RECOMMENDATION:
Recommendation to adopt on second reading by title only, Ordinance No. 2026-624, amending Section 1.12.050 (C) of Chapter 1.12 of Title 1 of the Hawaiian Gardens Municipal Code regarding authorization to issue citations.
SUMMARY
In June 2025, the City of Hawaiian Gardens adopted city wide budgets for fiscal years 2025-2026 and 2026-2027.In these budgets, the city provided funding for new positions in the Public Safety Department. The approved positions are one full time Parking Enforcement Officer and two part time Parking Enforcement Officers.
The Parking Enforcement Officers duties will include: Assist in the removal of abandoned vehicles, direct traffic in emergency situations, enforce parking regulations and issue citations, provide quality customer service to the public, respond to requests for assistance with traffic/parking problems and other duties as assigned.
Currently, the Hawaiian Gardens Municipal Code (“HGMC”) section 1.12.050 (C) specifies the classifications of officers and employees of the City who are authorized to issue citations pursuant to Penal Code section 836.5. It is the city’s intention to authorize the “Parking Enforcement Officer” to issue citations pursuant to Penal Code section 836.5. Therefore, this Ordinance would amend HGMC section 1.12.050 (C) to add “Parking Enforcement Officer” to the list of classifications of officers and employees of the City who are authorized to issue citations.
Pursuant to Government Code sections 36934 and 36937, ordinances are “introduced” by first reading at a City Council meeting, “passed” (i.e., approved) at a later City Council meeting by conducting a second reading, and then take effect 30 days after passage.
