COUNCIL VACANCY PROCESS

LEGISLATIVE BUSINESS
ITEM #3
LB 22-026
1 Council Vacancy Process: Adopt a Resolution
Approving a Process for Filling a Two-Year Term
City Council Vacancy
Kelly McAdoo, City Manager
Miriam Lens, City Clerk
Michael Lawson, City Attorney
2 Background
▪ November 2022: Election for Mayor and two City Council seats; Councilmember Mark Salinas elected Mayor, leaving a vacancy in his remaining term
▪ Vacancy runs from December 2022 through December 2024 ▪ City Charter Section 501 requires the Council either fill the vacancy or proceed with a special election within 30 days following the occurrence of the vacancy
▪ Special Election would occur as an all-mail ballot election to be held on May 2, 2023
3 Proposed Council Member Appointment
Timeline
Dec 13 Council Meeting to approve appointment process
Dec 14 Issue Notice of Vacancy/applications available
Jan 3 Applications due to City Clerk by 9am
Jan 3 Special Council Meeting: Accept applications and
confirm interview process
Jan 5 Council select up to 5 applicants to interview/City Clerk notifies applicants
Jan 9 Special Council Meeting: Interviews/Swearing in of new member OR Council directs City Clerk to call
for Special Municipal Election
4 Fiscal Considerations
• Special all-mail ballot election would cost between $9 - $11 per registered voter
• Estimating 80,000 registered voters, the cost to the City would be $720,000-880,000
5 Recommendation
That the Council adopts a resolution affirming the process for filling the unexpired term of Council Member Mark Salinas and calls for a Special Election if the appointment process is unsuccessful. 6 1. Council Questions

2. Open Public Hearing
