FOR THE COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) PROGRAM IN A NOT TO EXCEED AMOUNT OF $27,930 FOR A PERIOD OF ONE YEAR, WITH THE

OPTION TO RENEW FOR FOUR ADDITIONAL ONE-YEAR PERIODS AT THE

DISCRETION OF THE CITY MANAGER, AND AUTHORIZE THE CITY MANAGER TO

EXECUTE THE AGREEMENT

SUMMARY
The Community Development Block Grant (CDBG) program is funded by the United States Department of Housing and Urban Development (HUD) and administered by the Los Angeles County Development Authority (LACDA). The City of Hawaiian Gardens (City) receives an annual allocation of approximately $247,589 through the program. The funds must be used to benefit low and moderate income persons, aid in the prevention or elimination of slums or blight, or meet an urgent need. Compliance with all CDBG regulations and requirements is essential to the continued success of the CDBG program.

The City retains a consultant for administration services to work with City staff to provide oversight and monitoring for compliance with all CDBG program guidelines. Michael Baker International, Inc. has provided these administrative services for over 10 years. The current contract expires June 30, 2026. LACDA requires that at a minimum of every five years the City engage in a competitive procurement process to assure the City has the appropriate support for these programs.

On February 17, 2026, the City issued a request for proposals (RFP) for CDBG administrative services. The RFP was posted on the City website and distributed to Agenda Item #B7
May 27, 2026

multiple companies. There were three (3) proposals received from MVN & Associates, The Ramsay Group and Michael Baker International.

Staff reviewed the qualifications of the firms based on the criteria established in the RFP.

All firms have experience in various capacities with LACDA and CDBG. After reviewing the proposals and interviewing the principals of each organization, it is recommended that Michael Baker International, Inc. be awarded a professional services agreement for CDBG administrative services based on the competitiveness of the bid and the demonstrated experience and knowledge of the processes, procedures and requirements associated with participation in the CDBG program. The firm has provided administrative services to the City for over 10 years and has consistently met the program and financial requirements set forth by LACDA and HUD. In addition, the firm is an effective liaison between the City and LACDA to ensure compliance with all aspects of CDBG administration.

A one year contract for FY 2026-2027 is proposed for award, with four one-year options to renew at the City Manager’s discretion with mutual written consent of both parties. The not to exceed amount for the contract is $27,930, which may be adjusted following any annual adjustment of hourly rates implemented in January of each year.

FISCAL IMPACT
The administrative service costs are included in the annual budgets and are funded with CDGB grant funds.

3.4.9 Enforcement of Agreement Provisions (non estoppel). Consultant acknowledges and agrees that actual or alleged failure on the part of the City to inform Consultant of non-compliance with any requirement imposes no additional obligation on the City nor does it waive any rights hereunder.

(E) The limits set forth herein shall apply separately to each insured against whom claims are made or suits are brought, except with respect to the limits of liability. Further the limits set forth herein shall not be construed to relieve the Consultant from liability in excess of such coverage, nor shall it limit the Consultant’s indemnification obligations to the City and shall not preclude the City from taking such other actions available to the City under other provisions of the Agreement or law.
(F) Consultant shall report to the City, in addition to Consultant’s insurer, any and all insurance claims submitted by Consultant in connection with the Services under this Agreement.

Such action shall include, but not be limited to, the following: employment, upgrading, demotion or transfer; recruitment or recruitment advertising; layoff or termination; rates or pay or other forms of compensation; and selection of training, including apprenticeship. The Consultant agrees to post in conspicuous places, available to employees and applicants for employment, notices to be provided by the City setting forth the provision of this non-discrimination clause.

3. The Consultant will cause the foregoing provisions to be inserted in all subcontracts for all work covered by this Agreement so that such provisions will be binding upon each subcontractor, provided that the foregoing provisions shall not apply to contracts or subcontracts for standard commercial supplies or raw materials.

4. The Consultant will comply with all provisions of Executive Order 11246 of September 25, 1965, and the rules, regulations, and relevant orders of the Secretary of Labor.

5. The Consultant will furnish all information and reports required by Executive Order 11246 of September 24, 1965, and by the rules, regulations, and orders of the Secretary of Labor, or pursuant thereto, and will permit access to his books, records, and accounts by the City and the Secretary of Labor for purposes of investigation to ascertain compliance with such rules, regulations, and orders.

The Consultant will include the provisions of paragraphs (1) through (6) in every subcontract or purchase order unless exempt by rules, regulations, or orders of the Secretary of Labor issued pursuant to Section 204 of Executive Order 11246 of September 24, 1965, so that 65320.00001\45036461.1

III. “SECTION 3” COMPLIANCE IN THE PROVISION OF TRAINING,

EMPLOYMENT AND BUSINESS OPPORTUNITIES

1. The work to be performed under this Agreement is on a project assisted under a program providing direct federal financial assistance from the Department of Housing and Urban Development and is subject to the requirements of Section 3 of the Housing and Urban Development Act of 1968, as amended, 12 U.S.C. 1701u. Section 3 requires that, to the greatest extent feasible, opportunities for training and employment be given to lower income residents of the project area and contracts for work in connection with the project be awarded to business concerns, which are located in, or owned in substantial part by persons residing in the area of the project.

2. The parties to this Agreement will comply with the provisions of said Section 3 and the regulations issued pursuant thereto by the Secretary of Housing and Urban Development set forth in 24 CFR 135, and all applicable rules and orders of the Department issued thereunder prior to the execution to this Agreement. The parties to this Agreement certify and agree that they are under no contract or other disability, which would prevent them from complying with these requirements.

3. The Consultant will send to each labor organization or representative of workers with which he has a collective bargaining agreement or other contract or understanding, if any, a notice advising the said labor organization or workers’ representative of his commitments under this Section 3 clause and shall post copies of the notice in conspicuous places available to employees and applicants for employment or training.

4. 5. Compliance with the provisions of Section 3, the regulations set forth in 24 CFR Part 135, and all applicable rules and orders of the Department issued hereunder prior to the execution of the contract, shall be a condition of the federal financial assistance provided to the project, binding upon the City, its successors and assigns. Failure to fulfill these requirements shall subject the City, its contractors and subcontractors, its successors and assigns to those sanctions specified by the grant agreement through which federal assistance is provided, and to such sanctions as are specified by 24 CFR Part 135.

5. During the performance of this Agreement, Consultant and its subcontractors shall not unlawfully discriminate against any employee or applicant for employment because of race, religion, color, national origin, ancestry, physical handicap, medical condition, marital status, age (over 40), or sex. Consultant and its subcontractors shall ensure that the evaluation and treatment of their employees and applicants for employment are free of such discrimination. Consultant and its subcontractors shall comply with the provisions of the Fair Employment and Housing Act (Government Code, Section 12900 et seq.) and the applicable regulations promulgated thereunder (California Code of Regulations, Title 2, Section 7258.0 et seq.) The applicable regulations of the Fair Employment and Housing Commission implementing Government Code, Section 12990, set forth in Chapter 5 of Division 4 of Title 2 of the California Code of Regulations are incorporated into this Agreement by reference and made a part hereof as if set forth in full. Consultant and its subcontractors shall give written notice of their obligations under this clause to labor organizations with which they have a collective bargaining or other agreements.

6. Section 109, Title I of the Housing and Community Development Act of 1974, provides that no person shall, on the ground race, color, national origin, or sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity funded in whole or in part with funds made available under this Title.

SUMMARY
The City of Hawaiian Gardens (“City”) and Southeast Los Angeles County Workforce Development Board (SELACO), have previously entered into Agreement 106008, to provide work experience services and personal enrichment activities under the Los Angeles County Earn and Learn program.

STAFF REPORT
Agenda Item #B9
DATE: May 27, 2026
TO: Honorable Mayor and Members of the City Council
FROM: Ernesto Marquez, City Manager
BY: Steve Gomez, Director of Public Safety & Community Relations RECOMMENDATION:

Recommendation to authorize the Mayor to send on behalf of the City of Hawaiian Gardens a letter in opposition to Assembly Bill (AB) 1383 and a letter in opposition to Senate Bill (SB) 866.

SUMMARY
AB 1383 (McKinnor) Public employees’ retirement benefits.

AB 1383 (McKinnor), would make several significant changes to Public Employees’ Pension Reform Act (PEPRA), resulting in substantial cost increases for cities and other public agencies. AB 1383 is in the Senate Labor Employee Relations & Retirement Committee.

What the Bill Does:
• Increases the pensionable compensation cap for PEPRA public employees. • Reduces the retirement age for public safety employees from 57 to 55, applied prospectively.
• Creates a new fourth safety tier, establishing a 3% @ 55 formula that is prospective and subject to collective bargaining.
• Allows local agencies to adjust their local pension formulas prospectively, providing them with the authority to modify benefit structures going forward.

AB 1383 is Important to Cal Cities Members:
• PEPRA reforms have generated an estimated $5.8 billion in savings to date and $26.5 billion projected over 10 years.

Agenda Item #B9
May 27, 2026

Page 2 ends

• Changing these reforms would increase employer and employee contribution rates, create new administrative and long-term solvency challenges for cities, and would undermine a decade of progress in stabilizing pension systems and managing long-term liabilities.
• Cities are already facing rising pension obligations, stagnant revenues, and new federal and state mandates that strain local budgets.
• Higher pension costs would threaten core city services, staffing levels, and overall fiscal stability.
• Increased mandated costs would limit cities’ ability to invest in workforce compensation, community programs, and essential public services.

SB 866 (Blakespear) Planning and zoning: Housing Element Mandates:

Homelessness
SB 866 is eligible to be heard on the floor and can be taken up at any time before May 29, 2026.

What the Bill Does: SB 866 would require all but 14 cities to add extensive homelessness reporting to their housing elements. SB 866 targets cities without direct access to homelessness funding, placing extensive new reporting burdens on cities with the fewest resources.

Background: Since 2019, HHAP has provided state funding to the 14 largest cities, all 58 counties, and 44 Continuums of Care. The other 469 cities in California do not get direct state support. To receive funding, HHAP recipients must submit regional plans that include system performance metrics. SB 866 would impose those same performance metrics as a new housing element requirement only for those cities that do not receive HHAP funding.

Why SB 866 is bad for cities:
• SB 866 mandates reporting on systems operated by counties, the state, and private entities, not cities. Despite a city's best intentions, it may be unable to collect this data, and under SB 866, it would have a non-compliant housing element as a result.
• The reporting required in SB 866 does not belong in a long-term housing planning document that, for most cities, is updated every eight years. The information would quickly become outdated and would no longer be responsive to the evolving needs of unhoused residents.
• SB 866 would create siloed data, requiring 469 cities to report this information through housing elements, while counties and larger cities do so through regional plans, raising concerns about how the state would synthesize this data into meaningful policy.
• Over 300 of the 483 cities in California have populations under 50,000, representing very small numbers of unhoused individuals. Requiring these cities Agenda Item #B9

to report this level of data without funding for homelessness programs will not move California forward in addressing homelessness.

The League of California Cities opposes AB 1383 and SB 866.

CITY COUNCIL

STAFF REPORT
Agenda Item #C2
DATE: May 27, 2026
TO: Honorable Mayor and Members of the City Council
FROM: Ernesto Marquez, City Manager
BY: Pablo Rubio, City Clerk
RECOMMENDATION:

Recommendation to adopt Resolution No. 007-2026, adopting a new City Council policy addressing a disruption of telephonic or internet service during City Council meetings.

SUMMARY
Senate Bill 707 (SB 707) amended the Ralph M. Brown Act (Gov. Code §§ 54950 et seq.) among other open meeting requirements, to update teleconferencing and accessibility requirements, including provisions related to remote participation in public meetings.

SB 707 applies to all legislative bodies as defined by the Brown Act, but certain special provisions apply only to what is now defined in the Brown Act as “eligible legislative bodies.” The Hawaiian Gardens City Council (but not other boards, commissions, or committees of the City) qualifies as an “eligible legislative body” because the City Council governs a city located in Los Angeles County, a County with a population of more than 600,000 people. (See, Gov. Code 54953.4(e)(2)(C)(defining “eligible legislative body” to include a city council of a city located in a county with a population of 600,000 or more).

Among other requirements, starting July 1, 2026, SB 707 requires that the City provide a “two-way audiovisual platform” or “two-way telephonic service” to allow members of the public to participate in its City Council meetings remotely. The City currently provides a two-way audio visual platform. The City conducts, and will continue to conduct City Council meetings in a hybrid format via Zoom.

In addition, SB 707 requires that the City, on or before July 1, 2026, adopt a policy addressing procedures for recessing and reconvening a meeting in the event of a technology disruption, and the efforts the legislative body will make to attempt to restore service. Such a policy must be adopted by a separate majority vote (i.e. not on the consent calendar) of the eligible legislative body in an open session.

Agenda Item #C2
May 27, 2026

Page 2 ends

The proposed City Council policy addressing disruption of telephonic or internet service during City Council meetings has been prepared in accordance with Government Code § 54953.4 and is attached as Exhibit A to Resolution No. 007-2026. This policy outlines procedures for temporarily recessing meetings, restoring connectivity, notifying participants, and reconvening meetings.

As described in the policy, if service cannot be restored after at least one hour, the City Council, could choose to: (1) by roll call vote, make a finding that the public interest in continuing the meeting outweighs the public interest in remote public access; (2) adjourn the meeting; or (3) extend the recess to allow staff more time to make a good-faith effort to restore remote access services. These requirements do not apply to certain specified types of meetings, including meetings held offsite or for inspection purposes, or in emergency situations. The attached policy lists those exemptions.

The adoption of a technology disruption policy is required to ensure compliance with SB 707 and to promote transparency and continuity of public meetings.

FISCAL IMPACT
None.

SUGGESTED ACTION
Approve Recommendation.

CITY OF HAWAIIAN GARDENS

DISRUPTION OF TELEPHONIC OR INTERNET SERVICE DURING

CITY COUNCIL MEETINGS

1. Background
Senate Bill 707 (2025) amended the Brown Act to require eligible legislative bodies to adopt, on or before July 1, 2026, a policy addressing how the agency will respond to disruptions in telephonic or internet service that prevent members of the public from participating remotely in public meetings.

In compliance with SB 707, the City of Hawaiian Gardens (“City”) provides a two-way audiovisual platform to allow members of the public to participate in City Council meetings remotely.

2. Purpose
This policy establishes procedures for responding to a disruption in the telephonic or internet services that provide two-way remote public access to meetings of the City Council as required by the Brown Act (Government Code section 54953.4). The policy ensures transparency, public participation, and the continuation of meetings during technological disruptions.

3. Definitions
“Service Disruption” means any failure, outage, or other interruption to the agency’s remote access services that prevents members of the public from participating in a City Council meeting through the remote access service.
“Disrupting” means engaging in behavior during a meeting of the City Council that actually disrupts, disturbs, impedes, or renders infeasible the orderly conduct of the meeting and includes, but is not limited to one of the following:
a. A failure to comply with reasonable and lawful regulations adopted by the City Council.
b. Engaging in behavior that constitutes use of force or a true threat of force. “Remote access services” means the two-way telephonic service and/or two-way audiovisual platform used to provide real-time remote public attendance and observation of meetings.

Exhibit A
“Two-way audiovisual platform” means an online platform that provides participants with the ability to participate in a meeting via both an interactive video conference and a twoway telephonic service. “Two-way telephonic service” means a telephone service that does not require internet access and allows participants to dial a telephone number to listen and verbally participate.
“True threat of force” means a threat that has sufficient indicia of intent and seriousness, that a reasonable observer would perceive it to be an actual threat to use force by the person making the threat.

4. Applicability
This policy applies to all open and public meetings of the City Council at which remote public participation is required under the Brown Act. Consistent with the Brown Act, this policy shall not apply to the following meetings:
a. Meetings held to attend a judicial or administrative proceeding to which the City is a party.
b. Meetings held to inspect real or personal property provided that the topic of the meeting is limited to items directly related to the real or personal property. c. Meetings held to meet with elected or appointed officials of the United States or the State of California, solely to discuss a legislative or regulatory issue affecting the City and over which the federal or state officials have jurisdiction. d. Meetings held to meet in or nearby a facility owned by the City, provided that the topic of the meeting is limited to items directly related to the facility. e. Meetings held in an emergency situation pursuant to Government Code section 54956.5.

5. Remote Public Access Generally
When remote public access is required under the Brown Act, the City Council shall provide members of the public with an opportunity to attend and participate in the meeting using a two-way audiovisual platform or a two-way telephonic service, provided that adequate telephonic or internet service is operational at the meeting location.

If adequate telephonic or internet service is not operational at the meeting location, the City Council shall not be required to provide remote access. If adequate telephonic or internet service is operational for only a portion of the meeting, the City Council shall provide remote access during that portion of the meeting.

Exhibit A
If a two-way audiovisual platform is used, the City Council shall:
a. Publicly post and provide a call-in option as well; and b. Activate any automatic captioning function that is available in the audiovisual platform.

If a two-way audiovisual platform is not provided, the City Council shall provide a two-way telephonic service.

Members of the public participating remotely shall be provided the same opportunity to provide public comment as members of the public attending in person, including the same time allotment.

6. Response to Service Disruption
If the Mayor or Clerk becomes aware of a service disruption:
a. The Mayor or Clerk shall immediately announce the service disruption to the public.
b. The Mayor shall call for a recess of the open session and may convene the City Council in an authorized closed session, consistent with the Brown Act. The recess shall last for one hour or until service is restored, whichever is earlier. c. During the recess, City staff shall make a good faith effort to diagnose and restore the disrupted service.

7. Reconvening the Open Session
After the expiration of the hour, if service has not been restored, the Mayor or Clerk shall report on the status of staff’s efforts to restore remote access services, and the City Council may reconvene to:
a. Adjourn the meeting;
b. Extend the recess to allow staff more time to make a good faith effort to restore remote access services; or
c. Continue the open session portion of the meeting by adopting, by roll call vote, the following or a substantially similar finding:
“The City has made good faith efforts to restore telephonic or internet service in accordance with its adopted policy, and the public interest in continuing the meeting outweighs the public interest in remote public access.” Upon adoption of the finding, the City Council may continue the open session portion of the meeting despite the fact that remote access services have not been restored.

Exhibit A

8. Recordkeeping
The Clerk shall enter a brief statement into the meeting minutes, including:
• The nature and time of the service disruption;
• The time the meeting was reconvened (if applicable);
• Any finding adopted pursuant to Section 7.

9. Response to Members of the Public Disrupting a Meeting If the Mayor or Clerk becomes aware of a member of the public who is attending the meeting through remote access services and is disrupting the meeting or otherwise preventing other members of the public from attending or observing the meeting remotely or in-person:
a. The Mayor or Clerk shall warn the person who is participating through remote access services that he or she is disrupting the meeting and his or her failure to cease that behavior may result in his or her removal.
b. If the person to whom the Mayor gave the above warning persists in disrupting the meeting, the Mayor shall order staff to:
i. mute or otherwise limit the individual’s ability to disrupt the meeting, while allowing the individual to continue to observe and attend the meeting; or ii. remove the individual from the meeting if paragraph (a) does not address the disrupting behavior or is not available using the remote access service.

10.Review and Updates
This policy may be amended by the City Council at a noticed public meeting in open session and may not be placed on the consent calendar.
