RESOLUTION AWARDING A CONSTRUCTION CONTRACT TO ROSAS
BROTHERS CONSTRUCTION , INC., FOR THE FY25 SIDEWALK
REHABILITATION AND WHEELCHAIR RAMPS PROJECT NO. 05340 IN THE AMOUNT OF $494,569.50, APPROVING $49,569 IN ADMINISTRATIVE CONSTRUCTION CONTINGENCY, AND APPROPRIATING $351,000 IN MEASURE B (PEDESTRIAN AND BICYCLE) FUND 216
WHEREAS, by Resolution No. 25-096, on June 03, 2025, the City Council approved the plans and specifications for the FY 2025 Sidewalk Rehabilitation and Wheelchair Ramps, Project No. 05340 and called for bids to be received on July 29, 2025; and
WHEREAS, on July 29, 2025 , nine bids were received ranging from $ 494,569.50 to $878,868. Rosas Brothers Construction Inc. of Oakland, California, submitted the lowest bid in the amount of $ 494,569.50, which is 12.6% lower than the Engineer’s Estimate of $566,000; and
WHEREAS, FY23 Sidewalk Rehabilitation and Wheelchair Ramps Project, Project No. 05303, has approximately $351,000 funds remaining in Measure B (Pedestrian and Bicycle) Fund 216.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hayward that Rosas Brothers Construction Inc. is the lowest responsible bidder whose bid complies with the specifications and is hereby awarded the construction contract for the Sidewalk Rehabilitation and Wheelchair Ramps FY25, Project No. 05340, for the amount of $494,569.50 in accordance with the aforementioned plans and specifications on file in the Office of the City Clerk of the City of Hayward. All other bids are hereby rejected.
BE IT FURTHER RESOLVED by the City Council that the expenditure of $49,569 for Administrative Construction Contingency is hereby authorized.
BE IT FURTHER RESOLVED by the City Council that the Director of Public Works is authorized to expend up to $745,000 for project design, construction, project administration, and contingency costs to complete the project.
BE IT FURTHER RESOLVED that the City Manager is hereby authorized to execute the construction contract with Rosas Brothers Construction, Inc., in the name of and for and on behalf of the City of Hayward, in a form to be approved by the City Attorney.
BE IT FURTHER RESOLVED by the City Council that additional funds be appropriated in the amount of $351,000 from Sidewalk Rehabilitation and Wheelchair Ramps FY23, Project No. 05303 to Sidewalk Rehabilitation and Wheelchair Ramps FY25, Project No. 05340 in Measure B (Pedestrian and Bicycle) Fund 216.
