RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE
AMENDMENT NO. 2 TO THE PROFESSIONAL SERVICES AGREEMENT WITH
JONES HALL, A PROFESSIONAL LAW CORPORATION, AND INCREASE THE CONTRACT AMOUNT BY $111,000 FOR A TOTAL NOT -TO-EXCEED AMOUNT OF $185,000, BOND COUNSEL AND DISCLOSURE COUNSEL SERVICES
RELATED TO THE WATER RESOURCE R ECOVERY FACILITY (WRRF) IMPROVEMENT – PHASE II PROJECT
WHEREAS, the City entered into a Professional Services Agreement with Jones Hall, a Professional Law Corporation, on March 13, 2024, for bond counsel and disclosure counsel services related to the Water Resource Recovery Facility (WRRF) Improvements - Phase II Project; and
WHEREAS, Amendment No. 1 to the agreement with Jones Hall was executed on October 15, 2024, which increased the not-to-exceed agreement amount to $74,000; and
WHEREAS, City staff requires additional support and services in closing the WIFIA loan and the 2025 Wastewater Revenue Bonds related to the WRRF Improvements - Phase II Project; and
WHEREAS, the additional cost for such services has been negotiated at an amount not-to-exceed $111,000; and
WHEREAS, Wastewater Fund 612, WRRF Phase II Improvements Project No. 07760 and WRRF New Administration Building & Laboratory Project No. 0 7786 have sufficient funds to accommodate this updated not to exceed amount.
NOW, THEREFORE, BE IT RESOLVED that the City Council hereby finds and determines as follows that the City Manager is hereby authorized to execute Amendment No. 2 to increase the contract by $111,000 for a total not-to-exceed $185,000, in a form approved by the City Attorney.
