SUBJECT:

Ordinance No. 2253(1st Reading) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HAWTHORNE, CALIFORNIA, AMENDING CHAPTERS 17.04, 17.32, AND 17.34 TO UPDATE THE DEFINITIONS OF AUTOMOBILE REPAIR AND THE ZONES WITHIN WHICH THEY ARE PERMITTED. Motion to introduce RECOMMENDED MOTION:

Staff Recommends that the City Council conduct a public hearing and introduce Ord. No. 2253.

DISCUSSION:

Applicant, Jairon Munoz, opened an auto upholstery business at 4611 West Imperial Highway, which previously hosted an automobile repair business. This address is currently zoned Regional Commercial (CR) but is also within the Downtown Hawthorne Specific Plan (DHSP), which identifies this location as part of the Commercial Zone. This designation is implemented by the Local Commercial (C-2) and General Commercial (C-3) zones. As such, the Zoning, General Plan, and Specific Plan designations are not in agreement, so the designation found in the DHSP of Commercial prevails over the zoning and this designation is implemented by the C-2 or C-3 zone.

Currently, automotive upholstery falls under the definition of major automobile repair, which is only permitted in the Heavy Industrial Zone (M-2). For this reason, automobile upholstery is not permitted at this location and it cannot be considered as a continuing nonconforming use.

The Applicant, his representative, and the property owner filed an application to add auto upholstery to the permitted use list of the CR Zone, which would legalize their use. A straight forward change to permit major automobile repair would permit major automobile repair business in any area that is zoned Regional Commercial, which includes the area along Imperial Highway, the area near I-405 and Rosecrans, and portions of the City along 120th Street near the Airport. While these areas have some nonconforming automobile repair businesses, it is not something that Staff recommends encouraging in these areas. Staff proposes, instead, to update and clarify the definitions of major and minor automobile repair and the zones in which these uses are permitted. This will achieve the same outcome for the applicant and prevent the proliferation of automobile repair throughout the City, Auto upholstery is currently identified as an aspect of major automobile repair. The first part of the City’s proposal is to recognize that auto upholstery is actually more akin to minor automobile repair because auto upholstery no

Page 2 of 2 ends

longer presents impacts similar to other major automobile repairs. It does not require large portions of an automobile to be disassembled, nor does it require equipment which poses a risk to public health or safety. Changing auto upholstery to a minor automobile repair use maintains consistency with the current definitions and ensures the presence of uses which are conducive to the zones in which they are located.

Another update proposed by this project is to correct a long-standing error in the permitted uses of the M-2 zone.

Currently, major automobile repair is permitted by right but minor automobile repair is permitted only with a Conditional Use Permit by virtue of it being permitted that way in the C-3 and M-1 Zones. This creates the illogical situation there major automobile repair is permitted by right but but minor automobile repair requires a CUP.

Additionally, automobile body and fender businesses are permitted by right in both M-1 and M-2 Zones, and that is generally accepted as a use with potentially more significant impacts. To fix this mess, Staff proposes to permit minor automobile repair, by right, in both the M-1 and M-2 Zones.

SECTION 6. SEVERABILITY. If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid or unconstitutional by a decision of any court of any competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have passed this Ordinance, and each and every section, subsection, sentence, 4 clause, or phrase not declared invalid or unconstitutional without regard to whether any portion of the Ordinance would be subsequently declared invalid or unconstitutional.

SECTION 7. AUTHORIZATION TO PUBLISH SUMMARY OF ORDINANCE.

Pursuant to Government Code Section 36933(c)(1), the City Attorney is authorized to prepare a summary of this ordinance. The City Clerk is also authorized to publish a summary of the text of this ordinance in the Hawthorne Press Tribune at least five days prior to the adoption of this ordinance. Dear Jesus,
Reference: 2024 Sidewalk Visual Condition Assessment and Reporting As per your request, please find herein our proposal for providing a city-wide sidewalk visual condition assessment and reporting for the City of Hawthorne.

PROJECT UNDERSTANDING
The City of Hawthorne, CA (City) is responsible for maintaining approximately 96 centerline miles of roads.

The majority of the network has concrete sidewalks.

The City is committed to implementing a proactive approach to maintaining their current road network as well as their sidewalk network in order to provide the safety needed for the public.

Stantec collected the condition of the City’s roads and sidewalks/pedestrian ramps in 2019 for the first time. The City has now requested that Stantec perform another round of visual condition assessment on the City’s sidewalks/ramps in order to identify any existing issues that need to be handled.

The sidewalk condition data and rehabilitation recommendations can be viewed in the City’s RoadMatrix™ pavement management system (PMS). High severity distress types and locations will also be mapped in GIS for a quick visual identification of the location of such distresses.

A final report will be delivered to the City detailing the condition of the sidewalk network as well as recommendations.

SCOPE OF WORK
The following list of activities summarizes our work plan and the various tasks involved in executing the project to achieve the City’s desired assignment results and objectives within the allowable project timing.

This task includes the work needed to initiate and manage the project as well as the project kickoff meeting.

Upon receiving the notice-to-proceed (NTP), Stantec will contact the City project manager to agree on a date to kick off the project. The following agenda items will be discussed during the kickoff meeting:

1. Review and finalize the scope of work and survey approach;

2. Review proposed schedule, budget and invoicing procedure; and

3. Review information to be provided by the City and the City’s project team involvement.

Task 2: Sidewalk/Ramps Visual Condition Assessment Approach The sidewalk and ramps condition assessment will be completed visually in the form of a walking survey, to document the extent and severity of the surface distresses and to check ADA compliance of ramps. The evaluation shall be completed by trained technicians. While some providers may claim that sidewalk and ramp surveys can be completed using the collected ROW images, it is our experience that walking survey is the only approach that allows for a complete survey of sidewalk and ADA compliance of ramps for the following 2 reasons:

1. Sidewalk and ramp images cannot be captured should vehicles be parked along the sidewalk at the time of the survey. This is an oftenoccurring issue in urban settings. Hence, the condition of these sidewalks and ramps cannot be obtained/determined from reliance on ROW images.

2. ADA Compliance requires relatively accurate measurements of slopes and dimensions of the various ramp elements. In addition to potential view obstruction by nearby vehicles, measurement and condition may not be captured/determined accurately for an ADA compliance purpose.

Stantec has developed a proprietary mobile data collection application utilizing the ESRI™ Collector for ArcGIS application, which allows for distress rating inputs in a fast, efficient, and reliable manner. All data captured in the field is immediately synchronized using a Wi-Fi or cellular network to the ESRI™ Geospatial Cloud and is fully integrated with ESRI™ ArcGIS. Stantec office personnel can instantaneously perform QA/QC reviews and export the data for processing via an internet-based dashboard.

As well, utilizing the mobile devices built-in high-definition camera, geo-referenced digital images of highseverity sidewalk and ramp distresses and sub-standard ramps are captured. The images will be GPS-tagged and will be linked to the City’s GIS database for local and online display. All collected data is fully compatible with Stantec’s RoadMatrix™ Pavement Management System (PMS) software that the City already uses.

Stantec will review the proposed data collection approach of the sidewalks and ramps with the City before field data collection begins, if needed. Once the data collection approach is finalized, Stantec will visually collect the July 19, 2024

x Mean Width
Hazard Identification
x Tree/shrub encroachment
x Trip Hazards
x Tree Roots

x Missing para-ramps
x Missing slabs
x Sub-standard para-ramps
x Ponding/Drainage
Stantec believes in the importance of collecting some additional attributes as listed in Table 1.

Based on the collected distress types, severity and extent, a Sidewalk Condition Index (SCI) will be calculated for each sidewalk segment and for the network.

The survey methodology uses the following protocol; each sidewalk concrete slab will have one distress (the most critical) as an attribute. The hierarchy of distresses will be setup to distinguish which distresses will govern. For instance, a slab that has an occurrence of a medium linear crack, as well as low faulting, would be rated as a low faulting, as it poses a greater risk to the City, from a liability standpoint.

Task 3: Data Loading, QA/QC and Analysis
This task covers the sidewalk data loading to RoadMatrix™ and the before and after QA/QC procedures to ensure data completion and accuracy. Once loaded, the sidewalk analysis parameters will be reviewed, and treatment unit costs will be updated to reflect the City’s current unit costs for the various treatment types.

Analysis will be completed to calculate the Sidewalk Condition Index (SCI) as well as the recommended treatments and associated cost estimates.

Task 4: Reporting
A report will be completed and submitted to the City, upon completion of the data collection activities and data analysis. The report will describe the data collection details, and network-level recommendations for July 19, 2024

ECORP employs Python programming language, which is a programming language extensively used in the air quality/noise regulatory community, for automation and quality assurance of data. This allows for enhanced data aggregation and visualization that can assist in the understanding of regulatory and scientific data sets.

SCOPE OF WORK
Our approach to completing the CEQA documentation for the project is to first and foremost work collaboratively with City of Hawthorne staff to prepare a document that is legally defensible, aids the City in the decision-making process, and meets the City’s needs in terms of schedule and budget.

To accomplish these objectives, our approach is founded on the following principles:
1) Draw upon our experience preparing multiple CEQA documents for hotels and other development projects to identify and address the key issues early in the process to prevent delays and setbacks.
2) Conduct a technically adequate and complete environmental analysis. 3) Create a reader-friendly CEQA document to help the reader understand the environmental consequences of the project.
4) Establish and achieve a milestone/critical path project schedule. 5) Openly communicate with City of Hawthorne staff as we strive to meet the City’s expectations.

City of Hawthorne
Menlo Hotel Project

Page 5 ends

Based on our preliminary review of the project and for budgetary purposes, our proposal assumes that a Class 32 CE will be the appropriate CEQA document. However, Michael Baker makes no presumptions regarding the appropriate CEQA document. If, during the course of work, it becomes evident that the proposed project will not qualify for a CE, Michael Baker will immediately notify the City and would be available to prepare the appropriate documentation per the mutual agreement of a budget augmentation between the City and Michael Baker.

Our proposed scope of work to prepare and process a Class 32 CE consists of the following tasks, which are described in detail below.

Project Tasks
Task 1: Project Management and Coordination Meetings
Task 2: Categorical Exemption Documentation
Task 3: Air Quality Impact Analysis
Task 4: Noise Impact Analysis
Task 5: Notice of Exemption Preparation and Filing
Task 6: Public Hearings
Task 1: Project Management and Coordination Meetings
To initiate the project, Michael Baker’s project director and project manager will attend a kickoff meeting with City staff. The kickoff meeting will be used to review project plans, discuss the project’s key environmental considerations, solidify the project schedule, and discuss the action plan for achieving that schedule. Michael Baker’s project manager will be available to City staff throughout the assignment to discuss the project, coordinate the project schedule, exchange information, and ensure the City’s expectations are met. Michael Baker will participate in phone calls and email communication as needed and up to three in-person meetings or video calls. Additional management activities include monitoring the project schedule and budget, ensuring critical timeline milestones are met, and providing quality control review of all completed work products.

Task 2: Categorical Exemption Documentation
Michael Baker will prepare an evaluation report to describe why the project qualifies for a CE pursuant to CEQA Guidelines Section 15332 In-Fill Development Projects (Class 32). The report will evaluate the project to ensure it meets all of the following Class 32 CE requirements:
a) The project is consistent with the applicable general plan designation and all applicable general plan policies, as well as with applicable zoning designation and regulations. b) The proposed development occurs within city limits on a project site of no more than 5 acres substantially surrounded by urban uses.
c) The project site has no value as habitat for endangered, rare, or threatened species. d) Approval of the project would not result in any significant effects relating to traffic, noise, air quality, or water quality.
e) The site can be adequately served by all required utilities and public services.

The report will also evaluate the project to ensure that none of the following exceptions to the use of the CE (as set forth under CEQA Guidelines Section 15300.2, Exceptions) apply to the project:

City of Hawthorne
Menlo Hotel Project

Page 6 ends

a) Location. Classes 3, 4, 5, 6, and 11 are qualified by consideration of where the project is to be located—a project that is ordinarily insignificant in its impact on the environment may in a particularly sensitive environment be significant. Therefore, these classes are considered to apply in all instances, except where the project may impact on an environmental resource of hazardous or critical concern where designated, precisely mapped, and officially adopted pursuant to law by federal, state, or local agencies.
b) Cumulative Impact. All exemptions for these classes are inapplicable when the cumulative impact of successive projects of the same type in the same place, over time is significant. c) Significant Effect. A categorical exemption shall not be used for an activity where there is a reasonable possibility that the activity will have a significant effect on the environment due to unusual circumstances.
d) Scenic Highways. A categorical exemption shall not be used for a project which may result in damage to scenic resources, including, but not limited to, trees, historic buildings, rock outcroppings, or similar resources, within a highway officially designated as a state scenic highway. This does not apply to improvements which are required as mitigation by an adopted negative declaration or certified EIR.
e) Hazardous Waste Sites. A categorical exemption shall not be used for a project located on a site which is included on any list compiled pursuant to Section 65962.5 of the Government Code.
f) Historical Resources. A categorical exemption shall not be used for a project which may cause a substantial adverse change in the significance of a historical resource.

As discussed with the City, a traffic analysis will be prepared and provided to Michael Baker. In addition, Michael Baker assumes that the City will provide a Phase I Environmental Site Assessment (ESA) for the proposed project. Michael Baker will use the Phase I ESA to verify that the proposed hotel is not located on a hazardous waste site. If a Phase I ESA is not available, Michael Baker will review the Department of Toxic Substances Control’s and the State Water Resources Control Board’s databases to verify that the project site is not included on any list compiled pursuant to Section 65962.5 of the Government Code (i.e., the Cortese List). Michael Baker will also review the low impact development information provided by the City to assess water quality impacts.

As the site includes limited landscaping and no existing structures, we assume that historical and biological resources assessments will not be necessary to prepare the CE documentation.

The project team will conduct technical investigations to evaluate the proposed project’s potential impacts related to air quality and noise. The scopes of work for these technical investigations are described in Tasks 3 and 4 below.

Deliverables: Michael Baker will submit draft versions (electronic copy) and a final version (electronic copy) of the CE evaluation report to the City.

Task 3: Air Quality Impact Analysis
ECORP will conduct the air quality analysis. The assessment of air quality will quantify short-term (i.e., construction) and long-term (i.e., operational) emissions generated by the proposed project using the most recent version of the California Emissions Estimator Model (CalEEMod) software.

CalEEMod is a statewide land use emissions computer model designed to quantify pollutant emissions associated with operations from a variety of land use projects. Project criteria air pollutant will be compared to the thresholds of significance promulgated by the South Coast Air Quality Management District (SCAQMD), including SCAQMD’s recommended localized significance City of Hawthorne
Menlo Hotel Project

Page 7 ends

thresholds (LSTs). LSTs were developed in response to the SCAQMD Governing Boards' Environmental Justice Enhancement Initiative (I-4).

Please note that this scope assumes that the City will provide detailed site plans and proposed grading plans, detailed construction phasing and grading/excavation/paving quantities, and a detailed listing of all water/energy conservation measures that will be incorporated into the project design.

Deliverables: ECORP will complete an air quality analysis report. One electronic copy of the report will be provided to the City.

Task 4: Noise Impact Analysis
ECORP will conduct the noise analysis. The applicable noise criteria for the project area will be reviewed and discussed for land uses adjacent to, and nearby, the project site as they will be the basis for the project impact determination and whether mitigation is necessary. In order to establish the existing ambient noise levels currently experienced at and around the project site, ECORP will conduct up to four short-term (15 minutes) measurements in the vicinity. A predominant source of noise in the project area is Interstate 105; therefore, traffic noise generated on this facility will be calculated using the Federal Highway Administration Traffic Noise Prediction Model (FHWA-RD-77- 108) coupled with traffic data from the California Department of Transportation (Caltrans). The combination of the baseline noise survey and calculated traffic noise from Interstate 105 will provide a representative characterization of the existing ambient noise environment.

Noise levels from construction sources will be analyzed using the Federal Highway Administration Roadway Construction Noise Model and based on the anticipated equipment to be used. In order to evaluate the potential health-related effects (physical damage to the ear) from construction noise, construction noise will be evaluated in terms of hourly equivalent continuous noise levels (Leq) and the frequency of occurrence at the nearby receptors (residences to the south, southeast, and southwest). In addition, an analysis of vibration impacts will be prepared based on Caltrans’s vibration analysis guidance.

The evaluation of the project’s contribution to noise increases over existing conditions will be addressed. The predominant source of on-site noise would include parking lot activities within the predominantly enclosed parking areas and small crowd noise on the rooftop terrace. The analysis of on-site noise will rely on the SoundPLAN 3D noise model, which will be used to calculate the propagation/spread of on-site project noise levels from on-site operations.

The project also has the potential to increase off-site traffic noise. According to the 2020 Caltrans Technical Noise Supplement to the Traffic Noise Analysis Protocol, doubling of traffic on a roadway is required in order to increase noise to a perceptible level for humans. In the case that traffic is predicted to double the amount of existing traffic on vicinity roadways, off-site mobile source noise impacts from vehicular traffic will be assessed using the Federal Highway Traffic Noise Prediction Model. Otherwise, off-site traffic noise will be addressed qualitatively.

Please note that this scope assumes that the City will provide detailed site plans and proposed grading plans, as well as detailed construction phasing and grading/excavation/paving quantities.

Deliverables: ECORP will complete a noise analysis report. One electronic copy of the report will be provided to the City.

City of Hawthorne
Menlo Hotel Project

Task 5: Notice of Exemption Preparation and Filing
If the document described in Task 2 determines that the project qualifies for an exemption from CEQA, Michael Baker will prepare a Notice of Exemption (NOE) for the project pursuant to CEQA Guidelines Section 15062. Michael Baker will also file the signed notice with the Los Angeles County Clerk.

Deliverables: Michael Baker will submit an electronic version of the NOE for City review and approval. Upon City approval, Michael Baker will file the signed NOE with the Los Angeles County Clerk.

Task 6: Public Hearings
Michael Baker’s project manager will be available to attend up to two public hearings on the project.

For the purpose of developing a scope, schedule, and budget, we have assumed that a Class 32 Infill Development Projects CE is the appropriate level of CEQA compliance. Should the environmental analysis reveal that an IS/MND or EIR is the appropriate CEQA document for the project, Michael Baker would be available to prepare the document per the mutual agreement of a budget, scope, and schedule augmentation between the City and Michael Baker.

Michael Baker assumes that no technical studies other than those specifically included in our proposed scope of work will be required to complete the CEQA documentation for the project. If additional technical studies become necessary, Michael Baker would be available to conduct the studies per the mutual agreement of a budget augmentation between the City and Michael Baker.

Michael Baker has included one round of City review of administrative draft versions of all documents included in our scope of work, as well as one proofcheck draft version of the CE memorandum.

Should multiple reviews beyond those included in our scope of work be requested by the City, additional Michael Baker staff time may be necessary beyond the established budget. Should such a scenario arise, we would work with the City to seek mutually agreeable budget augmentation.

Michael Baker assumes that the project description will not substantively change during the assignment. Should the project description change during the course of the work, additional Michael Baker staff time may be necessary beyond the established budget to revise/update the document and the analysis. Should such a scenario arise, we would work with the City to seek mutually agreeable budget augmentation.

AGENDA ITEM NO. 14

CITY OF HAWTHORNE
City Council

AGENDA BILL
For the meeting of August 13, 2024
Originating Department: Public Works
City Manager: __________
Vontray Norris
Dir. of Public Works: ___________
Akbar Farokhi
SUBJECT:

New City Yard (City Project #24-02)- Out to Bid,
RECOMMENDED MOTION:

Staff recommends that the City Council approve the Plans and Specifications and authorize the Director of Public Works to advertise for construction bids with a return date of September 24, 2024.

DISCUSSION:

The current City Yard located at 12501 Truro Ave., was built in September 1955, and was evaluated to determine the current site conditions. The City determined that the current City Yard is noncompliant with current codes, the equipment is outdated, there is a limited amount of space remaining, and it would be more cost affective if a new facility were to be built rather than renovating and retrofitting the existing facility. This evaluation led to the City authorizing Public Works to create and advertise a Request for Proposals (RFP) for design services for a New City Yard. The City received five (5) RFP submittals and after careful review of all proposals, the City awarded the design services to Rania Alomar Architect, Inc (RA-DA). Over the past five (5) months, RA-DA has been working the City to design a New City Yard, which will be relocated to a more centralized location in the city at 3851 W. El Segundo Blvd. This New City Yard was designed to meet all current state codes, enough space to properly store all equipment and city maintenance vehicles, will have enough office space for multiple departments/divisions and will be better accessible to residents, enabling staff to be more efficient in providing proper and upto-standard work.

The New City Yard will be located at 3851 W. El Segundo Blvd. The work for the project includes adequate parking spaces for large and regular vehicles, a two-story building, a fuel-pumping station for gas and diesel vehicles, an above ground propane tank, a mechanic station, wash down bays,

hazardous material storage, welding area, general storage, employee restroom, and storage space for large city vehicles. Vehicle parking spaces will have a photovoltaic canopy above, as well as on all building rooftops. The two-story administration building will contain ground level storage, public facing entrance/vestibule, elevator, office, restrooms, and elevator equipment room. The second story will include City offices, training rooms, conference rooms, mail intake and sorting, and staff restrooms. The roof of the administration building will also hold a new radio tower and drone pad.

Additionally, new sidewalks will be installed that are ADA compliant, along with driveways that provide entrance and exit to the facility.

ECONOMIC DEVELOPMENT STRATEGIC PLAN:

Goal 3: Improve customer service operations
FISCAL IMPACT:

None. The project will be funded through issuance 2024 Lease Revenue Bonds (the “2024 Bonds”), SB1383, Equipment Funds, Sewer Funds, Proposition C, and allocated funds from the 2024-25 budget.

SUBJECT:

Progress Payment #1 in the amount of $67,925. 00 due to DOJA, Inc. of Ontario, CA for Zela Davis Park Renovation (Project # 24-04)
RECOMMENDED MOTION:

Staff recommends that the City Council approve this Progress Payment #1 to DOJA, Inc. of Ontario, CA.

DISCUSSION:

This project involves enhancing Zela Davis Park, a 0.5-acre underutilized park in the City of Hawthorne. The initiative aims to transform the existing space into a versatile, climate-resilient community area. This will be achieved through the installation of a new playground, a picnic area featuring shade structures, exercise equipment, a half court, walking paths adorned with mosaic art elements, perimeter fencing, restroom building, California native plants, bioswale, and various sustainable elements. All activities will be conducted in accordance with the specified Plans and Specifications to ensure the successful completion of the improvements.

Current progress consists of demolition of the existing park features, removal of trees, and commencement of rough soil grading.

ECONOMIC DEVELOPMENT STRATEGIC PLAN:

This project is a result of the City working closely with funding and regulatory agencies to support and improve our infrastructure. This project will enhance the quality of life in the City, creating publicly accessible and usable open space.

FISCAL IMPACT:

SUBJECT:

Agreement between the Hawthorne Police Department and Fusus for video and data collaboration for the Hawthorne Police Department.

RECOMMENDED MOTION:

Staff recommends that the City Council approve the agreement with Fusus for video and data collaboration in the amount of $326,750, and authorize Captain Eric Lane to execute the agreement.

DISCUSSION:

Since June of 2021, the Hawthorne Police Department has collaborated with Fusus on the integration of business and community owned security camera systems with the Hawthorne Police Department. This technology allows participating businesses to share live video surveillance with Hawthorne Police Department for improved safety and police response. The integration allows the Department to monitor business cameras, community cameras, park cameras, and intersection cameras in real time, aiding in reduction of response times, and improved criminal investigations. Fusus has improved officer situational awareness, and serves as a mutual aid platform for improved information sharing across the South Bay region.

Fusus allows the Department to view many different video systems through one ecosystem making it easier and more efficient for staff monitoring cameras. Fusus provides a video and data collaboration platform expediting intelligence gathering and efficiency of response to situations as they unfold throughout the community. Further, the platform is tied to a community-facing website portal for video camera registry, providing a tool for identifying the location of cameras in proximity to incidents, as well as a means for efficient outreach to collect recorded video and image files from camera owners, both public and private.

Page 2 of 2 ends

Fusus integration is also a vital part of the future camera integration with the City of Hawthorne’s legal cannabis retail businesses. Hawthorne Municipal Code section 5.100.110 requires the licensed to share their interior and exterior video camera surveillance systems with the Hawthorne Police Department.

ECONOMIC DEVELOPMENT STRATEGIC PLAN:

FISCAL IMPACT:
$326,750 over three (3) years to be paid from Asset Forfeiture or the General Fund, depending on the evolving regulations on Asset Forfeiture Spending. Blanket purchase Orders have already been approved by City Council for year one (1) and year two (2) of the agreement.

Agreement between the City of Hawthorne and the Los Angeles Dodgers Foundation for the installation of baseball field improvements at Jim Thorpe Park RECOMMENDED MOTION:

Staff Recommends that the City Council approve an agreement DISCUSSION:

The agreement between the City of Hawthorne and Los Angeles Dodgers Foundation (LADF) outlines the scope of work, responsibilities, and contributions of each party for the installation of the baseball field improvements at Jim Thorpe Park. The proposed improvements include, but are not limited to, the installation of new field turf, dugouts, fencing, and scoreboard, as well as enhancements to the seating area and overall field layout.

These improvements will not only enhance the aesthetic and functional aspects of the baseball field but will also provide a safer and more enjoyable environment for our community’s youth and recreational leagues. Additionally, the partnership with LADF is expected to foster greater community engagement and pride in the park’s facilities.

The financial implications of this agreement are favorable to the City. The LADF has agreed to cover the majority of the costs associated with the improvements, with the City providing thirty percent of the project cost. There is no significant financial burden anticipated for the City.

The partnership between the City of Hawthorne and the Los Angeles Dodgers Foundation represents a valuable opportunity to improve the quality of our recreational facilities at Jim Thorpe Park. The proposed agreement will benefit the community by providing enhanced amenities and fostering a positive relationship with a respected community partner. Staff

Human Resources Director:

Erika Lampkin
SUBJECT:

Amendment to the Employment Contract of the Chief of Police.

RECOMMENDED MOTION:

Staff Recommends that the City Council approve an amendment to the Chief of Police, Gary Tomatani’s employment contract.

DISCUSSION:

The Hawthorne Police Management Supervisors Group (HPMSG) have completed negotiations and entered into a new Memorandum of Understanding (MOU). As a result of this new Memorandum of Understanding and the current terms of Chief Tomatani’s employment contract (Section 6) will result in subordinates within the HPMSG with higher compensation rates than Chief Tomatani. In an effort to remedy this, the City and Chief Tomatani agree the base salary will increase by the same annual percentages each year as dictated by the Hawthorne Police Management Supervisors Group Memorandum of Understanding effective July 27, 2024 – June 30, 2027.

ECONOMIC DEVELOPMENT STRATEGIC PLAN:

This Side Letter Agreement will assist the City in its efforts for continuous growth in professional development and strategic planning.

FISCAL IMPACT:

Funds will be allocated to the general fund for the duration of the contract.

1. Side Letter Agreement between the City of Hawthorne and Chief Gary Tomatani

SIDE LETTER AGREEMENT

TO THE EMPLOYMENT AGREEMENT FOR THE CHIEF OF POLICE
(AGREEMENT EFFECTIVE MARCH 28, 2023 – MARCH 28, 2026)

BETWEEN THE CITY OF HAWTHORNE

AND GARY TOMATANI
This side letter is executed pursuant to the March 28, 2023 – March 28, 2026 Employment Agreement between the City of Hawthorne (City) and the Chief of Police (Tomatani). This letter will amend Section 5; Paragraph Three and Section 6 (“Bargaining Unit Applicable to Tomatani”) of the Employment Agreement
Change 1:

Section 5: Paragraph Three of the Employment Agreement for the Chief of Police, in part currently reads:
“Except as otherwise provided herein, Tomatani shall be entitled to all compensation and benefits which are received by the employees represented by the HPMSG including, but not limited to, those included in the MOU between the City and HPMSG for as long as Tomatani is a sworn employee of the City.”
The following specifications (two paragraphs) will be added to the existing text of Section 5 of the Employment Agreement for the Chief of Police, following the existing Paragraph Three:
“In addition to other compensation currently determined by the Employment Agreement for the Chief of Police, Tomatani will also be compensated for an additional 160 hours per calendar year as a part of his salary. The total compensation will be calculated at the current rate of pay based on the terms of the Employment Agreement. Changes in the rate of pay will go into effect on the following pay period. The 160 hours of compensation will be pro-rated and distributed evenly as a part of his salary, each two-week pay period, effective July 27, 2024, in which he has not yet been compensated for “Fixed Holidays” per the HPMSG MOU. There will be no retroactive compensation associated with this Side Letter Agreement.

When the terms of this Side Letter go into effect, Tomatani will forfeit the benefit of his “Fixed Holidays” (160 hours) as determined by the July 1, 2021 Through June 30, 2024 Memorandum of Understanding Between the City of Hawthorne and the Hawthorne Police Management Supervisory Group, Article 13 – Holidays (Paragraphs A, B, C, D, and E) and any subsequent MOUs between the HPMSG and the City in this regard.”
As 80 hours of the aforementioned, “Fixed Holiday” pay has already been paid and received by Chief Gary Tomatani in quarters 1 and 2, the remaining 80 hours will be calculated in the Chief’s base salary effective July 27, 2024 – December 31, 2024. January 1, 2025, and for the remainder of the contract, the full 160 hours will be a part of his base salary and will continue for the duration of the contract. For this change in the agreement, the base salary will be reflected as follows:
 Effective July 27, 2024, the base salary will be $16,355.77 per month.  Effective January 1, 2025, the base salary will be $16,961.54 per month.

Note: These base rates are not inclusive of the changes in Section 6 of this side letter agreement.

Change 2:

Section 6 of the Employment Agreement for the Chief of Police, in part currently reads:
“Tomatani’s base salary will be $15,000. For each year, if Tomatani’s contract is not terminated, he shall be entitled to an increase in pay by the lesser of five percent (5%) of this then base salary or the cost of living adjustment for the respective year.” As a result of the MOU being entered into by the HPMSG and the City effective July 27, 2024, following the current terms (of Section 5, Paragraph Three, and Section 6) will result in subordinates within the HPMSG with higher compensation rates than Chief Tomatani. In order to remedy this, Tomatani and the City agree that for the remainder of the Employment Agreement (which expires March 28, 2026), that:

Tomatani’s base salary will increase by the same annual percentages as the salary rates for HPMSG members, as dictated by the MOU between HPMSG and the City, which expires on June 30, 2027.

In return, Tomatani agrees to forego the annual increases in his Employment Agreement as specified in Section 6 while his employment agreement remains in place.

Addressing Homelessness In Light of Supreme Court’s Holding in Grants Pass, the Governor Newsome’s Executive Order and Good Neighbor Pledge from SBCCOG. (D. Patterson, A. English) RECOMMENDED MOTION:

Staff recommends that the City Council Discuss and Provide Directions to the Staff.

DISCUSSION:

The U.S. Supreme Court in City of Grants Pass v. Johnson held that an anti-camping ordinance did not violate the 8th Amendment to the Constitution on Cruel and Unusual Punishment. After this decision, Governor Newsome issued Executive Order N-1-24 which ordered the State agencies to work with local agencies to clean up encampments immediately where the encampment poses imminent threat or by posting a 48 hours notice with request for outreach services where there is no exigent circumstance.

Locally, the South Bay Cities Council of Governments (SBCCOG) issued “Good Neighbor Pledge” for the South Bay cities to join. The Pledge seeks to discourage cities from aggressively criminalizing homelessness and continue to offer services and address the root causes of homelessness. The Pledge is not a legally enforceable agreement and is meant to preclude city’s policy that results in the unhoused to move from one city to its neighboring cities.
