CITY OF HAWAIIAN GARDENS

CITY COUNCIL

STAFF REPORT
Agenda Item #C1
DATE: January 10, 2024
TO: Honorable Mayor and Members of the City Council
FROM: Ernesto Marquez, City Manager
BY: Joseph Jimenez, Recreation and Community Services Director RECOMMENDATION:

Recommendation to adopt Resolution No. 001-2024 authorizing the service of alcoholic beverages at the boxing event hosted by Marvnation Boxing Promotions on February 10, 2024.

SUMMARY
In order to authorize the service and consumption of alcohol at a City Facility, the City Council must find the event qualifies for an exemption under the Municipal Code.

BACKGROUND
Marvnation Promotions (“Marvnation”) held a professional boxing event (sanctioned by USA Boxing) on Saturday December 2, 2023, at the C. Robert Lee Activity Center. The event was largely a success for both Marvnation and the City. Following the December event, Marvnation approached the City to inquire into hosting another professional boxing event on February 10, 2024. This event, in addition to being live streamed, will be televised.

As with the previous event, Marvnation has requested to use the Gymnasium but will also need to use Multipurpose rooms A and B intermittently and the Senior Center Conference room for use by USA Boxing Commission. The plan is to have at a minimum 8 fights. As with the December 2 event, the service of alcoholic beverages at a boxing event is standard operation and Marvnation requires alcohol in order for it to continue moving forward with the event.

Agenda Item #C1
January 10, 2024

Page 2 ends

The event will require a temporary use permit, which requires a site plan and approval by the Community Development Director and will impose various conditions of approval relating to insurance, indemnification, licensing, and limitations on the use and scope of the event. Staff will work with Marvnation to address any issues from the December 2 event and to help improve overall processes, wait times, logistics, and event operation.

Marvnation will be required to obtain private security for the event and the City will be scheduling our SAO Team and PSO’s to assist with monitoring local streets – parking will be allowed on Civic Center Dr.

ANALYSIS
The service, and consumption of alcohol in a City owned facility is generally prohibited, unless the Council, in writing, finds that such location meets various administrative requirements. (Municipal Code section 9.24.010.) Staff finds that this event meets the findings based upon the following:

1. The boxing event will promote civil purposes as it will provide an opportunity for the community to come together for a unique sporting experience. The fights will be live streamed and televised and Marvnation will allow for the City to include promotional material such as a City-banner.

2. The event is proposed for February 10, 2024, and the necessary permit(s) and approval(s) will condition the event to limit the service of alcohol between the time of 5:30 PM to 10:30 PM.

3. The event will be confined to the interior C. Robert Lee Activity Center, located at 21815 S. Pioneer Blvd., Hawaiian Gardens, CA 90716, and no portion of the event will be allowed outside the permitted area.

4. The applicant will be required to obtain all necessary licenses and permits from any other public agency, including but not limited to the County of Los Angeles and the California Department of Alcohol Beverage Control. The applicant will be required to comply with all applicable local, state, and federal laws.

5. There will be no sale of alcoholic beverages.

The approval for service of alcohol at the event will be conditioned upon Marvnation obtaining all necessary permits and approvals, which includes a temporary use permit from the City. If Marvnation fails to obtain all necessary permits and approvals, then the Resolution before the Council shall be void.
