DATE: March 27, 2024
TO: Honorable Mayor and Members of the City Council
FROM: Ernesto Marquez, City Manager
BY: Elise McCaleb, Community Development Director
Celina Estrada, Community Development Technician
RECOMMENDATION:

SUMMARY
The City of Hawaiian Gardens Public Housing Authority created a City Beautification Program for exterior improvements for single-family, duplex, and mobile homes, and interior improvements for condominiums. The Program is currently funded through the Hawaiian Gardens Public Housing Authority and the General Fund. This report is an update on General Fund expenditures.

The intent of the Program is to improve the overall appearance of the City of Hawaiian Gardens’ neighborhoods, increase property values, and increase community pride. The improvements on the homes must be deemed beneficial to the overall exterior appearance of the property and address deteriorated and unsightly conditions visible from the street. Financial assistance up to a maximum of $10,000 is provided to property owners and up to $25,000 for substandard cases through a grant. There is also a $2,500 grant available for emergency cases.

RECOMMENDATION:

RECOMMENDATION TO DECLARE THE 1996 MQ WHISPERWATT GENERATOR WITH TRAILER AND 2004 TENNANT 6650 SWEEPER AS SURPLUS AND

AUTHORIZE CITY MANAGER TO SELL OR DISPOSE AS NECESSARY

SUMMARY
The Public Works Department relies on vital equipment as part of operations. Two such pieces of equipment are the 1996 MQ WhisperWatt mobile generator, as part of emergency preparedness, and the 2004 Tennant 6650 Sweeper. After years of use, they were earmarked for replacement as parts became obsolete, increased repair costs, and both became unreliable with frequent breakdowns.

In anticipation of decommissioning the equipment, the City Council allocated funding in the FY 2023-25 budget to procure replacement equipment. Following a thorough acquisition process, a new mobile generator and sweeper were acquired and promptly put into operation.

Municipal Code Section 3.12.120 permits equipment no longer in service to be declared surplus and outlines the process to dispose of it.

Due to the condition of the old equipment listed, staff recommends the City Council declare the MQ WhispeWatt generator (serial number 3403685 with trailer license plate number SE492084) and Tennant 6650 sweeper equipment as surplus and authorize the City Manager or designee to sell, donate or dispose of the mentioned equipment in their current "as is" condition.

RECOMMENDATION:

RECOMMENDATION TO APPROVE THE FIRST AMENDMENT TO EXTEND THE

PROFESSIONAL SERVICES AGREEMENT BETWEEN THE CITY OF HAWAIIAN

GARDENS AND MUNIENVIRONMENTAL PROFESSIONAL CONSULTANTS TO

PERFORM SOLID WASTE AND RECYCLING CONSULTING SERVICES FOR A

PERIOD OF THREE YEARS

SUMMARY
On October 7, 2017, the City Council adopted Resolution No.077-2017 approving the Profession Services Agreement (PSA) between the City of Hawaiian Gardens and MuniEnvironmental, LLC to provide professional solid waste and recycling consulting services.

The MuniEnvironmental, LLC has been the solid waste and recycling consultant for the City for the past six (6) years and has assisted the City in developing a Solid Waste Request for Proposal (RFP), solid waste franchise negotiations, new programs of recycler permitting and reporting, updating the City Ordinances, and developing new solid waste and recycling programs that meet CalRecycle’s regulatory requirements.

As the State of California strives to reach the recycling goal of 75%, each local municipality is required to enact new programs of recycling and diversion. Legislation such as Mandatory Commercial Recycling (AB 341) and Mandatory Organics Recycling (SB 1383) place a heavy burden on the City and the community.

Muni Environmental Services covers a range of professional services that are designed to meet the requirements of various regulatory mandates in California. These services include, but are not limited to, compliance with AB 939 (The Integrated Waste Management Act of 1989), SB 1374 (Mandatory Construction Diversion Programming of Agenda Item #C2

2002), California Green Building Code, as well as other program mandates legislated by the California State Legislature and/or CalRecycle.

MuniEnvironmental was founded in 2015 and has provided solid waste consulting services for various agencies across California including Santa Fe Springs, Bellflower, Lynwood, Industry, and West Hollywood. By extending this 3-year agreement term, Muni will deepen its collaboration with the Franchisee to develop and execute new collection and recycling initiatives in alignment with the regulatory standards outlined in SB 1383.

Over the past few years, the consultant has overseen the Solid Waste Services RFP process and the final negotiations with a local solid waste enterprise. The consultant has assisted the City in implementing the development of new AB 341 (Mandatory Commercial Recycling) as well as SB 1383 (Mandatory Organics Recycling), ensuring full compliance with CalRecycle's regulatory mandates.

MuniEnvironmental will continue to support the City by providing on-site technical support, overseeing grant administration, updating City ordinances and the franchise agreement as necessary, compiling regular reports on progress, and overseeing the Construction and Demolition Waste Monitoring and Mandatory Commercial and Organics Recycling Programs.

FISCAL IMPACT
Sufficient amounts are budgeted in the General Fund for the contract services. The proposed services are priced at $75,222 annually, and their expenses will be offset by the franchise hauler's AB 939 annual allocation, biennial performance audit funds, and the CalRecycle SB 1383 Local Assistance Grant Program.

SUGGESTED ACTION
Approve Recommendation.

WHEREAS, on October 7, 2017, the City of Hawaiian Gardens (“City”) and MuniEnvironmental, LLC (“Consultant”) entered into that certain Agreement to provide professional solid waste and recycling consulting services in which consultant agreed to perform certain services for the City;
WHEREAS, the City and Consultant desire to confirm the extension of the Agreement and further extend its term.

NOW, THEREFORE, in consideration of the promised and mutual covenants contained therein, City and Consultant hereby confirm the extension of the Agreement and agree to extend the termination date through March 27, 2027.

RECOMMENDATION:

Recommendation to adopt Resolution No. 007-2024 opposing Initiative No. 21-0042A1, the Taxpayer Protection and Government Accountability Act.

SUMMARY
The Taxpayer Protection and Government Accountability Act would amend the California Constitution with provisions that limit voters’ authority and input, adopt new and stricter rules for raising taxes and fees, and may make it more difficult to impose fines and penalties for violation of state and local laws.

The measure puts billions of local government tax and fee revenues at risk statewide with related core public service impacts.

The measure would have significant negative impacts on City of Hawaiian Gardens operations and core service delivery.

The proposed constitutional initiative is sponsored by the California Business Roundtable.

MAJOR PROVISIONS
Fees and Charges1:
• Except for licensing and other regulatory fees, fees and charges may not exceed the “actual cost” of providing the product or service for which the fee is charged. 1 Initiative No. 21-0042A1 (pgs.4-6; Section 1 (a)-(j)
Agenda Item #C3
March 27, 2024

Page 2 ends

“Actual cost” is the “minimum amount necessary.” The burden to prove the fee or charge does not exceed “actual cost” is changed to “clear and convincing” evidence.
• Requires fees and charges paid for the use of local and state government property and the amount paid to purchase or rent government property to be “reasonable.” These fees and charges are currently allowed to be market-based.

Whether the amount is “reasonable” (introducing a new legal standard aiming to force below market fee and charge amounts) must be proved by “clear and convincing evidence.”2 The standard may significantly reduce the amount large companies (e.g., oil, utilities, gas, railroads, garbage/refuse, cable, and other corporations) will pay for the use of local public property. • Prohibits fees on new development based on vehicle miles traveled.

Taxes3:
• Taxes and fees adopted after Jan. 1, 2022, that do not comply with the new rules, are void unless reenacted4.
• Invalidates Upland decision that allows a majority of local voters to pass special taxes. The measure specifies that taxes proposed by the initiative are subject to the same rules as taxes placed on the ballot by a city council. • Expressly prohibits local advisory measures which allow local voters to express a preference for how local general tax dollars should be spent.5 • Requires voter approval to expand existing taxes (e.g., Utility, Transient Occupancy) to new territory (e.g., annexations) or to expand the tax base (e.g., new utility service)
• New taxes can only be imposed for a specific time period. • City charters may not be amended to include a tax or fee. • All state taxes require majority voter approval.

Fines and Penalties6:
2 Initiative No. 21-0042A1 (pg.5; (3))
3 Initiative No. 21-0042A1 (pgs.4-6; Section 1 (a)-(j)
4 Initiative No. 21-0042A1 (pg.7; Section 6 (Sec. 2)(g) 5 Initiative No. 21-0042A1 (pg.6 (3))

• May require voter approval of fines, penalties, and levies for corporations and property owners that violate state and local laws unless a new, undefined adjudicatory process is used to impose the fines and penalties.

DISCUSSION/ADDITIONAL BACKGROUND
On Jan. 4, 2022, the California Business Roundtable filed the “Taxpayer Protection and Government Accountability Act” or AG# 21-0042A1. On Feb. 1, 2023, the measure qualified for the November 2024 ballot.

The League of California Cities, along with a broad coalition of local governments, labor and public safety leaders, infrastructure advocates, and businesses, strongly opposes this initiative.

Local government revenue-raising authority is currently substantially restricted by state statute and constitutional provisions, including the voter approved provisions of Proposition 13 of 1978, Proposition 218 of 1996, and Proposition 26 of 2010. The Taxpayer Protection and Government Accountability Act adds and expands restrictions on voters and local government tax and fee authority.

Fees and Taxes
Local governments levy a variety of fees and other charges to provide core public services.

Major examples of affected fees and charges are:
• Nuisance abatement charges, such as for weed, rubbish, and general nuisance abatement to fund community safety, code enforcement, and neighborhood cleanup programs.
• Commercial franchise fees.
• Emergency response fees, such as in connection with DUI. • Advanced Life Support (ALS) transport charges.
• Document processing and duplication fees.
• Transit fees, tolls, parking fees, and public airport and harbor use fees. • Facility use charges, fees for parks and recreation services, garbage disposal tipping fees.

Virtually every city, county, and special district must regularly (e.g., annually) adopt increases to fee rates and charges and revise rate schedules to accommodate new users and activities. Most of these would be subject to new standards and limitations under threat of legal challenge. Based on the current volume of fees and charges imposed by local agencies, including council-adopted increases to simply accommodate inflation, Cal Cities estimates the amount of local government fee and charge revenue Agenda Item #C3
March 27, 2024

Page 4 ends

at risk is approximately $2 billion per year including those adopted since Jan. 1, 2022.

Over ten years, $20 billion of local government fee and charge revenues will be at heightened legal peril.

Examples of affected fees and charges include:

Hundreds of local tax measures were approved in 20227 that likely do not comply with the provisions of the initiative. Nearly $2 billion of annual revenues from these voterapproved measures will cease a year after the effective date of the measure, reducing the local public services funded by these measures, unless the tax is re-submitted for voter approval.

Reductions on local government tax revenues have impacts on core services and infrastructure including fire and emergency response, law enforcement, streets and roads, drinking water, sewer sanitation, parks, libraries, public schools, affordable housing, homelessness prevention, and mental health services.

Examples of affected revenue measures and service impacts include:

Fines and Penalties
Under existing law, cities are required to provide due process before imposing a penalty or fine for violation of its municipal code:

1. A local agency must adopt administrative procedures that govern imposing fines and penalties, including providing a reasonable period of time for a person responsible for a continuing violation to correct or remedy the violation [Gov't Code 53069.4].

2. Notice must be given to the violating party before imposing the penalty; and give the party an opportunity to be heard and present any facts or arguments [Merco Construction Engineers v. Los Angeles Unified School District (1969) 274 CA 2d 154, 166].

3. The fine may not be "excessive" [U.S. Constitution amendments VIII and XIV].

The initiative converts administratively-imposed fines and penalties into taxes unless a new, undefined, and ambiguous “adjudicatory due process” is followed. This provision may put at risk authority to impose fines and penalties for violations of state and local law.

March 27, 2024

Page 5 ends

FISCAL IMPACT
The Taxpayer Protection and Government Accountability Act will take billions of dollars away from local government services statewide.

City of Hawaiian Gardens Financial Impact
There would be no current year fiscal impact, however the passage of this initiative can significantly limit the City’s ability to recover costs incurred to provide necessary and indemand services. The various fees charged by the City for facility rentals, recreational programs and development permitting and inspection services are affected by inflation and this initiative could negatively impact the City’s ability to recover adequate offsetting revenue, potentially resulting in in reduced services. In FY 22-23 approximately 5% of the General Fund revenue was due to these “fees and charges” to recover costs of service. These fees and charges require a review to account for current costs. Making the necessary adjustments to bring them to the appropriate level will be jeopardized if this initiative is passed.

Language in the initiative requiring that fees be “reasonable” does not provide any clear definition of what is reasonable and can increase the City’s burden to prove compliance with new fee requirements and could then result in costly litigation.

SUGGESTED ACTION
Approve Recommendation.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HAWAIIAN

GARDENS, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA,
OPPOSING INITIATIVE NO. 21-0042A1, THE TAXPAYER PROTECTION AND GOVERNMENT ACCOUNTABILITY ACT.

WHEREAS, an association representing California’s wealthiest corporations and developers is spending millions to push a deceptive proposition aimed for the November 2024 statewide ballot; and
WHEREAS, the measure includes undemocratic provisions that would make it more difficult for local voters to pass measures needed to fund local services and infrastructure, and would limit voter input by prohibiting local advisory measures where voters provide direction on how they want their local tax dollars spent; and
WHEREAS, the measure creates new constitutional loopholes that allow corporations to pay far less than their fair share for the impacts they have on our communities, including local infrastructure and our environment; and
WHEREAS, the measure may make it much more difficult for state and local regulators to issue fines and levies on corporations that violate laws intended to protect our environment, public health and safety, and our neighborhoods; and
WHEREAS, the measure puts billions of dollars currently dedicated to local services at risk and could force cuts to fire and emergency response, law enforcement, public health, parks, libraries, affordable housing, services to support homeless residents, mental health services, and more; and
THEREFORE, BE IT RESOLVED that the City of Hawaiian Gardens opposes Initiative 21- 0042A1;
BE IT FURTHER RESOLVED, that the City of Hawaiian Gardens will join the No on Initiative 21-0042A1 coalition, a growing coalition of public safety, education, labor, local government, and infrastructure groups throughout the state.
