RESOLUTION TO AUTHORIZING THE CITY MANAGER TO EXECUTE AMENDMENT NO. 1 TO THE CONSTRUCTION CONTRACT WITH GSW CONSTRUCTION, INC., INCREASING THE AMOUNT BY $210,000 FOR A NOT-TO-EXCEED TOTAL AMOUNT OF $647,800 WHEREAS, on May 21, 2024, Council adopted Resolution No. 24-096 awarding GSW Construction, Inc., to complete the Arf Avenue Trash Capture Project with a total not-to-exceed amount of $437,800; and WHEREAS, significant design changes in the construction plans have increased the Project costs causing the original budget to be insufficient; and WHEREAS, the FY25 CIP Budget has sufficient appropriated funds for the increased Project budget.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Hayward that Amendment No. 1 to the Professional Services Agreement with GSW Construction, Inc., hereby increased for completion of the Trash Capture Device Installation on Arf Avenue, Project No. 07746, in the amount of $210,000 for a total contract not-to-exceed amount of $647,800, in accordance with the plans and specifications adopted therefore and on file in the City Clerk’s Office and for the price named and stated in the bid of the hereinabove specified bidder.
