed equipment is also at the burden of the buyer. ITEM NO.9

COUNCIL AGENDA ITEM
APRIL 7, 2026
PREPARED BY: Ruben Chavez, Chief of Police
Aaron Chandler City Attorney, Best Best & Krieger
SUBJECT: Waive Second Reading and Adopt an Ordinance Amending Title 1, Chapter 1, Title 2, Chapter 7, and Title 10, Chapter 3, of the City of Gustine Municipal Code related to Administrative Code
Enforcement
STRATEGIC PLAN GOALS: 4. Financial and Budget Stability

BACKGROUND
Keeping up with statutory changes provides an avenue for municipalities to keep fines and fees current with contemporary standards. A review of current state regulations and supporting case law give the City broader discretion to update and enforce its municipal code regulations.

At their regular meeting on February 17, 2026, the City Council approved a resolution updating the city's municipal code fine schedule. At the same meeting, Council acted to introduce and waive the first reading of an ordinance amending the code related to streamlining administrative code enforcements. Ordinances require two public readings, this being the second of the two.

ANALYSIS/DISCUSSION
As staff collaborated with legal counsel to review and update provisions related to administrative citations, several sections of the Municipal Code were identified as needing clarification or modernization. The first of these revisions appears in Section 1-1-7, shown in redlined form in Exhibit E. This amendment expands the City's enforcement options by clarifying that violations may be addressed not only as criminal misdemeanors or as infractions, but may also be enforced through administrative civil penalties pursuant to Chapter 7 of Title 2. This update provides greater flexibility in enforcement and ensures consistency with the City's broader administrative citation framework.

The proposed amendments to Chapters 7 and 10 (Exhibits F and G) of the Gustine Municipal Code are intended to modernize and streamline the City's administrative code enforcement procedures. Over time, staff has identified several provisions that required clarification, updates to reflect current practices, and adjustments to ensure consistency with state law. The redlines refine definitions, and improve the clarity of enforcement authority. These changes help ensure that the administrative citation process is used appropriately and that enforcement actions are clearly supported by the Code.

A significant portion of the amendments focuses on improving the fairness and efficiency of the appeal process. The revisions replace the Planning Commission with a Hearing Officer appointed by the City Manager, creating a more neutral and administratively efficient hearing structure. The updated language also clarifies appeal

Page 60 of 97 ends

timelines, strengthens notice requirements, and expressly states that failure to file an appeal constitutes a waiver of rights. Additionally, the hearing procedures have been modernized to allow cross-examination, ensure consistent evidentiary standards, and require written findings to be provided within 30 days of the hearing's conclusion.

The redlines also update several operational components of the enforcement program.

These include clarifying the acceptable methods of serving citations, correcting outdated or unclear language, and simplifying the definition of "responsible party" to focus on individuals with legal or physical control over a property or business. The amendments further revise the fine schedule to establish a clear escalating structure for repeat violations and update misdemeanor fine amounts to better reflect current enforcement needs. These adjustments provide a more predictable and transparent penalty framework for the public and staff.

Collectively, the proposed amendments strengthen the City's ability to enforce its municipal code in a fair, consistent, and efficient manner. By improving clarity, updating outdated provisions, and aligning procedures with best practices, the proposed amendments will better support compliance efforts and enhance the City's overall code enforcement program. Staff recommends approval of the ordinance amendments as presented.

COMMUNITY OUTREACH
The City Clerk has noticed this item in the March 11, 2026 local adjudicated newspaper of general circulation in accordance with the law.

FISCAL IMPACT
Approval of this ordinance will result in a modest fiscal impact associated with codifying the updated provisions into the City's online Municipal Code. These costs are routine and have already been anticipated within the adopted FY 2025--26 budget.

STRATEGIC PLAN GOALS
Modernizing the City's administrative citation procedures enhances financial stability by reducing inefficiencies and ensuring enforcement activities are carried out in a timely, cost-effective manner. Streamlined processes also improve compliance and cost recovery, supporting long-term budget stewardship.

RECOMMENDATION
Staff recommends that Council waive the second reading and approve adoption of an ordinance amending Title 1, Chapter l, Title 2, Chapter 7, and Title 10, Chapter 3, of the City of Gustine Municipal Code related to administrative code enforcement.

ORDINANCE NO. 2026-XXX
AN ORDINANCE Of THE CITY COUNCIL Of THE CITY Of GUSTINE, AMENDING TITLE 1, CHAPTER 1, TITLE 2, CHAPTER 7, AND TITLE 10, CHAPTER 3, Of THE CITY Of GUSTINE

MUNICIPAL CODE RELATED TO ADMINISTRATIVE CODE ENFORCEMENT AND

ADMINISTRATIVE PENALTIES
WHEREAS, the City of Gustine is authorized under state law to establish and enforce administrative penalties for violations of its Municipal Code; and WHEREAS, the City Council previously approved a contract with Data Ticket, Inc. to provide administrative citation processing services, and staff has reviewed existing fine schedules and enforcement procedures to ensure consistency with current practices and statutory requirements; and
WHEREAS, staff and the City Attorney have identified several provisions within Titles 1, 2, and 10 of the Gustine Municipal Code requiring clarification, modernization, and alignment with the City's administrative citation program; and WHEREAS, the proposed amendments update enforcement authority, clarify administrative citation procedures, modernize appeal and hearing processes, and revise the administrative fine schedule to ensure penalties are commensurate with the severity of violations and sufficient to recover the City's costs of enforcement; and WHEREAS, the City Council finds that these amendments promote fairness, transparency, and efficiency in the City's code enforcement program and are in the best interest of the public health, safety, and welfare.

NOW THEREFORE BE IT RESOLVED by the City Council of the City of Gustine:

Section 1: That Title 1, Chapter 1, Title 2, Chapter 7, and Title 10, Chapter 3 of the City of Gustine Municipal Code be amended as stated in Attachment "A", attached hereto and made a part hereof by this reference.

Section 2: Necessity: The City Council finds that the amendments adopted by this Ordinance are reasonably necessary to address local administrative, operational, and enforcement conditions unique to the City of Gustine. The City contracts with an external citation processing vendor and must ensure that its Municipal Code provisions align with current enforcement practices, cost-recovery needs, and statutory requirements. Existing provisions in Titles 1, 2, and 10 contain outdated language, unclear procedures, and inconsistent enforcement mechanisms that hinder efficient and fair administration of the City's code enforcement program.

These local administrative conditions-including the need for predictable fine structures, modernized appeal procedures, clarified enforcement authority, and updated service and notice requirements-necessitate amendments to ensure that the City can effectively enforce its regulations, recover associated costs, and maintain a transparent and equitable enforcement system.

Section 3: Purpose and Authority: The purpose of this Ordinance is to update and modernize the City's administrative code enforcement framework by amending Title 1, Chapter 1; Title 2, Chapter 7; and Title 10, Chapter 3 of the Gustine Municipal Code.

These amendments clarify the City's authority to issue administrative civil penalties, refine definitions, update enforcement procedures, establish a Hearing Officer system for appeals, and adopt an updated Administrative Citation Violation Fine Schedule. This Ordinance is adopted pursuant to the City's police powers under Article XI, Section 7 of the California Constitution, and the authority granted to municipalities under Government Code sections 36900--36904 and 53069.4 to impose administrative penalties for violations of local ordinances. The purpose of these amendments is to ensure that the City's enforcement processes are fair, efficient, consistent with state law, and capable of recovering the City's actual costs associated with enforcing its Municipal Code.

Section 4: Effective Date and Publication This Ordinance shall take effect within thirty (30) days after its adoption. The City Clerk shall certify to the adoption of this ordinance and cause its publication in accordance with applicable law.

PASSED AND ADOPTED by the City Council of the City of Gustine after its introductions and waiver of the first reading at a scheduled meeting on February 17, 2026 and adopted this 7i day of April, 2026 by the following vote:

Sec. 2-7-1. Declaration of purpose.
(al The city council finds that the enforcement of this Code, the zoning code and applicable state codes throughout the city is an important public service. Code enforcement is vital to the protection of the public's health, safety, and quality of life. The council recognizes that enforcement starts with the drafting of precise regulations that can be effectively applied in administrative enforcement hearings and judicial proceedings.

The council further finds that a comprehensive code enforcement system that uses a combination of administrative and judicial remedies is critical to gain compliance with code regulations. Failure to comply with enforcement actions may ultimately require the city attorney to file litigious action to gain compliance. (bl The city council finds there is a need for an alternative method of enforcement for minor violations of this Code and applicable state codes. The council further finds that an administrative citation program is an appropriate alternative method of enforcement for such minor violations. (cl The procedures established in this chapter shall be in addition to criminal, civil, or any other legal remedy established by law, which may be pursued to address violations of this Code or applicable state codes. (d) The administrative citations process set forth in this title shall also apply to continuing violations of this Code or the zoning code that pertain to building, plumbing, electrical, or other similar structural or zoning issues as set forth in section 2-7-9, subsections (b) and (c).
(Ord. No. 438, 7-1-2008; Ord. No. 488, 5 1, 12-18-2018) Sec. 2-7-2. Authority.

Any person violating any provision of this Code, or applicable state code, wherein such violation consists of an action or failure to act which if sustained may result in the assessment of a fine, may be issued an administrative citation by the enforcement official as provided in this chapter. (1) The enforcement official shall have the authority and powers necessary to gain compliance with the provisions of this code and applicable state codes. These powers include the power to issue notices of violation and administrative citations, inspect public and private property (when such private property owner or manager has been served notice of being out of compliance), and use whatever judicial and administrative remedies as may be available under this code or applicable state codes. (2) The enforcement official is authorized to enter upon any property or premise to ascertain whether or not the provisions of this code or applicable state codes are being obeyed, and to make any examinations and surveys necessary to the performance of their enforcement duties pursuant to all applicable laws. These may include the taking of photographs, or collection of samples, or other physical evidence, or the recording of interviews. All such takings, examinations, inspections, gatherings, or surveys shall be done in a reasonable manner. Should a respondent refuse permission to enter to inspect, the enforcement official may seek an administrative inspection warrant pursuant to the procedures provided for in California Code of Civil Procedures (CCCP) 55 1822.50-1822.59. (3) Each and every day a minor violation of this code or applicable state code exists constitutes a separate and distinct offense.
(4) A civil penalty shall be assessed by means of administrative citation issued by the enforcement official and shall be payable directly to the city, and shall be deposited to the code enforcement fund established pursuant to section 2-7-3.

The first offense warning shall, in addition to the requirements set forth in subsection (a) above, identify how the violation(s) can be corrected and provide a date by which the violation(s) must be corrected. A first offense warning shall not be required for violations posing an immediate danger to the public health or safety. (2) Any person receiving a first offense warning for a continuing violation may file a written petition with the city clerk for consideration by the city manager for an extension chime to correct the identified violation(s). The city manager may grant an extension of time if the request is timely received and there is sufficient evidence to support the need for additional time to reasonably correct the violation(s).
(3) If a violation is not corrected in the time specified in a first offense warning or applicable extension, the enforcement official may issue an administrative citation in accordance with the procedures in this chapter.

ITEM NO. 11

COUNCIL AGENDA ITEM
APRIL 7, 2026
PREPARED BY: Melanie Correa, City Manager
SUBJECT: Seasonal Aquatics Operations Assistant Job Description STRATEGIC PLAN GOALS: 6. Community Services

BACKGROUND
The Gustine Aquatics Center continues to experience increased participation in recreational swim, swim lessons, and special events. As program demand has grown, administrative and customer-service responsibilities at the facility have expanded significantly. These duties are currently performed by the Lead Lifeguard, diverting attention away from essential safety-related functions such as lifeguard supervision, training, positioning, and patron monitoring.

To address this operational need, staff conducted a job analysis to identify tasks that could be reassigned from lifeguard personnel to a dedicated administrative and customer-service support role. This analysis resulted in the development of a new seasonal, part-time classification: Seasonal Aquatics Operations Assistant.

ANALYSIS/DISCUSSION
The proposed Seasonal Aquatics Operations Assistant classification provides structured support for front-desk operations, patron intake compliance, program promotion, snack bar operations, and general facility organization. These duties are essential to the daily functioning of the Aquatics Center and directly support the City's risk management requirements.

Key responsibilities include:
• Ensuring all patrons complete newly required liability waivers and sign-in procedures
• Managing membership cards and attendance records
• Providing customer service and answering program-related questions • Assisting with marketing, outreach, and CivicPlus Recreation Software updates • Supporting snack bar operations, inventory, and cleanliness • Assisting the Lead Lifeguard with scheduling logistics and training documentation • Maintaining facility signage, organization, and general cleanliness By shifting these administrative and customer-service tasks to a dedicated position, the Lead Lifeguard can focus on lifeguard supervision, training, and patron safety - the core functions required to maintain a safe aquatic environment.

The classification is part-time, seasonal, and non-exempt, consistent with other Aquatics

Page 89 of 97 ends

Center support roles. Minimum qualifications include CPR/First Aid certification (with City-provided training), food handling certification, and basic customer service and record-keeping skills.

COMMUNITY OUTREACH
Not applicable.

FISCAL IMPACT
The position is part-time and seasonal, not to exceed 28 hours per week. Funding for this classification is available within the existing Aquatics Center budget (Fund 016).

Establishing this role does not create any new full-time obligations and is not expected to increase overall program costs. To maintain alignment with approved budgetary allocations, the addition of this classification will be offset by reducing the seasonal lifeguard staffing count by one. This staffing adjustment ensures fiscal neutrality while improving operational efficiency and allowing lifeguard personnel to focus on safety-critical duties.

STRATEGIC PLAN GOALS
This item aligns with Strategic Plan Goal #6 Community Services, objective 2, maintain current level of staff-provided public services.

RECOMMENDATION
Staff recommends City Council adopt a resolution approving the new job classification of Seasonal Aquatics Operations Assistant and approving the proposed job description.
