RESOLUTION APPROVING PLANS AND SPECIFICATIONS FOR THE FY 25 PAVEMENT IMPROVEMENT PROJECT, PROJECT NOS. 05338 AND CALL FOR BIDS
WHEREAS, by resolution on February 25, 2025, the City Council approved the plans and specifications for the FY2 5 Pavement Improvement Project, Project No. 05338 and called for bids to be received on March 25, 2025; and
WHEREAS, on March 1 4, 202 5, Addendum No. 1 was provided to revise the plan s and specifications and revised call for bids to be received on March 25, 2025; and
WHEREAS, on March 25, 2025, six (6) bids were received, ranging from $12,570,061 to $14,749,159.70; DeSilva Gates Construction LLC , of Dublin, California submitted the lo w bid in the amount of $ 12,570,061 which is 2.9% below the engineer’s estimate of $12,940,000; and
WHEREAS, the Administrative Change Order (ACO) or contingency budget of $949,939 was not disclosed.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hayward that DeSilva Gates Construction LLC, is hereby awarded th e contract for the FY2 5 Pavement Improvement Project, Project No. 05338, in the amount of $ 12,570,061 in accordance with the plans and specifications adopted therefore and on file in the office of the City Clerk of the City of Hayward at and for the price named and stated in the bid of the hereinabove specified bidder, and all other bids are hereby rejected.
BE IT FURTHER RESOLVED that the expenditure of $ 949,939 for Administrativ e Change Orders is hereby authorized.
BE IT FURTHER RESOLVED that the City M anager is hereby authorized and directed to execute the contract with DeSilva Gates Construction LLC, in the name of and for and on behalf of the City of Hayward, in a form to be approved by the City Attorney.
