7 1. Amend sections of the Hayward Municipal Code (HMC) that relate to sidewalk vending, including Section §8-1.84, which regulates peddling by foot or vehicle.

2. The existing regulations that apply to food vending on private property will remain unchanged as SB 946 only addresses sidewalk vending in public right-of-way.

Possible Regulatory Changes

8 Questions for CEDC

1. Should the sidewalk vending ordinance include some of the optional regulations that are allowed per State law, such as establishing setback requirements from certain land uses, such as schools, parks, parking lots, public fixtures, and farmer’s markets?

2. Does the CEDC support limiting the hours of operation for sidewalk vendors?

3. Does the CEDC support the establishment of minimum performance standards for sidewalk vendors that includes maintaining sanitary conditions, maintaining sidewalk clearance in accordance with the ADA, providing trash receptacles to dispose of waste, and complying with noise regulations?

4. Does the CEDC support an integrated permitting program which entails a separate sidewalk vending permit, encroachment permit, and business license? What would be the cost of the sidewalk vending permit? Would the encroachment permit include a proof of general liability insurance?

5. Does the CEDC support enforcement that is more focused on the maximum fines similar to the State or more focused on a collaborative means for compliance, focused on education and awareness? Together for Hayward
