RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HAWAIIAN GARDENS
RATIFYING A MEMORANDUM OF UNDERSTANDING (MOU) BETWEEN THE CITY
OF HAWAIIAN GARDENS AND THE AMERICAN FEDERATION OF STATE,
COUNTY AND MUNICIPAL EMPLOYEES, RANK AND FILE UNIT AND APPROVING
A SIDE LETTER OF UNDERSTANDING TO THE MOU
WHEREAS, the term of the previous Memorandum of Understanding (MOU) and Side Letter Agreement between the City of Hawaiian Gardens (“City”) and American Federation Of State, County, and Municipal Employees AFL-CIO, Local 3624, Council 36, (“AFSCME”) Rank & File Unit expired on December 31, 2023; and
WHEREAS, in 2024, the City and the AFSCME engaged in negotiations that resulted in a tentative agreement for a successor MOU; and
WHEREAS, on December 11, 2024, the City Council approved that MOU by adopting Resolution No. 040-2024 and directed the City Manager to continue to work with AFSCME on any required side letter to clarify or explain the intent of the parties in the approved MOU; and WHEREAS, the parties engaged in further negotiation and recently completed the negotiations to clarify and finalize the terms of a successor agreement.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Hawaiian Gardens as follows:
Section 1. The City Council approves, ratifies and agrees to the terms of the attached Memorandum of Understanding between AFSCME Rank & File Unit and the City for the period of July 1, 2024 through June 30, 2028 (Exhibit 1) and Side Letter of Understanding (Exhibit 2), that are by this reference incorporated herein and shall have effect according to the terms when signed by the authorized representatives of all Parties.
Section 2. The City Manager is authorized to execute the successor MOU and Side Letter of Understanding in the form attached hereto as Exhibit 1 and Exhibit 2, and at that time the expired MOU and all other side letter agreements between the parties shall be deemed superseded and rescinded.
Section 3. This Resolution shall take effect immediately. The City Clerk, or duly designated staff, is directed to attest thereto.
ADOPTED by the City Council of City of Hawaiian Gardens at a regular meeting of the City Council held on the 8th day of July 2026.
