RECOMMENDATION TO RECEIVE AND FILE TREASURER’S REPORT FOR MAY 2024

SUMMARY
The attached Treasurer’s Reports provide balances for the month of May 2024. During this period, the City investments were in compliance with the Investment Policy and the City had sufficient cash reserves to meet the expenditure requirement for operations for the next six (6) months.

The City maintains checking accounts for general operations, payroll, and the housing account. In addition, we maintain an investment account with LAIF. Funds are also retained by the Bank of New York Mellon for the Successor Agency Bond payments. The general operating account and LAIF represent cash transactions for multiple funds (Pooled Cash) with the amount available for each fund tracked in the general ledger. Interest earned through LAIF is allocated to each fund based on the balance shown in the general ledger. The attached detail report provides balances by Fund as of May 2024.

RECOMMENDATION TO APPROVE RESOLUTION NO. 022-2024 FIXING THE

APPROPRIATIONS LIMITATION IN THE CITY OF HAWAIIAN GARDENS FOR THE FISCAL YEAR 2024-2025

SUMMARY
Article XIIIB (Proposition 4) of the California Constitution, as amended by Proposition 111, requires that local jurisdictions establish appropriation limits each fiscal year. This limits the amount of revenue that can be appropriated in any fiscal year to the Proceeds of Taxes. Proceeds of taxes include: all taxes levied by or for an agency; any revenues from license fees, general use charges and user fees to the extent that the proceeds exceed the cost of providing the service covered by the fee; and discretionary State subventions.

An increase over the prior year’s limitation is allowed in three instances:
1 Percentage change in California fourth quarter per capita personal income or the increase in the non- residential assessed valuation due to new construction.

2. Percentage change in the population of the jurisdiction or the county in which the jurisdiction is located, whichever is greater.

3. Corrections for previous computation errors.

The City has chosen the following factors for calculating the FY 2024-2025 appropriations limit:
• The population for Los Angeles County and the City of Hawaiian Gardens had population growth of .05 and -.29 respectively. The City used the change for the County as reported by the State Department of Finance.
• The price factor provided by the State Department of Finance is the per capita income of 3.62%.

Agenda Item #B5
July 24, 2024

Page 2 ends

The attached calculation schedules show that using these factors results in an increase to the appropriations limit of $884,232 for FY 2024-2025. The appropriations limit for this fiscal year is increased to $24,965,880. The appropriations (revenues) subject to the limit total $5,379,628 per the proposed budget, resulting in the appropriations limit exceeding the amount subject to the limit by $19,586,252.

RECOMMENDATION:

RECOMMENDATION TO RECEIVE AND FILE THE PUBLIC WORKS DEPARTMENT PERMITS REPORT FOR THE MONTHS OF MAY AND JUNE 2024

SUMMARY
The Engineering Division, as part of the Public Works Department, is responsible for the implementation of the policies and objectives of the community as set forth in the City of Hawaiian Gardens’ General Plan, Municipal Code, and oversees the project management for the construction of the City’s capital improvements, infrastructure, and public facilities.

The Engineering Division reviews applications and issues construction, and encroachment permits for any work that is done in the public right-of-way, such as the streets and alleys, and if the public rights-of-way are used for equipment parking/staging and to conduct any construction, repair, or maintenance of any property or utilities within or adjacent. Work on or use of the public right-of-ways may include: underground and above-ground utilities repair/replacement by utility companies and their contractors, driveway construction, temporary use for staging of equipment and vehicles, and contractors working on behalf of the City for public improvements. The permits and final inspections will ensure that any work is conducted in accordance with City Engineering specifications and appropriate standards and that any traffic control and safety measures are properly in place and followed.

The attached chart is a summary of all permits issued during the months of May & June 2024.

CITY OF HAWAIIAN GARDENS

CITY COUNCIL

STAFF REPORT
Agenda Item #C1
DATE: July 24, 2024
TO: Honorable Mayor and Members of the City Council
FROM: Ernesto Marquez, City Manager
BY: Elise McCaleb, Community Development Director
RECOMMENDATION:

Approve Right-of-Way Use Agreement and Resolution No. 024-2024.

SUMMARY
The City of Hawaiian Gardens entered into a Telecommunications License Agreement in 2001 with Level 3 Communications (“Level 3”). Level 3 Communications is also known as “Lumen”. This Agreement allowed Level 3 to install 7,793 feet of twenty-four (24),

1.25-inch HDPE conduits into the public right-of-way for the purpose of providing telecommunications services. The Agreement expired in 2011.

Fiber continues to occupy the City’s public right-of-way and Level 3 desires to maintain, operate, and install fiber optics in the City’s right-of-way. A Right-of-Way Use Agreement is proposed for Level 3’s continued use and maintenance.

DISCUSSION
Level 3 is requesting a Right-of-Way Use Agreement which will provide the opportunity to maintain, operate, and install fiber optics within the public right-of-way for the provision of telecommunications services. Level 3 is authorized to be in the public right-of-way in California pursuant to a state franchise right and under Public Utilities Code Section 7901 as a “telephone corporation”. Level 3 holds a Certificate of Public Convenience and Necessity from the California Public Utilities Commission. Because Level 3 has a state franchise right to be in the public right-of-way, they do not have to pay the City a license fee for the right to occupy the public right-of-way.

The City is authorized to regulate the terms and conditions for use of the public rights-ofway and land use. This Agreement provides the framework within which Level 3 will apply for encroachment permits and maintain fiber optics within the City. The Agreement Agenda Item #C1
July 24, 2024

provides Level 3 with the authority to install, maintain, operate, relocate, and remove fiber optics underground. Level 3 may also install fiber overhead with existing or new poles.

There is no cost to the City for the construction, installation, operation, maintenance, or removal of any fiber optics. Level 3 will obtain an encroachment permit for any work in the street. Level 3 will provide a bond to cover 100% of the costs of work to be performed on or on behalf of the company within and affecting the public right-of-way. The term of the Agreement is ten (10) years and is renewable in one (1) year increments.

FISCAL IMPACT
There is no expense to the City of Hawaiian Gardens.

SUGGESTED ACTION
Approve Recommendation.

The project’s scope of work includes slurry sealing of various residential streets, striping, removal and installation of radar speed signs, manhole adjusting, traffic control, and other incidental items not mentioned but indicated in the Specifications.

Slurry seal is an effective road maintenance technique used to extend the life and improve the condition of asphalt pavement. This process is a budget-friendly solution compared to more extensive pavement repairs or full resurfacing that involves applying a thin, slurry mixture made of asphalt emulsion, fine aggregate (such as sand), water, and additives to the surface of existing roads.

The bid documents have been reviewed and approved by the City Engineer and the project is now ready to be advertised for competitive bids. The Project bid documents will be available for review in the City Clerk’s office.
