CITY OF HAWAIIAN GARDENS

CITY COUNCIL

STAFF REPORT
Agenda Item #B2
DATE: March 8, 2022
TO: Honorable Mayor and Members of the City Council
FROM: Ernesto Marquez, City Manager
BY: Megan Garibaldi, City Attorney
RECOMMENDATION:

RECOMMENDATION TO FIND THAT THERE EXISTS A PROCLAIMED STATE OF EMERGENCY AND EITHER: (I) THAT STATE OR LOCAL OFFICIALS HAVE IMPOSED OR RECOMMENDED MEASURES TO PROMOTE SOCIAL DISTANCING; AND

AUTHORIZE VIRTUAL AND HYBRID CITY COUNCIL MEETINGS AS WELL AS

VIRTUAL AND HYBRID MEETINGS FOR ALL OTHER CITY BOARDS, COMMISSIONS, COMMITTEES OR AGENCIES IN LIGHT OF AB 361

SUMMARY
On March 17, 2020, Governor Newsom issued Executive Order N-29-20, which allowed legislative bodies to conduct public meetings through teleconferencing without complying with certain provisions of the Ralph M. Brown Act. All provisions of Executive Order N-29-20 concerning the conduct of public meetings expired on September 30, 2021.

Assembly Bill 361 was signed into law by the governor on September 16, 2021, and went into effect immediately. AB 361 allows legislative bodies such as the Hawaiian Gardens City Council and other City bodies to meet virtually provided there is a state of emergency, and either (1) state or local officials have imposed or recommended measures to promote social distancing; or (2) the legislative body determines by majority vote that conducting full meetings in person would present imminent risks to the health and safety of attendees. The Governor by executive order signed on September 20, 2021, suspended the effective date of AB 361 to October 1, 2021. As a result, if the City Council desires to have virtual or hybrid City Council meetings on or after October 1, 2021, it must do so consistent with the requirements of AB 361. Though adopted in the context of the pandemic, Assembly Bill 361 allows for virtual or hybrid meetings during other proclaimed emergencies such as earthquakes or wildfires, where physical attendance may present a risk.

Agenda Item #B2
March 8, 2022

Page 2 ends

AB 361 requires the following:
 Public agencies, by majority vote within 30 days of the first virtual or hybrid meeting under AB 361 and every 30 days thereafter, find a state of emergency still exists and continues to directly impact the ability of the members to meet safely in person, or that officials continue to impose or recommend measures to promote social distancing.
 A public comment period where the public can address the legislative body directly.
 Public comments cannot be limited to only comments submitted in advance and specifies that the body “must provide an opportunity for the public to…offer comment in real time” per Government Code 54953(e)(2)(E).  The body must allow a reasonable time for public comment during the comment periods.
 The agenda must include information on the manner in which the public may access the meeting and on providing comments remotely.
 If technical problems arise that result in the public’s access being disrupted, the legislative body may not take any vote or other official action until the technical disruption is corrected and public access is restored.
 AB 361 provisions will sunset on January 1, 2024.

Under AB 361, the City may continue using virtual or hybrid meetings for the duration of the state-proclaimed state of emergency if the City Council finds that (1) state or local officials have imposed or recommended measures to promote social distancing or (2) if meeting in person would present imminent risks to the health and safety of attendees. The City Council is able to make those findings.

The Governor’s proclamation of a state of emergency is still active, and local officials continue to recommend social distancing measures. The Los Angeles County Department of Public Health (LACDPH) Health Officer Order, revised September 28, 2021, begins as follows:

SUMMARY OF THE ORDER: Since June 15, 2021 and after the retiring of the State’s Blueprint for a Safer Economy, community transmission of COVID-19 in Los Angeles County has rapidly increased from Low to High.

Based on continuously high daily new cases of COVID-19 to a level that indicates High community transmission of the COVID-19 virus, based on the federal Centers for Disease Control and Prevention (CDC) indicators, this Order continues to require masking by all, regardless of vaccination status, in an effort to slow the continuously high trends in and level of transmission of COVID-19 currently being seen in Los Angeles County.

Agenda Item #B2
March 8, 2022

Page 3 ends

In addition, the LACDPH “Reducing Risk Guidance (English)” revised on October 4, 2021, lists the following under the section titled “How to Reduce the Risk of COVID-19”:

Keep your distance. Use two arms lengths as your guide (about 6 feet) for social distancing with people outside your household when you are not sure that they are fully vaccinated.

Since the start of the COVID-19 pandemic, the City Council and other City meeting have had relatively low attendance from the public. Accordingly, the City Council believes it should generally be able to hold in-person meetings in City Council Chambers in a manner that allows the City officials, staff, and the public to attend in a socially distanced manner. At the same time, however, the City Council recognizes that members of the public, and from time-to-time, officials and City staff may need to or feel more comfortable attending meetings virtually, in light of the ongoing COVID-19 pandemic and the manner in which circumstances surrounding the pandemic, including the impact on individual and public health, may rapidly change. Accordingly, the City Council thus desires to allow for virtual and/or hybrid (i.e., in-person and virtual) meetings in order to both ensure the public health and safety of the public, City officials, and City staff, as well as continuity of government in allowing regularly-scheduled meetings to continue to occur without interruption.

Continued compliance with AB 361 will require the City Council to approve the action making the required findings every 30 days, via the consent agenda.

CIRCULATION ELEMENT OF GENERAL PLAN

SUMMARY
The Engineering Division as part of the Community Development Department is responsible for the implementation of the policies and objectives of the community as set forth in the City of Hawaiian Gardens’ General Plan, Municipal Code, and oversees the project management of the construction of the City’s capital improvements, infrastructure, and public facilities.

The term “Complete Streets” describes a comprehensive, integrated transportation network with infrastructure and design that allows safe and convenient travel along and across streets for all users, including pedestrians, users and operators of public transit, bicyclists, persons with disabilities, seniors, children, motorists, users of green modes, emergency vehicles, and movers of commercial goods.

The State of California has emphasized the importance of Complete Streets by enacting the California Complete Streets Act of 2008 (also known as AB 1358), which requires that when cities or counties make substantive revisions to the circulation elements of their general plans, they identify how they will provide for the mobility needs of all users of the roadways, as well as through Deputy Directive 64, in which the California Department of Transportation explained that it “views all transportation improvements as opportunities to improve safety, access, and mobility for all travelers in California and recognizes bicycle, pedestrian, and transit modes as integral elements of the transportation system.

EXHIBIT “A”
City of Hawaiian Gardens
Complete Streets Policy
The objective of this policy is to establish guiding principles and practices so that transportation improvements are planned, designed, constructed, operated and maintained to encourage walking, bicycling, and transit use while promoting safe operations for all users.

The City of Hawaiian Gardens will create a safe and efficient transportation system that promotes the health and mobility of all Hawaiian Gardens citizens and visitors by providing high quality pedestrian, bicycling, and transit access to all destinations throughout the city, and will design its streets for people, with beauty and amenities. The City of Hawaiian Gardens will provide for the needs of drivers, transit users, bicyclists, and pedestrians of all ages and abilities in all planning, design, construction, reconstruction, retrofit, operations, and maintenance activities and products.

The City of Hawaiian Gardens will enhance the safety, access, convenience, and comfort of all users of all ages and abilities. The City understands that children, seniors, and persons with disabilities will require special accommodations.

STREET NETWORK / CONNECTIVITY
(A) The City of Hawaiian Gardens will design, operate, and maintain a transportation network that provides a connected network of facilities accommodating all modes of travel. (B) The City will actively look for opportunities to repurpose rights-of-way to enhance connectivity for pedestrians, bicyclists, and transit.
(C) The City will focus non-motorized connectivity improvements to services, schools, parks, civic uses, regional connections and commercial uses. (D) The City will require new developments to provide interconnected street networks with small blocks.

JURISDICTION
(A) This Complete Streets Policy is intended to cover all development and redevelopment in the public domain and all street improvement assessment districts within Hawaiian Gardens but will also focus on regional connectivity.
(B) Every City Department including Administration, Public Works, Engineering, Community Development, Parks and Recreation, and Police, will follow the policy. (C) The City requires all developers and builders to obtain and comply with the City's standards.
(D) The City requires agencies that Hawaiian Gardens has permitting authority over, including, but no limited to, water agencies, electrical utilities, gas and petroleum utilities, communications utilities, and service contractors to comply with this policy. (E) The City will work closely with Los Angeles County, the Los Angeles County Metropolitan Transportation Authority, the Southern California Regional Rail Authority, and the Southern California Association of Governments to promote compliance. (F) The City encourages agencies not under Hawaiian Gardens' jurisdiction to satisfy this policy.

PHASES
The City of Hawaiian Gardens will apply this Complete Streets policy to all roadway projects, including those involving new construction, reconstruction, retrofits, repaving, rehabilitation, or changes in the allocation of pavement space on an existing roadway, as well as those that involve new privately built roads and easements intended for public use. Complete Streets may be achieved through single projects or incrementally through a series of smaller improvements or maintenance and operation activities over time.

EXCEPTIONS
Complete Streets principles and practices will be included in street construction, reconstruction, repaving, and rehabilitation projects, as well as other plans and manuals, except under one or more of the following conditions:
(A) A project involves only ordinary or emergency maintenance activities designed to keep assets in serviceable condition such as mowing, cleaning, sweeping, spot repair, concrete joint repair, or pothole filling, or when interim measures are implemented on temporary detour or haul routes.
(B) The City Council exempts a project due to excessive and disproportionate cost of establishing a bikeway, walkway or transit enhancement as part of a project. (C) The Director of Public Works, City Engineer and the Director of Community Development jointly determine the construction is not practically feasible or cost-effective because of significant or adverse environmental impacts to waterways, flood plains, remnants of native vegetation, wetlands, or other critical areas, or due to impacts on neighboring land uses, including impact from right of way acquisitions.
(D) Unless otherwise determined by the City Council, the Director of Public Works, City Engineer and the Director of Community Development jointly determine it is not practically feasible or cost-effective to implement the provisions of this policy through public or private project design or manuals or other plans.

Exceptions described above, will be documented.

DESIGN
Additionally, the Hawaiian Gardens City Council declares it is the City of Hawaiian Gardens' policy to:
(A) Adopt new Complete Streets Design Guidelines to guide the planning, funding, design, construction, operation, and maintenance of new and modified streets in Hawaiian Gardens while remaining flexible to the unique circumstances of different streets where sound engineering and planning judgment will produce context sensitive designs. (B) Incorporate the Complete Streets Design Guidelines' principles into all City plans, manuals, rules, regulations, and programs as appropriate. (C) Provide well-designed pedestrian accommodations on all streets and crossings.

Pedestrian accommodations can take numerous forms, including but not limited to traffic signals, roundabouts, bulb-outs, curb extensions, sidewalks, buffer zones, shared-use pathways, and perpendicular curb ramps, among others.
(D) Provide well-designed bicycle accommodations along all streets. Bicycle accommodations can take numerous forms, including but not limited to the use of bicycle boulevards, striping, slow streets, low auto volume streets, traffic calming, signs, and pavement markings, among others.
(E) Where physical conditions warrant, landscaping shall be planted whenever a street is newly constructed, reconstructed, or relocated.

CONTEXT SENSITIVITY
(A) The City of Hawaiian Gardens will plan its streets in harmony with the adjacent land uses and neighborhoods.
(B) The City will solicit input from local stakeholders during the planning process. (C) The City will integrate natural features, such as waterways, and other topography into design of streets.
(D) The City will design streets with a strong sense of place. Architecture, landscaping, streetscaping, public art, signage, etc. will be used to reflect the community and neighborhood. (E) The City will coordinate street improvements with merchants along retail and commercial corridors to develop vibrant and livable districts. (F) The City will practice sustainable storm water management strategies.

PERFORMANCE MEASURES
The City will evaluate this Complete Streets Policy using the following performance measures:

1. Total miles of on-street bikeways defined by streets with clearly marked or signed bicycle accommodation

2. Total miles of streets with pedestrian accommodation

3. Number of missing or non-compliant curb ramps along City streets

4. Number of new street trees planted along City streets

5. Percentage of new street projects that are multi-modal

6. Number and severity of pedestrian-vehicle and bicycle-vehicle crashes

STAFF REPORT
Agenda Item #C2
DATE: March 8, 2022
TO: Honorable Mayor and Members of the City Council
FROM: Ernesto Marquez, City Manager
BY: Megan Garibaldi, City Attorney
RECOMMENDATION:

RECOMMENDATION TO REVIEW THE APPLICATIONS SUBMITTED FOR THE

VACANT CITY COUNCIL SEAT, HEAR PRESENTATIONS FROM THE APPLICANTS, AND EITHER: (I) ADOPT RESOLUTION NO. 014-2022 TO APPOINT AN INDIVIDUAL TO THE CITY COUNCIL SEAT RESULTING FROM COUNCILMEMBER MARAVILLA’S RESIGNATION; OR (II) DIRECT STAFF AS TO AN ALTERNATIVE REVIEW PROCESS BY WHICH THE CITY COUNCIL WOULD PROCEED FOR AN APPOINTMENT.

SUMMARY
The City Council consists of five (5) members who are elected at-large to a four (4) year term of office. The next regularly-established election date for the City for which an election could be called is November 8, 2022. Three (3) City Council seats with fouryear terms were already up at that election; a fourth City Council seat with a two-year term to fill the vacancy left by Councilmember Maravilla will also be placed on that ballot.

On February 8, 2022, Councilmember Maravilla announced her resignation from the City Council. The resignation became effective immediately, thus as of February 9, 2022 Councilmember Maravilla’s Council seat was vacant. This vacancy occurred in the first half of Councilmember Maravilla’s term.

State law provides that to fill the vacant seat, the City Council must, within 60 days from the commencement of the vacancy, either fill the vacancy by appointment or by calling a special election. (Gov. Code, § 36512 (b).) Because the effective date of Councilmember Maravilla’s resignation was February 9, 2022, the City Council must therefore either call a special election or appoint someone to fill the vacancy by April 9, Agenda Item #C2
March 8, 2022

Page 2 ends

2022. At the February 22, 2022 City Council meeting, the City Council directed staff to proceed with the “appointment” option to fill the vacant City Council seat.

The appointment method to fill a vacant City Council seat allows the City Council to appoint a person to serve until the next general municipal election—i.e., November 8, 2022. (Gov. Code, § 36512 (b)(2)(A) [if vacancy occurs in the first half of a term of office and at least 130 days prior to the next general municipal election, the person appointed to fill the vacancy shall hold office until the next general municipal election that is scheduled 130 or more days after the City Council is notified of the vacancy].) Thus, at the November 2022 election, this seat would then be up for election for a two-year term (i.e., the remainder of former Councilmember Maravilla’s term). The person appointed to fill the vacant seat in the interim or any other person may seek election to the two-year seat.

City staff posted the notice of vacancy and solicited applications for the vacant seat. As of the March 2, 2022 deadline to submit applications, the City has received three (3) applications. Those applications are attached. Further, these three applicants were notified and encouraged to participate in tonight’s meeting via a three (3) minute presentation during the Public Comments period to make their statement.

The criteria by which the City Council chooses an appointee to fill a vacancy is at the Council’s discretion. However, the deliberation, consideration and voting on an appointment to a vacant City Council seat must be done in an open session. (See Gov.

Code, § 54957(b)(4) & 59 Ops. Cal. Atty. Gen. 619 (1976).) The appointment can only be made by majority vote of the City Council.

CONCLUSION To fill former Councilmember Maravilla’s vacant seat, the City Council can:
(i) appoint someone this evening to the vacant seat left until the swearing in of the candidate elected to the two year-term that will complete the remainder of Councilmember Maravilla’s term, as elected at the November 2022 election (which will be conducted alongside the November 2022 general municipal election), by adoption of the attached resolution; or
(ii) provide City staff direction on any further review processes for filling the vacant seat.

FISCAL IMPACT
If the City Council fills the vacancy by appointment, minimal fiscal impacts are anticipated.

The special election in November 2022 is similarly expected to have some minor fiscal costs but these will be lessened due to the fact that a general municipal election is already scheduled for November 2022.

SUGGESTED ACTION
Staff recommends that the City Council appoint one of the three applicants to the vacant City Council seat resulting from Councilmember Maravilla’s resignation via Resolution No. 014-2022. If the Council appoints someone to fill this seat, this person would serve until November 2022 (which is when the next general municipal elections will be held).

3 I am a lifelong resident and my family has been here since the city incorporated. My grandmother Mary Carbajal worked for the parks and recs department. She raised me to love this city. I see tremendous potential in our city. It shocks me to know our median household income is equal to South LA. We are adjacent to several wealthy communities and have not capitalized on our geographic position. I am currently studying real estate development and urban planning at USC. I chose this field because it would allow me to pursue a goal I have of positively transforming the community using the built environment. I believe I can bring in outside businesses to our community. I'd like to bring growth to our city and offer a different perspective for our community. I would like to address the growing number of transients in our community. Where I live they are beginning to congregate alongside 226th and no one seems to care. I would also like use my education in urban planning to work on our updates to the housing plan and bring best practices from across the southland into our city so we can capitalize on this moment in time. Southern California needs housing desperatly. The communities that embrace growth and figure out how to bring in new housing will be the communities that benefit long term from the progress.

3 I have always felt great pride being part of the Hawaiian Gardens community, like most residents that take pride in their little city by always helping one another no matter their own circumstances. I also strive to give back to the community that gave me a strong foundation for my early success in life. I am grateful for being a member of a community that takes cares of its own. My interest to be a member of the City Council started when I was hired in 2017 as Recreation Leader for the City of Hawaiian Gardens. As a city worker I played a role in many great ideas and projects that demonstrated the community spirit of going above and beyond expectations from the City Staff and Council by giving in abundance. City Council's influence in the community to better serve the residents has always been demonstrated in its efforts. I would like to continue that tradition and also bring new ideas and perspectives from a participant, resident and city worker. I understand the situation we are in as a City, coming out of COVID and threats to our revenue this November, along with a rise in crime, homelessness and fast rising inflation. These challenging situations the Council finds itself in, is an opportunity to renew itself with the same foundational principles in which it has succeed for decades. That is helping one another, caring for your neighbor and giving in abundance. The challenge we have is doing more when we do not have the same resources and tools available. My interest is to help us learn to adapt and bring ideas from new places to move forward together as a community
