RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH MBS ENGINEERING, INC., FOR INSTALLATION OF LIQUEFIED PETROLEUM GAS LINES, CONNECTION PITS AND REGULATORS FOR THE FIRE STATION 6 AND FIRE TRAINING CENTER PROJECT IN AN AMOUNT NOT-TO-EXCEED $224,321 WHEREAS, the construction of the new Fire Station 6/Fire Training Center project includes training with the use of live fire training at the four-story Training Tower building and at the outdoor area with the use of liquefied petroleum gas (LPG); and WHEREAS, pipes were installed underground from the LPG tanks to the Training Tower building and to the outdoor area by the contractor per the contract documents; and WHEREAS, the project learned after installation of the underground pipes to the outdoor area required thicker wall pipes for the higher-pressure vapor and liquid lines per code requirements; and WHEREAS, Stantec Consulting Services, Inc., the designer of the LPG system, acknowledged the error in the design and provided revised drawings to install the correct pipes and connection pits where these pipes terminate; and WHEREAS, on April 28, 2023, the City of Hayward solicited Request for Proposals for the LPG modification; and WHEREAS, on May 19, 2023, one (1) bid was received in the amount of $224,321; and WHEREAS, the proposal submitted by MBS Engineering, Inc., is responsive.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hayward that the City Manager is hereby authorized to execute, on behalf of the City of Hayward, an agreement with MBS Engineering, Inc., in an amount not-to-exceed $224,321 to include direct payment between Stantec Consulting Services, Inc., and MBS Engineering, Inc.
