STAFF REPORT
Agenda Item #A1
DATE: July 22, 2026
TO: Honorable Mayor and Members of the City Council
FROM: Ernesto Marquez, City Manager
BY: Linda Hollinsworth, Finance Director
RECOMMENDATION:
RECOMMENDATION TO CONDUCT A PUBLIC HEARING AND APPROVE
RESOLUTION 021-2026, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
HAWAIIAN GARDENS, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA,
AUTHORIZING THE RECORDING OF LIENS AGAINST VARIOUS REAL PROPERTIES
IN THE CITY OF HAWAIIAN GARDENS FOR DELINQUENT RUBBISH COLLECTION CHARGES DUE TO WASTE MANAGEMENT, INC.
SUMMARY
The City has received notifications from the franchised trash hauler, Waste Management, Inc. that there exist various delinquent rubbish accounts. To place a lien on a property for these fees they must be over 60 days past due. Although the waste hauler has not been compensated for its services, the collection of rubbish has continued due to health and safety issues. The waste hauler has made all reasonable efforts to diligently pursue and collect fees and charges due to them. However, several accounts remain unpaid as indicated in Exhibit “A” of Resolution No. 021-2026 Letters were sent to all owners of the properties listed on this report at least 10 days prior to this meeting.
Hawaiian Gardens Municipal Code Section 6.12.102 provides a mechanism for the City to collect on delinquent accounts by recording a special assessment against the real property served. Upon proper notification to the property owner, the City Council shall review and approve the assessment, which would include the amount of the unpaid delinquent balance, the amount of the penalty, and the collections costs. If the assessment determined and approved by the City Council is not paid within a minimum grace period of ten (10) days after the Council’s adoption of Resolution No. 021-2026, the City Manager or duly authorized representative is directed to record in the office of the County Recorder, a lien against the real property for the amount of the special Agenda Item #A1

RECOMMENDATION:
Recommendation to continue the Public Hearing for the Minor Use Permit (MUP) for a proposed boat sales business located at 12347 E. Carson Street, to the meeting of September 9, 2026.
SUMMARY
On February 20, 2024, Surf City Boats, Inc. (“Applicant”) filed an application for Minor Use Permit (“MUP”) No. PLNG2024-0011 to authorize a boat sales business to be located at 12347 E. Carson Street (“the Property”). On December 12, 2024, the Community Development Director (“Director”) issued a decision to deny MUP No. PLNG2024-0011.
The property owner of the subject Property (“Property Owner”) timely filed an appeal of the Director’s decision to the City of Hawaiian Gardens Planning Commission.
On January 29, 2025, the Planning Commission held a public hearing to consider the appeal filed by Surf City Boats, Inc. The Planning Commission determined that the proposed use of the property is a Boat Sales business and directed staff to prepare appropriate resolutions and conditions of approval to authorize the boat sales use on the Property 3 (AYES) to 2 (NOES).
On March 5, 2025, the Planning Commission determined that the project is categorically exempt from the California Environmental Quality Action (CEQA) and approved Resolution No. 2025-001 (3 AYES; 2 ABSENT), subject to meeting certain Conditions of Approval.
On March 10, 2025, a Councilmember requested that the Planning Commission’s decision approving MUP No. PLNG2024-0011 be reviewed by the entire City Council pursuant to the authority granted in Hawaiian Gardens Municipal Code (“HGMC”) Section 12347 E. Carson Street
July 22, 2026
18.100.170(D). This section of the HGMC authorizes any member of the City Council to call up for review any decision made by the Director or Planning Commission. The City Council’s decision on the matter will be final.
On October 22, 2025 the City Council held a public hearing to review the decision of the Planning Commission and affirm (with the same or different conditions of approval) or overturn the Planning Commission’s decision and adopt appropriate findings to deny the MUP. The City Council voted to continue the public hearing until December 10, 2025 to allow for additional time to review the information provided.
On December 10, 2025, the public hearing was reopened and both Staff and the Applicant made presentations. The City Council directed the City Attorney and applicant’s attorney to meet to discuss the uses as well as conditions of approval. The hearing was continued to February 11, 2026 to allow the parties additional time to review the project and revise the conditions of approval, per Council direction. The hearing was further continued to March 11, 2026. The City Attorney and applicant’s attorney have been in discussions regarding the uses and conditions. On March 3, 2026, the applicant submitted a revised site plan to the City. To allow staff sufficient time to review the site plan and for the parties to finalize discussions regarding uses and conditions, this item was continued by the City Council to April 22, 2026.
Following continuance, staff reviewed and provided comments on the revised site plan for the applicant. The City Attorney’s office also met with the Applicant’s attorney on the outstanding Conditions of Approval. Based upon the progress made, the public hearing was further continued until June 10, 2026.
Thereafter, a Zoom meeting was held on May 7, 2026 to explain the Low Impact Development (LID) requirements for the proposed project. Pending resolution of remaining issues, including submission of a revised Site Plan and review by the Los Angeles County fire Department, the hearing was continued until July 22, 2026.
In follow up to the May 7 meeting, on June 16, 2026, the City received a memorandum from Fuscoe Engineering representing the Applicant where they contend that the proposed work constitutes “maintenance” and not “redevelopment” as defined in the City’s code. The Applicant is proposing to repair 20 potholes distributed throughout the paved areas, totaling 650 square feet and minor site improvements. This issue is not yet resolved. However, based on the position stated in the memo and existing drainage conditions, the City has requested that the revised site plan incorporate additional drainage information to inform the City’s review.
Given that there are still several outstanding issues that must be addressed prior to the City Council’s consideration, staff recommends that the Public Hearing be continued to the meeting of September 9, 2026.

RECOMMENDATION:
Recommendation to continue the Public Hearing for the appeal of business license denial for Chavez Unlimited Construction, Inc., for property located at 12347 E. Carson Street, to the meeting of September 9, 2026.
SUMMARY
The Community Development Department (“Department”) received the Business License Application for Chavez Unlimited Construction, Inc. (“Appellant”) on April 22, 2025 requesting a business license for Office and Professional Use at the property located at 12347 E. Carson Street. The business license application for the proposed office use at the Property was denied by the Community Development Director based on the Director’s interpretation of Code provisions and the determination that the principal use is not an office but a contractor storage yard which is not permitted by the City of Hawaiian Gardens’ General Commercial (C-4) zoning designation. Following the denial, the property owner appealed the decision, and the matter is now before the City Council pursuant to Hawaiian Gardens Municipal Code Section 5.04.230 and 18.100.170.
On December 10, 2025 a public hearing was scheduled to hear the appeal. This appeal is being considered concurrently with a separate appeal by the City Council at the same property for a minor use permit (MUP) for boat sales use. The City Council determined that it would be appropriate to continue this item along with the MUP appeal hearing to February 11, 2026. Both hearings were further continued to March 11, 2026, to April 22, 2026, to June 10, 2026 and again to July 22, 2026.
The parties are still in discussions regarding the various uses at the property and related conditions of approval and need more time for consideration by the City Council.
Communication has continued between the parties. Staff has reviewed and provided comments on the revised site plan for the MUP applicant that includes the proposed office use. The City Attorney’s office has had ongoing discussions with the MUP applicant’s attorney to resolve the outstanding items and conditions of approval. 12347 E. Carson Street
July 22, 2026
Additionally, the parties have met to review the Low Impact Development (LID) requirements for the proposed project. Staff is waiting for the MUP applicant’s submission of the revised site plan and for review of it by the Los Angeles County Fire Department.
There are still several outstanding issues that must be addressed prior to the City Council’s consideration. Therefore, staff recommends that the Public Hearing be continued to the meeting of September 9, 2026.

C. ORAL COMMISIONERS REPORT
Commissioner Hernandez asked whether the city could organize a paper shredding event.
Commissioner Rodriguez expressed her gratitude to the Easter photo booth attendant for taking care of her while dressed in the Easter Bunny costume, especially since the weather was quite warm. Regarding the parade, she feels more secure riding in a car rather than on a float. Additionally, she was somewhat disappointed by the low attendance at the parade breakfast, as she would have preferred the more formal arrangement that drew a larger crowd two years ago.
Vice Chair Gonzalez expressed his gratitude to the staff and Eric for organizing the parade and carnival, highlighting their ongoing excellent work in special events. He also noted that during the parade, the paper signs on the cars were falling off, suggesting that more durable options are needed.
Chair Amaro asked whether the parade would consistently be a community event. He also expressed his gratitude to the staff for their great work during the parade and carnival.

RECOMMENDATION THAT THE CITY COUNCIL CONSIDER ADOPTING
RESOLUTION NO.022-2026 PLACING A BUSINESS LICENSE TAX MEASURE ON THE NOVEMBER 3, 2026 GENERAL MUNICIPAL ELECTION BALLOT
SUMMARY
In an effort to update and simplify the City’s business license tax structure, and yield revenue that can provide improved services to the community, the City is proposing a business license tax ballot measure.
The City of Hawaiian Gardens business license tax structure was adopted in 1993 by Ordinance No. 412 and is codified in Chapters 5.04 and 5.06 – Business License Fees of the Hawaiian Gardens Municipal Code (HGMC). The current business license tax structure has remained largely unchanged since 1993 and the City determined that a review and update was necessary.
Under the current framework, the tax is applied to various businesses with different types of rates including flat rates, percentage of revenue, number of employees, number of rental units or number of seats in a restaurant. There are approximately 34 categories of business types. Currently, annual average business license tax revenue collected is approximately $140,000. This revenue is recorded in the City’s General Fund and is used to fund City services including public safety, fire services, animal control and maintenance of public infrastructure, including streets, sidewalks, traffic signals, landscaping, and street lights.
The City engaged HDL to review the business license taxes and prepare an analysis of the current tax structure, the businesses within the City, and revenue trends for Hawaiian Gardens businesses, with a comparison of surrounding cities. Using the results of this Agenda Item #C2
July 22, 2026
analysis, HDL proposed three models that would update and modernize the business license tax framework and provide an adjustment to revenue to reflect the increased costs for municipal services.
At the July 8, 2026 City Council meeting, City Council provided direction to staff on updating the business license tax structure and placing a business license tax measure on the November 3, 2026 General Municipal Election ballot. The proposed model per Council direction applies a gross receipts structure to all businesses other than contractors and a flat rate for contractors. The simplified structure reduces the number of categories and applies the same rate to all business types to spread the tax burden. The updated business license tax structure is expected to provide additional revenue for the City to use in providing these municipal services for the business community.
New Business License Tax Structure
The City Council considered three models proposed by HdL for an updated and more streamlined Business License Tax structure. The City Council selected the Single Gross Receipts and Contractor Flat Rate structure. This applies a single gross receipts structure to all businesses other than “contractors”, consisting of a $50 flat rate for businesses with up to $30,000 in gross receipts, followed by a fixed rate per $1,000 of gross receipts above $30,000. Under this structure, businesses classified as “contractors”, without a business location in the City, would be charged a flat rate of $175. Applying a rate of $0.95 per thousand of gross receipts over the base of $30,000, this model is projected to generate an estimated annual revenue of approximately $563,810 annually, representing an estimated increase of $423,810 over current estimated revenue using current rates.
The updated structure is projected to increase revenue above the current levels and improve the City’s long-term ability to support municipal services, administrative programs, and fiscal planning.
This structure applies a flat annual tax for “contractors” for those businesses performing work in the City for which a California contractor’s license is required that generally work in the City for limited periods of time, but may have multiple projects throughout the year. A flat rate would allow for multiple projects in one calendar year without requiring business licenses for every project while still providing revenue to cover costs for municipal services. Contractors made up approximately 12% of the business license tax revenue for FY 24-25. Of the comparison cities, two cities also have a flat rate for contractors. Under the current tax structure contractors pay $120 annually. This rate would increase to $175.
Agenda Item #C2
July 22, 2026
Ballot Measure
This report returns a general tax measure for the Council’s consideration for placement on the November 3, 2026 General Municipal Election ballot. The proposed measure would:
Amend Section 5.04.100 of Chapter 5.04 and various sections of Articles I and II of Chapter 5.06 of the Hawaiian Gardens Municipal Code to update and simplify the City’s Business License Tax rate structure for the purpose of raising revenue to provide City services and supplement the General Fund.
Reduce the number of categories and establish a business tax rate based on a gross receipts structure for most businesses and a flat annual tax rate for contractors so that the tax rates will be based only upon three classes of business: (i) all businesses other than contractors will pay an annual $50 baseline flat rate plus a rate of ninety-five cents ($0.95) per $1,000 of gross receipts earned by the business above $30,000, (ii) contractor businesses will pay a single flat rate of $175 annually, and (iii) exempt businesses will not pay the tax.
Consistent with California Government Code Section 53724 and Elections Code Section 9222, the placement of the business license tax measure on the ballot requires a twothirds (2/3) vote of the City Council (four affirmative votes), and as a general tax, the measure requires approval by a simple majority of voters.
The City faces sustained cost pressures for public services that have outpaced existing revenue. If passed, this proposed measure would support the City of Hawaiian Gardens’ long-term fiscal planning objectives by strengthening the City’s revenue framework.
Modernizing the business license tax structure promotes:
• Responsible long-range fiscal planning;
• Alignment between economic activity and revenue generation; and • Improved sustainability of City services.
Staff recommends that the City council adopt the accompanying Resolution placing the measure on the November 3, 2026 ballot.
The ballot question and the City Attorney’s impartial analysis are intended to convey, in plain and neutral language and within the applicable word limits, what the tax does and who ultimately pays it. Staff will engage its consultants to prepare a public information effort to educate voters on the measure if the Council elects to proceed.
Agenda Item #C2
July 22, 2026
Process Timeline
In order to change the business license tax structure, a vote of the registered voters in Hawaiian Gardens is required. A simple majority is required to approve the proposed business license tax structure. Once the Resolution is approved, the City will forward it to the Los Angeles County Registrar of Voters/Elections Department to process the measure for the ballot in November. Staff will work with Englander, Knabe & Allen (EKA) and HDL to do community outreach to provide information and to answer questions from the local businesses and residents. The schedule for placement on the November 2026 ballot is as follows:
Resolution calling for placement on the ballot July 22, 2026 Submit to County Registrar-no later than August 7, 2026 Election November 3, 2026
If the ballot measure is successful, a resolution certifying the election results and that the voters approved the Ordinance will be presented for Council adoption.
The City Attorney’s Office has reviewed this staff report and prepared the accompanying resolution and ordinance. The City Attorney will prepare an impartial analysis for the measure as described in the Resolution.
ENVIRONMENTAL ANALYSIS
The recommended action is not a project subject to the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines Section 15378 because it involves calling an election and placing proposed general tax measures before the voters, which does not commit the City to a specific project and will not result in a direct or reasonably foreseeable indirect physical change to the environment. Alternatively, the action is exempt under CEQA Guidelines Section 15061(b)(3) because it can be seen with certainty that there is no possibility that the action may have a significant effect on the environment. Any future projects funded by revenue from the measures, if approved by the voters, would be subject to separate environmental review as required. No further environmental review is required for this action.
FISCAL IMPACT
The proposed business license tax structure is projected to produce approximately $563,810 annually. As a general tax, the additional revenue would be deposited in the General Fund and would have a positive impact on the City’s ability to pay for important Agenda Item #C2
July 22, 2026
general City services. Actual revenue will depend on approval by the voters and implementation of the new business license tax structure. Election costs are budgeted in FY 2026-2027 with a sufficient amount to include costs related to this ballot measure.
SUGGESTED ACTION
It is recommended that the City Council adopt the attached Resolution calling for the placement of a general tax measure on the November 3, 2026 General Municipal Election ballot for the submission to the qualified voters of a proposed ordinance amending section
5.04.100 of Chapter 5.04 and various sections of articles I and II of Chapter 5.06 of the City’s municipal code as it relates to business license taxes; requesting the County of Los Angeles to consolidate said election with the Statewide General Election of even date; and setting rules and deadlines for arguments and rebuttals for and against the measure.
