RESOLUTION AWARDING THE CONSTRUCTION CONTRACT TO BEAR CONSTRUCTION, INC., AND APPROVING ADDENDUM NO. 1, 2 AND 3 FOR THE FY23 MEDIAN LANDSCAPE IMPROVEMENT – PHASE 2, PROJECT NO. 05281 WHEREAS, by Resolution No. 23-140 on June 6, 2023, the City Council approved the plans and specifications for the FY23 Median Landscape Improvement – Phase 2, Project No. 05281, and called for bids to be received on June 20, 2023; and WHEREAS, Addendum No. 1, 2 and 3 were issued to clarify bidder questions; and WHEREAS, two (2) bids were received, ranging from $852,600 to $874,875; Bear Construction, Inc., of Hayward, California submitted the low bid in the amount of $852,600, which is 7.6% lower than the Engineer’s Estimate of $922,700.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Hayward that the City Manager is authorized to award Bear Construction, Inc., a construction contract for the FY23 Median Landscape Improvement – Phase 2, Project No. 05281 in the amount of $852,600 with a contract change order budget of $155,000, for a total not-to-exceed contract amount of $1,007,600, and approve Addendum Nos. 1, 2 and 3, in accordance with the plans and specifications adopted therefore and on file in the office of the City Clerk of the City of Hayward at and for the price named and stated in the bid of the hereinabove specified bidder, and all other bids are hereby rejected.
BE IT FURTHER RESOLVED that the City Manager is hereby authorized and directed to execute the contract with Bear Construction, Inc. in the name of and for and on behalf of the City of Hayward, in a form to be approved by the City Attorney.
