DATE: September 9, 2026
TO: Honorable Mayor and Members of the City Council
FROM: Ernesto Marquez, City Manager
BY: Elise McCaleb, Community Development Director
RECOMMENDATION:

Recommendation to continue the Public Hearing for the Minor Use Permit (MUP) for a proposed boat sales business located at 12347 E. Carson Street, to the meeting of October 14, 2026.

SUMMARY
On February 20, 2024, Surf City Boats, Inc. (“Applicant”) filed an application for Minor Use Permit (“MUP”) No. PLNG2024-0011 to authorize a boat sales business to be located at 12347 E. Carson Street (“the Property”). On December 12, 2024, the Community Development Director (“Director”) issued a decision to deny MUP No. PLNG2024-0011.

The property owner of the subject Property (“Property Owner”) timely filed an appeal of the Director’s decision to the City of Hawaiian Gardens Planning Commission.

On January 29, 2025, the Planning Commission held a public hearing to consider the appeal filed by Surf City Boats, Inc. The Planning Commission determined that the proposed use of the property is a Boat Sales business and directed staff to prepare appropriate resolutions and conditions of approval to authorize the boat sales use on the Property 3 (AYES) to 2 (NOES).

On March 5, 2025, the Planning Commission determined that the project is categorically exempt from the California Environmental Quality Action (CEQA) and approved Resolution No. 2025-001 (3 AYES; 2 ABSENT), subject to meeting certain Conditions of Approval.

On March 10, 2025, a Councilmember requested that the Planning Commission’s decision approving MUP No. PLNG2024-0011 be reviewed by the entire City Council pursuant to the authority granted in Hawaiian Gardens Municipal Code (“HGMC”) Section 12347 E. Carson Street

18.100.170(D). This section of the HGMC authorizes any member of the City Council to call up for review any decision made by the Director or Planning Commission. The City Council’s decision on the matter will be final.

On October 22, 2025, the City Council held a public hearing to review the decision of the Planning Commission and affirm (with the same or different conditions of approval) or overturn the Planning Commission’s decision and adopt appropriate findings to deny the MUP. The City Council voted to continue the public hearing until December 10, 2025, to allow for additional time to review the information provided.

On December 10, 2025, the public hearing was reopened and both Staff and the Applicant made presentations. The City Council directed the City Attorney and applicant’s attorney to meet to discuss the uses as well as conditions of approval. The City Attorney and applicant’s attorney have been in ongoing discussions regarding the uses and conditions of approval, per Council’s direction.

The City Council continued the hearing to February 11, 2026, to allow the parties additional time to review the project and revise the conditions of approval. The City Council further continued the hearing to March 11, 2026.

On March 3, 2026, the applicant submitted a revised site plan to the City. To allow staff sufficient time to review the site plan and for the parties to finalize discussions regarding uses and conditions, the hearing was again continued to April 22, 2026. Following continuance, staff reviewed and provided comments on the revised site plan for the applicant. The City Attorney’s office also met with the Applicant’s attorney on the outstanding conditions of approval. Based upon the progress made, the Public Hearing was further continued until June 10, 2026.

Thereafter, the parties held a Zoom meeting on May 7, 2026, to discuss the Low Impact Development (LID) requirements for the proposed project. Pending resolution of the remaining issues, including submission of a revised Site Plan and review by the Los Angeles County Fire Department, the Public Hearing was continued until July 22, 2026.

In follow up to the May 7 meeting, on June 16, 2026, the City received a memorandum from Fuscoe Engineering representing the Applicant where they contend that the proposed work constitutes “maintenance” and not “redevelopment” a defined in the City’s code. Based on the memo and existing draining conditions, the City requested that the revised site plan incorporate additional drainage information to inform the City’s review.

Given that there were several outstanding site conditions and requirements that needed to be addressed prior to the City Council’s consideration, the Public Hearing was continued to the meeting of September 9, 2026.

Since the last meeting continuance, the City further considered whether the proposed proposal for maintenance of the pavement on the site triggers LID requirements. The City Attorney’s Office met with the Applicant’s attorney and the Conditions of Approval were 12347 E. Carson Street

further refined. A revised site plan was submitted for review, but it does not include a landscape plan. It is unknown if Los Angeles County Fire has reviewed the site plan. RECOMMENDATION:

Recommendation to continue the Public Hearing for the appeal of business license denial for Chavez Unlimited Construction, Inc., for property located at 12347 E. Carson Street, to the meeting of October 14, 2026.

SUMMARY
The Community Development Department (“Department”) received the Business License Application for Chavez Unlimited Construction, Inc. (“Appellant”) on April 22, 2025 requesting a business license for Office and Professional Use at the property located at 12347 E. Carson Street. The business license application for the proposed office use at the Property was denied by the Community Development Director based on the Director’s interpretation of Code provisions and the determination that the principal use is not an office but a contractor storage yard which is not permitted by the City of Hawaiian Gardens’ General Commercial (C-4) zoning designation. Following the denial, the property owner appealed the decision, and the matter is now before the City Council pursuant to Hawaiian Gardens Municipal Code Section 5.04.230 and 18.100.170.

On December 10, 2025 a public hearing was scheduled to hear the appeal. This appeal is being considered concurrently with a separate appeal by the City Council at the same property for a minor use permit (MUP) for boat sales use. The City Council determined that it would be appropriate to continue this item along with the MUP appeal hearing to February 11, 2026. Both hearings were further continued to March 11, 2026 and again to April 22, 2026, June 10, 2026, July 22, 2026, and September 9, 2026.

Since the last continuance, the City further considered whether the proposed proposal for maintenance of the pavement on the site triggers LID requirements. The City Attorney’s Office met with the Applicant’s attorney and the Conditions of Approval were further refined. A revised site plan was submitted for review, but it does not include a separate landscape plan. It is unknown if Los Angeles County Fire has reviewed the site plan.

CITY OF HAWAIIAN GARDENS

CITY COUNCIL

STAFF REPORT
Agenda Item #C1
DATE: September 9, 2026
TO: Honorable Mayor and Members of the City Council
FROM: Elise McCaleb, Community Development Director
BY: Cielo Frausto-Lupo, Community Development Specialist RECOMMENDATION:

Receive and file the Hawaiian Gardens Community Retail Survey results.

SUMMARY
The City conducted the Hawaiian Gardens Community Retail Survey to better understand residents’ shopping habits and identify retail and dining options they would like to see in the City. There were 241 responses to the survey, with most respondents identifying as Hawaiian Gardens residents.

BACKGROUND & ANALYSIS
The survey was conducted online through SurveyMonkey and was promoted through the City’s social media and website posting. The survey consisted of 10 questions and was available from July 31 through August 31. The survey asked residents where they currently shop and dine, how often they leave Hawaiian Gardens to shop or eat, what types of retail and dining options they would like to see, and which specific businesses they would like to open in the City.

The results indicate that residents frequently leave Hawaiian Gardens to shop and dine elsewhere. The most common reasons identified were that better selection of goods and services are available outside the City and that preferred stores are located elsewhere.

Residents identified several retail categories as missing from Hawaiian Gardens. The most requested types of retailer were Hispanic supermarkets (52.52%), discount/dollar stores (47.48%), clothing/apparel boutiques (43.28%), specialty food markets (43.70%), and home décor (26.05%).

For dining, casual sit-down restaurants (68.94%) and coffee shops/cafes (54.04%) were the most requested types of dining options.

Agenda Item #C1
September 9, 2026

Page 2 ends

Staff also reviewed and categorized the open-ended responses. These responses also included comments received through social media. Among the specific businesses identified by respondents, Trader Joes (72 mentions), Northgate market (42 mentions), Target (34 mentions), Dutch Bros (34 mentions), Sprouts (23 mentions), and Tierra Mia (14) were among the most frequently requested retail and food uses. Respondents also identified recurring interest in casual sit-down restaurants, coffee shops, burger restaurants, and other dining concepts. Staff also noted recurring requests for entertainment and recreational uses, including bowling, movie theaters, tap rooms, breweries, children’s entertainment, and other family-oriented spaces.

The survey results provide staff with Community input that can be used to inform future economic development and retail attraction efforts, including outreach to prospective retailers and businesses. Attracting additional retail and dining establishments may also expand the City’s sales tax base and generate additional local revenue.

FISCAL IMPACT
There is no immediate fiscal impact associated with receiving and filing the Community Retail Survey results. Future business attraction efforts may generate additional sale tax revenue for the City.

CITY OF HAWAIIAN GARDENS

CITY COUNCIL

STAFF REPORT
Agenda Item #C2
DATE: September 9, 2026
TO: Honorable Mayor and Members of the City Council
FROM: Ernesto Marquez, City Manager
BY: Linda Hollinsworth, Finance Director
RECOMMENDATION:

RECOMMENDATION TO SELECT SPRINGBROOK HOLDING COMPANY LLC FOR

LICENSING SOFTWARE AND IMPLEMENTATION SERVICES FOR AN ENTERPRISE

RESOURCE PLANNING SYSTEM AND AUTHORIZE THE CITY MANAGER TO

INITIATE NEGOTIATIONS TO ENTER INTO A CONTRACT WITH THE SELECTED

PROVIDER SUBJECT TO FINAL CITY COUNCIL APPROVAL

SUMMARY
The City currently uses Tyler Technologies Fund Balance to support the core financial process for the City. Tyler Technologies notified the City that they would be discontinuing support for this system effective 12/31/2026. This has required that the City look for alternative ERP systems to replace this current software. The City engaged SDI Presence LLC (“SDI”) to support the procurement and selection process for a new Enterprise Resource Planning (ERP) software system to replace our existing ERP systems. A request for proposals (RFP) was issued January 20, 2026. The City received a total of 5 proposals and determined that four proposals met the minimum requirements of the RFP.

Following evaluation, City staff recommends Springbrook Cirrus as the preferred provider and seeks Council approval to initiate contract negotiations.

DISCUSSION
A committee of department heads evaluated the four proposals. Based on estimated pricing, functionality, and consideration of the needs of the City, two (2) companies were selected to provide demonstrations of their systems - Tyler Technologies ERP Pro and Springbrook Cirrus. These demonstrations were held at City Hall and staff from all departments were invited and encouraged to participate and provide evaluations of these systems. Additional sessions were held to clarify some key areas, including an understanding of the pricing and implementation approach for each company.

Agenda Item #C2
September 9, 2026

Page 2 ends

Because the City has a small staff responsible for implementation, support from both the selected software vendor and SDI will be critical to the project’s success. After reviewing the evaluation criteria, staff determined that Springbrook Cirrus ERP best meets the City's needs for software functionality and implementation support.

The implementation of the selected system will be done in phases with Phase One focused on implementing the core financial systems which will include General Ledger, Accounts Payable, Cash Receipts and Payroll. It is estimated that Phase One will have a one-time implementation cost of $120,000 and a first-year subscription cost of $29,000.

Funds for the ERP procurement and implementation for core financials in Phase One are available in the FY 2025-2026 and 2026-2027 Citywide Budget that was approved on June 11, 2025.

Once the core financial systems have been fully implemented other financial modules may be implemented including a module for Purchase Orders. The timing and cost of adding other modules will be determined during contract negotiations.

Addition of an HR system module is also a priority for the City and will be added in Phase Two. Currently there is no system communication between HR and payroll which requires manual processing of records. This may result in delays and duplication of efforts to maintain accurate information related to personnel and recruitment. An automated timekeeping system would also provide improved efficiency and accuracy. These additional modules will have an estimated one-time implementation cost of $40,000 and first year annual subscription costs of $38,000.

The final implementation and annual subscription costs will be determined when the negotiations are complete, and the contract is brought to Council for approval. Staff is requesting approval of the selected provider and authority to enter negotiations to finalize the scope of work, pricing, and implementation costs.

FISCAL IMPACT
None

SUGGESTED ACTION
Approve Recommendation.

Since its inception 35 years ago, Springbrook Software has focused on delivering one pure-play product to the market – financialsolutions specifically for small to mid-sized local government agencies. Accounts Payable
Springbrook Accounts Payable helps to manage the money owed to vendors. You can:
• Enter invoices for accounting records if they are not already being created from other integrated modules

AI Invoicing
Our AI Invoicing feature is designed to transform invoice processing by saving time and reducing manual inefficiencies. As part of our Accounts Payable module, users can upload and review PDF invoices into their Invoices batch.
• Invoice data, such as vendor details, invoice numbers, dollar amounts, and dates, is extracted to create detailed invoice records in Cirrus.
• Invoices are linked to the appropriate vendor records, eliminating the need for manual searches and data entry.
• Users can review and edit the imported data to ensure accuracy.

Bank Reconciliation
Springbrook's Bank Reconciliation module provides the tools to track and maintain the relationship between an organization's accounting and bank records.

E.2 Application Integration/Interface
Third-Party Integrations and Interfaces
Springbrook is proud to offer a cutting-edge solution that simplifies data integration and promotes seamless collaboration across various platforms. At Springbrook, we understand the importance of connecting with third-party applications and services to maximize efficiency and productivity. That's why we have expanded our offerings from SFTP and import/export options to include a real-time API, empowering you with the ability to access and retrieve data from the Springbrook cloud in real time. With our real-time API, you can effortlessly establish read access to all the data stored within the Springbrook cloud.

Data Exchange Standards
Springbrook supports the following:
• A variety of "productized" in-application configurable data exports for common/frequently requested areas.
• Read-only access to all data via the OData standard
• Purpose-built read/write REST APIs for specific common scenarios (e.g., updating parcel/property information).

Additionally, we provide an optional "database copy" service where a complete copy of the database can be securely downloaded on a nightlight basis for extreme or data-intensive operations.

Local Customizations
Each Springbrook client has one or more unique database instances that are specific to that agency, but Springbrook's software and compute instances are shared across all customers. Springbrook doesn't support client-specific code in the codebase; instead, all configurations are determined based on setup values in the database itself. Springbrook uses a combination of various types of automated and manual tests to ensure stable software releases. Because Springbrook deploys all releases on a weekly cadence, the impact of any one release is generally relatively small. In the unlikely event that a critical issue is discovered due to one of these weekly releases, Springbrook can deploy a correction in advance of the following weekly deployment cycle.

E.3 Data Storage and Backup
Springbrook Cloud Services utilize a fully protected network for data storage. This protected network is where any system resides that directly interfaces with customer data stored within the transactional databases, data warehouse, or file shares. Transfer to/from other networks is only permitted through the appropriate application access.

All data is stored within Azure Regions located within the United States. No data is stored or processed outside of the United States.

SPRINGBROOKSOFTWARE.COM 14

The Springbrook Cloud Services transactional databases are implemented using Microsoft SQL Server Standard Edition. A full backup of this database is performed weekly, with incremental backups performed daily and real-time replication of the archive logs. Backups and archive logs are stored in the alternate DR region to be used during a DR event.

Optionally, a customer-specific database backup can be performed on a schedule mutually agreed upon, and that backup is staged for pickup by the customer.

E.4 Reporting
Springbrook offers a variety of report writing tools to create comprehensive and concise reports and queries throughout all modules. The platform has an array of reporting capabilities such as template based or canned reports, state specific required reports, financial reporting, ad-hoc requested reports, and executive dashboards. We also offer Tableau Reporting.

E.5 Data Access and Security
At Springbrook, we understand the importance of data accessibility and security. To ensure a seamless experience for our clients, we have implemented various methods for accessing backend data tables.

Our platform supports standard web APIs, which allow clients to programmatically interact with the data tables and retrieve the desired information. This enables efficient data retrieval and integration with other systems or applications.

In addition to web APIs, we offer SFTPs (Secure File Transfer Protocol) as a secure method for accessing the backend data tables. SFTP provides a highly encrypted channel for transferring files between systems, ensuring the confidentiality and integrity of your data during transit.

Furthermore, we recognize the significance of data visualization and reporting for informed decisionmaking. To address this, we have integrated Tableau reporting capabilities into our platform. Tableau enables you to create interactive and visually appealing reports and dashboards, leveraging the data stored within our backend data tables. With this integration, you can generate insightful reports and gain valuable insights from your data.

To ensure the security of our client's data, we have implemented robust measures within our system.

Springbrook Cloud/Cirrus utilizes the Auth0 identity platform, which provides authentication services to the application. The default authentication method is username/password with multi-factor authentication (MFA), enhancing the security of user accounts. Additionally, we offer customers the option to integrate their identity provider (IDP) with Auth0 through our Springbrook enterprise connection. This allows for a seamless authentication experience and leverages the existing IDP infrastructure.

SPRINGBROOKSOFTWARE.COM 15
Moreover, we prioritize data encryption to safeguard your information. All data stored within Azure storage accounts or disks is encrypted using vendor-managed keys. This encryption ensures that your data remains protected at rest, minimizing the risk of unauthorized access.

We understand the importance of both data accessibility and security in all business operations. We aim to provide our customers with a reliable and secure platform that empowers our users to access and utilize data effectively.

Confidentiality and Integrity
To ensure Customer Data remains confidential throughout processing and remains intact, complete, and current during processing activities, the following measures are in place:
• Springbrook has a formal background check process and carries out background checks on all new employees.
• Springbrook trains its Personnel engaged in software development or testing in application security practices and secure coding practices.
• Springbrook has a central, secured repository of product source code, which is accessible only to authorized Springbrook Personnel.

• All changes to Springbrook Cloud Services are via a controlled, approved release mechanism within a formal change management process.
• All encryption and other cryptographic functionality used within the Springbrook Cloud Services use industry standard encryption and cryptographic measures aligned with the standards promulgated with FIPS 140-2.

Data Transmission, Storage and Destruction
To ensure Springbrook Customer Data is not read, copied, altered, or deleted by unauthorized parties during transfer or storage, the following measures are in place:
• Customer access to the Springbrook Cloud Services is protected by the most current version of Transport Layer Security (TLS 1.2+).
• Springbrook uses strong encryption (AES 256) when storing Customer Data within our Microsoft Azure public cloud infrastructure.
• Springbrook storage media has all data securely wiped when de-provisioned. • Springbrook offers optional services for periodic Customer Data backup exports for storage by the Customer.
• Upon contract termination or Customer request, all Customer Data is securely deleted from Springbrook Cloud Services.

SPRINGBROOKSOFTWARE.COM 16
E.6 Business Continuity and Disaster Recovery
Springbrook uses Terraform as an infrastructure provisioning and configuration orchestration tool to manage and provision resources within Azure. Using this tool and an Infrastructure as Code (IaC) process allows us to quickly and repeatably deploy the infrastructure necessary to run the Springbrook Cloud Services. With this capability, Springbrook can move the Springbrook Cloud Services between Azure regions, and it is an integral component of Springbrook’s disaster recovery process.

Following a disaster declaration for the Production instance of Springbrook Cloud Services, the Springbrook Incident Response Team will initiate the following steps:
• Start timeline for recovery objective (RTO) milestones • Immediate communication to customers with details of the event and the impact of the interruption.
• Establish an emergency command center and communicate bridge numbers for the Crisis team.
• Communicate roster of active personnel and management structure. • Coordinate with Microsoft on the assessment of production region outage. • Begin bringing disaster recovery instances online in the DR region using Terraform automation and the backups and snapshots replicated from the production region. • Update customers with details of the disaster and projected time to recovery.

Within 4 hours of incident:
• Incident Response Team will determine the impact on the production region and whether to wait for restoration or initiate operation in the DR region. • Site Reliability Engineers will monitor and validate the activation of the disaster recovery instances in the DR region.
• Site Reliability Engineers will monitor the restoration of the transactional databases. • Customer support will provide hourly updates to customers.

Within 24 hours of incident:
• Push DNS changes to move customer traffic to the DR region. • Transactional database in the DR region will be rolled forward to the last complete point in the time replicated log.
• Site Reliability Engineers will validate transactional databases for consistency. • Start the ETL processes to rebuild the data warehouse. • Run the automated smoke test to validate the DR.

F.2 Project Methodology
The following framework describes the steps required to complete successful implementation.

The software implementation framework comprises five key elements that outline the stages and activities involved in successfully deploying and transitioning Springbrook software solutions to customers:

Contract Signature & Initial Contact: This initial stage involves signing the contract between the software provider and the customer. It marks the beginning of the implementation process and includes establishing initial contact with the customer to set expectations, clarify requirements, and gather the necessary information to initiate the project.

Customer Pre-Work: In this phase, the customer undertakes preparatory activities to ensure a smooth implementation process. This may include providing access to relevant systems and data, conducting user readiness assessments, and identifying key stakeholders involved in the implementation.

Project Kick-Off: The project kick-off marks the official start of the implementation process. During this phase, Springbrook and the customer discuss project goals, deliverables, timelines, and resource requirements. The project team is introduced, roles and responsibilities are defined, and a detailed project plan is established. This phase sets the foundation for successful collaboration and communication throughout the implementation.

Module Implementation: This stage focuses on implementing software modules or components. It involves configuring the Springbrook solution based on the customer's specific requirements. The module implementation phase includes activities such as data migration, system integration, testing, and training.

Project Completion & Support Transition: The software implementation framework's final phase involves the project's completion and the transition to ongoing support. This includes finalizing any remaining tasks, concluding post-go-live services, and communicating project completion. The transition to support involves transferring knowledge and responsibilities to the customer's support team, ensuring they are equipped to handle any future software maintenance and support needs.

SPRINGBROOKSOFTWARE.COM 25
F.3 Implementation Approach & Schedule
The software implementation framework consists of four key elements that guide the process of deploying and transitioning software solutions to users:

Data Collection and Review: In this initial stage,
data relevant to the software implementation is
collected and reviewed. This includes gathering
existing data, such as customer records or system
information, and conducting a thorough analysis
to ensure data accuracy and completeness. The
goal is to lay the foundation for successful
configuration and setup of the software.

Configuration and Set-Up: Once the necessary
data has been collected and reviewed, the
software is configured to meet the organization's
specific requirements..

Training and Go-Live: In this phase, end-users
receive comprehensive training on effectively
using the software. Training sessions may include
workshops, hands-on exercises, or virtual training
modules to familiarize users with the software's
features and functionalities. The training also covers best practices, tips, and specific guidelines or procedures relevant to software usage.

Support Transition: The support transition phase involves shifting from the implementation team to the ongoing support and maintenance team. During this phase, knowledge transfer and handover activities occur, ensuring that the organization's support team is equipped to handle user inquiries, troubleshoot issues, and provide ongoing assistance.

Sample Project Schedule
If selected, the project start date will vary based on Springbrook's backlog. Springbrook commits to beginning the work as quickly as possible.

A sample timeline is provided below for estimation purposes. An agreed-upon timeline with dates and project milestones will be completed as part of the project kick-off.

SPRINGBROOKSOFTWARE.COM 26
The following is an example of a project plan. Dates are not representative of the District’s timeline. A specific timeline will be discussed after selection.

Milestones/Deliverables
The project plan details are discussed during the kick-off call, including schedule, cost, scope, communications, issue, risk, and change management. As previously stated, Springbrook and the customer discuss project goals, deliverables, timelines, and resource requirements during kick-off.

As part of a weekly cadence during implementation, the team reviews the hours allotted for each module compared to the time remaining to ensure the project is on track.

Deliverables
The following deliverables will be executed as a part of the executed SOW:

1. Agreed upon project plan with timeline and milestones

2. Roles & responsibilities matrix and communication plan

3. Well-maintained issue log with individually tracked status updates

4. Feature request log with Springbrook's product team review(s) and comment(s)

5. All modules in scope will be deployed to a production environment

6. Key customer resources will have received training on the in-scope modules Project Management Approach
The PDCA (Plan-Do-Check-Act) process is a widely recognized framework for continuous improvement and problem solving. It promotes a systematic approach to identify, analyze, implement, and monitor improvements throughout the project lifecycle. The PDCA cycle consists of four iterative steps: Plan, Do, Check, and Act.

Plan: In the planning phase, the project team identifies goals, defines objectives, and determines the best course of action to achieve them. This includes analyzing requirements, establishing success criteria, and creating a detailed plan outlining tasks, timelines, resources, and responsibilities.

Do: The "Do" phase involves executing the planned activities, implementing the solutions, and carrying out the project tasks according to the established plan. This step focuses on effective communication, collaboration, and coordination among team members to ensure smooth project execution.

Check: During the "Check" phase, project performance and outcomes are evaluated against the predefined objectives and success criteria. This includes monitoring key performance indicators, SPRINGBROOKSOFTWARE.COM 27
conducting quality assurance reviews, and gathering stakeholder feedback. The purpose is to assess whether the project is on track and if any deviations or issues need to be addressed.

Act: In the "Act" phase, based on the findings from the "Check" phase, necessary corrective actions and improvements are implemented. This may involve adjusting the project plan, revising processes, or resolving identified issues. The focus is continuously improving project performance and ensuring that lessons learned are incorporated into future iterations or projects.

The PDCA process is a cyclical and iterative approach, with each cycle building upon the knowledge and insights gained from the previous one. It encourages a proactive and flexible mindset, fostering a culture of learning and adaptability within the project team.

Implementation Phases
Implementation is typically done in phases depending on the modules included. Please note these phases include the optional modules presented and can change based on need and desired timeline. • Phase I – Finance Modules
• Phase II – Payroll + ESS
• Phase III – Cirrus HR
• Phase IV – Advanced Budgeting
• Phase V - Remaining modules
Critical Success Factors
Springbrook has identified several critical success factors that are key to successfully implementing the project:

Knowledge Transfer – A critical part of the implementation involves the agency’s transfer of knowledge from Springbrook with the goal of becoming self-sustainable in supporting Springbrook Software. Strong and focused participation by the agency’s personnel throughout the analysis, configuration, and deployment of Springbrook's Cirrus Cloud Application will enable Springbrook's services to mentor and equip the District to assume standard operations once the project ends.

Dedicated Customer Participation – The success of the project hinges on thoughtful, prepared, and sustained participation from the agency’s team and Information Technology staff. The agency will be asked to identify key stakeholders to be involved in the tasks and provide deliverable reviews and feedback. This collaborative approach will help verify that the collective knowledge of the agency’s team is reflected in the design and implementation of the new system.

Project Governance – The successful management and implementation of a software project of this size and complexity requires strong management communication and participation from the District and Springbrook. Springbrook and the District will follow the agreed-upon escalation procedure to resolve issues and mitigate risks in a timely manner.

No Custom Development – As part of this SOW, no custom development items are identified to bring the agenct live. The intent is to complete this engagement using the system's existing capabilities without any additional development effort. This will help avoid incorporating conflicting or unique requirements in the design that will later cause rework or other issues when another agency is incorporated into the solution.

G.3 System Monitoring
System Response
As previously stated, Springbrook Support operates on a severity-level philosophy. If a customer calls in with work stoppage issues, that case moves to the head of other tickets. We let the customer initiate the severity level they believe their case to be. Our agents assess the case and place it in the appropriate queue.

Our severity levels are defined as follows:
• Critical severity: System or application is non-functional or seriously affected and there is no reasonable workaround available (e.g., business is halted). • High severity: System or application is affected and there is no workaround available, or the workaround is impractical (e.g., system response is very slow, day to day operations continue but are impacted by the work around).
• Medium severity: System or application feature is non-functional, and a convenient workaround exists (e.g., non-critical feature is unavailable or requires additional user intervention). • Low severity: System or application feature works, but there is a minor problem (e.g., incorrect label, or cosmetic defect).

Response Times
Our success is measured in our response SLAs.
• Critical severity: 1-hour response
• High severity: 4-hour response
• Medium severity: 8-hour response
• Low severity: 24-hour response
If, during the Support Request process, the issue either warrants assignment of a higher severity level than currently assigned or no longer warrants the severity level currently assigned based on its current impact on the production database, then the severity level will be upgraded or downgraded accordingly to the severity level that most appropriately reflects its current impact.

Resolution Times
Our resolution goals are as follows:
• Critical severity: Upon confirmation of receipt, Springbrook begins continuous work on the case.

Springbrook will put forth the effort to provide a workaround, fix, or estimated completion date within 72 hours after the problem has been diagnosed and/or replicated, provided there is an agency representative available to assist with issue diagnosis and testing during the resolution process.

After an emergency call/case is received, it would be classified as "Critical," and it would immediately be posted in our urgent channel where the Support owner, key development resources, and IT would be notified to begin an investigation. Communication channels would be aligned to keep the City up to date until a resolution has taken place.

SPRINGBROOKSOFTWARE.COM 31
• High severity: Springbrook will put forth the effort to provide a workaround or fix or estimated completion date within 14 business days after the problem has been diagnosed and/or replicated.
• Medium severity: Springbrook will put forth the effort to provide a workaround or fix or estimated completion date within 21 business days after the problem has been diagnosed and/or replicated.
• Low severity: Resolution for the issue may be released as a patch set or be incorporated into a future release of the product.

Problem Escalation Procedures
Incidents
As previously stated, incidents can be reported to Springbrook Support using the following methods:
• Telephone Support: Springbrook’s live technical support is available during regular business hours of Monday through Friday from 5 AM to 5 PM PST (7 AM to 7 PM CST), excluding Springbrook’s observed holidays.
• Email Support: Springbrook provides an email address ([email protected]) to which Customers may submit routine or non-critical support requests. Email Support Requests will be addressed by Springbrook during regular business hours. • Community Website: Cases can be created on the Springbrook Success Community website, which is available 24/7.

After an incident is reported, Springbrook enters and tracks all incidents in our Salesforce CRM system.

The City’s contact will then receive an email with a case number to serve as a notification and confirmation. Priority and severity are determined based on the incident details.

Chain of Command
Our chain of command for Support is as follows:
• Customer Support Manager
• Customer Support Director
• Senior VP of Operations
Escalation Resources
Springbrook Customer Support has escalation resources in the following departments:
• Engineering

Re: Important Legal Matter—Prompt Attention Required
Notice of Potential Liability and Fourth Tolling Agreement BKK Landfill, West Covina, CA
City of Hawaiian Gardens
Dear City of Hawaiian Gardens Representative:

This firm represents the BKK Working Group, an unaffiliated association of entities that has entered into a series of judicially-approved consent decrees with the California Department of Toxic Substances Control C'DTSC") to take certain limited actions at the Class I Landfill portion ("Class I Landfill") of the BKK Corporation Landfill Facility in West Covina, CA (the "Site"). The BKK Working Group previously entered into a Third Tolling Agreement with City of Hawaiian Gardens (hereinafter referred to as "YOU" or "YOUR"). As we previously informed YOU, the BKK Working Group has recently discovered information suggesting that City of Hawaiian Gardens (hereinafter referred to as "YOU") disposed of waste at the Class I Landfill and may therefore be liable for necessary response actions and other costs incurred by the BKK Working Group under § 107(a) of the Comprehensive Environmental Response, Compensation and Liability Act ("CERCLA"), 42 U.S.C. § 9607(a), and California Health and Safety Code § 78145. Enclosed with this letter is a Fourth Tolling Agreement relating to potential claims the BKK Working Group may have against YOU based on its work at the Class I Landfill. At this time, the Working Group requests that YOU enter into a Fourth Tolling Agreement.

The BKK Landfill and Response Actions
The BKK Site is an approximately 583-acre facility located at 2210 South Azusa Avenue, West Covina, California. The Site contains a closed hazardous waste Class I landfill, a closed Class III municipal solid waste landfill, and related facilities including a leachate treatment plant and a landfill gas collection system. The Class I Landfill is approximately 190 acres in size and accepted waste from roughly 1962 to 1987. In total, the Class I Landfill accepted approximately five million tons of liquid and solid hazardous wastes together with substantially greater amounts of municipal and commercial wastes. BKK Corporation is the owner and operator of the Class I and Class III landfills.

In October 2004, BKK Corporation announced that it could not continue to conduct post-closure care for the Class I Landfill after November 17, 2004. Consequently, DTSC engaged a contractor to conduct emergency response activities and to operate and maintain the Class I Landfill's critical equipment and systems. In December 2004, DTSC issued an "Imminent and Substantial Endangerment Determination and Order and Remedial Action Order" ("ISE Order") to BKK Corporation and 50 other respondents, including former customers, who were alleged to be potentially responsible for conditions at the BKK Landfill. Some of these respondents are now members of the BKK Working Group. The ISE Order required the respondents to conduct operation and maintenance activities at the Class I Landfill and the leachate treatment plant.

In 2005, pursuant to several interim settlement agreements, the BKK Working Group began reimbursing DTSC for a portion of its response costs. In October 2005, the BKK Working Group and DTSC lodged a proposed Consent Decree with the Federal District Court for the Central District of California. That Consent Decree provided for the BKK Working Group to complete certain projects and perform operations at the BKK Class I Landfill and to pay for, and be released from, certain of DTSC's response costs. It also provided for DTSC to dismiss, without prejudice, the ISE Order against the BKK Working Group members. The Court entered the Consent Decree on March 6, 2006. The BKK Working Group and DTSC next agreed to a Second Consent Decree, which was entered by the Court on August 10, 2010. The Second Consent Decree required the BKK Working Group to conduct additional investigation activities at the Class I Landfill. Finally, the BKK Working Group and DTSC agreed to a Third Consent Decree, which requires the BKK Working Group to conduct certain investigation activities at the Class I Landfill related to groundwater. The Federal District Court entered the Third Consent Decree on July 24, 2015 and the First Amended Third Partial Consent Decree on October 18, 2016. DTSC may conduct or compel additional actions at the BKK Class I Landfill, including actions to address groundwater contamination.

Additional information about the BKK Site may be found at:
https://dtsc.ca.gov/hw-projects/bkk-corporation-landfill/ and http://www.envirostor.dtsc.ca.qov/public/Drofile report.asp?qlobal id=19490005 Notice of Potential Liability
DTSC has documented the release or threatened release of hazardous substances, pollutants or contaminants at the Class I Landfill. DTSC spent and will spend public funds, and the BKK Working Group spent and will spend its funds, on actions to investigate and control such releases or threatened releases at the Class I Landfill. Under provisions of California's Hazardous Substance Account Act ("HSAA"), Health and Safety Code sections 78000 etseq., including sections 79055 DB3/ 205297805.1
August 11, 2026

Page 3 ends

and 78870, DTSC may order potentially responsible parties ("PRPs") to perform response actions deemed necessary by DTSC to protect the public health, welfare or the environment. Also, under the HSAA and CERCLA, PRPs may be compelled to compensate DTSC or other parties, including but not limited to the BKK Working Group, for costs incurred in responding to any release or threatened release at the Class I Landfill. Such actions and costs may include, but are not limited to, expenditures for conducting daily maintenance of the Class I Landfill and associated systems, necessary repair work, monitoring and other post-closure activities, Engineering Evaluation/Cost Analyses, Remedial Investigation/Feasibility Studies, Remedial Design/Remedial Actions, groundwater cleanup and other investigative, planning, response oversight and enforcement activities. In addition, PRPs may be required to pay damages for injury to, destruction of, or loss of natural resources, including the cost of assessing such damages.

Shipping records maintained by DTSC and the BKK Corporation, as well as other business records maintained by the BKK Corporation, identify generators who arranged for the disposal of waste at the Class I landfill. Based on this information, the BKK Working Group believes that YOU are one of the generators that disposed of waste at the Class I landfill and therefore a PRP with respect to the Facility.

Fourth Tolling Agreement
The BKK Working Group has incurred response costs related to the BKK Class I Landfill, including but not limited to costs incurred pursuant to the three Consent Decrees. As a result, the BKK Working Group possesses claims against you for the recovery of response costs pursuant to CERCLA, the HSAA, and California common law. The BKK Working Group strongly prefers that any litigation be deferred until such time as a long-term settlement and enforcement approach has been developed for the Class I Landfill and that you and the other entities who arranged for the disposal of wastes have had the opportunity to participate in such a settlement. The BKK Working Group is working with DTSC on such an approach.

The BKK Working Group previously entered into a Third Tolling Agreement with YOU that will terminate on September 25, 2026. Enclosed is a Fourth Tolling Agreement that would further toll, or stop, any statute of limitations applicable to potential claims that the BKK Working Group has against you—or that you have against the BKK Working Group—relating to the Site from the effective date of the Fourth Tolling Agreement through 60 days following the termination of the Fourth Tolling Agreement. The Fourth Tolling Agreement terminates on September 25, 2029. The Fourth Tolling Agreement does not constitute an admission of fact or of liability. It is simply intended to provide the parties with additional time to consider settlement options. Please give these matters your immediate attention.
