Agenda Item #A1
DATE: June 10, 2026
TO: Honorable Mayor and Members of the City Council
FROM: Ernesto Marquez, City Manager
BY: Elise McCaleb, Community Development Director
RECOMMENDATION:
Recommendation to continue the Public Hearing for the Minor Use Permit (MUP) for a proposed boat sales business located at 12347 E. Carson Street, to the meeting of July 22, 2026.
SUMMARY
On February 20, 2024, Surf City Boats, Inc. (“Applicant”) filed an application for Minor Use Permit (“MUP”) No. PLNG2024-0011 to authorize a boat sales business to be located at 12347 E. Carson Street (“the Property”). On December 12, 2024, the Community Development Director (“Director”) issued a decision to deny MUP No. PLNG2024-0011.
The property owner of the subject Property (“Property Owner”) timely filed an appeal of the Director’s decision to the City of Hawaiian Gardens Planning Commission.
On January 29, 2025, the Planning Commission held a public hearing to consider the appeal filed by Surf City Boats, Inc. The Planning Commission determined that the proposed use of the property is a Boat Sales business and directed staff to prepare appropriate resolutions and conditions of approval to authorize the boat sales use on the Property 3 (AYES) to 2 (NOES).
On March 5, 2025, the Planning Commission determined that the project is categorically exempt from the California Environmental Quality Action (CEQA) and approved Resolution No. 2025-001 (3 AYES; 2 ABSENT), subject to meeting certain Conditions of Approval.
On March 10, 2025, a Councilmember requested that the Planning Commission’s decision approving MUP No. PLNG2024-0011 be reviewed by the entire City Council pursuant to the authority granted in Hawaiian Gardens Municipal Code (“HGMC”) Section 12347 E. Carson Street
June 10, 2026
18.100.170(D). This section of the HGMC authorizes any member of the City Council to call up for review any decision made by the Director or Planning Commission. The City Council’s decision on the matter will be final.
On October 22, 2025 the City Council held a public hearing to review the decision of the Planning Commission and affirm (with the same or different conditions of approval) or overturn the Planning Commission’s decision and adopt appropriate findings to deny the MUP. The City Council voted to continue the public hearing until December 10, 2025 to allow for additional time to review the information provided.
On December 10, 2025, the public hearing was reopened and both Staff and the Applicant made presentations. The City Council directed the City Attorney and applicant’s attorney to meet to discuss the uses as well as conditions of approval. The hearing was continued to February 11, 2026 to allow the parties additional time to review the project and revise the conditions of approval, per Council direction. The hearing was further continued to March 11, 2026. The City Attorney and applicant’s attorney have been in discussions regarding the uses and conditions. On March 3, 2026, the applicant submitted a revised site plan to the City. To allow staff sufficient time to review the site plan and for the parties to finalize discussions regarding uses and conditions, staff recommended that this item be continued to April 22, 2026.
Since the meeting continuance to April 22, 2026, Staff reviewed and provided comments on the revised site plan for the applicant. The City Attorney’s office also met with the Applicant’s attorney on the outstanding Conditions of Approval. Based upon the progress made, Staff is recommending that the Public Hearing be continued until June 10, 2026.
Since the meeting continuance to June 10, 2026, a Zoom meeting was held to explain the Low Impact Development (LID) requirements for the proposed project. Staff is waiting for the submission of the revised Site Plan and for review of it by the Los Angeles County Fire Department. Because no site plan has been submitted to date, Staff is recommending that the Public Hearing by continued until July 22, 2026.

RECOMMENDATION:
Recommendation to continue the Public Hearing for the appeal of business license denial for Chavez Unlimited Construction, Inc., for property located at 12347 E. Carson Street, to the meeting of July 22, 2026.
SUMMARY
The Community Development Department (“Department”) received the Business License Application for Chavez Unlimited Construction, Inc. (“Appellant”) on April 22, 2025 requesting a business license for Office and Professional Use at the property located at 12347 E. Carson Street. The business license application for the proposed office use at the Property was denied by the Community Development Director based on the Director’s interpretation of Code provisions and the determination that the principal use is not an office but a contractor storage yard which is not permitted by the City of Hawaiian Gardens’ General Commercial (C-4) zoning designation. Following the denial, the property owner appealed the decision, and the matter is now before the City Council pursuant to Hawaiian Gardens Municipal Code Section 5.04.230 and 18.100.170.
On December 10, 2025 a public hearing was scheduled to hear the appeal. This appeal is being considered concurrently with a separate appeal by the City Council at the same property for a minor use permit (MUP) for boat sales use. The City Council determined that it would be appropriate to continue this item along with the MUP appeal hearing to February 11, 2026. Both hearings were further continued to March 11, 2026 and again to April 22, 2026 and to June 10, 2026.
The parties are still in discussions regarding the various uses at the property and related conditions of approval and need more time for consideration by the City Council.
Communication has continued between the parties. Staff has reviewed and provided comments on the revised site plan for the MUP applicant that includes the proposed office use. The City Attorney’s office has had ongoing discussions with the MUP applicant’s attorney to resolve the outstanding items and conditions of approval. 12347 E. Carson Street
June 10, 2026
Additionally, the parties have met to review the Low Impact Development (LID) requirements for the proposed project. Staff is waiting for the MUP applicant’s submission of the revised site plan and for review of it by the Los Angeles County Fire Department.
Based on the progress made and because the revised site plan has not been received to date, Staff is recommending that the Public Hearing be continued until July 22, 2026.

CITY OF HAWAIIAN GARDENS
CITY COUNCIL
STAFF REPORT
Agenda Item #C1
DATE: June 10, 2026
TO: Honorable Mayor and Members of the City Council
FROM: Ernesto Marquez, City Manager
BY: Neema Ghanbari, MS, PE, Public Works Director
RECOMMENDATION:
RECOMMENDATION TO AUTHORIZE THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH MARIPOSA LANDSCAPES, INC. FOR STREET CLEANUP,
TRASH COLLECTION, LANDSCAPING, AND TREE MAINTENANCE SERVICES IN
ACCORDANCE WITH THE HAWAIIAN GARDENS BEAUTIFICATION GRANT
PROJECT SCOPE OF WORK
SUMMARY
The Public Works Department is responsible for maintaining arterial and collector street parkways, including landscaped medians and street trees throughout the City. The Department also provides street cleanup services, including the removal of litter, debris, and bulky items, as well as graffiti abatement within public rights-of-way. These efforts support the City's beautification goals and help maintain a clean, safe, and attractive environment for residents, businesses, and visitors.
The Department currently expends approximately $110,000 annually for parkway and median landscaping, tree maintenance, and street cleanup activities. In addition, approximately $50,000 is spent each year on graffiti abatement services, including contractor costs, materials, equipment, and staff labor.
To assist local agencies in improving public spaces, the California Department of Transportation (Caltrans) established the Clean California Local Grant Program. The program provides funding to local communities to beautify and enhance streets, roads, parks, pathways, transit facilities, and other public spaces. Through litter removal, graffiti abatement, landscaping improvements, and public beautification efforts, the program seeks to create cleaner, safer, and more welcoming environments for residents while promoting walking, recreation, and community engagement.
Agenda Item #C1
June 10, 2026
The goals of the Clean CA Local Grant Program are to:
• Reduce the amount of waste and debris within public rights-of-way, pathways, parks, transit centers, and other public spaces.
• Enhance, rehabilitate, restore, or install measures to beautify and improve public spaces and mitigate the urban heat island effect.
• Enhance public health, cultural connection, and community placemaking by improving public spaces for walking and recreation.
• Advance equity for underserved communities.
In October 2025, the City's Engineering Division submitted an application for funding under the Clean California Community Cleanup and Employment Pathways (CCEP) Grant Program.
On February 19, 2026, Caltrans awarded the City $180,000 in Clean California Local Grant Program funding for the Hawaiian Gardens Beautification Project. Following the award notification, Caltrans requested the City to submit a final scope of work and supporting documentation necessary to execute the grant agreement and issue a Notice to Proceed.
On May 15, 2026, the City received the fully executed Grant Agreement No. RGA 07- CCEP-17 and Notice to Proceed from Caltrans. The $180,000 grant award will assist the Public Works Department in implementing a citywide beautification program focused on arterial corridors and public spaces. Project activities include graffiti abatement, litter and bulky-item removal, landscaping improvements, tree maintenance, and transit stop cleanups. These efforts will enhance the appearance and condition of public infrastructure, sidewalks, transit facilities, and major transportation corridors throughout the City.
To support the timely and efficient implementation of the grant-funded activities, the City issued a Request for Proposals (RFP) on April 14, 2026, seeking qualified contractors to provide citywide graffiti removal, pressure washing, street cleanup, landscaping, and tree maintenance services. The objective was to establish a contractual agreement with a qualified contractor capable of delivering responsive and cost-effective services consistent with the grant requirements.
On May 6, 2026, the City received three (3) proposals from qualified contractors.
Following an evaluation of qualifications, experience, responsiveness, and cost, Mariposa Landscapes, Inc. was determined to be the most qualified and responsive proposer and is able to provide the majority of the requested services within the available grant budget.
The agreement will cover a broad scope of services identified in the approved grant scope of work, including street cleanup, litter and bulky-item collection, graffiti abatement support, landscaping, and tree maintenance services. The agreement will be for an initial one-year term, with options for annual extensions subject to funding availability, Agenda Item #C1

satisfactory contractor performance, and the continued needs of the City. Work will be performed on both a routine and as-needed basis through task orders issued and administered by the Public Works Department.
Mariposa Landscapes, Inc. currently provides similar maintenance and beautification services for several local agencies, including the Cities of Lawndale, Signal Hill, Santa Monica, and South Gate.
Staff recommends that the City Council authorize the City Manager to execute an agreement with Mariposa Landscapes, Inc. for street cleanup, trash collection, landscaping, and tree maintenance services in accordance with the Hawaiian Gardens Beautification Grant Project scope of work.
FISCAL IMPACT
Sufficient funds are appropriated in the Public Works Department’s Contract Services account to cover the routine maintenance costs for trash collection, cleanup, graffiti removal, landscaping, and tree maintenance services. The $180,000 Clean California grant award will fund this agreement and other eligible services necessary to implement the approved project scope of work.
SUGGESTED ACTION
Approve Recommendation.

The insurer shall agree to waive all rights of subrogation against the CITY, its officers, agents, employees, and volunteers for losses arising from work performed by the CONTRACTOR for CITY.
2. General Liability Coverage. The CONTRACTOR shall maintain commercial general liability insurance in an amount of not less than two million dollars ($2,000,000) per occurrence for bodily injury, personal injury, and property damage. If a commercial general liability insurance form or other form with a general aggregate limit is used, either the general aggregate limit shall apply separately to the work to be performed under this Agreement or the general aggregate limit shall be at least twice the required occurrence limit.
3. Automobile Liability Coverage. The CONTRACTOR shall maintain automobile liability insurance covering bodily injury and property damage for all activities of the CONTRACTOR arising out of or in connection with the work to be performed under this Agreement, including coverage for owned, hired, and non-owned vehicles, in an amount of not less than one million dollars ($1,000,000) combined single limit for each occurrence.
4. Professional Liability Coverage. The CONTRACTOR shall maintain professional errors and omissions liability insurance for protection against claims alleging negligent acts, errors, or omissions which may arise from the CONTRACTOR’S operations under this Agreement, whether such operations be by the CONTRACTOR or by its employees, subcontractors, or subcontractors. The amount of this insurance shall not be less than one million dollars ($1,000,000) on a claims-made annual aggregate basis, or a combined single-limit-peroccurrence basis. When coverage is provided on a “claims made basis,” CONTRACTOR will continue to renew the insurance for a period of three (3) years after this Agreement expires or is terminated. Such insurance will have the same coverage and limits as the policy that was in effect during the term of this Agreement, and will cover CONTRACTOR for all claims made by CITY arising out of any errors or omissions of CONTRACTOR, or its officers, employees or agents during the time this Agreement was in effect.
B. Endorsements. Each general liability, automobile liability and professional liability insurance policy shall be issued by a financially responsible insurance company or companies admitted and authorized to do business in the State of California, or which is approved in writing by CITY, and shall be endorsed as follows. CONTRACTOR also agrees to require all contractors, and subcontractors to do likewise.
1. “The CITY, its elected or appointed officers, officials, employees, agents, and volunteers are to be covered as additional insureds with respect to liability arising out of work performed by or on behalf of the CONTRACTOR, including materials, parts, or equipment furnished in connection with such work or operations.”
2. This policy shall be considered primary insurance as respects the CITY, its elected or appointed officers, officials, employees, agents, and volunteers. Any insurance maintained by the CITY, including any self-insured retention the CITY may have, shall be considered excess insurance only and shall not contribute with this policy.
3. This insurance shall act for each insured and additional insured as though a separate policy had been written for each, except with respect to the limits of liability of the insuring company.
4. The insurer waives all rights of subrogation against the CITY, its elected or appointed officers, officials, employees, or agents.
5. Any failure to comply with reporting provisions of the policies shall not affect coverage provided to the CITY, its elected or appointed officers, officials, employees, agents, or volunteers.
6. The insurance provided by this policy shall not be suspended, voided, canceled, or reduced in coverage or in limits except after thirty (30) days written notice has been received by the CITY.
C. CONTRACTOR agreesto provide immediate notice to CITY of any claim or loss against Contractor arising out of the work performed under this agreement. CITY assumes no obligation or liability by such notice, but has the right (but not the duty) to monitor the handling of any such claim or claims if they are likely to involve CITY.

E. The CONTRACTOR shall provide certificates of insurance with original endorsements to the CITY as evidence of the insurance coverage required herein. Certificates of such insurance shall be filed with the CITY on or before commencement of performance of this Agreement. Current certification of insurance shall be kept on file with the CITY at all times during the term of this Agreement.
F. Failure on the part of the CONTRACTOR to procure or maintain required insurance shall constitute a material breach of contract under which the CITY may terminate this Agreement pursuant to Section 11 above.
G. The commercial general and automobile liability policies required by this Agreement shall allow CITY, as additional insured, to satisfy the self-insured retention (“SIR”) and/or deductible of the policy in lieu of the CONTRACTOR (as the named insured) should CONTRACTOR fail to pay the SIR or deductible requirements. The amount of the SIR or deductible shall be subject to the approval of the City Attorney and the Finance Director. CONTRACTOR understands and agrees that satisfaction of this requirement is an express condition precedent to the effectiveness of this Agreement. Failure by CONTRACTOR as primary insured to pay its SIR or deductible constitutes a material breach of this Agreement. Should CITY pay the SIR or deductible on CONTRACTOR’s behalf upon the CONTRACTOR’s failure or refusal to do so in order to secure defense and indemnification as an additional insured under the policy, CITY may include such amounts as damages in any action against CONTRACTOR for breach of this Agreement in addition to any other damages incurred by CITY due to the breach.
USE OF OTHER CONTRACTORS. CONTRACTOR must obtain CITY’s prior written approval to use any sub-contractors while performing any portion of this Agreement. Such approval must include approval of the proposed CONTRACTOR and the terms of compensation.
FINAL PAYMENT ACCEPTANCE CONSTITUTES RELEASE. The acceptance by the CONTRACTOR of the final payment made under this Agreement shall operate as and be a release of the CITY from all claims and liabilities for compensation to the CONTRACTOR for anything done, furnished or relating to the CONTRACTOR’S work or services. Acceptance of payment shall be any negotiation of the CITY’S check or the failure to make a written extra compensation claim within ten (10) calendar days of the receipt of that check. However, approval or payment by the CITY shall not constitute, nor be deemed, a release of the responsibility and liability of the CONTRACTOR, its employees, sub-contractors and agents for the accuracy and competency of the information provided
and/or work performed; nor shall such approval or payment be deemed to be an assumption of such responsibility or liability by the CITY for any defect or error in the work prepared by the CONTRACTOR, its employees, sub-contractors and agents.
CORRECTIONS. In addition to the above indemnification obligations, the CONTRACTOR shall correct, at its expense, all errors in the work which may be disclosed during the CITY’s review of the CONTRACTOR’s report or plans. Should the CONTRACTOR fail to make such correction in a reasonably timely manner, such correction shall be made by the CITY, and the cost thereof shall be charged to the CONTRACTOR. In addition to all other available remedies, the CITY may deduct the cost ofsuch correction from any retention amount held by the CITY or may withhold payment otherwise owed CONTRACTOR under this Agreement up to the amount of the cost of correction.
NON-APPROPRIATION OF FUNDS. Payments to be made to CONTRACTOR by CITY for services preformed within the current fiscal year are within the current fiscal budget and within an available, unexhausted fund. In the event that CITY does not appropriate sufficient funds for payment of CONTRACTOR’S services beyond the current fiscal year, the Agreement shall cover payment for CONTRACTOR’S services only to the conclusion of the last fiscal year in which CITY appropriates sufficient funds and shall automatically terminate at the conclusion of such fiscal year.

Prior to CONTRACTOR commencing services hereunder, the City’s Manager shall prepare and deliver to CONTRACTOR a memorandum detailing the extent of CONTRACTOR’s disclosure obligations in accordance with the CITY’s Conflictof Interest Code.
36 LABOR COMPLIANCE. As used herein, “Project” is synonymous with services described in this Agreement.
36.1 Prevailing Wages. Contractor is aware of the requirements of California Labor Code Section 1720 et seq., and 1770 et seq., as well as California Code of Regulations, Title 8, Section 16000 et seq., (“Prevailing Wage Laws”), which require the payment of prevailing wage rates and the performance of other requirements on “public works” and “maintenance” projects. Since the Services are being performed as part of an applicable “public works” or “maintenance” project, as defined by the Prevailing Wage Laws, and since the total compensation is $1,000 or more, Contractor agrees to fully comply with such Prevailing Wage Laws. City shall provide Contractor with a copy of the prevailing rates of per diem wages in effect at the commencement of this Contract upon request. Contractor shall make copies of the prevailing rates of per diem wages for each craft, classification or type of worker needed to execute the Services available to interested parties upon request, and shall post copies at Contractor’s principal place of business and at the project site. Contractor shall defend, indemnify and hold the City, its officials, officers, employees and agents free and harmless from any claim or liability arising out of any failure or alleged failure to comply with the Prevailing Wage Laws. Contractor and any subcontractor shall forfeit a penalty of up to $200 per calendar day or portion thereof for each worker paid less than the prevailing wage rates.
36.2 Apprenticeable Crafts. When Contractor employs workmen in an apprenticeable craft or trade, Contractor shall comply with the provisions of Section 1777.5 of the California Labor Code with respect to the employment of properly registered apprentices upon public works. The primary responsibility for compliance with said section for all apprenticeable occupations shall be with Contractor. The Contractor or any subcontractor that is determined by the Labor Commissioner to have knowingly violated Section 1777.5 shall forfeit as a civil penalty an amount not exceeding $100 for each full calendar day of noncompliance, or such greater amount as provided by law.
36.3 Hours of Work. Contractor is advised that eight (8) hours labor constitutes a legal day’s work. Pursuant to Section 1813 of the California Labor Code, Contractor shall forfeit a penalty of $25.00 per worker for each day that each worker is permitted to work more than eight (8) hours in any one calendar day and forty (40) hours in any one calendar week, except when payment for overtime is made at not less than one and one-half (1-1/2) times the basic rate for that worker.
36.4 Payroll Records. Contractor and each subcontractor shall keep an accurate payroll record, showing the name, address, social security number, work classification, straight time and overtime
hours worked each day and week, and the actual per diem wages paid to each journeyman, apprentice, worker, or other employee employed by him or her in connection with the public work. The payroll records shall be certified and shall be available for inspection at all reasonable hours at the principal office of Contractor in the manner provided in Labor Code section 1776. In the event of noncompliance with the requirements of this section, Contractor shall have 10 days in which to comply subsequent to receipt of written notice specifying in what respects such Contractor must comply with this section. Should noncompliance still be evident after such 10-day period, Contractor shall, as a penalty to City, forfeit not more than $100.00 for each calendar day or portion thereof, for each worker, until strict compliance is effectuated. The amount of the forfeiture is to be determined by the Labor Commissioner. A contractor who is found to have violated the provisions of law regarding wages on Public Works with the intent to defraud shall be ineligible to bid on Public Works contracts for a period of one to three years as determined by the Labor Commissioner. Upon the request of the Division of Apprenticeship Standards or the Division of Labor Standards Enforcement, such penalties shall be withheld from progress payments then due. The responsibility for compliance with this section is on Contractor. The requirement to submit certified payroll records directly to the Labor Commissioner under Labor Code section 1771.4 shall not apply to work performed on a public works project that is exempt pursuant to the small project exemption specified in Labor Code Section 1771.4.
36.5 Contractor and Subcontractor Registration. Pursuant to Labor Code sections 1725.5 and 1771.1, all contractors and subcontractors that wish to bid on, be listed in a bid proposal, or enter into a contract to perform public work must be registered with the Department of Industrial Relations. No bid will be accepted nor any contract entered into without proof of the contractor’s and subcontractors’ current registration with the Department of Industrial Relations to perform public work. Contractor is directed to review, fill out and execute the Public Works Contractor Registration Certification attached hereto as Exhibit “E” prior to contract execution. Notwithstanding the foregoing, the contractor registration requirements mandated by Labor Code Sections 1725.5 and 1771.1 shall not apply to work performed on a public works project that is exempt pursuant to the small project exemption specified in Labor Code Sections 1725.5 and 1771.1.
36.6 Labor Compliance; Stop Orders. This Project is subject to compliance monitoring and enforcement by the Department of Industrial Relations. It shall be the Contractor’s sole responsibility to evaluate and pay the cost of complying with all labor compliance requirements under this Contract and applicable law. Any stop orders issued by the Department of Industrial Relations against Contractor or any subcontractor that affect Contractor’s performance of Work, including any delay, shall be Contractor’s sole responsibility. Any delay arising out of or resulting from such stop orders shall be considered Contractor caused delay subject to any applicable liquidated damages and shall not be compensable by the City. Contractor shall defend, indemnify and hold the City, its officials, officers, employees and agents free and harmless from any claim or liability arising out of stop orders issued by the Department of Industrial Relations against Contractor or any subcontractor.

INSURANCE REQUIREMENTS.
A. The CONTRACTOR, at the CONTRACTOR’s own cost and expense, shall procure and maintain, for the duration of the contract, the following insurance policies:
1. Workers Compensation Insurance as required by law. The CONTRACTOR shall require all subcontractors similarly to provide such compensation insurance for their respective employees.
Any notice of cancellation or non-renewal of all Workers’ Compensation policies must be received by the CITY at least thirty (30) days prior to such change.
D. Any deductibles or self-insured retentions must be declared to and approved by the CITY. At the CITY’s option, the CONTRACTOR shall demonstrate financial capability for payment of such deductibles or self-insured retentions.
