Agenda Item #B3
DATE: February 28, 2024
TO: Honorable Mayor and Members of the City Council
FROM: Ernesto Marquez, City Manager
BY: Elise McCaleb, Community Development Director
Celina Estrada, Community Development Technician
RECOMMENDATION:
Recommendation to receive and file the Beautification Program updated report for the month of January 2024.
SUMMARY
The City of Hawaiian Gardens Public Housing Authority created a City Beautification Program for exterior improvements for single-family, duplex, and mobile homes, and interior improvements for condominiums. The Program is currently funded through the Hawaiian Gardens Public Housing Authority and the General Fund. This report is an update on General Fund expenditures.
The intent of the Program is to improve the overall appearance of the City of Hawaiian Gardens’ neighborhoods, increase property values, and increase community pride. The improvements on the homes must be deemed beneficial to the overall exterior appearance of the property and address deteriorated and unsightly conditions visible from the street. Financial assistance up to a maximum of $10,000 is provided to property owners and up to $25,000 for substandard cases through a grant. There is also a $2,500 grant available for emergency cases.

STAFF REPORT
Agenda Item #C1
DATE: February 28, 2024
TO: Honorable Mayor and Members of the City Council
FROM: Ernesto Marquez, City Manager
BY: Ernesto Marquez, City Manager
RECOMMENDATION:
Recommendation to conduct second reading of Ordinance No. 2024-616, amending the Municipal Code regarding possession, service, and consumption of Alcoholic Beverages in Public Places; and adopt Resolution No. 004-2024, establishing a policy regulating Alcoholic Beverages in public places.
SUMMARY
Staff is looking to update and modernize the City’s current ordinance on possession, service, and consumption of alcohol in public places. The proposed ordinance (Attachment A) and resolution (Attachment B) will continue to prohibit open containers, service (including sale), and consumption of alcohol in public places, but create a new regulatory process which will allow an individual to obtain an Administrative Alcohol Permit if there is an event in a public place at which alcohol will be served and consumed and meets various requirements.
BACKGROUND
Hawaiian Gardens Municipal Code (“HGMC”) section 9.24.010 governs alcohol in public places. While it generally prohibits possession, sale, and consumption of alcohol in public, staff desires to more clearly set forth these prohibitions as the section is somewhat ambiguous. Additionally, under Section 9.24.010, every time an event at a public facility wants to serve or consume alcohol, the City Council must make five written findings to permit the service and consumption of alcohol. Sale of alcohol is currently never permitted. Staff believes that there should be a more streamlined administrative process through an adopted Council policy, and believes that with bigger events coming to the City (such as the professional boxing matches) alcohol should be permitted to be sold.
Agenda Item #C1
February 28, 2024
ANALYSIS
Ordinance No. 2024-616
Under the proposed ordinance, staff recommends repealing and replacing Section
9.24.010. The proposed ordinance will do the following:
• Define what constitutes an “Alcoholic Beverage(s).”[1] • Define what constitutes a “Public Place,” which includes any street, sidewalk, parkway, alley, highway, parking lot open to the public, public park, public school, public playground, public facility or building, or any other public place. • Prohibit consumption and service (which includes sale or offer to sell) of any alcoholic beverage in a public place which is not licensed, permitted, and authorized by law.
• Prohibit possession of open containers of alcoholic beverages in public places. • Authorize the adoption of administrative regulations for possession, service, and consumption of alcoholic beverages in public places.
• Establish that violations of this ordinance and any adopted regulations is subject to enforcement.
The major distinction between the proposed ordinance and the current language of Section 9.24.010 is the removal of the required Council findings and the authorization for establishing administrative regulations for possession, service, and consumption of alcoholic beverages in public places.
Resolution No. 004-2024
The proposed resolution will become the City’s official policy regarding possession, service, and consumption of alcoholic beverages in public places. Making it a resolution allows the Council to more quickly and efficiently manage the policy in the event that the Council wanted to make changes (rather than through the code amendment process).
The policy requires an applicant to obtain an Administrative Alcohol Permit before any alcoholic beverage can be possessed, served, or consumed in any public place. The Permit can be approved, conditionally approved, or denied by the City Manager or their designee. There are five bases for which a Permit could be denied, which are:
1. The applicant is not at least 21 years of age;
2. The application contains materially false or intentionally misleading information;

ENVIRONMENTAL REVIEW
The Ordinance and Policy are not a project under the requirements of the California Environmental Quality Act (“CEQA”) and the CEQA Guidelines because it has no potential for resulting in either a direct or reasonably foreseeable indirect change in the environment. If the Ordinance and Policy were found to be a project under CEQA, the action being considered is exempt from environmental review pursuant to CEQA Guidelines Section 15061(b)(3) in that the activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. The Ordinance and Policy, which would regulate Alcoholic Beverages in Public Places, would have no impact on the environment.
[1] The definition will match the State law definition of Alcoholic Beverage found in Bus. & Prof. Code section 23004. This definition defines Alcoholic Beverage to mean “includes alcohol, spirits, liquor, wine, beer, and every liquid or solid containing alcohol, spirits, wine, or beer, and which contains one-half of 1 percent or more of alcohol by volume and which is fit for beverage purposes either alone or when diluted, mixed, or combined with other substances.“ Alcoholic beverage” does not include “powdered alcohol,” as defined in Section 23003.1.”
FISCAL IMPACT
While the creation of this new administrative process generates administrative costs associated with processing and administering the Permit, the adoption of an application fee will mitigate the administrative costs.

RECOMMENDATION TO ADOPT RESOLUTION 005-2024 OF THE CITY COUNCIL OF
THE CITY OF HAWAIIAN GARDENS APPROVING THE REALLOCATING SPECIAL EVENT FUNDS TO SUPPORT THE 60TH ANNIVERSARY CARNIVAL AND PARADE
SUMMARY
Staff are proposing the budgeted funds from the Truck Show and Golf Tournament events for fiscal year 2023/2024 to be transferred to the Parade and Carnival events. Due to the increased cost of implementing a successful Parade and Carnival, we will need additional funds to cover items such as parade floats, entertainment, and other logistical and safety needs.
The parade is estimated to need approximately $25,000 in additional funds to assist with the rental of parade floats, vehicles, and possible entertainment/participation. The cost of parade floats has increased by 200% from years past, the vendor used in the past is no longer available. In addition, the Carnival will need additional funds due to the expansion from a 3-day carnival to a 4- day carnival. The funds will be used to help secure quality entertainment for all four days, road closures for 4 days and additional items. Entertainment for the Carnival is expected to increase to $60,000 in 2024. This includes additional entertainment throughout carnival and increased pricing from entertainers.
Funds to be transferred are from events that are still pending due to date conflicts or are not being held this fiscal year. Staff recommends the reallocation of the budget of the Golf Tournament and Truck Show budgets to the Parade and Carnival as we prepare to celebrate the 60TH Anniversary.

RECOMMENDATION TO AWARD A PROFESSIONAL SERVICES AGREEMENT TO
NICHOLS CONSULTING ENGINEERS (NCE) FOR PREPARATION OF THE
CITYWIDE PAVEMENT MANAGEMENT PROGRAM, SIDEWALK AND CURB RAMP
SURVEY, AND ASSET INVENTORY AND AUTHORIZE THE PUBLIC WORKS
MANAGER TO REQUEST ADDITIONAL PAVEMENT MANAGEMENT RELATED
SERVICES FROM THE CONSULTANT WITHIN THE BUDGETED AMOUNT
SUMMARY
The Pavement Management Program (PMP) is an essential tool in determining the condition, expected life, recommended improvements, and associated costs of the City’s pavement assets. The program enables the City to prioritize pavement rehabilitation projects where they are most cost effective.
The PMP is implemented by creating an inventory using historical construction data for all arterial and residential roadway networks within the City. The roadway inventory is then assessed in the field and a Pavement Condition Index (PCI) is evaluated for each roadway segment. The PCI is a numerical index between 0 and 100, with 100 representing the best possible pavement condition and 0 representing the worst possible pavement condition. The PCI is a critical factor used to develop the schedule for when roadways would need to be resurfaced or reconstructed. Local Jurisdictions are required by LACMTA to have comprehensive pavement data collected and updated for arterial and residential streets. The last update to the PMP program was done in August 2019.
On January 11, 2024, the Request for Proposal (RFP) for updating the City’s Pavement Management Program was prepared by engineering staff and advertised on the City’s website.
Agenda Item #C3
February 28, 2024
On February 1, 2024, the Public Works Department received three (3) Proposals from the following firms:
• Bucknam Infrastructure Group, Inc., of Oceanside, CA
• Infrastructure Management Services (IMS) of Largo, FL • Nichols Consulting Engineers (NCE) of Fountain Valley, CA The proposals were reviewed and evaluated based on general responsiveness to the City’s RFP, staff and firm experience with projects in similar size and scope of work, consultant’s approach/methodology, hours and level of effort, and ability to meet the City’s schedule and expectations.
After a thorough evaluation of all proposals by the engineering staff, NCE ranked the highest score among all the participants with a proposal amount of $34,500 for the preparation of the Citywide Pavement Management Program update.
NCE has extensive experience evaluating and implementing pavement management systems for numerous public agencies throughout California including Anaheim, Santa Ana, Baldwin Park, Diamond Bar, Carson, Burbank, Redondo Beach, Hermosa Beach, and San Diego cities.
NCE will use mobile data collection equipment to evaluate the pavement surface. This consists of modified vehicles with GPS-enabled detection, laser measuring system, and 360-degree imagery equipment that drive the streets and record pavement surface data.
In addition, NCE will assist the City in conducting a comprehensive analysis of the proposed software program and make recommendations for implementation to ensure that the software is the most effective for the City’s intended purpose.
In addition to the PMP update, the proposal also includes optional tasks for the Citywide sidewalk and curb ramp survey and condition evaluation for ADA compliance for an additional $16,800 and asset inventory preparation for signs, signposts, driveway approaches, curb and gutters, striping and pavement markings, curb markings, and utility boxes for an additional $20,800. The proposed services also include mapping and Geographic Information System (GIS) support.
Approval of this item including optional tasks supports the City’s effort to develop a complete inventory of all assets to determine the scope of improvements needed to sustain the City’s current infrastructure and ensure adequate funding for repair/and or replacement costs in future budgets.
Agenda Item #C3

FISCAL IMPACT
The project was included in the approved Capital Improvements Program budget for Fiscal Year 2023-24. Staff recommends that the City Council award a contract to NCE in an amount not to exceed $82,000/budgeted amount.

The CITY reserves the right to check references not only for those 5 stated in the RFP but also references from the CITY’s consultant evaluation reports. Reference information provided in the RFP found to be in error may be reflected as a reduction in the evaluation score.
7. CONSULTANT EVALUATION AND SELECTION PROCESS
The CITY will select a consultant for the project based on the following criteria:
a) The City will review all RFPs and award a contract, or contracts, based on a firm’s qualifications and what is most advantageous to the City.
b) The City may elect to interview a short list of qualified firms or to interview only the top rated firm based upon RFPs submitted for the project. c) City may request consultants, who appear to be most qualified for this project, to participate in a brief oral interview and presentation of their proposal.
d) Most qualified, based on personnel and previous experience with this type of project.
e) Proposed scope of services, and demonstration of an approach to the project, that is most beneficial to the City.
f) Effective use of resources and man-hours proposed for the project. g) The City staff will negotiate a contract with the best qualified firm for the desired consulting services. In the event City staff is unable to negotiate a satisfactory contract with the firm considered to be the most qualified, negotiations with that firm shall be formally terminated.
Negotiations will then be undertaken with the next most qualified firm.
Failing accord with the second most qualified firm, the City staff will terminate negotiations and continue the negotiation process with the next most qualified firms in order of their evaluation ranking until an agreement is reached, and a firm is selected and an agreement is executed.

Paperwork Reduction Act Statement - This information collection meets the requirements of 44 USC § 3507, as amended by section 2 of the Paperwork Reduction Act of 1995. You do not need to answer these questions unless we display a valid Office of Management and Budget (OMB) control number.
The OMB control number for this collection is 9000-0157. We estimate that it will take 29 hours (25 hours for part 1 and 4 hours for Part 2) to read the instructions, gather the facts, and answer the questions. Send only comments relating to our time estimate, including suggestions for reducing this burden, or any other aspects of this collection of information to: U.S. General Services Administration, Regulatory Secretariat Division (M1V1CB), 1800 F Street, NW, Washington, DC 20405.
PURPOSE
Federal agencies use this form to obtain information from architect-engineer (A-E) firms about their professional qualifications. Federal agencies select firms for A-E contracts on the basis of professional qualifications as required by 40 U.S.C. chapter 11, Selection of Architects Engineers, and Part 36 of the Federal Acquisition Regulation (FAR).
The Selection of Architects and Engineers statute requires the public announcement of requirements for A-E services (with some exceptions provided by other statutes), and the selection of at least three of the most highly qualified firms based on demonstrated competence and professional qualifications according to specific criteria published in the announcement.
The Act then requires the negotiation of a contract at a fair and reasonable price starting first with the most highly qualified firm.
The information used to evaluate firms is from this form and other sources, including performance evaluations, any additional data requested by the agency, and interviews with the most highly qualified firms and their references.
GENERAL INSTRUCTIONS
Part I presents the qualifications for a specific contract.
Part II presents the general qualifications of a firm or a specific branch office of a firm. Part II has two uses:
1. An A-E firm may submit Part II to the appropriate central, regional or local office of each Federal agency to be kept on file.
A public announcement is not required for certain contracts, and agencies may use Part II as a basis for selecting at least three of the most highly qualified firms for discussions prior to requesting submission of Part I. Firms are encouraged to update Part II on file with agency offices, as appropriate, according to FAR Part
36. If a firm has branch offices, submit a separate Part II for each branch office seeking work.
2. Prepare a separate Part II for each firm that will be part of the team proposed for a specific contract and submitted with Part I. If a firm has branch offices, submit a separate Part II for each branch office that has a key role on the team.
INDIVIDUAL AGENCY INSTRUCTIONS
Individual agencies may supplement these instructions. For example, they may limit the number of projects or number of pages submitted in Part I in response to a public announcement for a particular project. Carefully comply with any agency instructions when preparing and submitting this form. Be as concise as possible and provide only the information requested by the agency.

As additional consideration, CONTRACTOR and CITY agree to abide by the terms and conditions contained in this Agreement.
As additional consideration, CITY agrees to pay CONTRACTOR An amount not to exceed [INSERT TOTAL AMOUNT OF AGREEMENT] during the term of the Agreement as specified in paragraph 7 below, for CONTRACTOR’s services, unless otherwise specified by written amendment to this Agreement.
No additional compensation shall be paid for any other expenses incurred, unless first approved by the City Manager or his/her designee.
CONTRACTOR shall submit to CITY, by not later than the 10th day of each month, its invoice for services itemizing the fees and costs incurred during the previous month. CITY shall pay CONTRACTOR all uncontested amounts set forth in CONTRACTOR’s invoice within 30 days after it is received.

Except as herein otherwise expressly specified to be furnished by CITY, CONTRACTOR will, in a professional manner, furnish all of the labor, technical, administrative, professional and other personnel, all supplies and materials, equipment, printing, vehicles, transportation, office space, and facilities necessary or proper to perform and complete the work and provide the professional services required of CONTRACTOR by this Agreement.
PAYMENTS. For CITY to pay CONTRACTOR as specified by this Agreement, CONTRACTOR must submit an invoice to CITY which lists the reimbursable costs, the specific tasks performed, and, for work that includes deliverables, the percentage of the task completed during the billing period in accordance with the schedule of compensation incorporated in “Exhibit A.” TIME OF PERFORMANCE. The services of the CONTRACTOR are to commence upon receipt of a notice to proceed from the CITY and shall continue until all authorized work is completed to the CITY’s reasonable satisfaction, in accordance with the schedule incorporated in “Exhibit A,” unless extended in writing by the CITY.
FAMILIARITY WITH WORK. By executing this Agreement, CONTRACTOR represents that CONTRACTOR has (a) thoroughly investigated and considered the scope of services to be performed; (b) carefully considered how the services should be performed; and (c) understands the facilities, difficulties, and restrictions attending performance of the services under this Agreement.
KEY PERSONNEL. CONTRACTOR’s key person assigned to perform work under this Agreement is [NAME OF CONTACT]. CONTRACTOR shall not assign another person to be in charge of the work contemplated by this Agreement without the prior written authorization of the CITY.

CHANGES. CITY may order changes in the services within the general scope of this Agreement, consisting of additions, deletions, or other revisions, and the contract sum and the contract time will be adjusted accordingly. All such changes must be authorized in writing, executed by CONTRACTOR and CITY. The cost or credit to CITY resulting from changes in the services will be determined in accordance with written agreement between the parties.
TAXPAYER IDENTIFICATION NUMBER. CONTRACTOR will provide CITY with a Taxpayer Identification Number.
PERMITS AND LICENSES. CONTRACTOR will obtain and maintain during the term of this Agreement all necessary permits, licenses, and certificates that may be required in connection with the performance of services under this Agreement.
TERMINATION. Except as otherwise provided, CITY may terminate this Agreement at any time with or without cause. Notice of termination shall be in writing.
CONTRACTOR may terminate this Agreement. Notice will be in writing at least 30 days before the effective termination date.
In the event of such termination, the CONTRACTOR shall cease services as of the date of termination, and all finished or unfinished documents, data, drawings, maps, and other materials prepared by CONTRACTOR shall, at CITY’s option, become CITY’s property, and CONTRACTOR will receive just and equitable compensation for any work satisfactorily completed up to the effective date of notice of termination.
Should the Agreement be terminated pursuant to this Section, CITY may procure services similar to those terminated without restriction by this Agreement.
INDEMNIFICATION. CONTRACTOR shall indemnify, defend with counsel approved by CITY, and hold harmless CITY, its officers, officials, employees and volunteers from and against all liability, loss, damage, expense, and cost (including without limitation reasonable attorneys fees, expert fees and all other costs and fees of litigation) of every nature arising out of or in connection with CONTRACTOR's performance of work hereunder or its failure to comply with any of its obligations contained in this AGREEMENT, regardless of CITY’S passive negligence, but excepting such loss or damage which is caused by the sole active negligence or willful misconduct of the CITY. Should CITY in its sole discretion find CONTRACTOR’S legal counsel unacceptable, then CONTRACTOR shall reimburse the CITY its costs of defense, including without limitation reasonable attorneys fees, expert fees and all other costs and fees of litigation. The CONTRACTOR shall promptly pay any final judgment rendered against the CITY (and its officers, officials, employees and volunteers) covered by this indemnity obligation. It is expressly understood and agreed that the foregoing provisions are intended to be as broad and inclusive as is permitted by the law of the State of California and will survive termination of this Agreement.
The requirements as to the types and limits of insurance coverage to be maintained by CONTRACTOR as required by Section 17, and any approval of said insurance by CITY, are not intended to and will not in any manner limit or qualify the liabilities and obligations otherwise assumed by CONTRACTOR pursuant to this Agreement, including, without limitation, to the provisions concerning indemnification.
ASSIGNABILITY. This Agreement is for CONTRACTOR’s professional services.
CONTRACTOR’s attempts to assign the benefits or burdens of this Agreement without CITY’s written approval are prohibited and will be null and void.
INDEPENDENT CONTRACTOR. CITY and CONTRACTOR agree that CONTRACTOR will act as an independent contractor and will have control of all work and the manner in which is it performed.
CONTRACTOR will be free to contract for similar service to be performed for other employers while under contract with CITY. CONTRACTOR is not an agent or employee of CITY and is not entitled to participate in any pension plan, insurance, bonus or similar benefits CITY provides for its employees.
Any provision in this Agreement that may appear to give CITY the right to direct CONTRACTOR as to the details of doing the work or to exercise a measure of control over the work means that CONTRACTOR will follow the direction of the CITY as to end results of the work only.
AUDIT OF RECORDS. CONTRACTOR agrees that CITY, or designee, has the right to review, obtain, and copy all records pertaining to the performance of this Agreement. CONTRACTOR agrees to provide CITY, or designee, with any relevant information requested and will permit CITY, or designee, access to its premises, upon reasonable notice, during normal business hours for the purpose of interviewing employees and inspecting and copying such books, records, accounts, and other material that may be relevant to a matter under investigation for the purpose of determining compliance with this Agreement. CONTRACTOR further agrees to maintain such records for a period of three (3) years following final payment under this Agreement.
CONTRACTOR will keep all books, records, accounts and documents pertaining to this Agreement separate from other activities unrelated to this Agreement.
CORRECTIVE MEASURES. CONTRACTOR will promptly implement any corrective measures required by CITY regarding the requirements and obligations of this Agreement. CONTRACTOR will be given a reasonable amount of time as determined by the CITY to implement said corrective measures.
Failure of CONTRACTOR to implement required corrective measures shall result in immediate termination of this Agreement.
INSURANCE REQUIREMENTS.
A. The CONTRACTOR, at the CONTRACTOR’s own cost and expense, shall procure and maintain, for the duration of the contract, the following insurance policies:
1. Workers Compensation Insurance as required by law. The CONTRACTOR shall require all subcontractors similarly to provide such compensation insurance for their respective employees.
Any notice of cancellation or non-renewal of all Workers’ Compensation policies must be received by the CITY at least thirty (30) days prior to such change. The insurer shall agree to waive all rights of subrogation against the CITY, its officers, agents, employees, and volunteers for losses arising from work performed by the CONTRACTOR for CITY.
2. General Liability Coverage. The CONTRACTOR shall maintain commercial general liability insurance in an amount of not less than two million dollars ($2,000,000) per occurrence for bodily injury, personal injury, and property damage. If a commercial general liability insurance form or other form with a general aggregate limit is used, either the general aggregate limit shall apply separately to the work to be performed under this Agreement or the general aggregate limit shall be at least twice the required occurrence limit.
3. Automobile Liability Coverage. The CONTRACTOR shall maintain automobile liability insurance covering bodily injury and property damage for all activities of the CONTRACTOR arising out of or in connection with the work to be performed under this Agreement, including coverage for owned, hired, and non-owned vehicles, in an amount of not less than one million dollars ($1,000,000) combined single limit for each occurrence.
4. Professional Liability Coverage. The CONTRACTOR shall maintain professional errors and omissions liability insurance for protection against claims alleging negligent acts, errors, or omissions which may arise from the CONTRACTOR’S operations under this Agreement, whether such operations be by the CONTRACTOR or by its employees, subcontractors, or subcontractors. The amount of this insurance shall not be less than one million dollars ($1,000,000) on a claims-made annual aggregate basis, or a combined single-limit-peroccurrence basis. When coverage is provided on a “claims made basis,” CONTRACTOR will continue to renew the insurance for a period of three (3) years after this Agreement expires or is terminated. Such insurance will have the same coverage and limits as the policy that was in effect during the term of this Agreement, and will cover CONTRACTOR for all claims made by CITY arising out of any errors or omissions of CONTRACTOR, or its officers, employees or agents during the time this Agreement was in effect.
B. Endorsements. Each general liability, automobile liability and professional liability insurance policy shall be issued by a financially responsible insurance company or companies admitted and authorized to do business in the State of California, or which is approved in writing by CITY, and shall be endorsed as follows. CONTRACTOR also agrees to require all contractors, and subcontractors to do likewise.
1. “The CITY, its elected or appointed officers, officials, employees, agents, and volunteers are to be covered as additional insureds with respect to liability arising out of work performed by or on behalf of the CONTRACTOR, including materials, parts, or equipment furnished in connection with such work or operations.”
2. This policy shall be considered primary insurance as respects the CITY, its elected or appointed officers, officials, employees, agents, and volunteers. Any insurance maintained by the CITY, including any self-insured retention the CITY may have, shall be considered excess insurance only and shall not contribute with this policy.
3. This insurance shall act for each insured and additional insured as though a separate policy had been written for each, except with respect to the limits of liability of the insuring company.
4. The insurer waives all rights of subrogation against the CITY, its elected or appointed officers, officials, employees, or agents.
5. Any failure to comply with reporting provisions of the policies shall not affect coverage provided to the CITY, its elected or appointed officers, officials, employees, agents, or volunteers.
6. The insurance provided by this policy shall not be suspended, voided, canceled, or reduced in coverage or in limits except after thirty (30) days written notice has been received by the CITY.
C. CONTRACTOR agrees to provide immediate notice to CITY of any claim or loss against Contractor arising out of the work performed under this agreement. CITY assumes no obligation or liability by such notice, but has the right (but not the duty) to monitor the handling of any such claim or claims if they are likely to involve CITY.
D. Any deductibles or self-insured retentions must be declared to and approved by the CITY. At the CITY’s option, the CONTRACTOR shall demonstrate financial capability for payment of such deductibles or self-insured retentions.
E. The CONTRACTOR shall provide certificates of insurance with original endorsements to the CITY as evidence of the insurance coverage required herein. Certificates of such insurance shall be filed with the CITY on or before commencement of performance of this Agreement. Current certification of insurance shall be kept on file with the CITY at all times during the term of this Agreement.
F. Failure on the part of the CONTRACTOR to procure or maintain required insurance shall constitute a material breach of contract under which the CITY may terminate this Agreement pursuant to Section 11 above.
G. The commercial general and automobile liability policies required by this Agreement shall allow CITY, as additional insured, to satisfy the self-insured retention (“SIR”) and/or deductible of the policy in lieu of the CONTRACTOR (as the named insured) should CONTRACTOR fail to pay the SIR or deductible requirements. The amount of the SIR or deductible shall be subject to the approval of the City Attorney and the Finance Director. CONTRACTOR understands and agrees that satisfaction of this requirement is an express condition precedent to the effectiveness of this Agreement. Failure by CONTRACTOR as primary insured to pay its SIR or deductible constitutes a material breach of this Agreement. Should CITY pay the SIR or deductible on CONTRACTOR’s behalf upon the CONTRACTOR’s failure or refusal to do so in order to secure defense and indemnification as an additional insured under the policy, CITY may include such amounts as damages in any action against CONTRACTOR for breach of this Agreement in addition to any other damages incurred by CITY due to the breach.
USE OF OTHER CONTRACTORS. CONTRACTOR must obtain CITY’s prior written approval to use any sub-contractors while performing any portion of this Agreement. Such approval must include approval of the proposed CONTRACTOR and the terms of compensation.
FINAL PAYMENT ACCEPTANCE CONSTITUTES RELEASE. The acceptance by the CONTRACTOR of the final payment made under this Agreement shall operate as and be a release of the CITY from all claims and liabilities for compensation to the CONTRACTOR for anything done, furnished or relating to the CONTRACTOR’S work or services. Acceptance of payment shall be any negotiation of the CITY’S check or the failure to make a written extra compensation claim within ten (10) calendar days of the receipt of that check. However, approval or payment by the CITY shall not constitute, nor be deemed, a release of the responsibility and liability of the CONTRACTOR, its employees, sub-contractors and agents for the accuracy and competency of the information provided
and/or work performed; nor shall such approval or payment be deemed to be an assumption of such responsibility or liability by the CITY for any defect or error in the work prepared by the CONTRACTOR, its employees, sub-contractors and agents.
CORRECTIONS. In addition to the above indemnification obligations, the CONTRACTOR shall correct, at its expense, all errors in the work which may be disclosed during the CITY’s review of the CONTRACTOR’s report or plans. Should the CONTRACTOR fail to make such correction in a reasonably timely manner, such correction shall be made by the CITY, and the cost thereof shall be charged to the CONTRACTOR. In addition to all other available remedies, the CITY may deduct the cost of such correction from any retention amount held by the CITY or may withhold payment otherwise owed CONTRACTOR under this Agreement up to the amount of the cost of correction.
NON-APPROPRIATION OF FUNDS. Payments to be made to CONTRACTOR by CITY for services preformed within the current fiscal year are within the current fiscal budget and within an available, unexhausted fund. In the event that CITY does not appropriate sufficient funds for payment of CONTRACTOR’S services beyond the current fiscal year, the Agreement shall cover payment for CONTRACTOR’S services only to the conclusion of the last fiscal year in which CITY appropriates sufficient funds and shall automatically terminate at the conclusion of such fiscal year.

The amount of this insurance shall not be less than one million dollars ($1,000,000) on a claims-made annual aggregate basis, or a combined single-limit-per-occurrence basis.
However, approval or payment by the CITY shall not constitute, nor be deemed, a release of the responsibility and liability of the CONTRACTOR, its employees, sub-contractors and agents for the accuracy and competency of the information provided and/or work performed; nor shall such approval or payment be deemed to be an assumption of such responsibility or liability by the CITY for any defect or error in the work prepared by the CONTRACTOR, its employees, sub-contractors and agents.

Scope of Work
Project Understanding
NCE understands that the City of Hawaiian Garden (City) is seeking proposals from consulting firms with expertise in developing, implementing, and/or preparing updates for a pavement management program (PMP). A comprehensive PMP will be critical in assisting the City in developing funding scenarios as well as multi-year budget and treatment plans that are practical and cost-effective. An updated PMP will also allow the City to comply with LA Metro Proposition C requirement, which requires agencies to update the PMP every three (3) years.
Ideally, the PMP is used to prepare a multi-year maintenance plan, which consists of a rotating maintenance schedule using consolidation of treatments versus rehabilitation and zone improvement approaches. These approaches are used by many cities, as it reduces construction costs by creating more aggressive bidding and reducing mobilization and minimizing disruptions to businesses and residents. NCE has performed similar analyses for numerous agencies in Southern California.
The City currently manages its street network of approximately 18 centerline miles of streets and alleys using a detailed inventory of street segments to determine pavement condition and develop its maintenance and resurfacing program.
The PMP will provide the City’s policymakers and asset management experts with the following key pieces of information:
1. Updated inventory of the City’s current pavement network, including condition and attribute information of sectionalized street segments, such as to/from locations, functional class, length, width, area, number of lanes, etc.
2. The current Pavement Condition Index (PCI) of the entire network and by functional class.
3. Recommendations for future maintenance and rehabilitation (M&R) strategy based on discussions between NCE and the City’s asset management professionals.
4. A five-year workplan based on various funding and treatment scenarios, which will show the Council and the public the most cost-effective manner of spending the City’s tax revenue and newer revenue sources such as SB1.
5. A long-term funding analysis to determine future needs which will help guide the City Council in making informed policy decisions and achieve PCI goals.
The following sections provide NCE’s scope of work and proposed schedule to complete the work.
Scope of Work
NCE has assembled a team of highly experienced individuals who have implemented PMP’s and updates throughout Southern California. The NCE team will be led by Mr. Vivek Jha, MS, PE, who will be responsible for day-to-day project management.
Task A: Project Management and Meetings
NCE will first meet with City staff to kick off the project and review and discuss the technical approach (covering both field and office work) and any administrative matters as may be necessary. At a minimum, items to be discussed will include the following:
•
•
•
•
•
Scope of work, project schedule, budget, and invoicing requirements.
Points of contacts.
Available street inventory or GIS map if any.
Monthly Progress Reports.
Field work (scheduling and access requirements for field work; public safety concerns, requirements and procedures; and Quality Control Plan (QCP).
In addition to the kick-off meeting, NCE will schedule additional meetings with City staff at appropriate milestones to review work performed, update survey progress, and address any questions or issues that arise if needed. After the kickoff meeting, NCE will prepare a draft Quality Control Plan and submit it to the City for review.
Deliverables

City of Hawaiian Gardens
2024 Pavement Management Program Services
• Agenda and summary of meetings; Draft Quality Control Plan.
Task B: Set-Up PMP Database
As part of this Task, NCE will create an inventory of the City’s existing street network. This will include the following items:
•
•
•
•
•
•
•
•
•
Obtaining GIS Maps for the City’s street Network or from the County website.
Determining the functional classification of each street within City’s street network.
Sectionalizing streets into homogeneous pavement sections.
Linking pavement management sections in selected PMP software to GIS shapefiles.
Setting up user-defined fields as desired.
Standardizing parameters for streets names and suffixes.
Obtaining original construction dates.
Determining surface types.
Determining lengths and widths of sections.
Based on our previous conversation with the City staff, the City would like to have the option to determine the network PCI at more frequent intervals (every 6 months) or after a major maintenance or rehabilitation project is completed. To accomplish this objective our team proposes the City to use StreetSaver® as their PMP software. However, as the cost associated with StreetSaver® is high, we have also provided the cost of implementing PAVER™ as the City’s PMP software.
Compared to StreetSaver®, PAVER™ does not have a live dashboard which provides information on the existing PCI of any street or the network at any given time. See cost proposals with assumptions of different inspection methods and PMP software.
Irrespective of the PMP software the City decides to use, when populating the PMP software, we will ensure that the pavement management sections align with the existing sections i.e. blocks. We have helped numerous agencies to populate the StreetSaver® database to be consistent with the City's preferences.
If the City chooses to use StreetSaver®, we can add up to 6 additional GIS layers to the StreetSaver® database at time of GIS mapping integration with no additional cost. These layers can include information like council districts and work zones, among others. Our team will collaborate with the City staff to determine which additional layers will be most beneficial from the development of an annual street rehabilitation program perspective.
Please note that we have assumed that the City will provide NCE with the GIS shapefiles showing the streets and alleys within the City’s jurisdiction. If the City does not have GIS shapefile available, then NCE will download the shapefile from the LA County Website. Additionally, our cost is based on 18 centerline miles of streets and alleys. The image to the right shows the example of a work zone based rotating maintenance schedule that NCE worked on for the City of Diamond Bar. Please note that creating new work zones is not part of our scope of work. However, we can assist the City in developing new work zones at an extra cost if needed.
Lastly, as this task will have a huge impact on this project and future projects, we have allocated two (2) weeks for this task. This is based on our extensive experience setting up the PMP database using a custom GIS shapefile (similar to what we will perform for the City) for numerous other agencies. Please note our proposal does not include the cost of an annual StreetSaver® subscription or PAVER™ costs.
Deliverables
• One-Year StreetSaver License; Uploading GIS Shapefile with up to 6 GIS Layers; Populated PMP database with inventory, linked pavement sections to GIS shapefile.

Task C: Pavement Condition Surveys
NCE’s MTC and OCTA certified inspectors will inspect the 18 centerline miles of City maintained streets and alleys using ASTM D6433 protocols. The evaluation of the pavement surface distress is based on three components:
•
•
•
Type is defined as ‘What kind of crack or defect is it?’ based on environmental distresses (e.g., block, longitudinal/transverse cracking, weathering) or load related distresses (e.g., alligator cracking, rutting).
Severity is defined as ‘How bad is the defect?’ in terms of the measurement or degree of wear associated with the condition.
Extent refers to quantity or ‘How much?’ of the pavement is affected by a particular distress.
As part of this proposal, we have provided options for using either windshield or fully-automated surveys. The primary advantage of the automated method is that it involves surveying ~100% of the City’s network for a similar cost under safer conditions and in comparatively less time in the field. Our team (NCE and märker) is well-practiced in collecting, measuring, and mapping all roadway data with a sophisticated automated approach using pavement laser scanners. In addition, our team complements this automated process with MTC-certified inspectors in our survey vehicle to identify and confirm all pavement distress data by using our on-board surface distress recording subsystem. One survey pass per pavement section will be performed on one to two lane
streets. Additional passes will be performed on streets with three or more lanes or divided streets (see survey coverage area in the illustration to the right).
Irrespective of the data collection method, the
pavement condition inspection will be performed per
ASTM D6433, “Standard Practice for Roads and Parking
Lots Pavement Condition Index Surveys”. A minimum
of one sample unit per section will be inspected. Any
areas which are not typical for the entire section will be inspected and recorded as a special sample unit.
Under both approaches, our team will also determine
the ride quality of the streets. Please note that as part of the windshield survey, the ride quality will be a subjective assessment by an experienced inspector while the automated approach will provide the international roughness index (IRI).
NCE will be responsible for providing the equipment necessary for the performance of this task. Should City personnel wish to observe NCE’s crews during the inspections, they can accompany NCE’s field crews for up to ½ day – to gain hands-on training at no additional cost to the City. We have found that this is the most effective training method for agency staff, as they become part of the data collection crew, rather than just an observer.
NCE’s pavement inspectors have undergone a rigorous certification test through both the Orange County Transportation Authority’s (OCTA) and the Metropolitan Transportation Commission (MTC) “Inspector Certification/Testing” programs. These cover both ASTM D6433 and StreetSaver® distress protocols.
In addition, märker is also certified by the Metropolitan Transportation Commission (MTC) “Automated Rating Vendor Certification” program.
Please note that NCE’s scope of work and condition surveys do not address issues including but not limited to traffic, safety and road hazards, geometric issues, road shoulders, sidewalks, curb and gutters, drainage issues or short-term maintenance that should be performed.

2024 Pavement Management Program Services
Quality Control Plan – Effective pavement management involves implementing quality management practices that go beyond a one-time survey of the final data. Relying solely on such surveys poses a high risk of failure. To ensure superior quality for our clients, NCE incorporates a Quality Control (QC) component into all our projects. Please refer to Appendix C for a Sample QC Plan. For this particular project, we have proposed the appointment of a QC/QA Manager, Dr. Mei-Hui Lee, PhD, PE. She will oversee the following project responsibilities.:
•
•
•
•
•
•
Calibration of all data collection activities.
Review of field activities, including spot checks on the field crews.
Review field procedures and making changes as needed.
Compare the field data collected with on-site conditions.
Review of all data entry functions, including random spot checks.
Review of reports generated, and analyses performed to ensure a quality product.
NCE’s QC/QA Plan provides for a minimum of 5% of the field data to be re-inspected by a different inspector. A comparison of the distresses (type, severity, and quantity) will be made and at least 95% of re-inspected sections must be in compliance.
Deliverables
• PMP database with distress data; PCI Calculation; PCI listing report.
Task D: Maintenance and Rehabilitation (M&R) History, Decision Tree, Unit Cost, and Budget Analysis
M&R History – As part of this task, NCE will review the list of street segments and pavement treatments for the last five (5) years (to be provided by the City). Recent M&R historical data is extremely useful to present accurate pavement conditions and predict future performance.
M&R activities (e.g., overlays and reconstructions) that have occurred within the last five years will be entered into the StreetSaver® database.
The City will need to provide the M&R historical records in the following format: street name and identifiers; beginning and ending limits of work; type of treatment; and date of treatment.
In addition, NCE will update completed project lists into selected PMP software for the next five years. Assume City will provide the information for the database update.
Decision Tree and Unit Cost – NCE's expertise in civil and pavement engineering makes us well-suited to help the City create an M&R decision tree. We will work with City staff to identify past successful treatments and explore rehabilitation treatments like cold in-place recycling and asphalt rubber overlays. Once the M&R alternatives are defined, we will determine treatment unit costs for each alternative and ensure accuracy by reviewing recent bid tabs and neighboring cities' unit prices. Our unit prices will be fully loaded rates and will include not just contractors’ prices but also design, inspection, and testing costs.
Budgetary Analysis – NCE will perform a Budget need analysis using an analysis period of five years (can be as many as 30). This task will identify M&R requirements for each street section and determine the total M&R requirements over the entire analysis period. The costs are then summed up for the entire period. This forms the basis for performing Budget Scenario evaluations, which optimize the street sections for repair under constrained budgets.
P a g e | 4
City of Hawaiian Gardens
2024 Pavement Management Program Services
Simply put, the Budget-Need analysis answers these questions:
“If I have unconstrained funding to meet my PCI goals, which streets should I fix? When should I fix them?
What treatments should I apply?
How much will it cost?”
The Budget Scenarios evaluation prioritizes road sections for repair under constrained, realistic, budgetary assumptions.
A minimum of five budget- or target-driven scenarios will be performed after discussions with City staff. The budget analysis will focus on how different scenarios impact the PCI over time and how much (if any) additional funding is required to achieve the target PCI goals (determined by the City) for each scenario. Examples of typical scenarios include:
•
•
•
•
Future pavement condition based on historical funding of pavement maintenance.
Impact of drops and/or increases in existing funding on network PCI.
Funding levels necessary to maintain current network PCI.
Funding level necessary to improve current network PCI.
In simplistic terms, the Budget Scenario answers the questions:
“If I only have limited funds for road maintenance and repair, which streets have the highest priority? When should I perform the repairs?
How much will it cost?”
Deliverables
• M&R history report; Virtual meeting to discuss treatment alternatives and costs; Results from various budget scenarios.
• Update City’s PMP with annual M&R updates and provide the updated PCI of the Network once a year for 5 years.
Task E: Report
Based on discussion with the project team (NCE and City staff), a preferred scenario will be recommended. The results from the preferred scenario will be used to develop a five-year
rehabilitation program. Upon completion of the analyses, NCE will prepare a Draft Report for the City to review. Following the City’s review of the Draft Plan, NCE will prepare a Final Report.
The Final Report (see sample in Appendix C) will be a single comprehensive document with appendices that clearly and concisely contains all relevant findings, observations, and recommendations. The report and its exhibits will be presented legibly. The report charts and map exhibits will have distinguishable color gradations. At a minimum, the Final report will contain the following components:
•
•
•
Executive Summary outline complete report.
Methodologies utilized for field surveys and budget analysis.
Current overall pavement conditions (PCI):
o Condition distribution by functional road classification. o Condition distribution by percent of roadway network. o Condition comparison with other cities in region and state. • Projected annual repair/rehabilitation road maintenance programs over a 5-year period.

Quality Management Plan document (see sample in Appendix C).
Deliverables
• Draft Report within 4 months from NTP; Virtual meeting to discuss draft report; and Final Report within 5 months from NTP; One Council Presentation; Virtual 2-hour training on basic StreetSaver Training Task F: Sidewalk and Curb Ramp Survey (OPTIONAL)
As optional task, NCE will perform a survey of the City’s existing sidewalk network and also analyze the curb ramps to determine compliance with the American with Disabilities Act (ADA). Using our prior experience with these projects for Cities in Southern California, NCE will recommend the City distress criteria (faulting, vaulting, and cracking) for the sidewalk condition evaluation. The curb ramps will be surveyed for ADA compliance and include mid-block ramps.
The assessment will also include the identification of priority areas such as those that are close to pedestrian centers, such as schools, hospitals, etc. Once the sidewalks are assessed, NCE will rank the severity of the problem areas using criteria developed in conjunction with City staff and document the areas with photographs. The deficiencies identified, located, and assessed for severity, including tripping hazards and appropriate recommendations for repair provided. A summary report will be provided with the overall condition of the City’s sidewalks, and curb ramps, and recommendations for a five-year completion plan.
The summary report will contain the following:
•
•
•
•
•
•
Executive Summary.
Description of methodology for inspection.
Description of survey criteria used.
Summaries of existing condition of sidewalks and curb ramps.
Repair strategies with estimated costs (Excel spreadsheet) Tables containing:
o Condition assessment of sidewalks, curb and gutter, and curb ramps. o Prioritized list of locations and repairs.
o Cost estimate to perform repairs.
o Citywide maps showing locations of deficiencies.
Deliverables
• Tables and Shapefiles showing all the location of deficiencies and repairs; 5-year CIP Plan aligned with Street Rehab Program; Summary Report
Task G: Asset Inventory (OPTIONAL)
In this optional task, NCE will perform an asset inventory for the entire City network. For cost effective purposes, NCE will perform this task using Artificial Intelligence-Machine Learning (AI-ML) approach and perform a manual QC to obtain 95% reliability. The following assets can be inventoried by NCE. •
•
•
•

Deliverables
• Shapefile with all asset inventory and images; Memo Report Task H – Multi-Year Focus Plan (OPTIONAL)
As part of this task, NCE will develop a focused Multi-Year M&R Work Plan; the PCI plays a role in treatment selection, but for design purposes, confirmation and refinement of proposed treatments must be performed as well as consideration of base repair quantities, aggregation or re-grouping of streets to maximize construction savings, separation/combination of surface seal or rehabilitation paving programs, and cost to comply with complete and green street policies. The multi-year plan will only be developed for the preferred scenarios selected by the City and will be developed for three fiscal years.
The criteria for various funding sources available to the City will be considered when selecting streets in the Work Plan.
NCE will perform focused field reviews to identify the items listed below for streets selected by the PMP software for the preferred scenario. Before developing the work plan, NCE staff will meet the City staff in the field to determine their priorities and objectives in determining the rehabilitation treatment and repair criteria. Our scope includes one additional meeting to finalize the multi-year plan. The Work Plan elements include:
•
•
Verify treatment type and project limits.
Identify approximate base repair percentage or mark digouts in the field.
•
•
Identify number of Americans with Disabilities Act (ADA) ramp upgrades triggered by proposed treatments.
Identify potential tripping hazards area caused by tree roots or surface materials build-up area near the pavement edge.
Tripping hazards area locations (house address or distance to intersection) would be recorded in the field review.
Identify alternative newer technologies (CIR, FDR, etc.) and/or alternative surface seal treatments on cul-de-sac areas.
Identify excessive cracking problems and propose alternative treatments as appropriate. •
•
NCE will generate enough candidate streets for grouping, consolidation, removing outliers, and determining other conflicts. Based on the criteria agreed upon with the City, pavement maintenance strategies, and field observations, the sections selected would be grouped together geographically to produce continuous sections for treatment to minimize inefficiencies with shorter and isolated street segments and reduce construction costs and traffic impacts.
If there is a budget surplus or a need to update the decision tree based on the multi-year focus plan, NCE will re-run the preferred scenario budget analysis to incorporate the findings from the site visits/multi-year focus plan.
