CLIMATE ACTION PLAN UPDATE 4
Preliminary Concept Review
Zoning Text Amendment and
Modification of Approved Site Plan Review and Variance
to allow a drive-through establishment at 22091 Hesperian Blvd.
CLIMATE ACTION PLAN UPDATE 5
Open a Starbucks drive-through at
22091 Hesperian Boulevard
Site Information
• Located in AT-C (Air Terminal Commercial)
District
• Site Plan Review and Variance approved in 2019
• Located within 0.4 miles of an existing drive-
through Burger King
• Located in the vicinity of three Starbucks coffee
shops
Proposal
CLIMATE ACTION PLAN UPDATE 6
AT-C District Drive-Through Regulations
• AT-C District Use Regulations do
not allow drive-through
restaurants (Section 10-1.1952
of the Hayward Municipal Code).
• The proposal includes a Zoning
Text Amendment to allow drive-
through restaurants in the AT-C
District
CLIMATE ACTION PLAN UPDATE 7
Half-Mile Minimum Distance Standard for Drive-Throughs
• Section 10-1.1045(j)(5) of HMC
prohibits drive-through restaurants
to be within a one-half mile radius of
one another.
• The proposed drive-through facility
is less than one-half mile from an
existing Burger King drive-through
restaurant.
• 2018 Zoning Text Amendment to
allow less than minimum half-mile
distances for drive-throughs within
half-mile of I-880 or State Route 92.
• The project site does not meet the
standard (does not qualify to be
closer than half-mile to another
drive-through establishment)
The proposed establishment would require a
Zoning Text Amendment to reduce the minimum
distance.
Half-mile buffer map showing site and I-880
CLIMATE ACTION PLAN UPDATE 8
Approved Site Plan Review and Variance
• Approved project:
Four-story, 131-room
Home2Suites hotel by Hilton and
a 5,400 square-foot multi-tenant
commercial building.
• The project included a Variance
to allow the hotel to exceed 40
feet in height to allow for the
development of the commercial
building, plaza and parking for
both uses, which could not be
achieved under the applicable
regulations.
The conceptual proposal includes shrinking the
size of the previously approved commercial
building to 2,500 square feet to accommodate
the drive-through coffee shop.
CLIMATE ACTION PLAN UPDATE 6
Would the CEDC support a Zone Text
Amendment to allow drive-through
establishments in the AT-C district?
Does the CEDC have any concerns with
allowing the proposed modification to the
approved plan considering the details and
conditions of the approved Variance?
Does the CEDC support amending the
regulations for drive-through establishments
to allow these to be closer than one-half mile
to each other when not in close proximity to
major highways?
Policy Questions
6.53 STARBUCKS DRIVE
THRU CONCEPT
22091 HESPERIAN BLVD. HAYWARD, CA
ABOUT US
KG Hotels is a commercial development company
specializing in hospitality industry. Our aim is to help to stimulate local economic markets with development
projects that fit the needs of the city. Our projects have been proven to generate tax revenue bases to help cities grow and attract new long-term businesses. We have
recently invested millions of dollars in tax revenue with the building of two hotels within the city limits.
2 STARBUCK CORPORATION
3 The Starbucks Corporation does not sell franchises. It is important to note that once they building a store – they maintain and manage it under their strict protocol. This helps to ensure long term leases instead of short term turnovers. They have approached our leasing agent as an interest party and would like to offer the city of Hayward another Drive Thru location with a café and enhanced patio.
Drive thru restaurants offer a heightened convenience for the community. This With the café + patio – we are providing the community a third-place atmosphere to gather and creating the walkable neighborhood. The location will offer convenience in support of the activities in the nearby businesses.
CURRENT
LOCATIONS
Starbucks currently has two locations on
either end of this strip of the divided
boulevard.
This location would help to eliminate the
U-turns associated with accessing the
other drive thru locations along the
section, thereby making the vehicle
circulation safer.
This location would cannibalize the sales
of nearby drive thrus, thereby alleviating
any stacking issues that may be
occurring at those locations.
4 PROJECT RESTRICTIONS
SITE ZONE RESTRICTION (AT-C)
• Site is currently zoned AT-C
• This zone restricts drive throughs
DRIVE THROUGH PROXIMITY RESTRICTION
• The city of Hayward has placed a restriction on drive through establishments being building within ½ mile
4/25/2022 22091 HESPERIAN BLVD. 5
6 While restaurants are allowed - Drive-thrus are not allowed within the AT-C zoning district.
SEC. 10-1.1951 - The purpose of the AT-C Subdistrict is to provide for certain specified commercial and service uses that are compatible with airport activity, in addition to simultaneously serving the general population of the City.
We could not find in the zoning ordinance, directly, any (specific) reasons for not allowing drive-throughs near airports. We would like to request any additional supporting documentation that justifies the restriction, such as airport security clauses or other FAA guidelines specifically restricting their installation in proximity.
RESTRICTION #1
7 AT-C ZONES
It is important to note that there are
several businesses located within this
district that do not necessarily meet, what
we would consider to be, “ .. services
compatible with airport activity..” as noted
in the description of uses for the AT-C
zone.
Starbucks certainly has more to offer in
support of Airport patronage than the
neighboring Dialysis center or Home
Depot.
PROPOSED SITE PLAN
8 • 22 Parking spaces
• 2500 SF – 1 story
• 13+ stacking
• Site plan is not final
and can be modified
to suit desired drive
thru approach and
stacking
RESTRICTION #2
9 It is noted that there is a Burger King drive thru located just within proximity to the north at 0.4 miles. We would like to ascertain that this drive-thru location is on, and accessed from, West A Street and will in no way impact traffic on Hesperian Blvd.
There are no other drive thru locations within this one-half mile radius.
There are no other drive thru locations on this side of the boulevard.
Per city regulations: drive thru restaurants and drive-thru coffee shops shall be a minimum of one-half mile apart
TRAFFIC IMPACTS
The Starbucks directly to the North of
our site does not have a drive thru and is
walk up POS service only.
This new location would help to
eliminate the U-turns associated with
accessing the drive thru location to the
south, thereby making the vehicle
circulation safer.
This location would cannibalize the sales
of nearby drive thrus, thereby alleviating
any stacking issues that may be
occurring at those locations.
Skyway Drive can also be used as a
means to access the drive thru without
impacting the boulevard.
10 SUPPORTING STATEMENT
11 We need to consider in detail the ramifications a post-covid society presents. With labor shortages and increased costs to staff, maintain, and sanitize dining rooms and facilities, We have seen an increased need for drive thru food service as guest dining rooms have proven to be costly to maintain and sanitize. We have seen a dynamic design trend in fast food experience. Some Starbucks, as well as other franchises including Taco Bell, KFC, and Wendy’s, are developing fully automated, drive-thru only type locations and eliminating their dining rooms completely.
Please note also that we are aware of the environmental impacts this project might have on the local community. We understand our responsibility and are willing to perform any vehicle traffic analysis, noise impacts, or other environmental studies necessary to support this project. $1M $3M

SUMMARY
13 We understand your concerns in the Text amendments we are requesting could have planning design impacts city wide; However, we do not see this request affecting the grand scale of city design. The AT-C district is relatively small and only encompasses a few city blocks outside of the airport proper; of which a very small percentage is left for future development or renovation.
We also appreciate that you are consciously reviewing the impacts drive thru proximity has on vehicular circulation.
Rather than ask for a text amendment, we would like to request Variances for these two items instead to allow installment of a drive through for this parcel only. We then avoid having to unnecessarily disrupt the overall city plan.
THANK YOU
