Resolution Authorizing the City Manager to AMEND THE PROFESSIONAL SERVICES Agreement with First PresbyteriaN church of hayward TO INCREASE THE WINTER WARMING SHELTER AT SOUTH HAYWARD PARISH CONTRACT AMOUNT BY $405,686 FOR A total NOT TO EXCEED amount of $2,050,000 AND EXTEND EMERGENCY SHELTER SERVICES THROUGH JULY 31, 2024 WHEREAS, the bill from the House of Representatives (H.R. 1319) was passed by the Senate of the United States on March 6, 2021 as the “American Rescue Plan Act of 2021” (ARPA); and WHEREAS, ARPA provides $350 billion to help states, counties, cities, and tribal governments cover increased expenditures, replenish lost revenue and mitigate economic harm from the COVID-19 pandemic; and WHEREAS, local Governments (City and County) shall receive $130 billion in entitlements under ARPA, with City Funding estimated at $65 billion in total entitlements; and WHEREAS, the City of Hayward is estimated to receive an entitlement in the amount of $38,232,335, received in two equal tranches of payments over the next 12 months; and WHEREAS, the City Council of the City of Hayward by Resolution No 21-100 authorized and appropriated $18,900,000 of the Federal Stimulus allocation under the American Rescue Plan Act of 2021 for Year 1 projects and programs; and WHEREAS, Council by Resolution No. 21-139, indicated its intention to allocate $2,000,000 of the City of Hayward’s ARPA Federal Stimulus funding to First Presbyterian Church of Hayward for Winter Warming Center Expansion and Day-Resource Center at South Hayward Parish; and WHEREAS, Council annually allocates $25,000 of the City’s General Fund to First Presbyterian Church of Hayward for Winter Warming Center operations; and WHEREAS, Council by Resolution No. 21-145, dated July 13, 2021, authorized the City Manager to negotiate and execute an agreement with First Presbyterian Church of Hayward for FY21-22 Winter Warming Center Expansion and Day-Resource Center at South Hayward Parish Services for an amount not-to-exceed $1,644,314; and WHEREAS, Council by Resolution No. 22-206, dated July 5, 2022, authorized the City Manager to amend the professional services agreement with First Presbyterian Church of Hayward to increase the Winter Warming Shelter contract amount by $405,686 for a total not-to-exceed amount of $2,050,000, and WHEREAS, the execution of the authorized amendment was delayed past the term outlined in Resolution No. 22-206, due to constrained provider capacity caused by increased demand for shelter and necessary changes to the scope of work.
NOW, THEREFORE, BE IT RESOLVED THAT, the City Council of the City of Hayward hereby authorizes the City Manager to amend the professional services agreement with First Presbyterian Church of Hayward to 1) increase the Winter Warming Shelter contract amount by $405,686 for a total not-to-exceed amount of $2,050,000 for FY21-24 Winter Warming Shelter services and 2) extend the term of the agreement to end on June 30, 2024.
