AUTHORIZING THE CITY MANAGER TO EXECUTE A FUNDING AGREEMENT WITH AC TRANSIT TO HELP FUND SHELTER MAINTENANCE IN AN AMOUNT NOT TO EXCEED $39,361 ANNUALLY OVER THE FIVE-YEAR CONTRACT TERM WHEREAS, AC Transit is transitioning to a new fiscal model to separate contracts for shelter maintenance, advertising, and capital work and reached out to the City for help with maintenance funding for 63 transit shelters in the City; and WHEREAS, AC Transit provides scheduled and unscheduled maintenance repairs for the 63 transit shelters in the City; and WHEREAS, due to declining advertising revenue at bus shelters and increased maintenance costs, AC Transit has requested financial support from jurisdictions within the AC Transit District for ongoing maintenance of shelters; and WHEREAS, the maximum annual cost for the City is $39,361, which is the remaining maintenance cost after accounting for advertising revenue from the transit shelters in the City; and WHEREAS, the contract term will be five (5) years, including a guaranteed portion from April 1, 2023 to March 31, 2025 and three (3) one-year options to extend.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hayward that the City Manager is authorized to execute a funding agreement with AC Transit in an amount not to exceed $39,361 annually for up to a five-year contract term in a form to be approved by the City Attorney.
