RESOLUTION IMPLEMENTING LEVEL 2 OF THE CITY OF HAYWARD WATER SHORTAGE CONTINGENCY PLAN WHEREAS, Governor Newsom issued proclamations on April 21, May 10, July 8, and October 19, 2021 that a state of emergency exists statewide due to drought conditions and urging Californians to reduce their water use; and WHEREAS, on March 28, 2022, Governor Newsom issued Executive Order No. N-7-22 directing the State Water Resources Board to consider adopting an emergency regulation to increase water conservation; and WHEREAS, on May 24, 2022, the State Water Resources Control Board adopted an emergency regulation, requiring among other provisions, that urban water suppliers implement Level 2 of their Water Shortage Contingency Plans, which is designed for water shortages of 11 percent to 20 percent; and WHEREAS, Hayward’s wholesale water supplier, the San Francisco Public Utilities Commission, has requested a voluntary system-wide decrease in water usage of 11 percent, based on FY 2019-20 demand; and WHEREAS, Hayward is an urban water supplier under the California Water Code Section 10617; and WHEREAS, the Hayward City Council adopted the 2020 Urban Water Management Plan on July 20, 2021; and WHEREAS, the 2020 Urban Water Management Plan includes a Water Shortage Contingency Plan, adopted separately by Resolution No. 21-167, which in part identifies shortage levels and measures to be implemented at each level; and WHEREAS, the Hayward City Council supports and encourages water conservation at all times, and recognizes that current water supply conditions call for additional measures.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hayward that Level 2 of the Water Shortage Contingency Plan is hereby implemented, effective immediately, and shall remain in effect until rescinded by the City Council.
