GARDENS MUNICIPAL CODE REGARDING ADUS AND JADUS AND DETERMINING
THE PROJECT IS EXEMPT UNDER THE CALIFORNIA ENVIRONMENTAL QUALITY ACT(CEQA) PURSUANT TO SECTION 21080.17 OF THE CALIFORNIA PUBLIC
RESOURCES CODE
SUMMARY
BACKGROUND
In 2019, the California Legislature approved, and the Governor signed into law a number of bills (“2019 ADU Laws”) that, among other things, amended Government Code section 65852.2 and 65852.22 to impose new limits on local authority to regulate ADUs and Junior ADUs (JADUs).
In September of 2020, the California Legislature approved, and the Governor signed into law, Assembly Bill 3182 (AB 3182). AB 3182, among other things, amended Government Code section 65852.2 to: (1) expand the scenarios under which the City must allow certain ADUs and JADUs with only a building permit; and (2) clarify the timeline under which the City must act on a complete ADU application. Failure to comply with Government Code section 65852.2 (as amended) renders the City’s ordinance regulating ADUs and JADUs null and void, thereby limiting the City to the application of the few Agenda Item #A1
September 13, 2022
default standards provided in Government Code sections 65852.2 and 65852.22 for the approval of ADUs and JADUs.
Approval of ADUs and JADUs based solely on the default statutory standards, without local regulations governing height, setback, landscape, architectural review, among other things, would threaten the character of existing neighborhoods, and negatively impact property values, personal privacy, and safety in the City. To avoid such a scenario, the proposed ordinance amends the City’s local regulatory scheme for the construction of ADUs and JADUs to comply with AB 3182 and provide, to some degree, local requirements geared toward mitigations these negative impacts.
DISCUSSION/ANALYSIS
The proposed ordinance’s amendments include, but are not limited to, the following amendment to Hawaiian Gardens Municipal Code Section 18.90.080:
• Clarifying that a property owner may construct one ADU and one JADU with only a building permit when the units are on a lot with a proposed or existing single-family dwelling and located within the space of a single-family dwelling or within the space of an existing accessory structure subject to certain development standards. • Clarifying changes to building permit only ADUs on multi-family lots, • Creating a permit process for those ADUs and JADUs (subject to various development standards) that are not subject to the ministerial building permit only process noted above.
• Clarifying that if a complete ADU or JADU application is not acted upon within 60 days, the application is deemed approved.
• Adding an income reporting section to the ordinance. This would allow the City to potentially take credit for affordable ADUs that are created if the rent meets affordable limits. This would require the applicant to estimate what would be the proposed rent for the ADU or JADU.
• Requiring ADU permit ADUs to have a roof slope that matches the dominant slope of the primary dwelling (to provide increased design compatibility) and to match appearance and architectural design of those of the primary dwelling.
The above mentioned State laws severely limit what additional restrictions the City can impose on ADUs and JADUs. The attached ordinance was drafted with this in mind so that it provides the maximum amount of local regulation to mitigate any negative impacts of these ADUs and JADUs without running afoul of the State statutory scheme. This area is so important to the State, that the City must submit its ordinance regulating ADUs and JADUs to the California Department of Housing and Community Development for review and comment. Expanding or increasing any of the development standards and restrictions in the attached ordinance may not be permitted under State law.
Agenda Item #A1
September 13, 2022
ENVIRONMENTAL ANALYSIS
Under California Public Resources Code section 21080.17, the California Environmental Quality Act (“CEQA”) does not apply to the adoption of an ordinance by a city or county implementing the provisions of section 65852.2 of the Government Code, which is California’s ADU law and which also regulates JADUs, as defined by section 65852.22.
Therefore, the proposed ordinance is statutorily exempt from CEQA in that the proposed ordinance implements the State’s ADU law.
GENERAL PLAN CONSISTENCY
The proposed text amendment has been evaluated for consistency with the City’s General Plan and is consistent with the following:
• Preserve and enhance the community’s quality of life by fostering safe and appealing neighborhoods
• Provide a variety of housing options
• Promote safe, walkable neighborhoods
• Ensure compatibility between residential and nonresidential land uses to create harmonious living environments
FISCAL IMPACT
None.
SUGGESTED ACTION
Approve Recommendation.

The ADU-permit processing fee is determined by the Community Development Director and approved by the City Council by resolution.
3. Process and Timing.
(a) An ADU permit is considered and approved ministerially, without discretionary review or a hearing. (b) The City must act on an application to create an ADU or JADU within 60 days from the date that the City receives a completed application. If the City does not act upon the completed application within 60 days, the application is deemed approved unless either:
(i) The applicant requests a delay, in which case the 60-day time period is tolled for the period of the requested delay, or
(ii) When an application to create an ADU or JADU is submitted with a permit application to create a new single-family dwelling on the lot, the City may delay acting on the permit application for the ADU or JADU until the City acts on the permit application to create the new single-family dwelling, but the application to create the ADU or JADU will still be considered ministerially without discretionary review or a hearing.

1. Zoning.
(a) An ADU or JADU subject only to a building permit under subsection (C)(1) above may be created on a lot in a residential or mixed-use zone.
(b) An ADU or JADU subject to an ADU permit under subsection (C)(2) above may be created on a lot that is zoned to allow single-family dwelling residential use or multifamily dwelling residential use.
2. Fire Sprinklers. Fire sprinklers are required in an ADU if sprinklers are required in the primary residence.
3. Rental Term. No ADU or JADU may be rented for a term that is shorter than 30 days. This prohibition applies regardless of when the ADU or JADU was created.
4. No Separate Conveyance. An ADU or JADU may be rented, but, except as otherwise provided in Government Code Section 65852.26, no ADU or JADU may be sold or otherwise conveyed separately from the lot and the primary dwelling (in the case of a single-family lot) or from the lot and all of the dwellings (in the case of a multifamily lot).
5. Owner Occupancy.
(a) All ADUs permitted before January 1, 2020 are subject to the owner-occupancy requirement that was in place when the ADU was created.
(b) An ADU that is permitted after that date but before January 1, 2025, is not subject to any owneroccupancy requirement. (c) All ADUs that are permitted on or after January 1, 2025 are subject to an owner-occupancy requirement. A natural person with legal or equitable title to the property must reside on the property as the person’s legal domicile and permanent residence. (d) All JADUs are subject to an owner-occupancy requirement. A natural person with legal or equitable title to the property must reside on the property, in either the primary dwelling or JADU, as the person’s legal domicile and permanent residence. However, the owner-occupancy requirement in this subsection does not apply if the property is entirely owned by another governmental agency, land trust, or housing organization
6.Deed Restriction. Prior to the issuance of a building permit for an ADU or JADU, a deed restriction must be recorded against the title of the property in the County Recorder’s office and a copy filed with the Community Development Department to the City’s satisfaction. The deed restriction must run with the land and bind all future owners. The form of the deed restriction will be provided by the City and must provide that, among other things:
(a) Except as otherwise provided in Government Code Section 65852.26, the ADU or JADU may not be sold separately from the primary dwelling.
(b) The ADU or JADU is restricted to the approved size and to other attributes allowed by this section. (c) The ADU or JADU cannot be rented out for a term less than 30 days. (d) The deed restriction runs with the land and may be enforced against future property owners. (d) The deed restriction may be removed if the owner eliminates the ADU or JADU, as evidenced by, for example, removal of the kitchen facilities. To remove the deed restriction, an owner may make a written request of the Community Development Director, providing evidence that the ADU or JADU has in fact been eliminated. The Community Development Director may then determine whether the evidence supports the claim that the ADU or JADU has been eliminated. Appeal(s) may be taken from the Director’s determination consistent with other provisions of this Code. If the ADU or JADU is not entirely physically removed, but is only eliminated by virtue of having a necessary component of an ADU or JADU removed, the remaining structure and improvements must otherwise comply with applicable provisions of this Code.
(e) The deed restriction is enforceable by the Community Development Director or his or her designee for the benefit of the City. Failure of the property owner to comply with the deed restriction may result in legal action against the property owner, and the City is authorized to obtain any remedy available to it at law or equity, including, but not limited to, obtaining an injunction enjoining the use of the ADU or JADU in violation of the recorded restriction(s) or abatement of the illegal unit.
7. Income Reporting. In order to facilitate the city’s obligation to identify adequate sites for housing in accordance with Government Code sections 65583.1 and 65852.2, the following requirements must be satisfied:
(a) With the building-permit application, the applicant must provide the city with an estimate of the projected annualized rent that will be charged for the ADU or JADU. (b) Within 90 days after each yearly anniversary of the issuance of the building permit, the owner must report the actual rent charged for the ADU or JADU during the prior year. If the city does not receive the report within the 90-day period, the owner is in violation of this Code, and the city may send the owner a notice of violation and allow the owner another 30 days to submit the report. If the owner fails to
submit the report within the 30-day period, the city may enforce this provision in accordance with applicable law.
8. Notice of Construction.
(a) At least ten business days before starting any construction of an ADU or JADU, the property owner must give written notice to all the owners of record of each of the adjacent residential parcels, which notice must include the following information:
(i) Notice that construction has been authorized,
(ii) The anticipated start and end dates for construction, (iii) The hours of construction,
(iv) Contact information for the project manager (for construction-related complaints), and (v) Contact information for the Building & Safety Department. (b) This notice requirement does not confer a right on the noticed persons or on anyone else to comment on the project before permits are issued. Approval is ministerial. Under state law, the City has no discretion in approving or denying a particular ADU project under this section. This notice requirement is purely to promote neighborhood awareness and expectation.
9. Building and Safety. All ADUs and JADUs must comply with all local building code requirements.
E. Specific ADU Requirements. The following requirements apply only to ADUs that require an ADU permit under subsection (C)(2) above.
1. Maximum Size.
(a) The maximum size of a detached or attached ADU subject to this subsection (E) is 850 square feet for a studio or one-bedroom unit and 1,000 square feet for a unit with two or more bedrooms. (b) An attached ADU that is created on a lot with an existing primary dwelling is further limited to 50 percent of the floor area of the existing primary dwelling (c) Application of other development standards in this subsection (E), such as FAR or lot coverage, might further limit the size of the ADU, but no application of the percent-based size limit in subsection (f)(1)(B) above or of an FAR or lot coverage limit or open-space requirement may require the ADU to be less than 800 square feet
2. Floor Area Ratio. No ADU subject to this subsection (E) may cause the total FAR of the lot to exceed 45 percent, subject to subsection (E)(1)(c) above.
3. Setbacks
(a) An ADU that is subject to this subsection must conform to a 20 foot front-yard setback. (b) An ADU that is subject to this subsection (E) must conform to 4 foot side- and rear-yard setbacks. (c) No setback is required for an ADU that is subject to this subsection (E) if the ADU is constructed in the same location and to the same dimensions as an existing structure. (d) If new construction is an addition to an existing structure, only the addition must comply with the 4 foot side or rear setback.
4. Lot Coverage. No ADU subject to this subsection (E) may cause the total lot coverage of the lot to exceed 50 percent, subject to subsection (E)(1)(c) above.
5. Minimum Open Space. No ADU subject to this subsection (f) may cause the total percentage of open space of the lot to fall below 50 percent, subject to subsection (E)(1)(c) above.
6. Height. No ADU subject to this subsection (E) may exceed 16 feet in height above grade, measured to the peak of the structure.
7. Passageway. No passageway, as defined above is required for an ADU.
8. Parking.
(a) Generally. One off-street parking space is required for each ADU. The parking space may be provided in setback areas or as tandem parking, as defined above. (b) Exceptions. No parking under subsection (E)(8)(a) is required in the following situations:
(i) The ADU is located within one-half mile walking distance of public transit, as defined above. (ii) The ADU is located within an architecturally and historically significant historic district. (iii) The ADU is part of the proposed or existing primary residence or an accessory structure under subsection (C)(1)(a) above.
(iv) When on-street parking permits are required but not offered to the occupant of the ADU. (v) When there is an established car share vehicle stop located within one block of the ADU. (c) No Replacement. When a garage, carport, or covered parking structure is demolished in conjunction with the construction of an ADU or converted to an ADU, those off-street parking spaces are not required to be replaced.
9. Architectural Requirements
(a) The materials and colors of the exterior walls, roof, and windows and doors must match the appearance and architectural design of those of the primary dwelling. (b) The roof slope must match that of the dominant roof slope of the primary dwelling. The dominant roof slope is the slope shared by the largest portion of the roof. (c) The exterior lighting must be limited to down-lights or as otherwise required by the building or fire code.
(d) The ADU must have an independent exterior entrance, apart from that of the primary dwelling. (e) The interior horizontal dimensions of an ADU must be at least 10 feet wide in every direction, with a minimum interior wall height of seven feet.
(f) Windows and doors of the ADU may not have a direct line of sight to an adjoining residential property.
Fencing, landscaping, or privacy glass may be used to provide screening and prevent a direct line of sight. (g) All windows and doors in an ADU that are less than 30 feet from a property line that is not a public right-of-way line must either be (for windows) the bottom of the glass at least six feet above the finished floor, or (for windows and for doors) utilize frosted or obscure glass.
10. Historical Protections. An ADU that is within 600 feet of real property that is listed in the California Register of Historic Resources must do both of the following:
(a) Comply with the Secretary of the Interior’s objective Standards for Preservation, Rehabilitation, Restoration, or Reconstruction for the Treatment of Historic Properties, as applicable. (b) Be located so as to not be visible from any public right-of-way.
F. Fees. The following requirements apply to all ADUs that are approved under subsections (C)(1) or (C)(2) above.
1. Impact Fees
(a) No impact fee is required for an ADU that is less than 750 square feet in size. For purposes of this subsection (F)(1), “impact fee” means a “fee” under the Mitigation Fee Act (Gov. Code § 66000(b)) and a
fee under the Quimby Act (Gov. Code § 66477). “Impact fee” here does not include any connection fee or capacity charge for water or sewer service.
(b) Any impact fee that is required for an ADU that is 750 square feet or larger in size must be charged proportionately in relation to the square footage of the primary dwelling unit. (E.g., the floor area of the ADU, divided by the floor area of the primary dwelling, times the typical fee amount charged for a new dwelling.)
2. Utility Fees
(a) If an ADU is constructed with a new single-family home, a separate utility connection directly between the ADU and the utility and payment of the normal connection fee and capacity charge for a new dwelling are required.
(b) Except as described in subsection (F)(2)(a), converted ADUs on a single-family lot that are created under subsection (C)(1)(a) above are not required to have a new or separate utility connection directly between the ADU and the utility. Nor is a connection fee or capacity charge required. (c) Except as described in subsection (F)(2)(a), all ADUs that are not covered by subsection (F)(2)(b) require a new, separate utility connection directly between the ADU and the utility. (i) The connection is subject to a connection fee or capacity charge that is proportionate to the burden created by the ADU based on either the floor area or the number of drainage-fixture units (DFU) values, as defined by the Uniform Plumbing Code, upon the water or sewer system. (ii) The portion of the fee or charge that is charged by the City may not exceed the reasonable cost of providing this service.
G. Nonconforming ADUs and Discretionary Approval. Any proposed ADU or JADU that does not conform to the objective standards set forth in subsections (A) through (G) of this section may be allowed by the City with a conditional use permit, in accordance with the other provisions of this title.
CITY OF HAWAIIAN GARDENS
CITY COUNCIL
STAFF REPORT
Agenda Item #B2
DATE: September 13, 2022
TO: Honorable Mayor and Members of the City Council
FROM: Ernesto Marquez, City Manager
BY: Megan Garibaldi, City Attorney
RECOMMENDATION:
RECOMMENDATION TO CONTINUE TO AUTHORIZE VIRTUAL AND HYBRID CITY
COUNCIL MEETINGS AS WELL AS VIRTUAL AND HYBRID MEETINGS FOR ALL
OTHER CITY BOARDS, COMMISSIONS, COMMITTEES, OR AGENCIES PURSUANT TO AB 361
SUMMARY
On March 17, 2020, Governor Newsom issued Executive Order N-29-20, which allowed legislative bodies to conduct public meetings through teleconferencing without complying with certain provisions of the Ralph M. Brown Act. All provisions of Executive Order N29-20 concerning the conduct of public meetings expired on September 30, 2021.
Assembly Bill 361 was signed into law by the governor on September 16, 2021, and went into effect immediately. AB 361 allows legislative bodies such as the Hawaiian Gardens City Council and other City bodies to meet virtually provided there is a state of emergency, and either (1) state or local officials have imposed or recommended measures to promote social distancing; or (2) the legislative body determines by majority vote that conducting full meetings in person would present imminent risks to the health and safety of attendees. The Governor by executive order signed on September 20, 2021, suspended the effective date of AB 361 to October 1, 2021. As a result, if the City Council desires to have virtual or hybrid City Council meetings on or after October 1, 2021, it must do so consistent with the requirements of AB 361. Though adopted in the context of the pandemic, Assembly Bill 361 allows for virtual or hybrid meetings during other proclaimed emergencies such as earthquakes or wildfires, where physical attendance may present a risk.
Agenda Item #B2
September 13, 2022
AB 361 requires the following:
• Public agencies, by majority vote within 30 days of the first virtual or hybrid meeting under AB 361 and every 30 days thereafter, find a state of emergency still exists and continues to directly impact the ability of the members to meet safely in person, or that officials continue to impose or recommend measures to promote social distancing.
• A public comment period where the public can address the legislative body directly. • Public comments cannot be limited to only comments submitted in advance and specifies that the body “must provide an opportunity for the public to offer comment in real time” per Government Code 54953(e)(2)(E).
• The body must allow a reasonable time for public comment during the comment periods.
• The agenda must include information on the manner in which the public may access the meeting and on providing comments remotely.
• If technical problems arise that result in the public’s access being disrupted, the legislative body may not take any vote or other official action until the technical disruption is corrected and public access is restored.
• AB 361 provisions will sunset on January 1, 2024.
Under AB 361, the City may continue using virtual or hybrid meetings for the duration of the state-proclaimed state of emergency if the City Council finds that (1) state or local officials have imposed or recommended measures to promote social distancing or (2) if meeting in person would present imminent risks to the health and safety of attendees.
The City Council is able to make those findings.
While the State continues to wind down certain pandemic restrictions, and County Health Orders no longer require masking in many indoor settings, LA County remains in the High COVID-19 Community Level.
The Los Angeles County Department of Public Health (LACDPH) Health Officer Order, revised April 21, 2022, states in pertinent part as follows:
Masking will continue to be strongly recommended, but no longer be required, in most indoor settings and in K-12 Schools or childcare facilities. Masking will continue to be required for all persons, regardless of vaccination status, in higher transmission risk settings within the County, like on public transit and in transportation hubs, all health care settings, correctional facilities and detention centers, emergency shelters, cooling and heating centers, homeless shelters, and long-term care settings and adult and senior care centers.
In addition, the LACDPH “Reducing Risk Guidance (English)” revised on July 8, 2022, lists the following under the section titled “How to Reduce the Risks of COVID-19”:
Improve air flow. Avoid indoor spaces with poor air flow as much as possible.
Agenda Item #B2
September 13, 2022
Choose outdoor spaces for social and fitness activities when possible.
Keep your distance. Use two arms lengths as your guide (about 6 feet) for social distancing with people you don’t live with.
LACDPH also issued a statement on July 15, 2022, noting:
If LA County remains in the High COVID-19 Community Level for two consecutive weeks, universal indoor masking will be implemented on July 29 to help slow the rate of transmission & protect those most vulnerable.
While the LACDPH ultimately did not implement indoor masking, LACDPH still strongly advises masks in indoor settings.
Despite the easing of certain State and local restrictions, and in light of the consideration to re-implement of some of these restrictions, community spread continues to threaten individuals’ ability to attend public meetings, in particular individuals who are immunocompromised, infected, and/or socially distancing. Therefore, continuing to offer attendees the opportunity to virtually attend City Council meetings under AB 361 furthers the purpose of AB 361 to provide equal access to meetings of local government.
Continued compliance with AB 361 will require the board approve the action making the required findings every 30 days, via the consent agenda.

RECOMMENDATION:
RECOMMENDATION TO RECEIVE AND FILE THE CITY WIDE FACILITY CLEAN-UP
PLAN FROM PUBLIC WORKS DEPARTMENT
SUMMARY
The Public Works Department maintains both the 221st Street and main Public Works yards, the storage facility, and maintenance storage rooms at the various city sites. Items are securely stored and maintained at each facility. Items include tools, equipment, facets, irrigation supplies, signs, cleaning materials, paints, etc.
Aware of fiscal responsibility and budget constraints, any items not in use or in excess are stored, re-purposed, and reused whenever possible. Throughout the years, stored materials have compiled, deteriorated, been updated, or met their useful life.
Currently, with limited space and storage capacity, we will implement the following citywide plan to clean-up and organize Public Works facilities:
1. Gather and stage required supplies for the clean-up
2. Sort, separate, and complete an inventory
3. Prepare a surplus disposal list
4. Update site specific supply lists
5. Organize, label, and sort remaining equipment and materials for efficiency.
This plan will take a full team effort and take place on a Saturday as to not impact standard Public Works operations.
Additionally, there will be similar facility clean-up plans scheduled throughout city facilities in the coming weeks as the new departmental Directors are fully familiarized with their respective departments.

RECOMMENDATION:
RECOMMENDATION TO INTRODUCE FOR FIRST READING, PROCEED BY TITLE ONLY, AND WAIVE READING IN FULL OF ORDINANCE NO. 2022-604, AMENDING
VARIOUS PROVISIONS OF THE HAWAIIAN GARDENS MUNICIPAL CODE
REGARDING OVERSIZED VEHICLE PARKING AND FINDING THE ORDINANCE
NOT SUBJECT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT FOR THE FOLLOWING REASONS:
A. THE ORDINANCE DOES NOT QUALIFY AS A “PROJECT” UNDER CEQA AND
BECAUSE THE ORDINANCE WILL NOT RESULT IN A DIRECT OR REASONABLY FORESEEABLE INDIRECT PHYSICAL CHANGE IN THE ENVIRONMENT. (STATE CEQA GUIDELINES SECTION 15060, SUBD. (C)(2), (3).)
B. THE ORDINANCE FALLS WITHIN THE “COMMON SENSE” EXEMPTION SET FORTH IN STATE CEQA GUIDELINES SECTION 15061, SUBDIVISION (B)(3), WHICH EXEMPTS ACTIVITY FROM CEQA WHERE “IT CAN BE SEEN WITH
CERTAINTY THAT THERE IS NO POSSIBILITY THAT THE ACTIVITY IN QUESTION MAY HAVE A SIGNIFICANT EFFECT ON THE ENVIRONMENT; AND
2. SET A PUBLIC HEARING FOR ADOPTION OF THE ORDINANCE ON SEPTEMBER 27, 2022 AND DIRECT STAFF TO PROVIDE NOTICE THEREOF AS REQUIRED BY LAW.
SUMMARY
BACKGROUND:
The City has received numerous complaints regarding oversized vehicles parking on City streets. Currently, the City’s regulations governing oversized vehicle parking are scattered across various provisions of the Hawaiian Gardens Municipal Code (“HGMC”).
Agenda Item #C1
September 13, 2022
(See e.g., HGMC, §§ 10.20.030, 10.36.020, 10.36.030). The attached Ordinance (Attachment 1) updates and streamlines the City’s oversized vehicle parking regulations as described in the following section.
ANALYSIS:
Oversized vehicle parking—especially in residential neighborhoods—continues to be an issue in the City. Continuous oversized vehicle parking contributes to numerous adverse consequences that impact the health, safety, and welfare of the City’s residents and visitors. These consequences include, but are not limited to:
• Obstructions and Visibility. Oversized vehicle parking raises unique public safety concerns, including the obstruction of access to rights-of-way, reduced sight distance, and reduced visibility at intersections; and
• Damage to City Streets. Oversized vehicles are typically heavier vehicles or trailers and thus have the potential to cause excessive wear and tear on streets; and • Accessibility. Some oversized vehicles accumulate and discharge trash and debris in and around areas where vehicles are parked. The accumulation and storage of trash, debris and other personal items in an around areas where oversized vehicles are parked has caused accessibility to hazards by obstructing and/or blocking sidewalks and preventing safe passage;
• Reduced Parking. Due to their size, oversized vehicles reduce the number of available on-street parking spaces by utilizing limited space that could accommodate a number of smaller vehicles. Parking scarcity negatively impacts the City’s residents and visitors by, among other things, making the City a less attractive destination and adding trip time for drivers who are searching for parking.
The proposed Ordinance amends the HGMC by collapsing the City’s oversized vehicle parking regulations into Chapter 10.36, which will be renamed “Oversized Vehicle Parking Regulations.” Subject to limited exceptions, the new Chapter 10.36 will prohibit oversized vehicles from parking on City streets. Covered vehicles include those weighing more than 6,000 pounds, exceeding 22 feet in length or 7 feet in height, as well as camping trailers, campers, fifth wheel travel trailers, house cars, mobile homes, semi-trailers, trailer coaches, and recreational vehicles.
Certain oversized vehicles are exempt from the parking prohibition, including: (1) vehicles parked in connection with the performance of a service at a nearby property; (2) oversized vehicles belonging to a federal, state, or local authority or public utility conducting official business; and (3) vehicles belonging to residents or guests of residents that are parked in accordance with a City-issued parking permit.
Features of the oversized vehicle permit parking framework include the following:
• Obtaining a permit will allow individuals to park their oversized vehicle on public residential streets for up to 72 consecutive hours for loading and unloading purposes.
Agenda Item #C1
September 13, 2022
• After an oversized vehicle has been parked for 72 consecutive hours, the vehicle must vacate the public right-of-way and may not park on any public street for at least 72 consecutive hours.
• Oversized vehicles must park within 1/10th of a mile from the permit’s registered residential address.
• Permits will be issued to City residents only. However, residents can obtain permits on behalf of out of town guests.
• Residents can obtain up to 12 oversized vehicle parking permits each calendar year (inclusive of permits for guests and the resident’s vehicle(s)).
In addition to the above, the Ordinance prohibits electrical, water, gas, telephone or utility connections between a property and an oversized vehicle from encroaching into the public right-of-way (including across or above a street or sidewalk). The Ordinance also includes other minor amendments to the HGMC to remove overlapping standards and ensure consistency across the HGMC with regard to oversized vehicle parking.
IMPLEMENTATION
The Ordinance provides City staff and enforcement personnel with numerous enforcement options, including citing violators for an infraction and issuing a civil penalty (i.e., parking ticket). In order to issue parking tickets, the California Vehicle Code requires the City to adopt a schedule of civil penalties for parking violations. Staff will bring a proposed schedule of civil penalties for parking violations to the City Council for consideration at the September 27, 2022 meeting.
Before the Ordinance can be enforced, the Vehicle Code requires the City to place adequate signage or markings to notify motorists of the Oversized Vehicle parking regulations. The Ordinance includes a directive to staff to comply with this requirement.
The Ordinance also directs enforcement personnel to issue warnings (in lieu of citations) for the first 30 calendar days after the signage or markings have been placed. Staff is recommending this initial 30 day warning period to provide additional notice to the public and allow time for compliance before citations will be issued.
ENVIRONMENTAL:
This Ordinance is exempt from the California Environmental Quality Act ("CEQA") because the Ordinance does not qualify as a “project” under CEQA and because the Ordinance will not result in a direct or reasonably foreseeable indirect physical change in the environment. (State CEQA Guidelines section 15060, subd. (c)(2), (3).) Section 15378 of the State CEQA Guidelines defines a project as the whole of an action, which could potentially result in either a direct physical change, or reasonably foreseeable indirect physical change, in the environment. Here, the Ordinance will not result in any construction or development, and it will not have any other effect that would physically change the environment. The Ordinance therefore does not qualify as a project subject to CEQA.
Agenda Item #C1
September 13, 2022
In the alternative, even if the Ordinance did qualify as a “project” under CEQA, the Ordinance is exempt from CEQA under State CEQA Guidelines section 15061(b)(3), which exempts projects from CEQA “[w]here it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment.” Thus, even if the Ordinance could result in some physical change in the environment, the Ordinance is exempt from CEQA because it can be seen with certainty that there is no possibility that the Ordinance may have a significant effect on the environment.
FISCAL IMPACT
Funds to implement this Ordinance are available in the current adopted budget. Minimal funds will be needed to implement the permit program and install signage. Also pending are the penalty fees for violations of this Ordinance. These fees will be adopted by City Council at a future City Council meeting.
SUGGESTED ACTION
Approve Recommendation.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
HAWAIIAN GARDENS, CALIFORNIA, AMENDING
VARIOUS PROVISIONS OF THE HAWAIIAN GARDENS
MUNICIPAL CODE REGARDING OVERSIZED VEHICLE
PARKING AND FINDING THE ORDINANCE NOT SUBJECT
TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT
WHEREAS, the City of Hawaiian Gardens (“City”) has received numerous complaints from members of the public regarding the proliferation of oversized vehicles parked on public streets; and
WHEREAS, oversized vehicle parking raises unique public safety concerns, including the obstruction of access to rights-of-way, reduced site distance, and reduced visibility at intersections; and
WHEREAS, oversized vehicles are typically heavier vehicles (often with trailers) and thus have the potential to cause excessive wear and tear on roadways; and WHEREAS, oversized vehicles have also been the source of environmental hazards in the City by discharging waste into the street. Such waste includes gas, oil, and human waste. These discharges create unsanitary conditions for members of the public and also result in downstream impacts as such waste flows into the City’s storm drains; and
WHEREAS, the discharge of waste can also cause damage to City streets by, among other things, staining portions thereof; and
WHEREAS, City staff has observed that some oversized vehicles accumulate and discharge trash and debris in and around areas where vehicles are parked. City staff has been spending an increasing amount of time on fielding complaints from residents regarding trash and debris from oversized vehicle parking; and WHEREAS, the accumulation and storage of trash, debris, and other personal items in and around areas where oversized vehicles are parked has caused accessibility hazards by obstructing and/or blocking sidewalks and preventing safe passage thereon; and
WHEREAS, due to their large storage capacities, oversized vehicles can be increased targets for criminal activity such as burglaries, vandalism and vehicle thefts; and
WHEREAS, the availability of sufficient parking in the City has been an issue of increasing concern for residents and visitors. Continuous oversized vehicle parking exacerbates this issue by further reducing the number of available parking spaces on the 65320.00001\40505829.2

street. Given their size, oversized vehicles utilize limited space that could accommodate a number of smaller vehicles; and
WHEREAS, parking scarcity negatively impacts the City’s residents and visitors by, among other things, making the City a less attractive destination and adding trip time for drivers who are searching for parking; and
WHEREAS, reduced parking opportunities, environmental hazards, increased wear and tear of the City’s roadways, higher probability for traffic hazards, and the increased possibility for criminal activity collectively deteriorate the safety, tranquility, aesthetics and other similar values in the City; and
WHEREAS, pursuant to Cal. Const. Art. XI, Sec. 7 and under the City’s general police powers, the City is empowered and charged with responsibility for the health, safety, and welfare of its citizens; and
WHEREAS, the California Vehicle Code (“CVC”) provides the City with extensive authority to regulate parking within its boundaries. For example, CVC Section 35701 allows the City to prohibit the use of vehicles on City streets that exceed a maximum gross weight limit. CVC Section 21101(c) likewise allows the City to prohibit the use of highways by certain vehicles; and
WHEREAS, in addition to the foregoing, CVC Section 22507 authorizes the City to prohibit or restrict the stopping, parking, or standing of vehicles on certain streets or highways, or portions thereof, during all or certain hours of the day; and WHEREAS, CVC Section 22507 also empowers the City to adopt parking permit programs for the benefit of residents with dwellings adjacent to the regulated public streets. CVC Section 22507.5 contains many of these same authorizations; and WHEREAS, in light of the foregoing, the City Council desires to amend the Hawaiian Gardens Municipal Code (“HGMC”) in order to regulate the parking of oversized vehicles in the City; and
WHEREAS, subject to limited exceptions, this ordinance (“Ordinance”) prohibits oversized vehicles from parking on public streets in the City. Oversized vehicles encompassed within this Ordinance include: (1) vehicles that weigh more than 6,000 pounds or exceed 22 feet in length or 7 feet in width and 7 feet in height; and (2) camp trailers, campers, fifth wheel travel trailers, house cars, mobile homes, trailer coaches, and recreational vehicles; and
WHEREAS, various vehicles are exempt from the oversized vehicle parking restrictions, including: (1) vehicles parked in connection with the performance of a service to or on a nearby property; (2) oversized vehicles belonging to a federal, state, or local authority or public utility conducting official business; and (3) vehicles belonging to 65320.00001\40505829.2

residents or guests of residents that are parked in accordance with a City-issued parking permit; and
WHEREAS, this Ordinance’s parking restrictions reflect the City Council’s desire to revise the City’s parking regulations in a manner that: (1) is reflective of and consistent with residents’ values; (2) further mitigates the aesthetic and public safety concerns associated with the parking of oversized vehicles on public streets; (3) increases the availability of parking for the City’s residents and visitors; and, (4) preserves the character of neighborhoods for the benefit of public health, safety, and welfare; and WHEREAS, prior to adoption, the City gave public notice of a City Council public hearing to consider this Ordinance as required by law; and WHEREAS, all legal prerequisites to the adoption of this Ordinance have occurred.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF HAWAIIAN GARDENS DOES ORDAIN AS FOLLOWS:
Section 1. Recitals. The City Council hereby finds and determines that the Recitals above are true and correct and are incorporated herein.
Section 2. Environmental. The City Council finds that this Ordinance is exempt from the California Environmental Quality Act ("CEQA") because the Ordinance does not qualify as a “project” under CEQA and because the Ordinance will not result in a direct or reasonably foreseeable indirect physical change in the environment.
In the alternative, even if the Ordinance did qualify as a “project” under CEQA, it would be exempt from CEQA under State CEQA Guidelines section 15061(b)(3), which exempts projects from CEQA “[w]here it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment.” Thus, even if the Ordinance could result in some physical change in the environment, the Ordinance is exempt from CEQA because it can be seen with certainty that there is no possibility that the Ordinance may have a significant effect on the environment.
Section 3. Code Amendment. Chapter 10.36 of Title 10 of the Hawaiian Gardens Municipal Code is hereby amended to read in its entirety as follows:
“Chapter 10.36 – Oversized Vehicle Parking Regulations
65320.00001\40505829.2
-4-
10.36.010 Purpose
The purpose of this Chapter is to reduce the adverse impacts associated with Oversized Vehicle parking. Such impacts include, but are not limited to, the following:
A. Oversized Vehicle parking raises unique public safety concerns, including the obstruction of access to rights-of-way, reduced sight distance, and reduced visibility at intersections.
B. Oversized Vehicles are typically heavier vehicles or trailers and thus have the potential to cause excessive wear and tear on roadways.
C. Oversized Vehicles have been the source of environmental hazards in the City by discharging waste into the street. Such waste includes gas, oil, and human waste. These discharges create unsanitary conditions for members of the public and also result in downstream impacts as such waste flows into the City’s storm drains. The discharge of waste has also caused damage to City streets by staining portions thereof.
D. Some Oversized Vehicles accumulate and discharge trash and debris in and around areas where vehicles are parked. The accumulation and storage of trash, debris, and other personal items in and around areas where oversized vehicles are parked has caused accessibility hazards by obstructing and/or blocking sidewalks and preventing safe passage thereon.
E. Oversized Vehicle parking exacerbates the City’s parking issues by further reducing the number of available parking spaces on the street. Given their size, Oversized Vehicles utilize limited space that could accommodate a number of smaller vehicles. Parking scarcity negatively impacts the City’s residents and visitors by, among other things, making the City a less attractive destination and adding trip time for drivers who are searching for parking.

SUMMARY
Mayor Luis Roa is requesting a discussion to consider opening Lee Ware Pool yearround to offer swimming lessons, recreational swimming, and a place for the local swim team to practice.
Options for year-round swim team program:
1. City to provide facility/Swimming Pool much like we provide fields to all other non-profit community groups in the city. Swim Team should organize and register as a nonprofit. Staff can volunteer their time as a head coach and the swimming pool could be used for training only. No Personal or private use of the swimming pool will be allowed, and the use of the swimming pool will be highly regulated.
2. City to contract with the Local YMCA or School district for use of their larger swimming pools for Swim Team practice.
Options for year-round Swim lesson/Recreational swimming programs:
1. City to provide training during summer months.
2. Contract with our Local YMCA to provide swimming lessons at their location for the remaining months (excluding summer months) of the year.
FISCAL IMPACT
Additional research/analysis would need to be done in order to determine estimated cost.

RECOMMENDATION TO:
A. CONSIDER AWARDING ELIGIBLE EMPLOYEES A RETENTION AND RECOGNITION BONUS; AND
B. IF DESIRED BY COUNCIL, ADOPTION OF RESOLUTION NO. 048-2022,
AWARDING ELIGIBLE EMPLOYEES A RETENTION AND RECOGNITION BONUS
SUMMARY
Mayor Roa has requested that the Council consider paying eligible employees a retention and recognition bonus for those City employees who worked through the COVID-19 pandemic and a period of financial hardship for the City from March 13, 2020 through June 30, 2022 (“eligibility period”).
The pandemic affected employees in various ways. Some had their hours reduced, others were laid off and subsequently recalled, and still others continued to come to the City and pick up additional work to address the reduced staff. These employees also showed a dedication to the City and flexibility in a time of uncertainty due to the COVID pandemic and revenue reductions.
In order to recognize these employees and their efforts to support the City during this time, and to retain exceptional employees given the shortage of replacement candidates for employment and to remain competitive in the labor market, the Mayor has recommended awarding a retention and recognition bonus to any current, active employee that was employed with the City during eligibility period, whether in full-time or part-time employment, and currently remains employed by the City today. Employees hired after the last day of the eligibility period, that were laid off and not subsequently rehired, or those that are not current, active employees with the City, even if employed Agenda Item #C5

during the eligibility period, would not fit within the list of eligible employees able to receive the proposed retention and recognition bonus.
The proposed bonus amount would be $1,500 for full-time employees and $750 for parttime employees. The proposed bonus is further intended to be prorated for those employees who did not work the entirety of the eligibility period (whether due to hire date, layoff, or otherwise).
The bonus is proposed to be paid using the City’s American Recovery Plan Act (“ARPA”) funds, to the extent such funds remain available for such use and the payment of the proposed bonuses is in compliance with the rules applicable to ARPA funds.
FISCAL IMPACT
This would result in an unbudgeted ARPA expense of approximately $85,000. Staff will need to return to Council with a proposed Budget amendment to reallocate budgeted ARPA expenditures with proposed General Fund expenditures.
