RESOLUTION AUTHORIZING THE CITY MANAGER TO INCREASE THE TOTAL CONSTRUCTION CONTRACT AMOUNT NOT TO EXCEED $16,373,134 DUE TO INCREASE IN CONTINGENCY FROM $855,050 TO $1,078,184 WHEREAS, by resolution on February 28, 2023, the City Council approved the plans and specifications for the FY23 Pavement Improvement Project, Project No. 05240 and called for bids to be received on March 28, 2023; and WHEREAS, on April 25, 2023, the City Council awarded Bay Cities Paving & Grading, Inc. the contract for the FY23 Pavement Improvement Project, Project No. 05240, in the amount of $15,294,950; and WHEREAS, on April 25, 2023, the City Council authorized a construction contingency budget of $855,050, for a total not to exceed contract of $16,150,000; and WHEREAS, Bay Cities Paving & Grading, Inc., completed construction work in a total amount of $16,373,134.
NOW, THEREFORE, BE IT RESOLVED that the City Council authorizes the City Manager to increase construction contingency in the contract with Bay Cities Paving & Grading, Inc., for the FY23 Pavement Improvement Project, Project No. 05240, by $223,134, from $855,050 to $1,078,184 for a total construction contract amount not-to-exceed $16,373,134.
BE IT FURTHER RESOLVED that the City Manager is hereby authorized and directed to amend the contract with Bay Cities Paving & Grading, Inc., in the name of and for and on behalf of the City of Hayward, in a form to be approved by the City Attorney.
