CITY COUNCIL

STAFF REPORT
Agenda Item #B3
DATE: April 9, 2025
TO: Honorable Mayor and Members of the City Council
FROM: Ernesto Marquez, City Manager
BY: Neema Ghanbari, Public Works Manager
RECOMMENDATION:

RECOMMENDATION TO APPROVE A MEMORANDUM OF UNDERSTANDING WITH

THE CALIFORNIA JOINT POWERS INSURANCE AUTHORITY AUTHORIZING WORK

RELATED TO THE AMERICANS WITH DISABILITY ACT ASSISTANCE PROGRAM

SUMMARY
Title II of the Americans with Disabilities Act (ADA) requires local governments to develop an ADA Transition Plan, as outlined in 28 CFR §35.150(d). Title II mandates that public entities identify and rectify physical barriers to ensure accessibility for individuals with disabilities in public facilities, streets, roads, and walkways. Entities must detail methods for barrier removal, establish a timeline, designate an official for oversight, and community engagement processes.

To address the challenges of navigating ADA compliance amid rising audits and litigation, the California Joint Powers Insurance Authority has partnered with Disability Access Consultants (DAC) and created the ADA Assistance Program to help member cities with ADA Compliance by helping offset the cost of developing an ADA Transition Plan. This program provides various services, including initial compliance assessments, facility and public rights-of-way inspections, and an evaluation of policies, procedures, and programs. The program also includes the DACTrak software, which helps track ADA compliance progress and costs.

The ADA Self-Evaluation and Transition Plan project will be divided into two phases.

Phase I will include a comprehensive Self-Evaluation to identify accessibility barriers within City-owned properties, parks, parking lots, and public rights-of-way. It also includes an analysis of the City's current policies and procedures to identify any accessibility concerns. This phase will map out the City's existing challenges and help plan for remediation efforts.

Agenda Item #B3
April 9, 2025

Page 2 ends

Phase II will include the development of an ADA Transition Plan. This plan would outline specific measures for removing identified barriers to accessibility. The objective is to ensure ADA compliance while significantly enhancing overall accessibility within the City's infrastructure. Essential components of a Transition Plan include identifying physical barriers and their locations, methods for making facilities accessible, timelines for barrier removal, responsible officials, cost estimates, and ensuring community engagement throughout the process.

Conducting a Self-Evaluation and creating an ADA Transition Plan helps ensure that all members of the community have equal access to services, programs, and activities. The Transition Plan will serve as a strategic roadmap, guiding the City in systematically addressing accessibility challenges over time. Additionally, having an ADA Transition Plan provides protections for the City against liability claims which could arise for not having a strategic plan to address ADA improvements.

Staff recommends approving a Memorandum of understanding (MOU) with the California Joint Powers Insurance Authority (CJPIA) in the amount of $53,400 to have DAC evaluate the City’s facilities, parks, sidewalks, curb ramps, intersections, bus stops, and bus shelters and develop a ADA Self-Evaluation and Transition Plan.

FISCAL IMPACT
As part of the adopted 2024/25 fiscal year budget, the City Council allocated $150,000 from the General Fund for the development of an ADA Transition Plan.

SUGGESTED ACTION
Approve Recommendation.

Agenda Item #C1
DATE: April 9, 2025
TO: Honorable Mayor and Members of the City Council
FROM: Ernesto Marquez, City Manager
BY: Pablo Rubio, City Clerk
RECOMMENDATION:

Recommendation to discuss and consider approving a donation to Fedde Academy.

SUMMARY
The Fedde Academy History Day Team has made it to the State Finals and is requesting a $5,000 donation to help support funding for the trip. National History Day (NHD) is a highly regarded academic program for elementary and secondary school students that culminates in an annual competition. It encourages students to delve into historical topics that pique their interest and conduct extensive research using primary and secondary sources.

The NHD-CA State Finals will take place on May 2-4, 2025, and the National competition will take place on June 8-12, 2025. Fedde Academy is currently using the school budget to help to fund the trip, but needs additional funds to make the trip a reality.

The Fedde Academy History Day Team is made up of 20 students, who are all Hawaiian Gardens residents in 7th or 8th grade. A $5,000 donation will support Hawaiian Gardens students who have won their county divisions on National History Day and are traveling to compete at the state and national levels after six months of research.

FISCAL IMPACT
The donated amount would come out of the FY 2024-2025 budget.

SUGGESTED ACTION
Approve Recommendation.
