SUMMARY
The City's Public Safety Center roof is more than 15 years old and has reached the end of its useful service life.

In March 2026, staff retained engineering and architectural services from Willdan Engineering to prepare plans, specifications, and estimate (PS&E) for the Public Safety Center Roof Replacement, Project 125.

The project proposes to re-roof the Public Safety Center building located at 11940 Carson Street. This project will re-roof approximately 7000 square feet of roofing area to prevent water penetration and damage to the main structural frame.

On August 5, 2026, the City Clerk received seven (7) sealed bids for the project, as summarized below:

AMS Roofing & Construction, Inc., Riverside, CA $138,395.64 Best Contracting Services, Inc., Gardena, CA $195,596.50 Regan Roofing, Inc., Oceanside, CA $213,650.00
AME Builders, Inc., Upland, CA $243,558.90
Ranger Roofing & Solar, Malibu, CA $266,716.07
Courtney, Inc., Irvine, CA $275,197.00

Letner Roofing Company, Orange, CA $294,730.00
The project’s scope of work includes removal and replacement of the existing roof including furnishing roofing materials (PVC Single Ply Roofing System), roof drains, rain gutters, and screens.

City staff reviewed each bid and each company’s qualifications and responsiveness to the bid requirements. The lowest responsive bidder is Jax JCC Inc. DBA AMS Roofing & Construction, Inc., Riverside, CA, with a bid amount of $138,395.64. AMS Roofing & Construction, Inc. has provided similar services throughout California.

The City received a bid protest on August 7, 2026, from Best Contracting Services, Inc. stating that the bond was not executed by the principal and that there was an error in the final calculated bid amount. The protest was denied on the following basis:

First, a bid bond is enforceable if signed by the surety. (Civil Code section Civ. Code, § 2793; Pacific Mill & Timber Co. v. Massachusetts Bonding & Ins. Co. (1923) 192 Cal. 278, 282-292; Hill v. New Amsterdam Cas. Co. (1930) 105 Cal.App. 156, 158 -159; C. Ganahl Lumber Co. v. Thompson (1928) 205 Cal. 354, 358). The absence of the principal’s signature therefore is an immaterial irregularity which may be waived. (Bay Cities Paving & Grading, Inc. v. City of San Leandro (2014) 223 Cal.App.4th 1181, 1188 (missing page from bid bond inconsequential).

Furthermore, because the magnitude of the asserted clerical error in bid computation is so minimal, it is not grounds for bid withdrawal without bid forfeiture under section 5103 of the Public Contract Code and therefore conferred no competitive advantage. (See Diede Construction, Inc. v. Monterey Mechanical Co. (2004) 125 Cal.App.4th 380 (2.3% bid mistake probably not material).)
Staff recommends that the City Council ratify staff’s determination and reject the bid protest and award the contract to AMS Roofing & Construction, Inc.

Construction will begin in mid-September 2026 and will be completed by November 2026

FISCAL IMPACT
The project was included in the approved Capital Improvements Program budget for Fiscal Year 2025-26.

There might be roof substructure damage that will not be identified until the existing roof is removed. Per the architect’s recommendation staff increased the construction and inspection contingencies from 10% to 25%. The estimated project expenses are as follows:

Item Budget
Construction $140,000
Construction Contingency (25%) $35,000
Design $35,000
Inspection $50,000
Estimated Project Cost $260,000
