CITY OF HAWAIIAN GARDENS

CITY COUNCIL

STAFF REPORT
Agenda Item #A1
DATE: January 24, 2023
TO: Honorable Mayor and Members of the City Council
FROM: Ernesto Marquez, City Manager
BY: Elise McCaleb, Community Development Director
Sophia Tatlyan, Senior Planner
RECOMMENDATION:

RECOMMENDATION TO HOLD A PUBLIC HEARING AND SECOND READING OF ZONING ORDINANCE AMENDMENT 2023-608, AMENDING TITLE 18 (ZONING) OF

THE HAWAIIAN GARDENS MUNICIPAL CODE (HGMC) MODIFYING SECTION

18.80.010 (CC- CARD CLUB OVERLAY ZONE) AND SECTION 18.80.040 (BC- BINGO

CLUB OVERLAY ZONE) TO ALLOW ELECTRICAL UTILITY METERING AND SERVICE

EQUIPMENT FOR ELECTRIC CAR CHARGING SYSTEMS WITHIN A LANDSCAPE

SETBACK AND A DETERMINATION THE PROJECT IS EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT.

SUMMARY
Zoning Text Amendment 2022-012 is a City initiated amendment to Title 18 of the Hawaiian Gardens Municipal Code (HGMC) modifying Section 18.80.010 (CC- Card Club Overlay Zone) and Section 18.80.040 (BC- Bingo Club Overlay Zone) to allow electrical utility metering and service equipment for electric car charging systems within a landscape setback and a determination the project is exempt pursuant to Section 15061(b)(3) of the California Environmental Quality Act (CEQA).

BACKGROUND
In October of 2015, the California Legislature approved, and the Governor signed into law, Assembly Bill (AB) 1236 (Chapter 598), requiring cities and counties to develop an expedited, streamlined permitting process for EV stations. Government Code Section 65850.7 was codified, declaring the Legislatures’ intent for local agencies to encourage the installation of EV charging stations by removing obstacles to, and minimizing costs Agenda Item #A1

of, permitting for charging stations so long as the action does not supersede the building official’s authority to identify and address higher priority life-safety situations.

In October of 2019, The California Legislature approved, and the Governor signed into law AB 1100 (Chapter 819). This law requires parking spaces served by electric vehicle supply equipment to be counted as at least one standard automobile parking space for the purpose of complying with any applicable minimum parking requirements established by a local jurisdiction. An accessible parking space with an access aisle for a future electric vehicle charging space is to be counted as at least 2 standard automobile parking spaces for the purpose of complying with any minimum parking requirements established by a local jurisdiction.

In October of 2021, the California Legislature approved, and the Governor signed to law, AB 970 (Chapter 710), which clarifies that every city, charter city, county, and city and county is to create an expedited, streamlined permitting process for electric vehicle charging stations. The law also requires that a jurisdiction adopt a checklist pursuant to which an application that satisfies the information requirements in that checklist shall be deemed complete and therefore eligible for expedited review.

In March of 2022, Tesla approached the Community Development Director about the possibility of the addition of charging stations to the Casino parking lot. A conceptual plan was submitted and reviewed by all departments to determine parking, site plan layout, and safety implications. Due to recent State laws, AB 1236 (Chapter 598), AB 1100 (Chapter 819) and AB 970 (Chapter 710), as discussed above, City staff determined the conceptual plans could move forward with the proposed placement of the EV equipment in the landscape setback. Alternative placement of the stalls within the parking lot was discussed with several options presented. Tesla representatives, the Casino manager and City staff met to discuss site layout options and it was determined that the best place for the equipment is within the existing landscape areas so as not to disturb, remove, modify, or impact existing parking stalls in any way. It was determined that it would also be safer to have the chargers close to the entrance.

Staff has determined that making concessions to permit the equipment in the setback areas is not a health or safety issue.

The Planning Commission met on December 14, 2022 and recommended City Council approval of Zoning Text Amendment 2022-012, amending Title 18 of the Hawaiian Gardens Municipal Code (HGMC) modifying Section 18.80.010 (CC- Card Club Overlay Zone) and Section 18.80.040 (BC- Bingo Club Overlay Zone).

ANALYSIS
In an effort to reduce barriers to the installation of EV charging stations, the Community Development Department has reviewed the existing development standards which limits the placement of EV electrical utility metering and service equipment for electric car Agenda Item #A1

charging systems in the Casino Club and Bingo Overlay Zones. Under the current HGMC, EV charging stations and equipment must be located at least 8 feet from the property line abutting a public right-of-way within the Casino Club Overlay Zone and at least 5 feet from the property line along the street frontage of a parking lot within the Bingo Club Overlay Zone. In addition, utility equipment that does not comply with Visibility Clearance height and location requirements are not permitted within landscape setback areas. The equipment is 8 feet tall and complies with Visibility Clearance requirements. The City is initiating this request to amend the Casino Club and Bingo Club Overlay Zones to provide regulatory relief and allow EV charging stations and necessary equipment to fully encroach into the landscape setback areas with a minimum of 5 feet separation between the electrical utility metering and service equipment to provide a visual opening for safety.

The following are the amendments proposed to be added to the HGMC:

SECTION 18.80.010 (C) (4)

4. Landscape setback. A landscape setback with a minimum depth of eight feet, consisting of landscape planting and screening, shall be provided along street rights-of-way abutting the project site.
a. Electrical utility metering and service equipment for electric car charging systems are permitted within landscape setback areas.

SECTION 18.80.040 (C)
C. Development standards. Bingo club facilities within the BC overlay zone are subject to the development standards for the General Commercial zone contained in Section 18.60.020 C-4 - General Commercial zone; Chapter 18.70 Nonresidential Regulations; Chapter 18.90 supplemental regulations; and applicable conditions of approval required under a conditional use permit. Bingo club facilities shall also comply with all regulatory requirements contained in Chapter 5.42 bingo games, and, to the extent the above referenced applicable development standards conflict with any conditions of approval required under a conditional use permit, the conditions of approval shall prevail.

1.Location. Bingo games shall only be allowed in the BC overlay zone and on sites of two acres or more in size.

2.Parking. Bingo parlors: one parking space for every two seats.

3.Structures in Landscape Setbacks. Electrical utility metering and service equipment for electric car charging systems are permitted within landscape setback areas.

Environmental Determination
The proposed text amendments are exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15061(b)(3), because the proposed text amendments to the zoning ordinance will not cause a significant effect on the environment as amendments to the zoning ordinance are not considered a project and would provide for new standards consistent with State Law. Further, the amendments to the zoning code do not propose any physical construction.

Finally, the proposed text amendments are exempt under CEQA Guidelines, Section 15308 as an action by the City for the protection of the environment. Expanding the siting standards for electric vehicle charging stations is likely to result in more electric vehicle charging station which would encourage the use of electric vehicles.

General Plan Consistency
The proposed text amendment has been evaluated for consistency with the City’s General Plan and is consistent with the following:
• Collaborate with applicants and developers to provide high quality development projects
• Ensure compatibility between residential and nonresidential land uses to create harmonious living environments

FISCAL IMPACT
None

SUGGESTED ACTION

Guidelines. Section 15061(b)(3) states that CEQA applies only to projects that have the potential for causing a significant effect on the environment. Also, the proposed text amendments are exempt under CEQA Guidelines, Section 15308 as an action by the City for the protection of the environment. Expanding the siting standards for electric vehicle charging stations is likely to result in more electric vehicle charging station which would encourage the use of electric vehicles.

CITY OF HAWAIIAN GARDENS

CITY COUNCIL

STAFF REPORT
Agenda Item #B2
DATE: January 24, 2023
TO: Honorable Mayor and Members of the City Council
FROM: Ernesto Marquez, City Manager
BY: Megan Garibaldi, City Attorney
RECOMMENDATION:

Recommendation to continue to authorize virtual and hybrid City Council meetings as well as virtual and hybrid meetings for all other City Boards, Commissions, Committees, or Agencies Pursuant to AB 361.

SUMMARY
On March 17, 2020, Governor Newsom issued Executive Order N-29-20, which allowed legislative bodies to conduct public meetings through teleconferencing without complying with certain provisions of the Ralph M. Brown Act. All provisions of Executive Order N29-20 concerning the conduct of public meetings expired on September 30, 2021.

Assembly Bill 361 was signed into law by the governor on September 16, 2021, and went into effect immediately. AB 361 allows legislative bodies such as the Hawaiian Gardens City Council and other City bodies to meet virtually provided there is a state of emergency, and either (1) state or local officials have imposed or recommended measures to promote social distancing; or (2) the legislative body determines by majority vote that conducting full meetings in person would present imminent risks to the health and safety of attendees. The Governor by executive order signed on September 20, 2021, suspended the effective date of AB 361 to October 1, 2021. As a result, if the City Council desires to have virtual or hybrid City Council meetings on or after October 1, 2021, it must do so consistent with the requirements of AB 361. Though adopted in the context of the pandemic, Assembly Bill 361 allows for virtual or hybrid meetings during other proclaimed emergencies such as earthquakes or wildfires, where physical attendance may present a risk.

AB 361 requires the following:

Agenda Item #B2
January 24, 2023

Page 2 ends

• Public agencies, by majority vote within 30 days of the first virtual or hybrid meeting under AB 361 and every 30 days thereafter, find a state of emergency still exists and continues to directly impact the ability of the members to meet safely in person, or that officials continue to impose or recommend measures to promote social distancing.
• A public comment period where the public can address the legislative body directly. • Public comments cannot be limited to only comments submitted in advance and specifies that the body “must provide an opportunity for the public to offer comment in real time” per Government Code 54953(e)(2)(E).
• The body must allow a reasonable time for public comment during the comment periods.
• The agenda must include information on the manner in which the public may access the meeting and on providing comments remotely.
• If technical problems arise that result in the public’s access being disrupted, the legislative body may not take any vote or other official action until the technical disruption is corrected and public access is restored.
• AB 361 provisions will sunset on January 1, 2024.

Under AB 361, the City may continue using virtual or hybrid meetings for the duration of the state-proclaimed state of emergency if the City Council finds that (1) state or local officials have imposed or recommended measures to promote social distancing or (2) if meeting in person would present imminent risks to the health and safety of attendees.

The City Council is able to make those findings.

While the State continues to wind down certain pandemic restrictions, and County Health Orders no longer require masking in many indoor settings, LA County remains in the High COVID-19 Community Level.

The Los Angeles County Department of Public Health (LACDPH) Health Officer Order, revised April 21, 2022, states in pertinent part as follows:

Masking will continue to be strongly recommended, but no longer be required, in most indoor settings and in K-12 Schools or childcare facilities. Masking will continue to be required for all persons, regardless of vaccination status, in higher transmission risk settings within the County, like on public transit and in transportation hubs, all health care settings, correctional facilities and detention centers, emergency shelters, cooling and heating centers, homeless shelters, and long-term care settings and adult and senior care centers.

In addition, the LACDPH “Reducing Risk Guidance (English)” revised on July 8, 2022, lists the following under the section titled “How to Reduce the Risks of COVID-19”:

Improve air flow. Avoid indoor spaces with poor air flow as much as possible.

Choose outdoor spaces for social and fitness activities when possible.

Agenda Item #B2
January 24, 2023

Page 3 ends

Keep your distance. Use two arms lengths as your guide (about 6 feet) for social distancing with people you don’t live with.

LACDPH also issued a statement on July 15, 2022, noting:

If LA County remains in the High COVID-19 Community Level for two consecutive weeks, universal indoor masking will be implemented on July 29 to help slow the rate of transmission & protect those most vulnerable.

While the LACDPH ultimately did not implement indoor masking, LACDPH still strongly advises masks in indoor settings.

Despite the easing of certain State and local restrictions, and in light of the consideration to re-implement of some of these restrictions, community spread continues to threaten individuals’ ability to attend public meetings, in particular individuals who are immunocompromised, infected, and/or socially distancing. Therefore, continuing to offer attendees the opportunity to virtually attend City Council meetings under AB 361 furthers the purpose of AB 361 to provide equal access to meetings of local government.

Continued compliance with AB 361 will require the board approve the action making the required findings every 30 days, via the consent agenda.

RECOMMENDATION TO RECEIVE AND FILE TREASURER’S REPORT FOR OCTOBER AND NOVEMBER 2022

SUMMARY
The attached Treasurer’s Report provides balances for the months of October and November 2022. During these periods, the City investments were in compliance with the Investment Policy and the City had sufficient cash reserves to meet the expenditure requirement for operations for the next six (6) months.

The City maintains checking accounts for general operations, payroll, and the housing account. In addition, we maintain an investment account with LAIF. Funds are also retained by the Bank of New York Mellon for the Successor Agency Bond payments. The general operating account and LAIF represent cash transactions for multiple funds (Pooled Cash) with the amount available for each fund tracked in the general ledger. Interest earned through LAIF is allocated to each fund based on the balance shown in the general ledger. The attached detail report provides balances by Fund as of November 2022.

Recommendation to receive and file the Beautification Program updated report for the month of November/December 2022.

The City of Hawaiian Gardens Public Housing Authority created a City Beautification Program for exterior improvements for single-family, duplex, and mobile homes, and interior improvements for condominiums. CITY OF HAWAIIAN GARDENS

CITY COUNCIL

STAFF REPORT
Agenda Item #B11
DATE: January 24, 2023
TO: Honorable Mayor and Members of the City Council
FROM: Ernesto Marquez, City Manager
BY: Neema Ghanbari, Public Works Manager
RECOMMENDATION:

RECOMMENDATION TO AUTHORIZE STAFF TO REQUEST FOR PROPOSALS FOR

ON-CALL CONSTRUCTION MANAGEMENT, ENGINEERING SUPPORT,

GEOTECHNICAL ENGINEERING, TESTING, AND INSPECTION SERVICES

SUMMARY
The Public Works Department is requesting City Council to authorize the Engineering Division staff to solicit request of proposals from qualified firms for on-call construction management, engineering support, geotechnical engineering, surveying, material testing, construction inspection, grant administration, and labor compliance services for various projects within the City of Hawaiian Gardens.

On-call contracts provide the City with the flexibility to implement and deliver projects as necessary. The engineering division has relied on consulting firms for “as needed” city projects related services for engineering and architectural design and project management for many years, as well as for other services in other departments such as building and safety, planning, housing, and code enforcement.

The Public Works Department, at the discretion of the council, will be requesting a Statement of Qualification (SOQ) from qualified civil engineering firms to provide consulting services on an “as-needed” contract basis. The department will issue task orders for each project based upon a scope of work, work schedule, and fee proposal submitted to the City for its review and approval. The contract term shall be for three years with the City receiving the option to grant two (2) one-year extensions at the end of the term. Upon review and evaluation of the SOQ, staff will bring back this item for the City Council review and contract award.
