RECOMMENDATION:
RECOMMENDATION TO FIND THAT THERE EXISTS A PROCLAIMED STATE OF EMERGENCY AND EITHER: (I) THAT STATE OR LOCAL OFFICIALS HAVE IMPOSED OR RECOMMENDED MEASURES TO PROMOTE SOCIAL DISTANCING; AND
AUTHORIZE VIRTUAL AND HYBRID CITY COUNCIL MEETINGS AS WELL AS
VIRTUAL AND HYBRID MEETINGS FOR ALL OTHER CITY BOARDS, COMMISSIONS, COMMITTEES OR AGENCIES IN LIGHT OF AB 361
SUMMARY
On March 17, 2020, Governor Newsom issued Executive Order N-29-20, which allowed legislative bodies to conduct public meetings through teleconferencing without complying with certain provisions of the Ralph M. Brown Act. All provisions of Executive Order N-29-20 concerning the conduct of public meetings expired on September 30, 2021.
Assembly Bill 361 was signed into law by the governor on September 16, 2021, and went into effect immediately. AB 361 allows legislative bodies such as the Hawaiian Gardens City Council and other City bodies to meet virtually provided there is a state of emergency, and either (1) state or local officials have imposed or recommended measures to promote social distancing; or (2) the legislative body determines by majority vote that conducting full meetings in person would present imminent risks to the health and safety of attendees. The Governor by executive order signed on September 20, 2021, suspended the effective date of AB 361 to October 1, 2021. As a result, if the City Council desires to have virtual or hybrid City Council meetings on or after October 1, 2021, it must do so consistent with the requirements of AB 361. Though adopted in the context of the pandemic, Assembly Bill 361 allows for virtual or hybrid meetings during other proclaimed emergencies such as earthquakes or wildfires, where physical attendance may present a risk.
Agenda Item #B2
February 22, 2022
AB 361 requires the following:
Public agencies, by majority vote within 30 days of the first virtual or hybrid meeting under AB 361 and every 30 days thereafter, find a state of emergency still exists and continues to directly impact the ability of the members to meet safely in person, or that officials continue to impose or recommend measures to promote social distancing.
A public comment period where the public can address the legislative body directly.
Public comments cannot be limited to only comments submitted in advance and specifies that the body “must provide an opportunity for the public to…offer comment in real time” per Government Code 54953(e)(2)(E). The body must allow a reasonable time for public comment during the comment periods.
The agenda must include information on the manner in which the public may access the meeting and on providing comments remotely.
If technical problems arise that result in the public’s access being disrupted, the legislative body may not take any vote or other official action until the technical disruption is corrected and public access is restored.
AB 361 provisions will sunset on January 1, 2024.
Under AB 361, the City may continue using virtual or hybrid meetings for the duration of the state-proclaimed state of emergency if the City Council finds that (1) state or local officials have imposed or recommended measures to promote social distancing or (2) if meeting in person would present imminent risks to the health and safety of attendees. The City Council is able to make those findings.
The Governor’s proclamation of a state of emergency is still active, and local officials continue to recommend social distancing measures. The Los Angeles County Department of Public Health (LACDPH) Health Officer Order, revised September 28, 2021, begins as follows:
SUMMARY OF THE ORDER: Since June 15, 2021 and after the retiring of the State’s Blueprint for a Safer Economy, community transmission of COVID-19 in Los Angeles County has rapidly increased from Low to High.
Based on continuously high daily new cases of COVID-19 to a level that indicates High community transmission of the COVID-19 virus, based on the federal Centers for Disease Control and Prevention (CDC) indicators, this Order continues to require masking by all, regardless of vaccination status, in an effort to slow the continuously high trends in and level of transmission of COVID-19 currently being seen in Los Angeles County.
Agenda Item #B2
February 22, 2022
In addition, the LACDPH “Reducing Risk Guidance (English)” revised on October 4, 2021, lists the following under the section titled “How to Reduce the Risk of COVID-19”:
Keep your distance. Use two arms lengths as your guide (about 6 feet) for social distancing with people outside your household when you are not sure that they are fully vaccinated.
Since the start of the COVID-19 pandemic, the City Council and other City meeting have had relatively low attendance from the public. Accordingly, the City Council believes it should generally be able to hold in-person meetings in City Council Chambers in a manner that allows the City officials, staff, and the public to attend in a socially distanced manner. At the same time, however, the City Council recognizes that members of the public, and from time-to-time, officials and City staff may need to or feel more comfortable attending meetings virtually, in light of the ongoing COVID-19 pandemic and the manner in which circumstances surrounding the pandemic, including the impact on individual and public health, may rapidly change. Accordingly, the City Council thus desires to allow for virtual and/or hybrid (i.e., in-person and virtual) meetings in order to both ensure the public health and safety of the public, City officials, and City staff, as well as continuity of government in allowing regularly-scheduled meetings to continue to occur without interruption.
Continued compliance with AB 361 will require the City Council to approve the action making the required findings every 30 days, via the consent agenda.

RECOMMENDATION:
RECOMMENDATION TO APPROVE RESOLUTION NO. 012-2022 APPROVING AN
AGREEMENT WITH WILLDAN ENGINEERING TO PROVIDE PROFESSIONAL
SERVICES FOR CODE ENFORCEMENT AND RELATED COMMUNITY
DEVELOPMENT SERVICES
SUMMARY
The City of Hawaiian Gardens currently contracts with various consulting companies for professional services to meet ongoing service and technical functions and needs in the city. The City Manager directed the Community Development Department to solicit proposals from qualified firms to fill important current service needs. It is recommended that the City Council award a contract to Willdan Engineering.
DISCUSSION
The Community Development Department contracts for various professional services for building, planning, code enforcement, engineering, etc. There are current responsibilities and positions unfilled or unmet by current contracted consultants that create the need for these contracted services. Staff contacted Willdan Engineering, a reputable consulting firm that the city used in the past for code enforcement services. The recommendation is to contract with Willdan Engineering since they provided the best qualified candidates and services at an acceptable hourly fee. Willdan Engineering demonstrated the qualifications, responsiveness, and ability to fill the necessary services on an on-call and as-needed basis. The fee for code enforcement supervision services is $65 an hour. To staff’s knowledge, the contract shall include services for up to 40 hours a week.
Consequently, the total overall cost of the project will depend on the duration of the assignment.
Agenda Item #B8
February 22, 2022
Willdan Engineering has been in business for over 57 years and specializes in providing municipal services. They provide planning, code enforcement, building and safety, public works, fire prevention, and other services to over 200 municipalities and businesses throughout the country. They have 14 local offices in California.
FISCAL IMPACT
None, as adequate funds have been allocated in the current Community Development Department budget.
SUGGESTED ACTION

RECOMMENDATION TO ADOPT RESOLUTION 009-2022 APPROVING THE CITY OF
HAWAIIAN GARDENS FUND POLICY AND A REVISED COMMITTED CONTINGENCY
AND MAINTENANCE AND EQUIPMENT RESERVE POLICY FOR THE GENERAL FUND
SUMMARY
In order to comply with The Governmental Accounting Standards Board (GASB) Statement No. 54, Fund Balance Reporting and Governmental Fund Type Definitions, The City adopted a Fund Policy under Resolution 062-2011. This policy outlined the 5 types of fund balances that must be reported for a City. These are Nonspendable, Restricted, Committed, Assigned, and Unassigned. As part of this policy the Council included approval of a Committed Contingency Reserve. Under Resolution 041-2013 the Council set this reserve amount to $15,000,000 as well as establishing a building and equipment reserve fund of $750,000. They identified the contingencies that would cause the use of these funds. Resolution 051-2017 was adopted as a stand-alone Contingency and Maintenance and Equipment Reserve Policy and revised the specific purposes for the use of these funds but retained the same committed amounts. The attached document contains the Fund Balance Policy and the revised Contingency and Maintenance and Equipment Reserve Policies.
The reduction in revenues, due to the pandemic, caused the City to use some of this reserve balance. The current budget includes an amount of $1,500,000 to be deposited into this reserve for each of the next two years. Additional amounts to be deposited in the reserve may be established by the Council as well as determining the limits for the reserves. These changes may be made at any Council meeting and the Council may modify the amounts and/or purpose for these reserves.
The Finance Committee recommended that the City Council consider increasing the amount of Agenda Item #C2

the contingency reserve. The attached policy is shown with an increased reserve balance of $20,000,000. The committee also recommended that, until the maximum established limit is reached, the City continue to transfer $1,500,000 each fiscal year into the reserve and it is also recommended that, at end of the fiscal year operations, all unassigned fund balance remaining in excess of $500,000 be deposited into the contingency reserve until the maximum established limit is reached.
Staff is requesting Council consider approval of this revised policy and limit or provide recommendations for modifications.

RECOMMENDATION:
RECOMMENDATION TO DISCUSS OPTIONS FOR FILLING VACANT CITY COUNCIL SEAT
SUMMARY
On February 8, 2022, Councilmember Maravilla announced her resignation from the City Council. The resignation became effective immediately, thus as of February 9, 2022 Councilmember Maravilla’s Council seat was vacant. This vacancy occurred in the first half of Councilmember Maravilla’s term.
State law provides that to fill the vacant seat, the City Council must, within 60 days from the commencement of the vacancy, either fill the vacancy by appointment or by calling a special election. (Gov. Code, § 36512 (b).) Because the effective date of Councilmember Maravilla’s resignation was February 9, 2022, the City Council must therefore either call a special election or appoint someone to fill the vacancy by April 9, 2022. Below is a more detailed discussion of each option.
Special Election. If a special election is called, it must be held on the next regular election date that is at least 114 days after the call for the special election (which must occur prior to April 9, 2022). The City incurs the costs of conducting the election. The term of the person elected to fill the vacant seat runs to the end of the vacant seat’s original term, which here would be November 2024. (Gov. Code, § 36512 (b)(1).) The Elections Code sets the election dates as follows: (a) the first Tuesday after the first Monday in March of each even-numbered year that is evenly divisible by four; (b) The first Tuesday after the first Monday in March of each odd-numbered year; (c) The second Tuesday of April in each even-numbered year; (d) The first Tuesday after the first Monday Agenda Item #C3
February 22, 2022
in June in each even-numbered year that is not evenly divisible by four; and (e) The first Tuesday after the first Monday in November of each year. (Elections Code, § 1000.) To conduct an election to fill the vacant seat, the City Council must adopt a resolution formally calling for a special election. (Elections Code, § 12001.) Assuming the City Council adopted this resolution in March (or early April) of 2022, the special election would be held on Tuesday, November 8, 2022 (which represents the first Tuesday after the first Monday in November 2022), as that is the next regular election date that is more than 114 days from the call of the election. If the Council proceeds with this option, Councilmember Maravilla’s vacant seat would sit open until that election.
Because a general municipal election is already scheduled for the same date that the special election would occur, there would be only additional nominal costs; such costs would not be nearly as much as holding a special election singularly without this general municipal election (i.e., because the City is already conducting and paying the County for this general municipal election, adding the special election would not be very costly).
If the City Council wishes to call a special election, staff will bring back before the Council the appropriate legislative package.
Appointment. Alternatively, the City Council could decide to appoint someone to fill Councilmember Maravilla’s seat. That person would serve until the next general municipal election—i.e., November 8, 2022. (Gov. Code, § 36512 (b)(2)(A) [if vacancy occurs in the first half of a term of office and at least 130 days prior to the next general municipal election, the person appointed to fill the vacancy shall hold office until the next general municipal election that is scheduled 130 or more days after the City Council is notified of the vacancy].) At the November 2022 election, the seat would then be subject to election for a two-year term. The person appointed to fill the vacant seat in the interim or any other person may seek election to the two-year seat.
Neither the Government Code nor the Hawaiian Gardens Municipal Code establish procedures for filling a vacancy on the City Council through appointment. Different cities handle it differently. For example, some cities follow the procedure in Government Code section 54974, which applies to vacancies on boards, commissions, and committees. This process involves posting a special vacancy notice in the City Clerk’s office and in the library with the largest service population within its jurisdiction within twenty days of the vacancy. (Gov. Code, § 54974(a).) The City Council then must wait at least ten working days from the posting before making a final appointment. (Gov. Code, § 54974(a).) By comparison, other cities permit Councilmembers to nominate candidates and/or allow prospective candidates to apply for the vacant seat by completing a City-provided application form. Some cities interview candidates and allow finalists to make a presentation at a City Council meeting.
Agenda Item #C3
February 22, 2022
Ultimately, the criteria by which the City Council chooses an appointee to fill a vacancy is at the Council’s discretion. Given the 60-day timeline and the lack of formalized procedures, if the Council were interested in the appointment option, we would advise the Council to direct staff as soon as possible with its intended process. Decisions with respect to whether (and if so when and how) to nominating and interviewing candidates before making a final determination must be conducted in open session. The Government Code forbids the Council from considering appointments to a vacant council seat in closed session. (Gov. Code, § 54957(b)(4).) Similarly, the California Attorney General has opined that the Council may not vote on an appointment to a council vacancy by way of secret ballot. (59 Ops. Cal. Atty. Gen. 619 (1976).)
Small City All Mail Election. Finally, Elections Code § 4004 explains that a city with a population of 100,000 or less (as is the City) can conduct an all-mail ballot election if the special election is to fill a vacancy on the City Council provided that the election is not held on the same date as a statewide primary or general election, and the election is not consolidated with any other election. This type of election is not limited to the established election dates but still cannot be called prior to 114 days after calling for the all-mail ballot election. The term would be for the remainder of the vacant seat – November 2024. The City would be responsible for all of the costs associated with the all-mail ballot election (designing and printing the ballot, postage and envelope costs, ballot counting, etc.) Given the staff time and costs involved, and given that this election process would barely conclude before the November election, in any event, staff does not recommend this process.
Conclusion. To fill Councilmember Maravilla’s vacant seat, the City Council can:
(i) appoint someone to fill the seat until the November 2022 election (which we be conducted alongside the November 2022 general municipal election); (ii) leave the seat vacant until the special election in November 2022; or (iii) call a special all-mail ballot election (the all-mail ballot election is not advisable due to the timing of the already scheduled November 2022 general municipal election and the costs that would be incurred by the City to conduct it).
FISCAL IMPACT
If the City Council fills the vacancy by appointment, minimal fiscal impacts are anticipated.
The special election in November 2022 is similarly expected to have some minor fiscal costs but these will be lessened due to the fact that a general municipal election is already scheduled for November 2022. The all-mail ballot election would have the most substantive costs as the City would be responsible for all of the costs of this not otherwise planned or scheduled election.
Agenda Item #C3
February 22, 2022
SUGGESTED ACTION
City Council discuss and direct staff regarding the filling of the vacant City Council seat resulting from Councilmember Maravilla’s resignation, which may either be filled by appointment or by calling a special election. The City Council consists of five (5) members who are elected at-large to a four (4) year term of office. The next regularly-established election date for the City for which an election could be called is November 8, 2022. Three (3) City Council seats with four-year terms were already up at that election; a fourth City Council seat with a two-year term to fill the vacancy left by Councilmember Maravilla will also be placed on that ballot.
