MEMORANDUM
DATE: July 17, 2026
TO: City Council
FROM: Kenneth Stiles, Interim Administrative Services Director SUBJECT: Claim Settlement
Background
During the December 24, 2025 storm event, a limb from a City-owned tree on Poplar Street fell onto a Coastside County Water District standby vehicle parked at an employee’s residence. The vehicle, a 2017 Ford F-150, was determined to be a total loss.
ACWA JPIA, on behalf of Coastside County Water District, submitted a property damage claim totaling $45,283.84. The City’s claims administrator determined that liability is unfavorable because the City had prior notice of problems with the tree, including previous limb failures.
Settlement Evaluation
The claims administrator determined that $16,705.62 in damages is supported, consisting of:
Actual cash value of the vehicle, including tax: $14,588.27 Towing: $195.50
Storage: $1,400.00
Loss of use: $521.85
The requested replacement value was not supported because the recoverable amount for a totaled vehicle is its actual cash value.
Recommendation
Approve settlement of the claim in an amount not to exceed $16,705.62. As a condition of payment, the claimant will execute a release resolving all additional damages associated with this claim.
