CITY OF HAWAIIAN GARDENS

CITY COUNCIL

STAFF REPORT
Agenda Item #A1
DATE: August 12, 2026
TO: Honorable Mayor and Members of the City Council
FROM: Ernesto Marquez, City Manager
BY: Steve Gomez, Director of Public Safety & Community Relations RECOMMENDATION:

Recommendation to adopt Resolution 025-2026, amending the City’s Administrative Citation Schedule to update fines for vehicle and traffic violations of Title 10 of the Hawaiian Gardens Municipal Code, Title 15 of the Los Angeles County Code and portions of the California Vehicle Code.

SUMMARY
Government Code Section 36900 states that a “[v]iolation of a city ordinance is a misdemeanor unless by ordinance it is made an infraction.” Government Code Section 53069.4 also authorizes local agencies, such as cities, to “by ordinance make any violation of any ordinance enacted by the local agency subject to an administrative fine or penalty.” Vehicle Code Section 40200 et seq. relatedly authorizes local agencies, such as cities, to impose and collect civil fines and penalties for violations of any local ordinance regulation pertaining to the stopping, standing, or parking of a vehicle by establishing a schedule of parking ticket amounts. To the extent feasible, the Vehicle Code aims for cities in the same county to have similar parking ticket amounts for similar violations.

On February 27, 1990, the City Council (“City Council”) of the City of Hawaiian Gardens (“City”) adopted Resolution No. 21-90, establishing a bail schedule (“Bail Schedule”) for violations of the City’s Municipal Code (“Municipal Code”). The Bail Schedule was subsequently amended on February 9, 1999 by Resolution 14-99 to reflect changes that had been made to the Municipal Code since the Bail Schedule’s adoption nine years prior.

On October 26, 2004, the City Council adopted Resolution No. 501-2004, adding Chapter

1.13 to the Municipal Code and establishing an Administrative Citation Program for violations of the City’s Municipal Code. A few months later, on December 14, 2004, the City Council adopted Resolution No. 106-2004, which amended the Bail Schedule to establish administrative fines pursuant to its Administrative Citation Program.

Agenda Item #A1

Page 2 ends

On October 25, 2022, the City Council adopted Resolution No. 050-2022, amending the Bail Schedule to establish civil penalties for violating the City’s Oversized Vehicle Parking Ordinance.

Because the Bail Schedule has not been comprehensively reviewed and revised since 2022, the Public Safety Department is now recommending a comprehensive review and update of the City’s Bail Schedule. As a first step, this Resolution will update the administrative fine schedule for traffic and vehicle violations to aid in improving the effectiveness of the City’s Code Enforcement efforts.

The purposes of the changes in fines is to:
Encourage vehicle operators to abide by all parking laws and regulations in an effort to create safer streets for all vehicles and pedestrians to utilize; Align fines with current rates in the county and surrounding cities; and Deter conduct and raise penalties equivalent to the severity of the violation.

This resolution repeals and replaces all portions of the Bail Schedule that specify fines for violations of Sections 10.04.010, 10.04.020, 10.28.010, 10.30.010, 10.36.030, and

10.36.040 of the Municipal Code, and specified Sections of the Vehicle Code. The revised fine amounts would go into effect on September 1, 2026.

Pursuant to Government Code Section 66018, the City Council held a duly noticed and advertised public hearing on August 12, 2026 to receive oral and written testimony concerning the proposed amendments to the Bail Schedule. Notice of the public hearing was given by publication in a newspaper of general circulation within the City once a week for two weeks commencing at least 10 days prior to the public hearing, with at least 5 days intervening between the first and last publication. The City Council heard and considered all oral and written testimony concerning the proposed amendments to the Bail Schedule on August 12, 2026 at the time and place set for the public hearing.

The proposed changes in fine amounts are as follows:

CITY OF HAWAIIAN GARDENS

CITY COUNCIL

STAFF REPORT
Agenda Item #C1
DATE: August 12, 2026
TO: Honorable Mayor and Members of the City Council
FROM: Ernesto Marquez, City Manager
BY: Steve Gomez, Director of Public Safety & Community Relations RECOMMENDATION:

RECOMMENDATION TO READ BY TITLE ONLY, CONDUCT FIRST READING AND INTRODUCE ORDINANCE NO. 2026-626, ADDING CHAPTER 12.22 TO TITLE XII OF

THE HAWAIIAN GARDENS MUNICIPAL CODE, REGULATING THE USE OF

ELECTRIC BICYCLES AND OTHER ELECTRIC MOBILITY DEVICES ON PUBLIC

PROPERTY AND WITHIN THE PUBLIC RIGHT-OF-WAY

SUMMARY
The use of electric bicycles and other electric mobility devices has grown in popularity in the City, and throughout the state. While these devices provide transportational and recreational benefits, their use on public property and within the public right-of-way can create safety concerns for pedestrians, motorists, and other riders. Additionally, electric mobility devices that are not operated responsibly can cause significant damage to personal and real property.

As a result, staff recommends adopting the proposed ordinance, which would add Chapter 12.22 to Title XII of the City’s Municipal Code. Chapter 12.22 would incorporate and regulate the use of electric mobility devices on public property and within the public right-of-way.

The proposed ordinance would prohibit the operation of electric mobility devices on public property or within the public right of way, unless (1) their use is specifically authorized by the City; or (2) they are being operated on a public highway, street, roadway, or designated bicycle lane, pursuant to state and federal law.

The proposed ordinance would also prohibit the operation of electric mobility devices in an “unsafe manner”. “Unsafe manner” is broadly defined and the following acts are Agenda Item #C1
August 12, 2026

included as examples of what may be considered operating an electric mobility devices in an “unsafe manner”:

1. Intentionally lifting one or more wheels into the air while operating an electric mobility device;

2. Operating an electric mobility device on a public highway, street, roadway, or designated bicycle lane against the flow of traffic or without regarding for surrounding vehicular traffic and pedestrians;

3. Intentionally swerving or riding around traffic;

4. Carrying more passengers than an electric mobility device is intended to carry;

5. Not obeying posted signs or traffic lights;

6. Operating an electric mobility device while using any handheld electronic device;

7. Operating an electric mobility device on a public sidewalk or on public property, unless specifically authorized to do;

8. Operating an electric mobility device while another individual who is not riding on the electric mobility device is clinging, or attaching oneself, to the electric mobility device;

9. Operating an electric mobility device in a manner that poses a risk of injury to pedestrians, motorists, bicyclists, or other persons; or

10.Operating an electric mobility device in a manner that actually causes injury to another person or damage to personal or real property.

Additionally, the proposed ordinance states that the City will be authorized to post signs about where operating electric mobility device is and is not permitted or regulated.

However, the presence or absence of such signage will not be a defense to a potential violation of this ordinance.

Furthermore, this proposed ordinance includes exemptions for use of electric mobility device by law enforcement, or other authorized government personnel; persons who rely on electric mobility devices for medical purposes; persons transporting electric mobility devices without actively operating them; and persons operating electric mobility devices in designated areas pursuant to applicable law.

Finally, violations of the proposed ordinance may result in the issuance of a citation.

Violations are also considered misdemeanors. Each act, occurrence, or incident in violation of the ordinance constitutes a separate offense.

DATE: August 12, 2026
TO: Honorable Mayor and Members of the City Council
FROM: Ernesto Marquez, City Manager
BY: Joseph Jimenez, Recreation and Community Services Director RECOMMENDATION:

Recommendation to receive and file a Youth Sports update.

SUMMARY
The City of Hawaiian Gardens Recreation and Community Services Department offers five youth recreational sports leagues each year. These programs are designed as recreational leagues that primarily focus on introducing participants to each sport by teaching basic skills, rules, teamwork, and good sportsmanship in a fun and supportive environment.

The City's 5 sports season offerings include:

Season Sport Ages
Fall Volleyball 7–12 years
Fall Flag Football 7–12 years
Winter Basketball 3–12 years
Spring Soccer 3–12 years
Summer Baseball 3–12 years
Currently, we are in our Youth Baseball Season. This season we have 148 youths participating in our league (83 in our Tee Ball Program- 3–6-year-olds, 65 in our youth baseball program, 7–12-year-olds). We currently have 14 teams in our current season, which play games on either Monday, Wednesday, Thursday and Friday.

Recreation staff play a significant role in the success of these programs by serving as coaches, officials, field set up, and score keepers. Prior to each season, staff participate in in-service training that covers:
• Basic sport-specific skills and drills
• Rules of play
• Safety procedures
• Field and court setup
• Customer service and program expectations
Program Successes
The Recreation and Community Services Department has implemented several improvements that have enhanced the overall participant experience, including:
• Improved communication with parents regarding schedules, game times, weather updates, and league information.
• Parent orientation meetings held prior to the first games to review league expectations, sportsmanship, volunteer opportunities, and team information. • Purchase and implementation of quality reversible jerseys for each participant. • Continued ability to adapt league rules and operations to align with current youth sports standards and participant needs.

Challenges
Like many recreation agencies across the country, our city continues to experience challenges affecting youth recreational sport, such as:
- Growth of Club and Travel Sports- Families choosing to participate in competitive club and travel programs over City recreational programs. o Impact on our older division (10-12) year olds tend to phase out from our division.
- Low Registration Cost: The City's leagues remain intentionally affordable to ensure accessibility for all families. However, the relatively low registration fee can sometimes result in reduced participant commitment, including missed practices and withdrawals during the season because families have minimal financial investment in the program.

Future Improvements
The Recreation and Community Services Department is committed to enhancing the quality of its youth sports programs. Planned improvements include:
