RESOLUTION AWARDING A CONTRACT TO BAY CITIES PAVING & GRADING, INC., FOR THE FY 26 PAVEMENT IMPROVEMENT PROJECT, PROJECT NO. 05347
BE IT RESOLVED by the City Council of the City of Hayward as follows:
WHEREAS, by resolution on February 24, 2026, the City Council approved the plans and specifications for the FY2 6 Pavement Improvement Project, Project No. 05347 and called for bids to be received on March 17, 2026; and
WHEREAS, on March 5, 2026, Addendum No. 1 was provided to revise the plans and specifications; and
WHEREAS, on March 13 , 2026, Addendum No. 2 was provided to revise the plans and specifications; and
WHEREAS, on March 17, 2026 , seven (7) bids were received, ranging from $10,063,947.60 to $13,595,460.70; Bay Cities Paving & Grading Inc. , of Concord, California submitted the low bid in the amount of $10,063,947.60 which is 13. 6% below the engineer’s estimate of $11,650,000; and
WHEREAS, the Administrative Change Order (ACO) or contingency budget of $1,436,052.40 was not disclosed.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hayward that Bay Cities Paving & Grading Inc., is hereby awarded the contract for the FY2 6 Pavement Improvement Project, Project No. 05347, in the amount of $ 10,063,947.60 in accordance with the plans and specifications adopted therefore and on file in the office of the City Clerk of the City of Hayward at and for the price named and stated in the bid of the hereinabove specified bidder, and all other bids are hereby rejected.
BE IT FURTHER RESOLVED that the expenditure of $ 1,436,052.40 for Administrative Change Orders is hereby authorized.
BE IT FURTHER RESOLVED that the City Manager is hereby authorized and directed to execute the contract with Bay Cities Paving & Grading Inc. , in the name of and for and on behalf of the City of Hayward, in a form to be approved by the City Attorney.
