PLAN OF CONTROL TRANSFER MONITORING
Dear Mr. Summers:
As requested, ENGEO Incorporated, acting as the Hayward GHAD Manager, conducted a monitoring event for Parcel B in the La Vista development (Tract 7620), in Hayward, California.
The site-monitoring event occurred on January 22, 2021 . The parcel is proposed for transfer (“Transfer Parcel ”), as identified on the transfer application provided by La Vista L.P. (“Developer”) to the Hayward GHAD. Parcel B (APN 83-477-3) will be owned by the Hayward GHAD after transfer . With the exception of Parcels A, B, P, and Easements M and TBD , the GHAD has accepted responsibilities outlined in the Plan of Control (Reference 1).
As described in Section 6.4 of the La Vista Development Plan of Control (Reference 1), the purpose of this monitoring is to verify that all the facilities for which the GHAD will have maintenance responsibility have been constructed and maintained according to the City-approved plans and specifications for the individual improvements, and that such facilities are operational and in good working order.
As stated in the Plan of Control, eligibility for transfer will occur exactly 1 year after the issuance of the first residential building permit within the La Vista development. The turnover date may be extended by the property owne r. The first residential building permit within the La Vista development was issued in 2016.
COMMENTS
We had the following observations from the site-monitoring event and comments regarding the transfer.
Tennyson Road Entrance
1. A temporary construction gate is located at the entrance to Parcel B from Tennyson Road and should be removed . As it is important to restrict vehicle access on Parcel B; therefore, we request information if the City of Hayward has required a permanent gate at this location. If approved plans are available that show a permanent gate at this location, please provide. If the City of Hayward did not require a permanent gate at the Tennyson Road entrance, we ask the temporary gate remain until the GHAD can install a permanent gate.

2. Grading on Parcel B does not appear to match the grading shown on the approved grading plans (Reference 3). The GHAD should be provided with City -approved grading plans showing the current site conditions.
3. A partially deconstructed det ention basin with a berm, inlet, and outfall was located on Parcel B and should be removed. The area should be graded to drain without concentrating surface flows. Detention basin pipes should be removed from Parcel B and the area should be restored to the approved grading plans.
4. Litter and construction debris should be removed from the future GHAD-owned Parcel B.
Construction debris observed on the site included pipes, concrete structures, tires, lumber, and other materials.
Vegetation Management
5. Vegetation on Parcel B should be controlled sufficiently to meet the requirements of the Hayward Fire Department or site-specific fuel management plan. In addition, t he GHAD should be provided with any agreements, plans, or requirements related to vegetation management on Parcel B.
Fencing
6. The perimeter of Parcel B was checked for proper fencing. As provided in the referenced Plan of Control, t he GHAD will maintain perimeter/boundary fencing on GHAD-owned parcels. In several areas, the fence along the tract bou ndary with the Ersted property was missing or in poor condition including areas bo rdering the off -site wetlands area .
GHAD-maintained fencing, if required, should be in a we ll-maintained condition prior to GHAD acceptance.
Instrumentation
7. A 2 -inch-diameter vertical pipe was observed on the parcel that was protected with a construction cone. Please identify what this pipe is and if it needs to be maintained by the GHAD.
Transfer Documents
8. The GHAD requests documentation from the City of Hayward that would include acceptance of GHAD-maintained improvements, including earthwork, within Parcel B.
9. The GHAD should be provided with a testing and observation report(s) related to recent earthwork on Parcel B.
10. The GHAD should be provided with a preliminary title report for Parcel B. Existing easements or other title exceptions will be reviewed and may need to be extinguished before deeds are recorded.

11. For the GHAD’s review, t he GHAD should be provided with draft Right -of-Entry agreement for landscape maintenance activities planned by others on future GHAD - owned Parcel B.
12. Developer must transfer and assign its rights, duties, obligations , and burdens under Easements "M" and "TBD" to the GHAD and the GHAD must be the beneficiary of a permanent easement by Hayward Tennyson, LLC acceptable to the GHAD.
13. Ownership of the Parcel B will be conveyed by the Developer to the GHAD at the end of the transfer process , which shall be the date the GHAD becomes responsible for oversight of the actual physical maintenance of the G HAD Parcels. The Developer shall record a grant deed transferring fee title to the GHAD for Parcel B. The grant deed must first be reviewed and approved by the GHAD Manager and GHAD Attorney.
We will review the requested documentation and reinspect the listed site conditions after we are informed in writing that the site corrective work has been completed.
