RESOLUTION AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE A MEMORANDUM OF UNDERSTANDING WITH THE HAYWARD AREA RECREATION AND PARK DISTRICT FOR THE TWIN BRIDGES PARK BASKETBALL COURT RENOVATION AND REIMBURSEMENT IN AN AMOUNT NOT-TO-EXCEED $90,000 WHEREAS, on July 1, 2024, the City and Hayward Area Recreation and Park District (HARD) entered into a Maintenance of Understanding (MOU) for the maintenance and operations of specific Lighting and Landscape Assessment District (LLAD) Parks that does not include capital replacement investments; and WHEREAS, HARD released a competitive bid seeking qualified contractors to renovate basketball and tennis courts at multiple parks, including Twin Bridges Park, throughout Hayward; and WHEREAS, on July 15, 2024, HARD awarded the construction contract to American Asphalt and Repair and Resurfacing, Inc.; and WHEREAS, HARD requests a $85,400 reimbursement from the City once the Park’s renovation are complete; and WHEREAS, staff reviewed and approved the proposal HARD received and agreed that entering into a Memorandum of Understanding would be appropriate and cost-effective; and WHEREAS, staff is requesting a 5% contingency in the event of unexpected expenses occur during construction.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hayward that the City Manager is hereby authorized and directed to execute a Memorandum of Understanding with the Hayward Area Recreation and Park District, in a form approved by the City Attorney, for the Twin Bridges Park basketball court renovation and reimbursement in an amount not-to-exceed $90,000.
