RESOLUTION AUTHORIZING THE CITY MANAGER TO ACCEPT AND APPROPRIATE $250,00 IN ONE BAY AREA GRANT PROGRAM FUNDS FROM THE ALAMEDA COUNTY TRANSPORTATION COMMISSION FOR THE DEVELOPMENT OF A COMMUNITY-BASED TRANSPORTION PLAN PROJECT NO. 06940 WHEREAS, the Alameda County Transportation Commission (“Alameda CTC”) administers funding programs for projects and programs that benefit the Alameda County transportation system, consisting of One Bay Area Grant program (OBAG3) funding, and such funding is collectively defined as and shall be referenced herein as the “Alameda CTC Administered Funds”; and WHEREAS, the City of Hayward (“City”) submitted a funding application (“Application”) to the Alameda CTC for the Community-Based Transportation Plan (“Project”); and WHEREAS, the City will develop a Community-Based Transportation Plan (CBTP) Project 06940, for areas in the City that have been identified as Equity Priority Communities (EPCs); and WHEREAS, by action at its meeting held on April 25, 2024, Alameda CTC awarded $250,000 in Alameda CTC Administered Funds to the City for the implementation and delivery of the planning (“Awarded Phase(s)”) of the Project; and WHEREAS, prior to receipt of any Alameda CTC Administered Funds, City shall be required to enter into a Project Funding Agreement (Agreement) with Alameda CTC based on Alameda CTC’s form therefor, said Agreement shall set forth certain project-specific requirements applicable to the Project; and WHEREAS, as part of the requirements to receive Alameda CTC Administered Funds awarded to the Project, Alameda CTC requires a resolution accepting the awarded funding to be adopted by the City’s governing body confirming the following:
City’s commitment to secure matching funds against the awarded Alameda CTC Administered Funds, if required; and City’s commitment to provide any additional funding required to deliver the Awarded Phase(s) of Project, with an understanding the same shall not be funded with additional Alameda CTC Administered Funds; and City’s commitment to implement the Awarded Phase(s) of Project as described in the funding application and the subsequent funding agreement between Alameda CTC and the City; and City’s commitment to comply with the Agreement; and
City’s commitment to comply with the applicable requirements set forth in Alameda CTC’s Local Business Contract Equity (“LBCE”) Program for professional services and construction contracts funded with Measure B, Measure BB, and/or VRF funds, and abide by the LBCE procedures in the applicable solicitations and contracts.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hayward that the City Manager is hereby authorized and directed to accept and execute an agreement for up to $250,000 from Alameda CTC Administered Funds to complete a CBTP.
RESOLVED that the City Council hereby finds and determines as follows:
City is not required to provide matching funds; and
City understands that the City shall be responsible to provide any additional funding required to deliver the Awarded Phase(s) of Project if the current funding is not sufficient to complete the project, and that the same shall not be funded with additional Alameda CTC Administered Funds; and Awarded Phase(s) of Project will be implemented as described in the Application, Agreement and in this resolution; and City will comply with the Agreement; and
City will comply with the applicable requirements set forth in Alameda CTC’s LBCE Program; and therefore, be it further FURTHERMORE, BE IT RESOLEVED, that the City Council of the City of Hayward authorizes the amendment to the Budget Resolution by accepting and appropriating $250,000 in funding from Alameda CTC to the Transportation System Improvement Fund (Fund 460).
FURTHERMORE, BE IT RESOLVED that the City Council confirms that there is no pending or threatened litigation that might in any way adversely affect City’s ability to implement and deliver the proposed Project; and FURTHERMORE BE IT RESOLVED that City shall provide Alameda CTC with a fully executed copy of this Resolution.
