PROJECT, AND AWARD CONSTRUCTION CONTRACTS TO EMPIRE DESIGN AND BUILD AND ANGUIANO LAWN CARE, INC. IN THE AMOUNT NOT TO EXCEED 230,800.00 FOR THE WATER EFFICIENCY, PROJECT 113

SUMMARY
The C. Robert Lee Recreation Center, Fedde Middle School, and Furgeson Elementary School in the City of Hawaiian Gardens have a total of six restrooms that need renovation and upgrades of existing deteriorating toilets, urinals, faucets, valves, and drinking fountains that are at the end of their life span. The City started searching for governmental funding to replace water-leaking fixtures, upgrade plumbing, and install new water-saving and smart sensor-controlled fixtures.

In addition, Pioneer Park's existing irrigation controller and irrigation system could not be included in the renovation due to budget shortages.

On September 5, 2023, a grant application was submitted to the Central Basin Municipal Water District (CBMWD) for the Water Efficiency Project. The proposed scope of work consists of replacing restroom faucets, toilets, urinals, and drinking fountains at the C.

Robert Lee Recreation Center, Fedde Middle School, and Furgeson Elementary School restrooms and upgrading the existing irrigation system at Pioneer Park to incorporate advanced features such as cellular network communication and a rain sensor for efficient water management.

On March 21, 2023, the City was granted a reimbursement fund from CBMWD in the amount up to $230,800 for the proposed Water Efficiency, Project 113. The project will begin shortly after funding is awarded and must be completed by June 15, 2024.

Expense Reimbursement Agreement
This Expense Reimbursement Agreement (this “Agreement”), dated as of March 21, 2024, is made by Central Basin Municipal Water District (the District) and agreed upon by the District and the City of Hawaiian Gardens (the City).

Metropolitan Water District (Metropolitan) gives its member agencies, including the District, MAAP funds to complete water efficiency projects throughout its service area.

Projects must fall under one of the following categories: documented water saving projects, non-documented water saving projects, projects in disadvantaged communities, and flex-funds. The funds are active for the duration of two consecutive fiscal years and do not roll over to the next funding period. The end of the current round of funding is on June 30th, 2024.

Agreement:

The City will be reimbursed up to $230,800 for park irrigation and public restroom retrofits. Pioneer Park’s irrigation system will be retrofitted in addition to the bathrooms at City Hall, C. Robert Lee Recreation Center, and Fedde Middle School.

Reporting
City staff will provide documentation which includes invoices, plans, photos, updates, materials used, and all other information related to the project. The District and the City will have meetings on an as needed basis. Once complete, the City will provide the District with an estimate of the yearly water savings for the park due to the renovation.

5. Project Completion
The project will begin shortly after funding is awarded and must be completed by June 15, 2024.

Reimbursement:

The City will be reimbursed for all project costs within 6 months of the project completion date but the estimated time for reimbursement is sooner. This time frame allows for the invoices to get to the Metropolitan and add a credit to the District’s account which may take a few months.

By signing below, the City understands that it is obligated to pay any funding amounts if the project goes unfulfilled by June 15, 2024.

This agreement is effective once signed by the District and the City and continues through June 30, 2024, or until an addendum is approved and implemented by the Attachment A
District and signed by the City, whichever comes first. Funding may not be applied retroactively and does not cover costs for labor. This funding authorization is effective only for the designated period or until a new authorization is received and approved by the District.

By signing, the District and the County agree to these terms.
