RESOLUTION APPROVING ADDENDUM NO. 1 AND AWARDING
CONSTRUCTION CONTRACT TO TEROCONS, INC., FOR THE FY23 AND FY24
NEW SIDEWALKS NEW SIDEWALKS PROJECT -CLAWITER ROAD AND
INDUSTRIAL BOULEVARD, PROJECT NOS. 05331 AND 05305 IN THE AMOUNT OF $1,185,290 IN ADDITION TO APPROVING $188,529 IN
ADMINISTRATIVE CHANGE ORDERS (CONSTRUCTION CONTINGENCIES)
WHEREAS, by Resolution No. 25-076, on May 6, 2025 the City Council approved plans and specifications for the FY23 and FY24 New Sidewalks Project – Clawiter Road and Industrial Blvd, Project Nos. 05305 and 05331 and called for bids to be received by June 3, 2025; and
WHEREAS, on May 30, 2025, Addendum No. 1 was provided to revise the plans, specifications, and bid sheet; and
WHEREAS, on June 3, 2025, five (5) bids were received ranging from $1,185,290 to $1,671,874.31. The low bid, submitted by Terocons, Inc., is approximately 10.7% below the Engineer’s Estimate of $1,328,000. The second lowest bid, submitted by J.J.R.Construction, Inc., is approximately 2.3% lower than the Engineer’s estimate; and
WHEREAS, the Administrative Change Order s (ACO) or construction contingency budget of $118,529 was not disclosed.
NOW, THEREFORE, BE IT RESOLVED by the City Council that Terocons, Inc., of San Francsico, CA is hereby awarded the contract for the FY23 and FY24 New Sidewalks Project – Clawiter Road and Industrial Blvd, Project Nos. 05305 and 05331, in accordance with the plans and specifications adopted therefore and on file in the office of the City Clerk of the City of Hayward, at and for the price named and stated in the final proposal of the hereinabove specified bidder, and all other bids are hereby rejected.
BE IT FURTHER RESOLVED that the expenditure of $118,5 29 for Administrative Change Orders is hereby authorized.
BE IT FURTHER RESOLVED by the City Council that the Director of Public Works is authorized to exp end up to $ 1,614,400 for construction, administrative change orders (construction contingencies ), construction administration, inspection, and testing to complete the project.
BE IT FURTHER RESOLVED that the City Manager is hereby authorized and directed to execute the contract with Terocons, Inc., in the name of and for an on behalf of the City of Hayward in a form to be approved by the City Attorney.
BE IT FURTHER RESOLVED that the project is categorically exempt from environmental review under section 1 5301(c) of the California Environmental Quality Act Guidelines for the operation, repair, maintenance, or minor alteration of existing facilities.
