DATE: August 15, 2023
TO: Mayor and City Council
FROM: Director of Maintenance Services
SUBJECT: Adopt a Resolution Authorizing the City Manager to Negotiate and Execute an Amendment to the Memorandum of Understanding with the Hayward Area Recreation and Park District for Operations and Maintenance of Certain Landscape and Lighting Assessment District (LLAD) Parks
RECOMMENDATION
That the Council adopts a resolution (Attachment II), authorizing the City Manager to negotiate and execute an amendment to the Memorandum of Understanding (MOU) with the Hayward Area Recreation and Park District (HARD) for operations and maintenance of certain Landscape and Lighting Assessment District (LLAD) Parks.
SUMMARY
The City and HARD first entered into a MOU in 2016 for Twin Bridges Park (LLAD 7), Gordon E. Oliver Eden Shores Park (LLAD 12), and Alden E. Sports Park (LLAD 10). Through the agreement, HARD assumes the responsibility of operating and maintaining the park sites per an agreed-upon maintenance cost funded out of the respective LLAD budgets. The MOU expired with the Master Lease Agreement (MLA) on June 30, 2023. A new MLA was executed on July 1, 2023. While City and HARD staff work collaboratively to discuss the benefits of another five-year MOU, staff recommends authorizing a one-year amendment to include the newly accepted SoHay Park and extend the MOU through June 30, 2024.
BACKGROUND AND DISCUSSION
On January 8, 2016, the City and HARD entered into a MOU for the operations and maintenance standards of parks in three LLADs: Twin Bridges (LLAD 7), Gordon E. Oliver Eden Shores Park (LLAD 12), and Alden E. Sports Park (LLAD 10). The MOU referenced the MLA, originally executed in 1970 and renewed every ten years, between the City and HARD for other City-owned parks. The MOU was valid for five years with options to renew through the life of the MLA. Due to staff vacancies and the Covid-19 pandemic, negotiation efforts to renew the MLA and MOU were delayed. During the same time, in April 2022, SoHay Park (LLAD 18) was accepted by both the City and HARD. On June 20, 2023, Council adopted Reso. 23-160 authorizing the City Manager to negotiate and execute another ten-year MLA with HARD. With the expiration of the current MOU and the execution of a new MLA, staff recommends executing a one-year amendment to include the maintenance of SoHay Park through June 30, 2024.
FISCAL AND ECONOMIC IMPACT
This item has no impact on the General Fund. The FY24 LLAD Budget Process adopted the park maintenance costs outlined below. Please note that the SoHay Park budget includes maintenance costs for both FY23 and FY24, due to the timing of the Park’s acceptance, LLAD budget process, and MOU amendment.
Park (LLAD, Fund)
FY24 Budget
Twin Bridges (LLAD 7, Fund 274)
$ 51,000
Gordon E. Eden Shores Park (LLAD 12, Fund 278)
$ 34,000
Alden E. Oliver Sports Park (LLAD 10, Fund 277)
$ 79,000
SoHay Park (LLAD 18, Fund 291)
$ 75,000
This item has no direct economic impact. However, park maintenance will provide a positive economic impact to the City by sustaining an overall environmentally-friendly aesthetic that helps the reduce the effects of greenhouse gasses, fire hazards, and blight. It also helps increase property value and provides safe open spaces for recreation and physical activity.
STRATEGIC ROADMAP AND SUSTAINABILITY FEATURES
This item is a routine operational item and does not directly support Council’s Strategic Priorities or have significant sustainability features.
NEXT STEPS
If Council approves this item, the City Manager will negotiate and execute an amendment to the MOU with HARD to include the maintenance of SoHay Park and extend the term length through June 30, 2024.
