RESOLUTION APPROVING THE PLANS AND SPECIFICATIONS INCLUDING USE
OF CERTAIN SOLE SOURCE PRODUCTS IN THE PLANS AND SPECIFICATIONS
AND CALLING FOR BIDS FOR CONSTRUCTION OF THE EFFLUENT CHANNEL
RETURN PUMP STATION PROJECT FOR THE WATER RESOURCE RECOVERY FACILITY’S (WRRF), PROJECT NO. 07806
WHEREAS, the City of Hayward (City) owns and operates the Water Resources Recovery Facility (W RRF), which treats an average flow of approximately eleven million gallons per day; and meets current regulatory requirements for discharge of treated effluent to the deep waters of San Francisco Bay; and
WHEREAS, during storm events, influent flows to the WRRF can exceed the facility’s discharge capacity, requiring temporary storage of treated wastewater within the WRRF storage ponds; and
WHEREAS, timely return of treated wastewater from the storage ponds to the effluent channel is essential to restore available pond capacity and maintain operational readiness for subsequent storm events; and
WHEREAS, increased return pumping capacity is necessary to improve wet -weather flow management, reduce operational risk, and strengthen overall system resiliency during peak flow events; and
WHEREAS, the Public Contract Code Section 3400 (c) allows a particular material, product, thing or service to be designated by specific brand or trade name in order to match other products in use on a particular improvement either completed or in the cours e of completion; and
WHEREAS, the City of Hayward intends to make a sole source purchase of the Allen Bradley Powerflex 755 Variable Frequency Drives (VFD) and Gorman Rupp T Series self- priming pumps for the project for operational consistency and efficiency; and
WHEREAS, design plans, technical specifications, and bidding documents for the Effluent Return Pump Station Project (Project) have been completed and are ready for bidding.

NOW, THEREFORE, BE IT RESOLVED, those certain plans and specifications for Project (No. 07806), on file in the Office of the City Clerk, are hereby adopted as plans and specifications for the project; and
BE IT FURTHER RESOLVED by the City Council of the City of Hayward that the City Council hereby approves the sole sourcing of the above-mentioned products in the plans and specifications, and no other brands or manufacturers will be considered for the Project (No. 07786); and
BE IT FURTHER RESOLVED that the City Clerk is hereby directed to cause a notice calling for bids for the required work and material to be made in the form and manner provided by law; and
BE IT FURTHER RESOLVED that the sealed bids therefore will be received by the City Clerk’s Office at City Hall, 777 B Street, Hayward, California 94541, up to the hour of 2:00 p.m. on Tuesday, July 21, 2026, and immediately thereafter publicly opened and declared by the City Clerk in the Rotunda, City Hall, Hayward, California; and
BE IT FURTHER RESOLVED that the City Council will consider a report on the bids at a regular meeting following the aforesaid opening and declaration of same.
