RESOLUTION CONFIRMING THE REPORT AND SPECIAL ASSESSMENT LIST AND AUTHORIZING TRANSMITTAL OF ASSESSMENTS TO THE COUNTY ASSESSOR FOR COLLECTION ASSOCIATED WITH OVERDUE COMMUNITY PRESERVATION AND RENTAL PROGRAM CHARGES FOR THE PERIOD OF JANUARY 1, 2022 THROUGH MAY 1, 2023 WHEREAS, In connection with the Community Preservation Program, the Code Enforcement Manager has rendered an itemized report herein referred to as an Assessment List (Attachment III) in writing to this Council showing the Community Preservation, violations and cost of fines, fees and penalties related to abating community preservation violations and vacant property violations in the City of Hayward as described in the report and as required by section 5-7.100 of the Hayward Municipal Code; and WHEREAS, In connection with the Residential Rental Inspection Program, the Code Enforcement Manager has rendered an assessment list (Attachment III), specifying the amount of unpaid program and other fees and penalties imposed during the above identified period, including the names and addresses of inspected rental unit owners, including hotel and motel units, as required by section 9-5.503 of the Hayward Municipal Code; and WHEREAS, the fixed time and place for receiving the report is 7:00 p.m. on Tuesday, June 27, 2023, in the Council Chambers, City Hall, 777 B Street, Hayward, California; and WHEREAS a copy of the report has been posted and published in the manner required by section(s)5-7.110 and 9-5.504 of the Hayward Municipal Code; and WHEREAS, The hearing was held at the time and place fixed, as stated above, and the City Council has considered the report and assessment list and all comments with respect thereto.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hayward that, except as amended by Council, the report of the Code Enforcement Manager of the Code Enforcement Division on the cost of causing the correction, repair, or abatement of violations on the properties therein described, a copy of which is attached hereto, is hereby confirmed.
BE IT FURTHER RESOLVED that payments of assessments confirmed herein may be received by the City of Hayward Finance Director until 5:00 p.m. on August 1, 2022, and thereafter, the Finance Director shall transmit the unpaid assessments to the County Assessor for collection on the property tax roll.
