RECOMENDATION TO ADOPT RESOLUTION 025-2024 OF THE CITY COUNCIL OF
THE CITY OF HAWAIIAN GARDENS, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA APPROVING THE EXCHANGE OF FY 2024-2025 PROPOSITION A
FUNDS BETWEEN THE CITY OF HAWAIIAN GARDENS AND THE CITY OF LA HABRA
HEIGHTS, CALIFORNIA AND AUTHORIZING THE CITY MANAGER TO EXECUTE ALL
NECESSARY DOCUMENTS
SUMMARY
The City recognizes that the cost to support the City’s transportation needs exceeds the revenues received from the available restricted funding. Transfers from the General Fund are required to subsidize transportation related expenses. One way to reduce the impact on the General Fund is to purchase Proposition A Transportation Funds at a discount from other cities in return for unrestricted General Fund dollars.
The City will receive approximately $370,000 in Prop A Local Return Transit Funds in FY 23-24 that can only be used for public transportation purposes. The budgeted expenditures FY 24-25 for the Prop A Fund will exceed the budgeted revenues. The City of La Habra Heights has $80,000 of Prop A Funds for the FY 24-25 allotment. They would like to exchange these Prop A funds at a rate of 75/100 or $60,000 of General Fund dollars. This additional revenue for Prop A is included in the Citywide FY 24-25 Budget.
FISCAL IMPACT
The Exchange of Prop A Funds is budgeted with an expense of $60,000 from the General Fund and an increase of $80,000 Prop A Fund revenue.

RECOMMENDATION:
Approve Communications Facility License Agreement, Memorandum of Communications Facility License Agreement and Resolution No. 026-2024 at 22115 Pioneer Boulevard.
SUMMARY
The Communication Facility License Agreement and Memorandum of Communications Facility License Agreement between the City of Hawaiian Gardens and Dish Wireless, LLC (“Dish”) provides Dish a non-exclusive license to install, operate, and maintain its communications facility on the City’s existing monopole located at 22115 Pioneer Boulevard.
DISCUSSION
The City of Hawaiian Gardens owns a communications tower and property located at 22115 Pioneer Boulevard. The City leased space previously to telecommunications providers like Sprint. Dish approached the City requesting a license to operate on the monopole. The monopole is eighty (80) feet in height and the license will allow Dish the right of non-exclusive ingress and egress to the area seven (7) days a week, twenty-four (24) hours a day to install, maintain, and operate the communications tower. With the license, Dish may transmit and receive communications signals.
The term of the lease is five (5) years. Dish is allowed to extend the license for three (3) additional terms of five (5) years each. The monthly license fee is $3,500 and the amount increases 4% annually. If Dish does not make payments on time, 10% interest per month is charged. Dish is required to keep and maintain the communications tower in good appearance, excluding wear and tear.
Agenda Item #C1
October 9, 2024
If Dish terminates the lease, Dish is required to remove the communications facility at its expense and return the area to its original state. Dish is required to obtain a performance bond totaling $30,000 upon the effective date of the agreement. The purpose of the bond is to cover the cost of removing all equipment and returning the property to its original state.
The Memorandum of Communications Facility License Agreement summarizes the lease agreement and is recorded with Los Angeles County.
FISCAL IMPACT
The City of Hawaiian Gardens will generate $42,000 in the first year.
