MEETING DATE: 11/19/2024 AGENDA SECTION: CONSENT CALENDAR

SUBJECT:

Authorization for the City Manager to sign a Grant of Easement from the City of Hanford to Southern California Edison for electrical services located within the Lennar Homes Tract 934, located at the Southeast corner of Grangeville Boulevard and 13th Avenue. A 11’x30’ easement will be located on Outlot “A” on the north side of West Ella Street and another 7’x54’ easement located on Outlot “C” on the west side of North Frontier Street.

RECOMMENDATION:

That that City Council, by motion, authorize the City Manager to sign a Grant of Easement from the City of Hanford to Southern California Edison for electrical service in two locations as described above, within Tract 934, easement strip #1 (11’x30’) on Outlot “A” on north side of West Ella Street and easement strip #2 (7’x54’) on Outlot “C” on the west side of North Frontier Street.

BACKGROUND:

Tract 934 is a subdivision development located at the southeast corner of 13th Ave and Grangeville Blvd. The developer, Lennar Homes, is constructing a residential development that has a Storm Drain Basin, Outlot “A” and a landscape lot, Outlot “C” that was dedicated to the City of Hanford with the Final Map. The Final Map, which was recorded on August 14, 2023, is attached for Council review.

To accommodate the improvements, a Grant of Easement from the City of Hanford to Southern California Edison Company has been prepared and is attached for Council review. The easement includes two locations, strip #1 (11’x30’) on Outlot “A” on the north side of West Ella Street and easement strip #2 (7’x54’) on Outlot “C” on the west side of North Frontier Street.

With Council's approval, the City Manager would sign and execute the Grant of Easement allowing SCE to record the document and install electrical service on the city-owned property.

FISCAL IMPACT:

There is no fiscal impact with this action. The costs of the SCE Easement and the underground service installation and improvements will be paid by the developer, Lennar Homes Tract 934.

MEETING DATE: 11/19/2024 AGENDA SECTION: CONSENT CALENDAR

SUBJECT:

Authorization for the General Fund to forgive the outstanding Courthouse Fund debt of $1,250,706 for past improvements and maintenance costs.

RECOMMENDATION:

Recommendation:

City Council authorize for the General Fund to write off the Courthouse Fund debt of $1,250,706 from past improvements and maintenance costs.

Recommended Motion:

I move to authorize the General Fund to write off the Courthouse Fund debt of $1,250,706.

BACKGROUND:

Since 2006, the Courthouse Fund (0330) has carried a balance owed to the general fund due to the fact that the Courthouse's expenses have consistently exceeded the revenues that the City was able to generate from the building. As a result, the debt has continued to accumulate, and the courthouse fund currently owes $1,250,706 to the General Fund as of the date of this report. Given that the Courthouse will no longer be a revenue-generating facility for the city, with the City Council's approval to sell the courthouse. Because the courthouse's necessary improvements exceed the value of the property and the sale of the courthouse will only generate $1, it is proposed that the outstanding debt of $1,250,706 owed by the courthouse be written off (absorbed) by the General Fund.

FISCAL IMPACT:

The General Fund balance will decrease by $1,250,706 and the Courthouse Fund (0330) balance will decrease to $0 and become an inactive fund. There is an existing receivable noted in the General Fund due from the Courthouse Fund, this will no longer be recognized as it is now known to not be realized. The sale of the courthouse is anticipated to happen within November 2024, any residual amount of negative fund balance would also be absorbed by the General Fund.

The sale of the facility for $1 will not cover the outstanding receivable owed to the General Fund.

Over time tenant income was not enough to cover costs for improvements or maintenance so the fund continued to go into the negative without even factoring deferred improvements. Staff had estimated the outstanding cost of improvements to be in the approximate range of $10 million as noted at the November 5, 2024 City Council meeting. The deferred improvements will no longer be a concern for the City.

STAFF REPORT

MEETING DATE: 11/19/2024 AGENDA SECTION: CONSENT CALENDAR

SUBJECT:

Introduction of Ordinance No. 2024-10, Adding Municipal Code 3.60 City of Hanford Sales and Use Tax Accountability Measures

RECOMMENDATION:

Recommendation: That the City Council, by motion, Introduce and waive the first reading of Ordinance No. 2024-10, Adding Municipal Code 3.60 City of Hanford Sales and Use Tax Accountability Measures

Recommended Motion: I move to introduce and waive the first reading of Ordinance No. 2024-10, Adding Municipal Code 3.60 City of Hanford Sales and Use Tax Accountability Measures BACKGROUND:

On July 2, 2024, Resolution 2024-21-R approved submission to City of Hanford voters submission of ballot language and necessary papers to be filed with the Kings County Elections Office for November 5, 2024 election. Revenue and Taxation Code Section 7285.9 authorizes city councils to levy a transactions and use tax for general revenue purposes via an ordinance approved by a two- thirds vote of all members of the City Council and if approved by a majority vote of the qualified voters of the city voting in an election on the issue. As of the date of this report Measure H has been approved on November 5, 2024 by voters pending final certification by the Kings County Registrar of Voters. This ordinance will establish accountability measures in the City's Municipal Code after implementation of Measure H.

The ballot language included funding categories consistent with the approved expenditure plan, a transactions and use tax rate that would cover the expenses outlined in the draft expenditure plan (1%), the establishment of citizen's oversight, audit requirements, a statement indicating that the funds would remain local and that the measure could be ended by voters.

The language is provided below:

" Measure H": Essential City Services Protection Measure

To provide funding that would remain local and cannot be taken by the State to preserve/improve essential city services including, police, fire, 911 emergency response, neighborhood police patrols, crime prevention; maintain city streets and parks; address homelessness; improve youth/senior programs; retain local jobs; and other general services, shall City of Hanford enact a 1¢ Transaction

and Use Tax (Sales Tax), providing approximately $19,200,000 annually, until ended by voters; requiring annual independent audits and citizens’ oversight?

Ordinance 2024-10, Sales and Use Tax Accountability Measures As presented July 2, 2024, the City proposed to amend the Hanford Municipal Code to include specific accountability measures. A final version of Chapter 3.60 Sales and Use Tax Accountability Measures is attached with this agenda. The language in the amendment presented to voters includes the following accountability measures:

1. Requirements for an expenditure plan that outlines implementation of the sales and use tax for the fiscal year

2. Requirements that any changes to the expenditure plan require a resolution adopted by the majority of Council following the recommendation by the Sales Tax Oversight Board and a public hearing.

3. The initial expenditure plan, annual budgets, and amendments to the expenditure plan are made publicly available.

4. The initial expenditure plan shall dedicate fifteen percent (15%) of budgeted revenues for the initial year of the plan to establish an economic uncertainty fund, which may only be accessed in times of fiscal emergencies. Council may direct that the economic uncertainty fund be accessed in order to fund the remainder of the plan in the case of a fiscal emergency, as determined by 4/5ths vote of the City Council as a whole.

5. Each expenditure plan shall fund department activities as may be recommended from time to time by the Board and approved by the City Council within the parameters approved by the voters.

6. The Council will appoint a standing oversight committee to constitute the Sales Tax Oversight Board (Board) as approved by Resolution.

7. Each member of the Board shall be a Hanford resident.

8. The City shall provide an annual independent audit that accounts for the tax revenues received and expenditures made. The audits will be made available to the public.

Final adoption of this ordinance will be brought back to City Council on December 3, 2024. This action will establish accountability requirements for Measure H. Upon final adoption, and seating of a new City Council, staff plans to bring back an item for discussion on December 17, 2024 for adoption of a resolution to establish a Citizens Oversight Board (as discussed in separate item on today's agenda for schedule of Measure H implementation).

FISCAL IMPACT:

There is no direct fiscal impact with this action. This action will establish accountability measures for when Measure H is fully implemented.

AGENDA

STAFF REPORT

MEETING DATE: 11/19/2024 AGENDA SECTION: CONSENT CALENDAR

SUBJECT:

Acceptance and authorization for staff to File the City of Hanford's Quarterly Investment Portfolio and Transactions Reports as of 09/30/2024.

RECOMMENDATION: That the City Council accept and authorize staff to file the City of Hanford's Quarterly Investment Portfolio and Transactions Report as of 09/30/2024.

RECOMMENDED MOTION: I move that the City Council accept and authorize staff to file the City of Hanford's Quarterly Investment Portfolio and Transactions Report as of 09/30/2024.

BACKGROUND:

Quarterly Investment Report
The City has approximately $124 million in investments and cash, across all funds, as of 09/30/2024.

Recent Activity
The City actively maintains its Wells Fargo cash accounts at a minimum of $3 million. At the beginning of the fiscal year with the onboarding of Meeder (our investment portfolio manager) we transferred out the entire amount in LAIF and a portion of CLASS (Local Government Investment Pools) for a total amount of $61,664,339.77 to a US Bank money market account. Over the course of several weeks, Meeder invested those funds on behalf of the City into various investment securities.

The portfolio's book yield is approximately 4.07% and most of the bonds purchased are not callable, or have coupons that will not be called away. The portfolio is well diversified and positioned to perform well in a potentially cutting rate environment.

Current Investment Environment. In September, the Federal Reserve cut interest rates by 50 basis points or 0.50% for the first time in four years. Strategists believe that there will be two additional rate cuts in 2024 and expect the cuts to continue into 2025.

The 10-year Treasury Note interest went down from last quarter after the Federal Reserve cuts at approximately 3.81% versus 4.36% at the end of last quarter. At the same time last year, the rate was higher at approximately 4.43%.

Future Actions
The City's portfolio will be actively managed and re-invested as securities mature. As idle cash is available it will be transferred to US Bank money market account, which then may be reinvested.

Meeder provides Staff with in depth quarterly reviews and timely economic updates as available.

Page 213 of 231 ends

Summary
The primary purpose of the City’s cash is to provide residents of Hanford with services. In order to maximize the earnings potential on the City’s idle cash, the City utilizes Meeder to actively monitor the portfolio and purchase low-risk investments which will provide a higher return versus allowing the cash to be held in savings accounts earning little to no interest. Additionally, idle cash is also held with government pools, including the Tulare County Investment Pool and CLASS. It is the policy of the City to invest public funds in a manner that will provide a high investment return with a high level of security (low risk) while meeting the daily cash flow demands of the entity and conforming to all state and local statutes governing the investment of public funds.

FISCAL IMPACT:

This item is informational. Investing the City's cash will generate continual interest earnings on the investment portfolio.

AGENDA

STAFF REPORT

MEETING DATE: 11/19/2024 AGENDA SECTION: GENERAL BUSINESS

SUBJECT:

Approval of the City's formal Temporary Street Closure Permit policy to ensure safe, organized, and efficient temporary street closures for community events, including block parties and neighborhood gatherings. This policy provides a clear process for residents and organizations to apply for and receive permission to temporarily close streets, ensuring proper planning, coordination, and notification for each event.

RECOMMENDATION:

Recommendation: That the City Council, by motion, Review and Approve the City's formal Temporary Street Closure Permit policy.

Recommended Motion:

BACKGROUND:

The City of Hanford is attempting to streamline its approach to managing temporary street closures for community events by formalizing its permit process. Previously, the Hanford Police Department oversaw these closures, but a recent review between the Public Works and Police Departments highlighted the need for a standardized, transparent policy to better serve both the city and residents.

Under the new policy, all permits for temporary street closures will be submitted directly to the Public Works Department. This centralized process aims to simplify approval and ensure that necessary conditions are met efficiently. Once a permit is approved, the Public Works Department will notify all relevant agencies, following the same protocol used for other scheduled and unscheduled street closures.

This change is expected to create a more organized and consistent process for residents and officials involved in community events, enhancing communication and coordination across city departments.

The cost of a temporary street closure permit has been established at $75.00. This fee would serve as cost recovery for staff time.

FISCAL IMPACT:

No fiscal impact to the City budget.
