RESOLUTION APPROVING AND AUTHORIZING THE CITY MANAGER TO
EXECUTE THE SIDE LETTER AGREEMENT AMENDING THE MEMORANDUM OF UNDERSTANDING (MOU), SECTION 12.01 FIRE EDUCATION INCENTIVE
PROGRAM BETWEEN THE CITY OF HAYWARD AND THE HAYWARD FIRE CHIEFS’ ASSOCIATION (HFCA), TO CORRECTLY REFLECT A RETROACTIVE
PERIOD TO COVER PREVIOUS MOU CONTRACT AGREEMENTS, BEGINNING JULY 1, 2007, THROUGH JUNE 30, 202 4, AND WHICH CURRENTLY COVERS THE MOU PERIOD BEGINNING JULY 1, 2024 THROUGH JUNE 30, 2029
WHEREAS, CalPERS determined that the impacts and effects of the previous MOU language did not allow for the education incentive to be counted as pensionable compensation. Subsequently, the MOU provision was corrected during the previous contract negotiation process to remove the requirement of having five (5) years in the Fire Service before a member was eligible to participate in the education incentive program. The current MOU, Section 12.01 Fire Education Incentive Program between the City of Hayward and the HFCA, was amended during negotiations and correctly reflects the education incentive benefit; and
WHEREAS, this amendment now includes the coverage period for previous MOU, Section 12.01 Fire Education Incentive Program, beginning July 1, 2007, through June 30, 2024, between the City of Hayward and the HFCA.
NOW, THEREFORE, BE IT RESOLVED THAT THE City Council hereby approves the correction to the MOU, Section 12.01 Fire Education Incentive Program between the City of Hayward and the HFCA, to cover the period retroactively for the period beginning July 1, 2007, through June 30, 2024, and authorizes staff to execute said agreement s, a copy of which will be on file in the Office of the City Clerk.
