RECOMMENDATION TO RECEIVE AND FILE TREASURER’S REPORT FOR JUNE 2023
SUMMARY
The attached Treasurer’s Reports provide balances for the months of June 2023. During this period, the City investments were in compliance with the Investment Policy and the City had sufficient cash reserves to meet the expenditure requirement for operations for the next six (6) months.
The City maintains checking accounts for general operations, payroll, and the housing account. In addition, we maintain an investment account with LAIF. Funds are also retained by the Bank of New York Mellon for the Successor Agency Bond payments. The general operating account and LAIF represent cash transactions for multiple funds (Pooled Cash) with the amount available for each fund tracked in the general ledger. Interest earned through LAIF is allocated to each fund based on the balance shown in the general ledger. The attached detail report provides balances by Fund as of June 2023.

RECOMMENDATION:
Recommendation to conduct second reading of Ordinance No. 2023-612, adding Chapter
15.38 to Title 15 (Buildings and Construction) of the Hawaiian Gardens Municipal Code relating to an expedited, streamlined permitting process for electric vehicle charging stations.
SUMMARY
In 2015, the State of California adopted Assembly Bill 1236 (AB 1236), codified as Government Code § 65850.7, which requires local jurisdictions with a population less than 200,000 residents to adopt an ordinance to create an expedited, streamlined permitting process for electric vehicle charging stations on or before September 30, 2017. AB 1236 was adopted to limit the restrictions that cities and counties could impose on applicants installing electric vehicle charging stations, to achieve timely and costeffective installation of electric vehicle charging stations, which has been deemed by the legislature to be a matter of statewide concern.
Assembly Bill 970 (AB 970), codified as Government Code § 65850.71, adopted by the State legislature on October 8, 2021, sets forth certain timing obligations applicable to cities when fulfilling their function of processing electric vehicle charging station permits.
The proposed ordinance would bring the City’s permitting processes for EV Charging stations in line with State law.
Agenda Item #C1
August 8, 2023
DISCUSSION
AB 1236 requires cities to adopt an ordinance to expedite permit processing for applicants looking to install electric vehicle charging stations. An electric vehicle charging station is any level of electric vehicle supply equipment station which delivers electricity from a source outside an electric vehicle into a plug-in electric vehicle.
AB 1236 also requires that jurisdictions adopt a checklist of requirements with which a permit application for an electric vehicle charging station will be eligible for expedited review. The content of the checklist requires the permit applicant to check the features of the existing electrical service such as: rating in amperes; system voltage; connected or calculated load; spare capacity in amperes; voltage and ampere rating of the electric vehicle supply equipment; circuit rating of the electric vehicle supply equipment; location of the electric vehicle supply equipment; if ventilation is or is not required; and clearances of the charging equipment to comply with all applicable building and fire safety laws.
Government Code Section 65850.7 requires the City’s checklist be based on the “PlugIn Electric Vehicle Infrastructure Permitting Checklist” of the “Zero-Emission Vehicles in California: Community Readiness Guidebook” of the Governor’s Office of Planning and Research.
In addition, AB 970 requires an application to install an electric vehicle charging station to be deemed complete if, either 5 business days or 10 business days after the application was submitted (depending on the number of electric vehicle charging stations proposed in the application), the city has not deemed the application to be incomplete or issued a written correction notice detailing all deficiencies in the application. Then, AB 970 requires an application to install an electric vehicle charging station to be deemed approved if, 20 business days or 40 business days after the application was deemed complete (depending on the number of electric vehicle charging stations proposed in the application): (1) the city has not approved the application; (2) the building official has not made a finding that the proposed installation could have an adverse impact upon the public health or safety or required the applicant to apply for a use permit; (3) the building official has not denied the permit; and (4) an appeal has not been made to the planning commission of the city. Members of the City Building Department are aware of these timing requirements and are prepared to comply with them in connection with the adoption of this Ordinance and all electric vehicle permitting laws.
The attached ordinance complies with the requirements set forth in AB 1236 and AB 970 by requiring that the City administratively approve applications that comply with the City’s “Expedited EV Permit & Checklist” and limit review to whether the installation would comply with safety and performance standards.
Agenda Item #C1
August 8, 2023
ENVIRONMENTAL DOCUMENTATION
The City Council finds that these ordinances are not subject to the requirements of California Environmental Quality Act (“CEQA”) for the following reasons: These ordinances are (1) not “project” within the meaning of sections 15060(c)(2) and 15060(c)(3) of the State CEQA Guidelines, because they have no potential for resulting in direct or indirect physical change in the environment; and (2) are exempt under section 15061, subdivision (b)(3), the general rule exemption, because it can be seen with certainty that there is no possibility that this code amendment will have a significant effect on the environment.
FISCAL IMPACT
No fiscal impact anticipated.
SUGGESTED ACTION
Approve Recommendation.

ORDINANCE NO. 2023-612
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
HAWAIIAN GARDENS ADDING CHAPTER 15.38 TO TITLE 15 OF THE
HAWAIIAN GARDENS MUNICIPAL CODE RELATING TO AN
EXPEDITED, STREAMLINED PERMITTING PROCESS FOR ELECTRIC
VEHICLE CHARGING STATIONS
WHEREAS, the State of California has adopted Assembly Bill 1236 (Chapter 598, Statutes of 2015), which requires every city with a population of less than 200,000 residents to adopt an ordinance that creates an expedited and streamlined permitting process for electric vehicle charging stations on or before September 30, 2017, and
WHEREAS, Assembly Bill 970 (Chapter 710, Statutes of 2021), requires, beginning January 1, 2023, such permitting applications, to be deemed complete, and subsequently deemed approved, at a certain point after submission if the City of Hawaiian Gardens (“City’) has not taken certain specified actions with respect to the applications; and WHEREAS, creation of an expedited, streamlined permitting process for electric vehicle charging stations would facilitate convenient charging of electric vehicles and help reduce the City’s reliance on environmentally damaging fossil fuels; and WHEREAS, the City wishes to amend the Hawaiian Gardens Municipal Code to meet these State law requirements and to facilitate convenient charging of electric vehicles.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF HAWAIIAN GARDENS DOES ORDAIN AS FOLLOWS:
SECTION 1. Recitals. The City Council hereby incorporates by reference the recitals of this Ordinance.
SECTION 2. Amendment. Chapter 15.38 is hereby added to Title 15 of the Hawaiian Gardens Municipal Code to read in full as follows:

B. “Building Official” means the chief building official of the City or their designee.
C. “Electric vehicle charging station” or “charging station” means any level of electric vehicle supply equipment station that is designed and built in compliance with Article 625 of the California Electrical Code, and any subsequent amendments thereto, and delivers electricity from a source outside an electric vehicle into a plug-in electric vehicle.
D. “Specific, adverse impact” means a significant, quantifiable, direct, and unavoidable impact, based on objective, identified, and written public health or safety standards, policies, or conditions as they existed on the date the application was deemed complete.
E. “Electronic submittal” means the utilization of one or more of the following:
a. Email
b. The Internet
15.38.030 – Electrical Vehicle Charging Station Requirements A. The electric vehicle charging station shall meet the applicable safety and performance standards established by the California Electrical Code, the Society of Automotive Engineers, the National Electrical Manufacturers Association, and accredited testing laboratories such as Underwriters Laboratories, and rules of the Public Utilities Commission and the local electric utility company regarding safety and reliability.
B. Installation of electric vehicle charging stations and associated wiring, bonding, disconnecting means and overcurrent protective devices shall meet the requirements of Article 625 and all applicable provisions of the California Electrical Code.
C. Installation of electric vehicle charging stations shall be incorporated into the load calculations of all new or existing electrical services and shall meet the requirements of the California Electrical Code. Electric vehicle charging equipment shall be considered a continuous load.
3 D. Anchorage of either floor-mounted or wall-mounted electric vehicle charging stations shall meet the requirements of the California Building or Residential Code as applicable per occupancy, and the provisions of the manufacturer’s installation instructions. Mounting of charging stations shall not adversely affect building elements.
15.38.040 – Expedited Permitting Process
Consistent with Government Code section 65850.7, the Building Official shall implement an expedited, streamlined permitting process for electric vehicle charging stations and adopt a checklist of all requirements with which electric vehicle charging stations shall comply with in order to be eligible for expedited review. The expedited, streamlined permitting process and checklist may refer to the recommendations contained in the most current version of the “Plug-In Electric Vehicle Infrastructure Permitting Checklist” of the “Zero-Emission Vehicles in California: Community Readiness Guidebook” as published by the Governor’s Office of Planning and Research. The City’s adopted checklist shall be published on the City’s website.
15.38.050 – Permit Application Process
A. Prior to submitting an application for processing, the applicant shall verify that the installation of an electric vehicle charging station will not have specific, adverse impact to public health and safety and building occupants. Verification by the applicant includes but is not limited to: electrical system capacity and loads; electrical system wiring, bonding and overcurrent protection; building infrastructure affected by charging station equipment and associated conduits; and areas of charging station equipment and vehicle parking.
B. A permit application that satisfies the information requirements in the City’s adopted checklist shall be deemed complete and be promptly processed. A completed application does not authorize an applicant to energize or utilize the electric vehicle charging station until approval and all necessary permits are granted by the City.
C. If the Building Official determines that the permit application is incomplete, they shall issue a written correction notice to the applicant, detailing all deficiencies in the application and any additional information required to be eligible for expedited permit issuance.
D. The Building Official shall allow for electronic submittal of permit applications covered by this chapter and associated supporting documentations. In accepting such permit applications, the Building Official shall also accept electronic signatures on all forms, applications, and other documentation in lieu of a wet signature by any applicant.
15.38.060 – Permit Review
A. The Building Official shall review all electric vehicle charging station applications.
Notwithstanding the expedited permit processing set forth in this chapter, the Building Official retains authority at all times to identify and address higher priority life-safety situations.

SECTION 3. CEQA. This Ordinance was assessed in accordance with the authority and criteria contained in the California Environmental Quality Act (CEQA), the State CEQA Guidelines (the Guidelines), and the environmental regulations of the City. The City Council hereby finds that this ordinance is not subject to CEQA because the adoption of this ordinance is not a "project" pursuant to Sections 15060(c)(2) and 15060(c)(3) of Title 14 of the California Code of Regulations.
Specifically, this Ordinance only establishes a streamlined process for electric vehicle charging station permits and merely authorizes administrative activities which will not result in a direct or reasonably foreseeable indirect physical change in the environment. Moreover, under Section 15061(b)(3) of the State CEQA Guidelines, this Ordinance is exempt from the requirements of CEQA because it can be seen with certainty that the provisions contained herein would not have the potential for causing a significant effect on the environment.
SECTION 4. Severability. If any section, subsection, subdivision, sentence, clause, phrase, or portion of this Ordinance for any reason is held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. CITY COUNCIL
STAFF REPORT
Agenda Item #C2
DATE: August 8, 2023
TO: Honorable Mayor and Members of the City Council
FROM: Ernesto Marquez, City Manager
BY: Elise McCaleb, Community Development Director
RECOMMENDATION:
Direct staff to submit letters of opposition signed by the Mayor to Assemblymember Sharon Quirk-Silva and State Senator Janet Nguyen regarding SB 423 (Wiener) and AB 309 (Lee).
SUMMARY
Assemblymember Wiener and Assemblymember Lee are proposing new legislation which would impact the development of housing in Hawaiian Gardens. SB 35 was signed in 2017 (Effective date: January 1, 2018) and provides a streamlined approval process for housing projects proposing certain affordable housing guarantees. SB 35 requires local entities to approve certain housing projects by providing a ministerial approval process, removing the requirement for CEQA analysis, and removing the requirement for discretionary entitlements granted by the Planning Commission.
SB 423 would extend the sunset date of SB 35 from January 1, 2026 to January 1, 2036 and allow the state Department of General Services (DGS) to control housing developments on state-owned or -leased property in disregard of the local zoning and development standards. This legislation would take away local control and force cities to ministerially approve certain housing projects without obtaining input from community.
Cities would have no ability to impose zoning standards, objective standards, or design review requirements on state-owned or -leased land.
AB 309 would create the Social Housing Program within the Department of General Services (DGS). This program would facilitate the construction of government-owned housing on leased state property or excess state-owned property. Cities would not be able to impose zoning standards, objective standards, or design review requirements.
Agenda Item #C2
August 8, 2023
Cities would have no ability to regulate development standards, including floor area ratios, height limitations, or density requirements.
The City of Hawaiian Gardens is creating a plan through the 6th Cycle Housing Element to build more housing units. Hawaiian Gardens is planning for 331 units. In total, cities across California are identifying sites for more than 2.5 million additional housing units.
This legislation erodes local control and forces cities to accept projects brought forward by the DGS.
FISCAL IMPACT
None.
SUGGESTED ACTION
Approve Recommendation.

RE: SB 423 (Wiener) By-right Housing Approvals: Multifamily Housing Developments: SB 35 (Chapter 366, Statutes of 2017) Expansion Notice of Opposition
Dear Senator Nguyen:
The City of Hawaiian Gardens opposes SB 423 (Wiener), which would greatly expand SB 35 (Chapter 366, Statutes of 2017), extend the January 1, 2026 sunset date to January 1, 2036, and allow the Department of General Services (DGS) to control housing developments on state-owned or -leased property, regardless of the locally required zoning or development standards.
The City of Hawaiian Gardens understands the affordable housing and homelessness crisis as it plays out in our community every day. Local leaders are working to find creative solutions so homes of all income levels can be built. They’re taking on these difficult and complex tasks, and in many cases successfully planning for more than 2.5 million new homes statewide.
SB 423 would force cities to approve certain housing projects without regard to the needs of the community, opportunities for environmental review, or public input. Public engagement often leads to better projects. Not having such outlets will increase public distrust in government and potentially result in additional ballot measures limiting housing development.
Lawmakers should partner with local officials to annually invest funds to help cities prevent and reduce homelessness and spur housing development. Targeted, ongoing funding is the only way cities can find community-based solutions that get residents off the streets and into homes. California needs a sustainable state investment that matches the scale of this long-term crisis.

RE: AB 309 (Lee) Social Housing Program
(as amended 7/13/2023)
Notice of Oppose Unless Amended
Dear Assemblymember Quirk-Silva:
The City of Hawaiian Gardens opposes AB 309 (Lee), unless it is amended to address the City’s concerns. AB 309 would create the Social Housing Program within the Department of General Services (DGS) to facilitate the construction of governmentowned housing on leased state property or excess state-owned property. Cities would have no ability to regulate zoning or development standards, including floor area ratios, height limitations, or density requirements.
Hawaiian Gardens strongly supports the intent of AB 309, which is to produce more housing. As you know, housing affordability and homelessness are among the most critical issues facing California cities. Affordably priced homes are out of reach for many people and housing is not being built fast enough to meet the current or projected needs of people living in the state. Cities support housing production by planning for new projects based upon public review and input and following state housing laws.
Importantly, cities are currently updating housing plans to identify sites for more than 2.5 million additional housing units.
AB 309 disregards the state-mandated planning process and specifically empowers DGS to make land use and zoning decisions on state excess property. While AB 309 currently limits DGS authority to three housing projects on declared excess state property suitable for housing, the measure broadly establishes the Social Housing Program within DGS which could be easily expanded to include all state-owned lands.
Bypassing California’s longstanding housing planning laws and local zoning rules is not a way out of the housing crisis. The City of Hawaiian Gardens urges the Governor and lawmakers to annually invest funds to help cities prevent and reduce homelessness and spur affordable housing development. Targeted, ongoing funding is the only way cities can find community-based solutions that produce housing at all income levels.
