RESOLUTION AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE AMENDMENT NO . 2 TO THE MEMORANDUM OF
UNDERSTANDING WITH THE HAYWARD AREA RECREATION AND PARK
DISTRICT FOR THE FUNDING, OPERATION S, AND MAINTENANCE OF LA VISTA PARK, PROJECT NO. 06914
WHEREAS, since 2017, the City and the Hayward Area Recreation al and Park District (HARD) have worked toward a shared vision of constructing and operating La Vista Park, a new destination park in South Hayward . The addition of a destination park will create a needed amenity and attraction for South Hayward, the City, and the entire region ; and
WHEREAS, by Resolution No. 24-259, on December 17, 2024, the City Council authorized and directed the City Manager to execute a new Memorandum of Understanding with the Hayward Area Recreation and Park District for the funding, operations, and maintenance of La Vista Park; and
WHEREAS, by Resolution No. 25 -111, the City Council authorized Amendment No. 1 to the Memorandum of Understanding to address additional project funding needs related to the construction of La Vista Park; and
WHEREAS, following award of the construction contract, City staff, the contractor, and the project design team conducted value engineering efforts to reduce construction costs while maintaining all park features, usability, and safety elements approved by City Council; and
WHEREAS, these value engineering efforts resulted in $5.2 million in project cost savings and eliminated the need for the previously identified Measure C funding contribution; and
WHEREAS, the City and HARD desire to amend the Memorandum of Understanding to eliminate the $5.2 million Measure C funding contribution for the La Vista Park Project.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hayward that the City Manager is hereby authorized and directed to negotiate and execute Amendment No. 2 to the Memorandum of Understanding with the Hayward Area Recreation and Park District for the funding, operations, and maintenance of La Vista Park to eliminate the $5.2 million Measure C funding contribution for the La Vista Park Project , in a form approved by the City Attorney.
