AGENDA ITEM NO. 5

CITY OF HAWTHORNE
City Council

AGENDA BILL
For the meeting of March 26, 2024
Originating Department: Planning
City Manager: __________
Vontray Norris
Dir. of Planning: ___________
Gregg McClain
SUBJECT:

Ordinance No. 2249 (2nd Reading) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HAWTHORNE, CALIFORNIA, AMENDING SECTION 17.87.050 (USES PROHIBITED) OF CHAPTER

17.87 (MIXED USE OVERLAY ZONE (MU)) TO REMOVE CANNABIS-RELATED USES FROM THE LIST OF USES PROHIBITED, AND APPROVING AN EXEMPTION UNDER SECTION 15061(b)(3) OF CEQA.

Motion to Adopt
RECOMMENDED MOTION:

Staff Recommends that the City Council adopt Ord. 2249.

DISCUSSION:

Cannabis was removed from the lists of uses prohibited in all commercial and industrial zones by Ordinance No. 2237 in 2023, but the Mixed Use Overlay Zones also lists cannabis businesses as prohibited and was overlooked in Ordinance No. 2237. This ordinance brings the Mixed Use Overlay Zone into alignment with all commercial and industrial zones on the City by removing cannabis businesses from the list of uses prohibited.

Presently, one of six cannabis businesses selected by the City to proceed with a conditional use permit for a cannabis retail business is proposed to be in a Mixed Use Overlay area. Although the conditional use permit hearing for this business will proceed as scheduled, it will be conditioned on this ordinance being adopted prior to being issued building permits.

ECONOMIC DEVELOPMENT STRATEGIC PLAN:

Goal 4: Update zoning code for the 21st century
FISCAL IMPACT:

There is no fiscal impact to the City as a result of the adoption of this Ordinance.
